World Organisation for Animal Health (OIE) Decision: An exchange of views with the Director General of the OIE will be scheduled during the next meeting of the AGRI Committee 6.2. Implementation Reports Decision: The Secretariat will provide information and statistics on implementation reports prepared by other EP Committees since the beginning of the current parliamentary term Consultations will continue between political groups on whether to prepare implementation reports in the AGRI Committee and, if so, on which topics 6.3. 7 ANNEX I FORM FOR TABLING A QUESTION FOR ORAL ANSWER WITH DEBATE (Rule 128) Select only one addressee : COUNCIL COMMISSION AUTHOR(S): Committee on Agriculture and Rural Development SUBJECT: Patents and Plant breeders rights A recent decision (G2/12 and G2/13) of the Enlarged Board of Appeal of the European Patent Office (EPO) creates the possibility to patent plant traits, also when these traits are developed from or could be obtained with essentially biological breeding techniques. This decision signifies a narrow interpretation of Article 53(b) of the European Patent Convention and thus implies broad possibilities for the granting of patents covering plant varieties. This goes directly against the breeder's exception, explained in article 15 of the 1991 Act of the UPOV Convention and article 15 of the EU Regulation 2100/94. Unrestricted access to biological material is necessary in order to stimulate the innovative strength of the plant breeding sector. The decision of the EPO undermines the innovative ability of the plant breeding sector to develop new varieties and poses a threat to global food production and food security. It will have a negative impact on European competitiveness and may lead to monopolies on the food market by decreasing the diversity of products offered to consumers. It is of utmost importance to balance European legislation (in particular Directive 98/44/EC) in order to fulfil international obligations on intellectual property rights (UPOV) and to boost the innovative competitiveness within the European plant breeding sector. Rule 26 of the Implementing Regulations of the EPC states that Directive 98/44/EC shall be used as a supplementary means of interpretation for European patent applications and patents concerning biotechnological inventions. A clarification in Directive 98/44/EC will have an immediate effect on the practice of the EPO. 1) Is the Commission aware that the decision of the EPO hampers innovation by making breeders dependant on patent holders and consequently will have an effect on global food production and food security? 2) Can the Commission with great urgency, revise or update, and in the short term clarify Directive 98/44/EC in order to ensure the effective exemption of plant varieties and traits from patentability and to secure the unrestricted use of biological material by breeders to stimulate innovation, guarantee a level playing field and create more opportunities for SMEs within the plant breeding sector as requested in resolution T7-0202/2012 of the European Parliament? The European Parliament was particularly pleased that the Strategy has introduced many aspects of the Parliament resolution (2009/2202 (INI) of 5 May The Parliament appreciates the progress made so far and encourages the Commission to make sure that the still outstanding actions points will be delivered in time. Will the Commission draw up a new strategy for the protection and welfare of animals for the years so as to ensure continuity and clarity of operations which are essential to achieve further positive developments in EU animal welfare policy? Will the Commission, as a crucial part of a new animal welfare strategy, prepare a proposal for a simplified EU legislative framework for animal welfare as called for by the Parliament in its resolution on the European Union Strategy for the Protection and Welfare of Animals (2012/2043 (INI))?
