1 YANKTON COUNTY COMMISSION MEETING August 21, 2018 The regular meeting of the Yankton County Commission was called to order by Chairman Todd Woods at 4:00 PM on Tuesday, August 21, Roll Call was taken with the following Commissioners present: Gary Swensen, Debra Bodenstedt, Raymon Epp and Todd Woods; Absent: Don Kettering. There were no conflicts of interest reported by Commissioners. Action 18292C: A motion was made by Epp and seconded by Bodenstedt to approve the meeting agenda with the following change: New load limits and mass casualty drill. Action 18295Aud: A motion was made by Epp and seconded by Bodenstedt to supplement the County Ambulance Budget due to unanticipated insurance revenue in the amount of $2, All present voted aye; motion carried. Action 18296C: A motion was made by Epp and seconded by Bodenstedt to approve the consent agenda. All present voted aye; motion carried. The Yankton County Welfare Report for July 2018 included 7 contacts, 10 notices of hospitalization and 4 medical bills for the County Jail. ROD: The Register of Deeds report from July 2018 showed collection of $12, in regular fees; $10, in transfer fees; $3, in copies revenue. Veterans Office: VSO Michael McDonald s July 2018 report showed 172 contacts on behalf of veterans last month. McDonald also coordinated transportation of 28 veterans (nine trips) to appointments at the VA Hospital in Sioux Falls. EMS: Emergency Medical Services monthly report for July 2018 listed 178 total calls. Year to date, Yankton County EMS has collected $465,733 and spent $592,031. Auditor/Treasurer: The Auditor s Monthly Settlement with the Treasurer as of July 31, 2018, showed Total Cash of $9,136, The General Fund was $5,728,057.60; Special Funds were $1,862,106.80; and Trust and Agency Funds were $1,546, adding to a Grand Total of General Ledger Cash and Investments of $9,136, A detailed report is on file with the County Auditor. Sheriff: Sheriff s office collected $8, in fees last month. Jail income was $218, in July. There were 58 county inmates, 78 city inmates, 52 state inmates and 66 federal inmates. Income from the 24-7 program was $5, in July. MI Income: The MI Illness income for July 2018 was $5, Entrance application from Irene Lyles in Township All present voted aye; motion carried. Page 4

Said line is running between Section 9 and Section 16, T93N-R56W, Utica South Township, Yankton County, South Dakota. Action 18297C: A motion was made Bodenstedt and seconded by Swensen to table the petition no later than the September 18, 2018 commission meeting. All present voted aye; motion carried. Action 18298C: A motion was made by Epp and seconded by Bodenstedt to approve the transport contract with Avera Sacred Heart Hospital. All present voted aye; motion carried. Sherriff: Sheriff Jim Vlahakis appeared before the board to discuss several items, jail laundry facility, surplus property and agreement with Heartland Humane Society. Vlahakis also presented quotes for jail security system upgrade. Quotes from Integrated Technology & Security (ITS) were $22, for Jail Guard Tour; $10, card reader and $4, for cameras and installation. Action 18299S: A motion was made by Bodenstedt and seconded by Epp to accept the quotes presented for the upgrades. All present voted aye; motion carried. Action 18300S: A motion was made by Epp and seconded by Swensen to approve the agreement with Heartland Humane Society. All present voted aye; motion carried. Action 18301S: A motion was made by Bodenstedt and seconded by Swensen to surplus the items presented by Yankton County Sheriff. All present voted aye; motion carried. Action 18302S: A motion was made by Epp and seconded by Bodenstedt to approve the purchase of a new washing machine for the Jail laundry facility. All present voted aye; motion carried. County Health Insurance: Julie Auch, representative from Blue Cross Blue Shield Insurance for Yankton County s employee health insurance program, presented Dental, Vision and life insurance options for county employees at no cost to the county. Auch also discussed policy change to the employee handbook on domestic partnerships. The board approved presenting the options to county employees. Action 18303Z: A motion was made by Epp and seconded by Bodenstedt to recess the regular session and convene as Board of Adjustment. All present voted aye; motion carried. CUP Public Hearing: This was the time and place for a public hearing for a Conditional Use Permit application from Karl Schenk. Applicant is requesting the modification of Conditional Page 5

6 Use Permit #3138 Mission Hill Site to be modified from a Class D Confined Animal Feeding Operation to a Class E Confined Animal Feeding Operation. Applicant requests to decrease to one (1) 2400 head pork (finisher swine over 55 pounds) (960 AU Animal Units) Class E finishing barn in an Agriculture District (AG) in Yankton County. Said property is legally described as E1/2, SW1/4 & SE1/4, S26-T94N-R55W, hereinafter referred to as Mission Hill North Township, County of Yankton, State of South Dakota. E911 address is TBA 308 th Street, Mission Hill, SD. The Planning Commission recommended approval 8-0. Mike Stevens spoke on behalf of Karl Schenk on the modification of Conditional Use Permit. Individuals opposed to the Conditional Use Permit were: Phil Tau, David Healy and Dan Dolejsi. Robert Freng and Louis Johnson spoke in support of the Conditional Use Permit. Mike Stevens gave a brief rebuttal statement. Action 18304Z: A motion was made by Epp and seconded by Bodenstedt to approve a Conditional Use Permit for Karl Schenk, based on Findings of Fact from the July 31, 2018 Yankton County Planning Commission meeting and on file in the Zoning Administrator s Office, to modify Conditional Use Permit #3138 Mission Hill Site to be modified from a Class D Confined Animal Feeding Operation to a Class E Confined Animal Feeding Operation. Action 18306Z: A motion was made by Bodenstedt and seconded by Epp to approve a Conditional Use Permit, based on Findings of Fact from the August 14, 2018 Yankton County Planning Commission meeting and on file in the Zoning Administrator s Office, for Crown Castle USA, to change antennas on existing towers pursuant to Article 19, Section 1905 of the Yankton County Zoning Ordinance. Highway Superintendent Brian Gustad and Adam Polley from Clark Engineering out of Sioux Falls, SD appeared before the board to discussed lowering the load limits on Fleege s bridge: 25-ton combination (down from 40 tons) and a 19-ton single vehicle limit (down from 24 tons). Polley stated the bridge remains sound but was built to handle the lighter traffic of another era. Commissioner Bodenstedt mentioned the September 20 th class on mass casualty and fatalities. Action 18312C: A motion was made by Epp and seconded by Bodenstedt to recess the regular session at 6:42 p.m. and convene in executive session to discuss a personnel issue. Bodenstedt, Epp and Woods voting Aye; Swensen Voting Nay; motion carried. Action 18313C: A motion was made by Bodenstedt seconded by Epp to adjourn executive session at 6:48 p.m. and reconvene in regular session. Epp, Bodenstedt and Woods voted aye; Swensen did not vote; motion carried. Page 8
