1 European Parliament Committee on Economic and Monetary Affairs ECON_PV(2017)0410_1 MINUTES Meeting of 10 April 2017, BRUSSELS The meeting opened at 15:06 with Luděk Niedermayer, Fourth Vice-Chair, presiding. 1. Adoption of agenda Decision: The draft agenda was adopted in the form shown in these minutes. 2. Chair s announcements None 3. Report on ongoing interinstitutional negotiations The Chair reported to Members on the following interinstitutional negotiations Securitisation files A fourth trilogue on the securitisation files took place on 28 March and progress was made on STS and CRR securitisation files. Under the STS file, the outcome was the following: the co-legislators discussed the Commission non-papers on the eligible parties to the securitisation market and on the homogeneity criteria for STS securitisations. They agreed to mandate the Commission to further refine its proposal on the nonpaper on the eligible parties and to mandate the technical level team to propose a drafting on the homogeneity criteria, based on the remarks made at the meeting. In addition, the STS Rapporteur will also propose a drafting for stress tests applicable to sponsors under STS securitisation. In addition, outstanding points related to the due diligence requirements were also agreed. Finally, the Council will propose a drafting for a ban on re-securitisation, with targeted carve-outs from the ban where those are really needed. PV\ docx PE v01-00 United in diversity

2 Under the CRR file, the outcome was the following: an empowerment to EBA to further specify the conditions to allow institutions to calculate KIRB when determining the capital requirements under the internal-rating based approach was agreed, including a reference to the use of proxy data as necessary. Moreover, the drafting of the specific treatment of senior positions in certain SME synthetic securitisations was further elaborated, including the possibility for promotional entities and under specific conditions - institutional investors to guarantee such transactions. The Commission was asked to assess whether the possibility for institutional investors to use "cash assimilated instruments" as guarantee could have unintended consequences. Finally, a number of other political issues were agreed, with a view to aligning as closely as possible the drafting to the revised securitisation framework of the Basel committee, and the co-legislators endorsed part of the technical work on the CRR file. Anti-Money Laundering Directive (ECON-LIBE) The second political trilogue on the fifth review of the Anti-Money Laundering Directive took place on 4 April 2017, with discussions on the following issues: 1. Politically Exposed Persons (PEPs): both Council and EP will come back on their approaches, while the Commission will report back on the feasibility of the Council approach and possible ways forward. 2. Financial Intelligence Units (FIUs): both Council and EP agreed on the need for improving cooperation between FIUs; the Commission has been invited to provide drafting suggestions on the basis of the FIU platform's recommendations. 3. List of Predicate offences: EP will come back on a possible need for a threshold for predicate offences 4. Prepaid Cards: The technical group was tasked to find a solution. 5. Sanctions: the Council signalled openness to some of the EP's demands; the technical group was tasked to further work on this point. 6. Mandate for technical work: technical work took place on the following day, 5 April, on all of the items above. The next Trilogue will take place on 10 May in Brussels. 4.
