1 Commissioners Court July 8, 2014 NOTICE OF A MEETING OF THE COMMISSIONERS COURT OF HAYS COUNTY, TEXAS This Notice is posted pursuant to the Texas Open Meetings Act. (VERNONS TEXAS CODES ANN. GOV. CODE CH.551). The Hays County Commissioners Court will hold a meeting at 9:00 A.M. on the 8 th day of July, 2014, in the Hays County Courthouse, Room 301, San Marcos, Texas. An Open Meeting will be held concerning the following subjects: CALL TO ORDER INVOCATION PLEDGE OF ALLEGIANCE - Pledge of Allegiance to the American Flag & Pledge of Allegiance to the Texas Flag ROLL CALL PRESENTATIONS & PROCLAMATIONS Adopt a proclamation declaring July 1-8, 2014 as Wimberley V.F.W. 4th of July Rodeo Glen "Corky" Gibbs week. HERZOG Approve Commissioners Court Minutes of June 24, COBB/GONZALEZ Approve the March, April and May 2014 Treasurer's Reports and Investment Reports. COBB/TUTTLE Approve transfer requests for (2) vehicles from the Hays County Sheriff's Office to the Hays County Constable, Precinct 1 Office. INGALSBE/PETERSON Accept two donations totaling $ to Hays County Sheriff's Office Community Outreach Division and amend the budget accordingly. COBB/CUTLER Authorize the County Judge to execute a utility adjustment agreement with Crystal Clear WSC for the relocation of water lines in the vicinity of the intersections of Francis Harris Lane and Centerpoint Road required by the widening of CR 266 (Old Bastrop Highway) as part of the Priority Road Bond Program project. INGALSBE Amend the Justice of the Peace Precinct 5 operating budget for additional continuing education expenses. COBB/CARY Accept the delivery of the Internal Examination Reports for the FY 2013 Sheriff Commissary, FY 2013 Sheriff Federal Discretionary Fund, Civic Center, District Attorney's Office, and Constable Pct. 2 Office. COBB/HERZOG Authorize the Building Maintenance Department to add a telephone allowance effective July 1, 2014 for Facility Maintenance, Slot number and amend the budget accordingly. COBB/GARZA Authorize the County Judge to execute an application for the 1033 Surplus Program on behalf of Constable Precinct 5. JONES/MANCILLAS Amend the National School Lunch Program Budget to increase grant revenue and food supplies, and move budget from the Juvenile Detention Center's operating budget to NSLP. COBB/LITTLEJOHN Authorize the Sheriff's Office to utilize funds from Law Enforcement Equipment for Continuing Education services and amend the budget accordingly. COBB/CUTLER Approve specifications for IFB 2014-B06 Road Building Materials for Hays County Road Department and authorize Purchasing to solicit for bid and advertise. COBB/BORCHERDING/MAIORKA

CONLEY/GARZA Discussion and possible action regarding the American Traffic Solutions (ATS) AxsisTM System for school zone traffic enforcement, including a presentation regarding the demonstration of the system in Hays County. COBB/CONLEY WORKSHOP 10:00 AM-Workshop to update the court on a proposed new Computer Aided Dispatch (CAD) system. CONLEY/CUTLER EXECUTIVE SESSIONS The Commissioners Court will announce it will go into Executive Session, if necessary, pursuant to Chapter 551 of the Texas Government Code, to receive advice from Legal Counsel to discuss matters of land acquisition, litigation, and personnel matters as specifically listed on this agenda. The Commissioners Court may also announce it will go into Executive Session, if necessary, to receive advice from Legal Counsel regarding any other item on this agenda Executive Session pursuant to Sections and of the Texas Government Code: consultation with counsel and deliberation regarding the purchase and value of a acre lot owned by Hays County located along Goforth Road in Precinct 2. Possible action may follow in open court. JONES STANDING AGENDA ITEMS The Commissioners Court utilizes Standing Agenda Items to address issues that are frequently or periodically discussed in court. This section allows the Court to open the item when a need for discussion arises. 