Ms. Hanne Kohout, 1550 Kersey Road, directed a question to Councillor Siklenka and questioned why he would deny hobby farm acreage to people in

Committee ii) Staff Memorandum a) Staff Memorandum dated April 18, 2011, from the Senior Engineering Technologist II entitled "ISMP Next Steps - Healthy Watershed Committee" b) Correspondence dated April 26, 2011, from D Coupland, Coordinator of the KENNES (Hagan/Graham Creek) Watershed Project Re: Representation on the Healthy Watershed Committee That the Staff Memorandum dated April 18, 2011, from the Senior Engineering Technologist /I entitled "ISMP Next Steps - Healthy Watershed Committee" be received, and Council endorse the attached draft Terms of Reference for the Healthy Watershed Committee, and further that Staff be authorized to proceed with the next steps in the process including letters to be folwarded to the appropriate stakeholder organizations requesting that they submit to the District the names of their respective nominees to sit on the Committee. 2. Advisory Committees I Other: Nil 3. ReQular Status Reports from Members of Council Who Participate on Advisory Bodies. Committees. Boards. or Commissions: Mayor Mar advised that BC Transit is conducting two public open houses for view and comment on the rapid transit solutions proposed for the Capital Region on Wednesday, May 4, 2011 from 12:00 p.m. to 7:00 p.m. at Victoria City Hall, and on Thursday, May 5, 2011 from 3:00 p.m. to 8:00 p.m. at the Juan de Fuca Fieldhouse. Councillor Bryson advised of a meeting of the Agricultural Area Plan Steering Committee which took place on April 28, Councillor Bryson advised that the Steering Committee is nearing completion of the draft Agricultural Area Plan which is anticipated to be presented to Council in the near future. Staff Memorandum a) Staff Memorandum dated April 26, 2011, from the Director of Planning & Building Services entitled "Second Request for Amendment of Restrictive Covenant, 1285 Benvenuto Avenue" The Director of Planning & Building Services overviewed the Staff Memorandum That the Staff Memorandum dated April 26, 2011, from the Director of Planning & Building Services entitled "Second Request for Amendment of Restrictive Covenant, 1285 Benvenuto A venue" be received, and Council authorize the amendment of the Section 219 restrictive covenant registered on the Land Title of 1285 Benvenuto Avenue to ai/ow for stucco over a portion of the exterior wal/s, with ai/legal costs to be borne by the applicant. 2. Staff Memorandum a) Staff Memorandum dated April 27, 2011, from the Planner entitled "Riparian Areas Development Permit Application; 8284 Thompson Place (David Lau & Tyna Mason)" The Director of Planning & Building Services overviewed the Staff Memorandum That the Staff Memorandum dated April 27, 2011, from the Planner entitled "Riparian Areas Development Permit Application; 8284 Thompson Place (David Lau & Tyna Mason)" be received, and Council, with regard to the proposed construction of a new house on the property at 8284 Thompson Place: 1. Indicate its support for the proposed modification to the Streamside Protection and Enhancement Area (SPEA); 2. Authorize issuance of the requested letter of support for the SPEA modification; and, 3. Authorize issuance of the requested riparian areas Development Permit, subject to the fol/owing conditions: a) That, prior to issuance of the Development Permit, the District receive notification from the Province that ai/ requirement of the Riparian Areas Regulation have been met; b) That ai/ recommendations of the Riparian Areas Regulation Report by Swel/ Environmental Consulting Ltd. dated March 10, 2011 be fol/owed; c) That the boundary of the SPEA be identified with permanent markers at approximate 15m intervals; and, d) That the Qualified Environmental Professional monitor the construction process and provide to the District a copy of the postdevelopment report to confirm that ai/ recommendations have been fol/owed. 3. Staff Memorandum a) Staff Memorandum dated April 27, 2011, from the Building Inspector entitled "Secondary Suites in Existing Single Family Dwellings - Results of Waived Building Permit Fees" The Director of Planning & Building Services overviewed the Staff Memorandum and responded to questions from Council. May 2,2011 Page 4 of 9
