1 European Parliament Delegation for relations with the United States D-US_PV(2018)02_20 MINUTES of the meeting of 20 February 2018, Brussels The meeting opened at on Tuesday, 20 February 2018, with Christian Ehler (Chair) presiding. 1. Adoption of draft agenda (PE ) The draft agenda was adopted in the form shown in these minutes. 2. Adoption of minutes of meeting of 14 December 2017 (PE ) The minutes of the meeting of 14 December 2017 were adopted. 3. Communications by the Chair The Chairman reminded Members that the meeting was web-streamed. 4. Report from the Bureau Delegation to Washington DC from 11 to 15 February 2018 The Chair presented his report from the visit of the Bureau to Washington DC the week before. The main purpose of the visit was to prepare the upcoming inter-parliamentary meeting from 15 to 16 June 2018 in Sofia, Bulgaria. The following topics were initially agreed for working sessions with the US Congress: - A general political session; - EU-US cooperation in the Western Balkans; - Cybersecurity and cyber-threats; - A session on economic topics possibly including energy security. 2 Military Facilities. The Chair further updated Members on other issues that arose during the visit. The outcome of the US elections had had an impact on trade and tax issues. The future functioning of the WTO Appellate Body is under threat from the current US Administration, which is withholding the necessary consensus for the appointment of new judges, when the terms of the current ones expire. After May this year, the necessary quorum on the Appellate Body possibly will not be met. At the USTR, the Bureau was told that the reason for the Administration taking this line was its view that the WTO Appellate Body was not fit for purpose, since in the USTR s view it had not been sufficiently accountable to WTO members. There was little ground for optimism that the Administration s policy would change. The Bureau raised this serious matter with all interlocutors, including officials from the Administration, Senators and the House Ways and Means sub-committee on trade, where no fewer than 14 Representatives were present for the meeting. Congressional Members noted that there were differences with the Administration and that Congress would not hesitate to exercise its prerogatives. Congress was also looking to deepen regulatory cooperation with the EU, which had been an unfortunate casualty of TTIP being frozen. 5. Exchange of views on transatlantic cooperation in the fields of counter-terrorism and cybersecurity with Julian King, European Commissioner for the Security Union Commissioner King began his presentation by striking a positive tone for EU-US relations in his area of work: whatever else is happening in other topics, on counterterrorism and cybersecurity, we have shared interests he commented. The US Terrorist Finance Tracking Programme had proven useful and the EU had made increasing use of it. Europol and US law enforcement agencies were cooperating, including through staff exchanges. Currently, there were no fewer than 32 US liaison officers at Europol, posted by 11 US agencies. In addition, the EU and the US cooperated in sharing info from battlefields in Iraq and Syria, based on an agreement with the US to enable Europol to access the law enforcement branch of Operation Gallant Phoenix in Jordan. There was cooperation on aviation security, as well as in international fora and with third countries, with the aim of building capacity in airports around the world. Tackling terrorist use of the internet and social platforms was an additional important item. As regards cyber-threats, the rate of cybercrime had increased, as well as politically motivated cyber-attacks. Examples included brute demonstrations of state power, interfering with voting and spreading fake news. The Commission had released a package of measures reinforcing cyber-security through better deterrence and international cooperation. Cross-border access to electronic evidence was the crux of the work with the US. Accountability for registered domain users and owners would be further increased through ICANN (Internet Corporation for Assigned Names and Numbers). Finally, the first coordinated NATO exercise on a cyber-attack scenario had taken place last year. 3 power grid, citing Ted Koppel's book 'Power out', a catastrophe scenario. Members raised Russian interference, including by using 'body snatchers' people posing as American or European citizens or stealing online profiles. Additionally, on the terrorist finance programme, it was noted that European intra-payments were not covered by the US financing activity. The Commissioner said that we should consider having a TFTP in Europe, as money movements remained important. Daesh had been raising $2 billion year a couple of years ago, and the figure was still in the hundreds of millions. Vice-Chair Marietje Schaake raised the issue of trust, as trust levels towards the current Administration could be higher. She found it remarkable that in the case of the NotPetya cyber-attack, while Members States had made the attribution to Russia, the EU had not. Commissioner King talked about measures to enforce protection of critical infrastructure, like power grids, including in the mission statement of the newly created Cybersecurity Agency. Outside interference in democratic processes was an area of great concern. Such interference included hacks, leaks, fake news and use of mined personal data to target messages. The Commission s Legislative package in September aimed to address these behavioural aspects. He further commended the creation of the European Centre of Excellence for Countering Hybrid Threats commended (11 EU Member States, Norway and US signed up). Dialogue with online platforms would become more productive. The Commission intended to produce guidelines for online platforms on how to prevent content using automated means, so that this content could be tracked by provider companies in cooperation with law enforcement as regards illegal content. On attribution, he commented that the EU was not an intelligence agency, hence there was no competence to attribute NotPetya. 6.
