1 MINUTES OF MEETING OF THE COMMISSIONERS COURT OF MIDLAND COUNTY, TEXAS Be it remembered that on Monday the 22 nd day of October, 2018 at 9:00a.m a meeting of the Commissioners Court was called to order in the Auxiliary Courtroom, located at the Midland County Courthouse, 500 North Loraine Street, Midland, Texas. The following members were present: Michael R. Bradford, County Judge; Scott Ramsey, County Commissioner Precinct No. 1; Robin Donnelly, County Commissioner Precinct No. 2; Luis D. Sanchez, County Commissioner Precinct No. 3; Randy Prude, County Commissioner Precinct No. 4 Recorded by Alison Haley, County Clerk 1. Invocation given by Sheriff Painter 2. Pledges of Allegiances. Call No. 19, 20 and Acknowledge October s I.M.P.A.C.T.S. of the Month, Art Villareal, from the Sheriff s Office. Commissioner Prude presented Art Villarreal with a plaque and certificate recognizing him as October s I.M.P.A.C.T.S. of the month honoree. Motion to acknowledge (Art Villareal as the October s I.M.P.A.C.T.S. of the month honoree). Motion by: Ramsey Second by: Sanchez Exhibit: 4. Acknowledge foreign exchange students. Commissioner Prude and Debbie Oliver, Director of Foreign Languages for MISD introduced the foreign exchange students. Luciano Nascimento Filho of Brazil, Auyin Chan of Hong Kong, Joshua Westberg of Germany and Max Gallardo Boluda of Spain. (Julie Knoblochova of Czech Republic and Diego Segura Menendez of Spain were absent) Commissioner Prude presented Luciano, Auyin, Joshua and Max with a certificate from the Court. 1

Teresa Galloway, Captain with the West Texas Patriot Guard presented the Court with a check for $9, to purchase a guardian archangel for the Veterans Park. On behalf of our gold star families. Motion to acknowledge (donation from the West Texas Patriot Guard for the purchase of a guardian archangel for the Veterans Park). Discuss and take action using County ROW for monitoring wells for Arcadis. Presented by Kim Golden with Arcadis, from Austin, Texas. There was some discussion amongst the Court members. Commissioner Donnelly spoke against doing something in the right of ways. Motion to allow Arcadis US, Inc. to use the county right of ways for monitoring wells as presented on this map (attached as exhibit). Motion by: Sanchez Second by: Donnelly Exhibit: Discuss and take action on OOG Grant Award # for a Restitution Specialist. Presented by Laura Nodolf, District Attorney. Asking for permission to accept the grant. This is a 2-year grant. $72, per year. Motion to accept this grant (OOG Grant Award # for a restitution specialist). 5 16. Discuss and take action on out of state travel for Jeff Floyd to attend Leadership Conference in Louisiana on November 12-16, Presented by Jeff Floyd, Extension Agent. Acknowledge Midland County Horseshoe Arena, Pavilion & Amphitheater Hi Lite Report. Motion to move $200, out of contingency into detention outplacement services. Motion to approve (service renewal agreement with Midland County and Permian Basin Community Centers DBA Permiacare Community Based Services Agreement). 10 36. Discuss and take action HP Toner Agreement with Total Office Solution. Presented by Kristy Engeldahl, Purchasing Agent. There is no cost for this service. Motion to approve the HP Toner agreement with Total office solutions pending on Russell Malm, County Attorney s review. Motion by: Sanchez Second by: Ramsey Exhibit: Call No Discuss and take action correcting previous action approving funding for Opportunity Park. Presented by Judge Bradford. The Bush Tennis Center is the umbrella organization that the Chris Davidson Opportunity Park is under. The check will be made to Bush tennis center for building and maintenance for the Chris Davidson Opportunity Park only. The amount is still $100, Motion to approve the contract between Midland County and the Bush Tennis Center for the building and maintenance of the Chris Davidson Opportunity Park. Motion by: Donnelly Second by: Ramsey Exhibit: 38. Discuss and take action on support of Midland Downtown Conservatory Park. Presented by Judge Bradford. Russell Malm, County Attorney should read Midland Downtown Park Conservatory. This is for a community park. They are requesting $1 million. Maintained by a non-profit. Scott Tidwell is in charge. There was some discussion amongst the Court members. If approved Russell Malm, County Attorney will draft an MOU. Motion to approve a contribution to the Midland Downtown Park Conservatory of a (1) million dollars. The public purpose is that it is a free public park with no admission charged and that it is subject to an MOU that is approved by the County Attorney, Russell Malm. The benefit to Midland County is that it is within walking distance of the court house and can be used by the general public. Motion by: Donnelly Second by: Ramsey Exhibit: 10

11 39. Discuss and take action on community service agreements. Presented by Jenny Hilton, County Court Administrator. Russell Malm, County Attorney stated that these are not donations or contributions. We are making payments and we are getting something in return. These are all budgeted items. Museum of the Southwest; Midland Rape Crisis Center and Children s Advocacy Center; Centers for Children s and Families; Midland Crime Stoppers; CASA of West Texas; Motran Alliance, Inc.; Senior Link; Humane Coalition; Midland Teen Court Motion to approve all of these community service agreements. Motion by: Sanchez Second by: Prude Exhibit: Motion to pay these community service agreements as presented by Jenny Hilton, County Court Administrator. Motion by: Sanchez Second by: Prude Exhibit: Discuss and take action on Treasurer s Monthly Reports for February, March, and April, Presented by Mitzi Baker, Treasurer Motion to approve (Treasurer s monthly reports for February March and April 2018). Presented by Dwayne Frantz, Risk management October 19 th unit#15494 was involved in an overnight hit and run in front of employee s house. October 12 th unit#15908 SO mental health officer was hit by a drunk driver. No insurance by other party. September 19 th a couple Juvenile Probation Officers were doing a home check and jumped on the home owner s car to avoid a pit bull and kicked out the windshield. 12 42. Discuss and take action on line item transfers. Presented by Veronica Morales, Auditor. Some are from 2018 budget and others are from the 2019 budget. Agenda item 24 in the current year budget for $8, additional funds for SO. Motion to approve all (line item transfers and additional).