29 Discussion of issues related to inmate population at the Hays County Jail. 5 WIMBERLEY V.F.W. 4 TH OF JULY RODEO GLEN CORKY GIBBS WEEK WHEREAS, Thursday, July 3rd, 2014 marked the start of the 69th Annual Wimberley 4 th of July Rodeo; and, WHEREAS, The Rodeo has become a very well-attended and valued program by local citizens of Wimberley and visitors far and wide; and, WHEREAS, The Rodeo is hosted by the Wimberley Oldham-Cummings V.F.W. Post 6441, and Corky Gibbs has served as Post Commander for the Wimberley Oldham-Cummings V.F.W Post 6441 for two years from ; and, WHEREAS, During Corky Gibbs tenure as the Post Commander, he successfully lead the Post in attaining the distinct honor of being recognized, as both, an All-State Post and All-American Post for , and again honored as an All-State Post for ; and, WHEREAS, Furthermore, under Corky s leadership, the post was recognized nationally as an Outstanding Community Service Post, which is noted on a plaque that hangs outside the building; and, WHEREAS, In addition, he served 4 years in the United States Navy; and, WHEREAS, He served two tours in Vietnam from November May 1971 and February September 1972 aboard a ship off the coast of South Vietnam attached to the Fighter Squadron 24 WHEREAS, Mr. Gibbs was honorably discharged ending his tour at the rank of E4; NOW, THEREFORE LET IT BE RESOLVED that the Commissioners Court Of Hays County, duly convened and acting in its capacity as the governing body of Hays County does hereby proclaim the week of July 1 st July 8 th 2014 as Wimberley V.F.W. 4 th of July Rodeo Glen Corky Gibbs Week And call upon the people of Hays County to join us in honoring Corky Gibbs as a community treasure that exemplifies all of the commendable attributes of a selfless and true patriot. MOTION PASSED APPROVE COMMISSIONERS COURT MINUTES OF JUNE 17, 2014 A motion was made by Commissioner Whisenant, seconded by Commissioner Ingalsbe to approve Commissioners Court Minutes of June 3, 2014 as presented by County Clerk. All voting Aye. MOTION PASSED AUTHORIZE INSTITUTIONAL OSSF PERMIT AT 158B HIGH ROAD, KYLE, TX Jose and Alejandra Martinez are proposing an OSSF to serve an event center and banquet hall in Precinct 1. This property is 20 acres. Water will be supplied by public water system. The system designer, Jim Conner, R.S. has designed a treatment system which consists of standard treatment with the effluent dispersed to a low pressure dosed drainfield at a daily usage rate of 600 gallons. A motion was made by Commissioner Whisenant, seconded by Commissioner Ingalsbe to authorize the Institutional OSSF Permit at 158B High Road, Kyle, TX. All voting Aye. MOTION PASSED RATIFY THE COUNTY JUDGE'S EXECUTION OF AN INTERLOCAL AGREEMENT WITH THE CITY OF SAN MARCOS REGARDING THE DISTRIBUTION OF GRANT FUNDS FROM THE U.S. DEPARTMENT OF JUSTICE, JUSTICE ASSISTANCE GRANT PROGRAM On June 3, 2014 the Commissioners Court authorized a grant application to the U.S. Department of Justice, Bureau of Justice Assistance under the Edward Byrne Memorial Justice Assistance Grant (JAG) program for $13, Hays County and the City of San Marcos are in what is known as a disparate allocation for this funding, where an agreement on the use of the grant funds by the two entities is required. Last year, Hays County waived its right to a portion of the funding, dedicating all funds to the City of San Marcos. This year, the City of San Marcos has similarly waived its right to the funds, dedicating the entire available amount to Hays County. The Interlocal Agreement formalizes this arrangement and will be submitted to USDOJ to complete our grant application package. A motion was made by Commissioner Whisenant, seconded by Commissioner Ingalsbe to ratify the County Judge's execution of an Interlocal Agreement with the City of San Marcos regarding the distribution of grant funds from the U.S. Department of Justice, Justice Assistance Grant program. All voting Aye. MOTION PASSED AUTHORIZE INSTITUTIONAL OSSF PERMIT AT 1018 PIER BRANCH ROAD, DRIPPING SPRINGS, TX RKC Partnership is proposing an OSSF to serve an office/warehouse building for a Pool Supply Business in Precinct 4. This property is Lot 16 in the Sunset Canyon Section 2C Subdivision (1.836 ac). Water will be supplied by public water supply. The System Designer, Jon Maass, R.S., has designed a treatment system which consists of standard treatment and pump tank to disperse to a low pressure dosed leaching chamber drain field at a daily usage rate of 96 gallons A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to authorize Institutional OSSF Permit at 1018 Pier Branch Road, Dripping Springs, TX. 10 HAYS COUNTY COMMISSIONERS' COURT MINUTES VOLUME V PG 408 ***** ***** JUNE 24, APPROVE A BUDGET AMENDMENT TO MOVE $1,002 FROM LAW ENFORCEMENT EQUIPMENT TO LAW ENFORCEMENT SUPPLIES FOR THE CJD EDWARD BYRNE MEMORIAL JUSTICE GRANT The CJD Edward Byrne Memorial Justice Grant was awarded for the purchase of body cameras and in-car