5 That the Staff Memorandum dated April 27, 2011, from the Building Inspector entitled "Secondary Suites in Existing Single Family Dwellings - Results of Waived Building Permit Fees" be received, and Council authorize the waiving of the permit fee for secondary suites to be continued for another year. 4. Staff Memorandum a) Staff Memorandum dated April 27, 2011, from the Director of Financial Services entitled " Financial Plan and 2011 Annual Tax Rate Bylaws" The Director of Financial Services overviewed the Staff Memorandum and responded to questions from Council members That the Staff Memorandum dated April 27, 2011, from the Director of Financial Services entitled " Financial Plan and 2011 Annual Tax Rate Bylaws" be received and Council proceed with the introduction and first three readings of "Central Saanich Five Year Financial Plan Bylaw No. 1746, 2011" and "Central Saanich Tax Rates Bylaw No. 1747, 2011". That "Central Saanich Five Year Financial Plan Bylaw No. 1746,2011" [A Bylaw to Adopt a Five Year Financial Plan for the Period 2011 to 2015, InclusiveJ receive first reading. CARRIED OPPOSED: One Member That "Central Saanich Five Year Financial Plan Bylaw No. 1746, 2011" receive second reading. CARRIED OPPOSED: One Member That "Central Saanich Five Year Financial Plan Bylaw No. 1746, 2011" receive third reading. CARRIED OPPOSED: One Member That "Central Saanich Tax Rates Bylaw No. 1747,2011" [A Bylaw to Levy Tax Rates for Municipal, Hospital and Regional District Purposes for the Year 2011J receive first reading. That "Central Saanich Tax Rates Bylaw No. 1747, 2011" receive second reading. That "Central Saanich Tax Rates Bylaw No. 1747, 2011" receive third reading. VII. BYLAWS: For Consideration of First Two ReadinQs and Referral to a Public HearinQ to be Held on Wednesday, June 8,2011, at 6:30 p.m.: 1. "Central Saanich Land Use Bylaw Amendment Bylaw No. 1739,2011" [A Bylaw to Amend the Land Use Bylaw (7355 Chatwell Drive)] May 2,2011 Page 5 of 9
6 That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1739, 2011" receive first reading. That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1739, 2011" receive second reading. That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1739, 2011" be referred to a Public Hearing to be held on Wednesday, June 8, 2011, at 6:30 p.rn. Due to a potential conflict of interest, Councillor Kubek excused himself from the Council Chamber at 7:22 p.m. He stated that he has a previous business relationship with respect to this application. 2. "Central Saanich Land Use Bylaw Amendment Bylaw No. 1740,2011" [A Bylaw to Amend the Land Use Bylaw (1196 Dignan Road)] That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1740, 2011" receive first reading. That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1740, 2011" receive second reading. BEFORE THE QUESTION WAS CALLED, it was.motion TO TABLE. That further consideration of the foregoing motion be tabled to afford members of Council the opportunity to speak to the applicant. During Council discussion around the table, Council questioned if the applicant would consider changing the design of the proposed subdivision to three lots, each with secondary suites, as opposed to four lots with one of the properties incorporating a secondary suite MOTION TO LIFT FROM TABLE. That further consideration of the foregoing motion be lifted from the table. Prior to the Question being called the following postponement motion was introduced POSTPONEMENT MOTION. That consideration of second reading of Bylaw No be postponed until after the upcoming neighbourhood public information meeting related to this particular application. Councillor Kubek returned to the Council Chamber at 7:27 p.m. IX. DELEGATIONS I PRESENTATIONS: 1. Sea Change Marine Conservation Society Re: Saanich Inlet and Peninsula Atlas of Shorelines (SIPAS) - Shoreline Rating System Ms. Sarah Verstegen, from the Sea Change Marine Conservation Society, gave May 2,2011 Page 6 of 9
