1 YANKTON COUNTY COMMISSION MEETING February 6, 2018 The regular meeting of the Yankton County Commission was called to order by Chairman Todd Woods at 4:00 PM on Tuesday, February 6, Roll Call was taken with the following Commissioners present: Debra Bodenstedt, Gary Swensen, Raymon Epp, Don Kettering and Todd Woods. Action 1847C: A motion was made by Epp and seconded by Kettering to approve the meeting agenda with the following addition: Janitor position. All present voted aye; motion carried. Action 1848C: A motion was made by Kettering and seconded by Bodenstedt to approve the minutes of the January 16, 2018 meeting. All present voted aye; motion carried. Highway: Highway Superintendent Brian Gustad appeared before the board to discuss the spring load limits Resolution 18-2 and the possibility allowing permits for overweight vehicles with non-divisible loads during the spring and approval for entrance application. Greg Vavra from South Dakota Local Transportation Assistance Program (SDLTAP) presented a power point on the effects of truck axle configuration on roads. Action 1851H: A motion was made by Bodenstedt and seconded by Kettering to amend Resolution 18-2 by increasing the 72,000 lbs gross vehicle weight to 80,000 lbs. All present voted aye; motion carried. Action 1852H: A motion was made by Bodenstedt and seconded by Epp to approve the application for Entrance from Deerfield Truck & Equipment located in S16-T93N-R56W in Yankton County. Action 1853Z: A motion was made by Kettering and seconded by Swensen to recess the regular session and convene as Board of Adjustment. All present voted aye; motion carried. Variance Public Hearing: This was the time and place for a public hearing for a Variance of Maximum Accessory Structure application from Jeremy Sayler. Variance of Minimum Lot Requirement from twenty (20) acres to sixteen +/- (16.44) acres in an Agriculture District (AG) in Yankton County. Said property is legally described as NE1/4, NW1/4, exc Lot R-38, S1-T96N-R55W, hereinafter referred to as Mayfield Township, County of Yankton, State of South Dakota. The E911 address is st Street, Irene, SD. The Planning Commission recommended approval 7-0. Action 1854Z: A motion was made by Kettering and seconded by Bodenstedt to approve a Variance Permit for Jeremy Sayler on the condition of an Agriculture Waiver placed on the permit, based on Findings of Fact from the January 9, 2018 Yankton County Planning Commission meeting and on file in the Zoning Administrator s Office, to approve a Variance of minimum Lot Requirement from twenty (20) acres to sixteen +/- (16.44) acres in an Agriculture District (AG) in Yankton County. Variance Public Hearing: This was the time and place for a public hearing for a Variance of Maximum Accessory Structure application from Kneifl Properties LLC. Variance of Maximum Accessory Structure Size Requirement from 2,000 sq. ft. with fourteen (14) foot sidewalls to 6,768 sq. ft. with sixteen (16) foot sidewalls in a Low Density Rural Residential District (R-1) in Yankton County. Said property is legally described as Tract 1, Kneifl s Addition, SW1/4, S7-T93N-R56W, hereinafter referred to as Utica South Township, County of Yankton, State of South Dakota. The E911 address is th Avenue, Yankton, SD. The Planning Commission voted against the variance 4-3. Zoning Administrator Pat Garrity read four (4) letters from area residents opposing the variance application. Several county residents voiced their concerns about the permit, citing blocked view and the size of the building. Two residents suggested reaching out to the landowners and try to come to agreement that would satisfy everyone involved. Action 1856Z: A motion was made by Kettering and seconded by Swensen to deny the variance application. Roll call vote on the application was taken with Kettering, Swensen, Epp, Bodenstedt and Woods voting Aye; Motion carried, 5-0. Action 1857C: A motion was made by Bodenstedt and seconded by Swensen to recess the Board of Adjustment and reconvene in regular session. All present voted aye; motion carried. Page 5

6 Action 1858: A motion was made by Bodenstedt and seconded by Kettering to adopt the following resolution: Whereas it appears, Jeremy Sayler owner of record, has caused a plat to be made of the following real property: Sayler Tract 1, NE1/4, NW1/4, S1-T96N-R55W, hereinafter referred to as Mayfield Township County of Yankton, S.D., and has submitted such plat to the Yankton County Planning Commission and the Yankton County Commission for approval. Now therefore be it resolved that such plat has been executed according to law and conforms to all existing applicable zoning, subdivision and erosion and sediment control and the same is hereby approved. The County Auditor is hereby authorized and directed to endorse on such the proper resolution and certify the same. All present voted aye; motion carried. Action 1859Z: A motion was made by Bodenstedt and seconded by Epp to adopt the following resolution: Whereas it appears, Clifford Luikens owner of record, has caused a plat to be made of the following real property: Lots 2A & 3A, Block 2, Replat Timberland Park Addition SE1/4, S15-T93N-R56W, hereinafter referred to as Utica South Township, County of Yankton, S.D., and has submitted such plat to the Yankton County Planning Commission and the Yankton County Commission for approval. Now therefore be it resolved that such plat has been executed according to law and conforms to all existing applicable zoning, subdivision and erosion and sediment control and the same is hereby approved. The County Auditor is hereby authorized and directed to endorse on such the proper resolution and certify the same. All present voted aye; motion carried. Action 1860C: A motion was made by Bodenstedt and seconded by Kettering to approve the abatement in the amount of $1, for Yankton Church Holdings, due to tax exempt status. All present voted aye; motion carried. Action 1861C: A motion was made by Kettering and seconded by Bodenstedt to approve the abatement in the amount of $77.36 for Leona H. Petersen, due to clerical error. All present voted aye; motion carried. Action 1862C: A motion was made by Epp and seconded by Bodenstedt to approve the abatement for parcel in the amount of $83, and parcel in the amount of $5, for Sacred Heart Health Services, due to tax exempt status. All present voted aye; motion carried. Smith Insurance: Roger Smith presented property and casualty renewal policies and pricing. Smith also presented a report stating the averages of workman s comp claims for Yankton County compared to other counties. Wage Scale: The wage scale discussion was rescheduled to the next meeting. Evaluations: The board discussed the status of the non-elected department head Evaluations Page 6

7 The Auditor stated four applications have been received for the Buildings and Grounds Supervisor position and Friday, February 9 th is the closing date for the position. Action 1863C: A motion was made by Epp and seconded by Bodenstedt to adjourn. All present voted aye; motion carried.