video systems for the Sheriff's Office and Constable Precinct #3. This amendment will allow for the purchase of support Accessories for the camera equipment Budget Amendment: Increase Expense ; Law Enforcement Supplies $1,002.00; Decrease Expense _400; Law Enforcement Equipment Operating ($1,002.00). A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to approve budget amendment to move $1,002 from Law Enforcement equipment to Law Enforcement supplies for the CJD Edward Bryne Memorial Justice Grant. All voting Aye. MOTION PASSED APPROVE SPECIFICATIONS FOR RFQ #2014-P02 REQUEST FOR QUALIFICATIONS FOR CONSTRUCTION INSPECTION AND MATERIALS TESTING FOR IMPROVEMENTS TO FM 1626 SOUTH" AND AUTHORIZE PURCHASING TO SOLICIT FOR PROPOSAL AND ADVERTISE The FM 1626 South Hays County Texas Department of Transportation Pass-Through Finance Program project is anticipated to be let by Hays County for construction in early The County's proposed solicitation for Construction Inspection and Materials Testing services for the project would provide for consultant services to be secured in advance of final construction design to allow for consultant participation in construction document review prior to construction letting. The County completed a solicitation for these services in 2011 for the FM 110 and FM 1626 North and South Pass-Through Finance Program projects and is moving forward with a new solicitation process for the FM 1626 South project now because of the dated status of the first solicitation materials. A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to approve specifications for RFQ #2014-P02 Request for Qualifications for Construction Inspection and Materials Testing for Improvements to FM 1626 South" and authorize Purchasing to Solicit for Proposal and Advertise. All voting Aye. MOTION PASSED AUTHORIZE THE COUNTY JUDGE TO EXECUTE A CHANGE IN COST ADDENDUM TO THE CAPITAL IMPROVEMENT AGREEMENT BETWEEN HAYS COUNTY, THE CITY OF SAN MARCOS AND COTTONWOOD CREEK JDR, LTD. RELATED TO THE RATTLER ROAD PROJECT IN HAYS COUNTY The funds for this addendum will come out of the County Road Budget. A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to authorize the County Judge to execute a Change in Cost Addendum to the Capital Improvement Agreement between Hays County, the City of San Marcos and Cottonwood Creek JDR, Ltd. related to the Rattler Road Project in Hays County All voting Aye. MOTION PASSED Item #8 was reopened: A motion was made by Commissioner Ingalsbe, seconded by Commissioner Jones to authorize the County Judge to execute a Change in Cost Addendum to the Capital Improvement Agreement between Hays County, the City of San Marcos and Cottonwood Creek JDR, Ltd. related to the Rattler Road Project in Hays County and amend the budget accordingly. All voting Aye. MOTION PASSED ACCEPT THE RESIGNATION OF RUSSELL MOLENAAR AS COMMISSIONER OF ESD #1 Commissioner Whisenant and Commissioner Conley spoke. Mr. Molenaar submitted his resignation dated May 27, A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to accept the resignation of Russell Molenaar as Commissioner of ESD #1. All voting Aye. MOTION PASSED APPROVE CHANGE ORDER NO. 8 ON THE CR266, OLD BASTROP HIGHWAY, PRIORITY ROAD BOND PROGRAM PROJECT Allen Crozier of HDR spoke. This Change Order is to rectify the final pay items as constructed against the final in place quantities. This adjustment includes both increases and decreased to project pay items due to adjustments made in the field as requested by the County. Largest adjustment include: TY-D Hot Mix, TY-B Hot Mix and 5" Concrete Riprap. The TY-B & TY-D Hot Mix quantity was overrun due to needing to extend final tie ins to cross streets further for smoother transitions. The 5" Concrete Riprap quantity was overrun for the extension of culvert aprons to reduce potential for erosion as well as for the extension of riprap along steep slopes along the Centerpoint roadside ditch to reduce future maintenance of a steep ditch slope. Budget Project Construction Cost $4,511,000.00, Contractors Bid $4,090, Total Change Orders $ 279,938.07B Final Construction Cost $4,370, Change Order Percentage +6.8% Change Orders included approximately $90,000 of work to relocate City of San Marcos waterlines throughout the project limits through an Interlocal agreement. This work has been reimbursed by the City 8BRevised Final Cost (COSM Utilities Removed) $4,273, Revised Change Order Percentage +4.5% Construction Savings $ 237, A motion was made by Commissioner Ingalsbe, seconded by Commissioner Jones to approve Change Order No. 8 on the CR 266, Old Bastrop Highway, Priority Road Bond Program Project. 