7 a brief PowerPoint presentation on the summary of the shoreline rating system which resulted from the Saanich Inlet and Peninsula Atlas of Shorelines project. During the presentation Ms. Verstegen discussed issues with respect to the "hardening of shorelines" and the impacts of retaining walls. Ms. Verstegen discussed the impacts of weathering over the years and the impacts of retaining walls on various marine species. The presentation included various alternatives to retaining walls and a detailed discussion of the rating system for rating shoreline health and issues with respect to terrestrial ecosystem mapping. Ms. Verstegen discussed the overall ratings which resulted from the Saanich Inlet and Peninsula Atlas of Shorelines project, and the correlation of these ratings to the impact of seawalls. Ms. Verstegen concluded her remarks by stating that the District of Central Saanich will be receiving the complete data base in the very near future, and the objective is that this data base be available as a tool to the District in its land use planning processes That the correspondence dated March 22, 2011, and the PowerPoint presentation from Sea Change Marine Conservation Society be received with thanks, and the contents noted. x. CORRESPONDENCE & PETITIONS: 1. Proposed UpcominQ Parade in Central Saanich: a) Brentwood Bay Revitalization Committee Re: Brentwood Bay Festival Parade, June 4, 2011 It was noted that a representative of Brentwood Bay Revitalization Committee was not in attendance at the Meeting to address this correspondence That the District grant conditional approval for the parade subject to acceptable co-ordination with any other events to take place during this same general time period, and further subject to the concurrence of the Police, Fire and Engineering and Public Works Departments, and no costs be incurred by the District of this event. 2. Central Saanich Firefighter's Charitable Foundation Re: Proposed "Family Movie Night" - Centennial Park, August 30, 2011 a) Correspondence dated April 19, 2011 Mr. Rob Syverson, representative of the Central Saanich Firefighter's Charitable Foundation, was available for questions That the correspondence dated April 19, 2011, from the Central Saanich Firefighter's Charitable Foundation requesting permission to host a onenight outdoor movie event in Centennial Park to raise funds for the Foundation be received, and Council indicate its support-in-principle of this event, and the request be referred back to Staff to work with the organizers and report back if deemed necessary on any special logistical and planning arrangements that would be required, and no costs be incurred by the District of this event. Due to a potential conflict of interest, Councillor Bryson excused himself from the Council Chamber at 7:40 p.m. He advised that he is seeking legal advice about a potential conflict of interest as he owns land adjacent to this site. 3. Woodwynn Farms Re: Intention to Move Forward with Application for Land Use Bylaw Amendment a) Correspondence received April 18, 2011 It was noted that a representative of Woodwynn Farms was not in attendance May 2,2011 Page 7 of 9
8 at the Meeting to address this correspondence Councillor That the correspondence dated April 18, 2011, from Woodwynn Farms advising Council of their intent to move folward with the application for a Land Use Bylaw Amendment be received and the application from Woodwyn Farms to rezone to a commercial/institutional use be denied, and the applicant be advised that they must first seek the approval of the Agricultural Land Commission as the land is 100 percent contained within the Agricultural Land Reserve, and further that Staff refund the rezoning application fee. That the correspondence from Woodwynn Farms also be referred to Staff to ensure compliance if and as required with the District's various Land Use and Regulatory Bylaws relative to this property. Bryson returned to the Council Chamber at 7:46 p.m. XI UNFINISHED BUSINESS: XII NEW BUSINESS I OTHER COMPETENT BUSINESS: 1. Motions to Refer "Central Saanich Land Use Bylaw Amendment Bylaw No. 1732, 2011" [A Bylaw to Amend the Land Use Bylaw (Owner-occupancy Restriction)] to a Public Hearing - Wednesday, June 8,2011, at 6:30 p.m. The Administrator gave a brief overview of this matter That "Central Saanich Land Use Bylaw Amendment Bylaw No. 1732, 2011" be referred to a Public Hearing to be held on Wednesday, June 8, 2011, at 6:30 p.rn. CARRIED OPPOSED: One Member 2.