11 HAYS COUNTY COMMISSIONERS' COURT MINUTES JUNE 24, 2014 ***** ***** VOLUME V PG AUTHORIZE THE COUNTY JUDGE TO EXECUTE SUPPLEMENT NO. 1 TO THE PROFESSIONAL SERVICES AGREEMENT AND WORK AUTHORIZATION NO. 1 WITH HDR ENGINEERING, INC. TO ADD SURVEYING SERVICES AND INCREASE THE COMPENSATION CAP FROM $55,000 TO $89, FOR THE CENTER POINT EXTENSION ROUTE STUDY Allen Krozier of HDR spoke. The initial work authorization included basic right of entry services and environmental field studies to identify potential habitat and presence of threatened and endangered species, karst features and potential archeological sites necessary for determining potential routes for the proposed extension of Center Point Road from Hunter Rd. to Old RM 12. This supplemental is to augment right of entry services, provide the necessary boundary survey for the two tracts between La Cima on the North and Paso Robles on the South, and collecting field data to verify available LiDAR Survey Data and provide overall survey control for the route study project. A motion was made by Commissioner Conley, seconded by Commissioner Whisenant to Authorize the County Judge to execute Supplement No. 1 to the Professional Services Agreement and Work Authorization No. 1 with HDR Engineering, Inc. to add surveying services and increase the compensation cap from $55,000 to $89, for the CenterPoint Extension Route Study. All voting Aye. MOTION PASSED BELLA VISTA SUBDIVISION, PHASE 1 (1 LOT) APPROVE FINAL PLAT AND ACCEPT CONSTRUCTION SURETY IN THE AMOUNT OF $42,750 FOR STREET AND DRAINAGE IMPROVEMENTS Director of Development and Community Services, Clint Garza spoke. The Bella Vista Subdivision is a proposed 138 acre Subdivision located off of Bell Springs Road in Precinct 4. The development will eventually consist of 86 lots averaging 1.6 acres in size. Each lot is planned to be served by a public water supply system provided by the Dripping Springs Water Supply Corporation. This initial phase of Bella Vista will plat a single lot (4.84 acres) and the entrance roadway, Calle Bella. A motion was made by Commissioner Whisenant, seconded by Commissioner Jones to approve final plat Bella Vista Subdivision Phase 1 and accept Construction Surety in the amount of $42, for Street and Drainage improvements. All voting Aye. MOTION PASSED ADOPT A RESOLUTION IN SUPPORT OF A CONSTITUTIONAL AMENDMENT FOR INCREASED STATE FUNDING FOR TRANSPORTATION Commissioner Ingalsbe and Commissioner Conley spoke. The Constitutional Amendment dedicates fifty percent of the growth in oil and gas severance tax that would currently go to the Rainy Day Fund to the State Highway Fund. The Constitutional Amendment, if approved by voters, limits the use of these highway funds to construction, maintenance, and rehabilitation projects (excludes toll roads). The amendment also allows the Legislature to adjust the amount sent to the highway fund if needed to preserve the integrity of the Rainy Day Fund. The Constitutional Amendment proposition will be considered November 4, 2014 and will read on the ballot as follows: The Constitutional Amendment providing for the use and dedication of certain money transferred to the State Highway fund to assist in the completion of transportation construction, maintenance, and rehabilitation projects, not to include toll roads. 143 ROAD BUILDING MATERIALS FOR HAYS COUNTY ROAD DEPARTMENT Bid #2014-B06 General Conditions 1. Bids are solicited for furnishing the materials set forth in this bid invitation. Completed bid proposals must be received in the purchasing office before 2:00 p.m. on the opening date. All bids must be in a sealed envelope clearly marked with the bid number and opening date. 2. Bids received in the County Purchasing office after submission deadline shall be returned unopened and will be considered void and unacceptable. Hays County is not responsible for lateness of mail, carrier, etc. and time/date stamp clock in the purchasing office shall be the official time of receipt. No fax bids will be accepted. 3. Bids may be withdrawn at any time prior to the official opening. Alterations made before opening time must be initialed by bidder guaranteeing authenticity. After the official opening, bids may not be amended, altered or withdrawn without the recommendation of the county purchasing agent and the approval of the commissioners court. 4. The County is exempt from federal excise and state sales tax; therefore, tax must not be included in this bid. 5. The bidder agrees if this bid is accepted, to furnish any and all materials upon which prices are offered, at the price(s) and upon the terms and conditions contained in the specifications. The period for acceptance of this bid proposal will be sixty (60) calendar days unless a different period is noted by bidder. 6. The County reserves the right to accept or reject in part or in whole any bids submitted, and to waive any technicalities for the best interest of the county. 7. Invoices shall be sent directly to the Hays County Auditor, 712 S. Stagecoach Trail, Suite 1071, San Marcos, Texas and attention: Accounts Payable. Payments will be processed after notification that all materials have been received satisfactorily and no unauthorized materials have been received. 8. Hays County terms of invoice are net 30 days from statement date. 9. Successful bidder will be awarded a twelve (12) month contract unless canceled by either party in writing thirty (30) days prior to any month thereafter. The contract shall be effective upon the execution by the Commissioners Court for one (1) year with the option to renew for an additional three (3) year terms in one (1) year increments provided both parties agree to do so. 10. Continuing non-performance of the bidder in terms of specifications shall be a basis for the termination of the contract by the county. The county shall not pay for services which are unsatisfactory. Bidders will be given a reasonable opportunity before termination to correct the deficiencies. If the vendor defaults in the performance of the terms and conditions contained herein, or materially breaches any of its provisions, the County shall have the right to terminate the contract associated with an accepted bid by giving written notice of termination within 30 days of the occurrence of the default or material breach. Bid Specifications 1. All materials shall meet the TXDOT specifications for the item number, class and type given. 2. Bidder may bid all or any portion if the items listed for bid. 3. If this bid is accepted and approved by Commissioners Court then this bid becomes the contract and there are no oral agreements either expressed or implied. 4. All bids must be submitted on the bid sheet provided. 5. All vendors, if required by the county shall furnish proof of being responsible by having the proper equipment to fulfill the terms and conditions of this contract, i.e. proper equipment for weighing materials, loading materials, etc. 6. Multiple awards will be made. Determination of source to provide materials for specific work sites will be made by the Hays County Road Department. The County reserves the right to accept or reject any and all bids. 144

145 7. Pricing must remain for one (1) year increments. This specification provides for a price increase or decrease every renewal period, if needed, based upon price changes the vendor receives for the established price of the product to be furnished. Each price change shall be made known, at time of renewal of bid, by a letter addressed to Cindy Maiorka, Hays County Purchasing Manager, 712 S. Stagecoach Trail, Suite 1071, San Marcos, Texas 78666, stating the price change and the effective date. If the price increases from the amount bid, Hays County may elect to terminate this contract if the County is able to purchase from another source on similar terms, product of like grade and quality, and in like amount at a lower price than the increased price and successful vendor declines to meet such lower price. 8. 163 Capital Area Regional Transportation Planning Organization Procedures for 2014 Call for Projects 1. Each county in the CAPCOG region may submit three projects for each of the Project List Categories: a. Regional: larger, more expensive projects that will likely require long-term programming to fund and complete. These projects are expected to have major impact towards improving the roadway system in the 10-county region. These projects will be ranked at the September 19, 2014 meeting. b. Local: smaller, more easily completed projects that are not only lesser in size and cost, but also generally of more local roadway improvement impact. These projects will not be scored, but will serve to provide TxDOT with a list of projects that can be addressed when funds for smaller projects become available.
