1 YANKTON COUNTY COMMISSION MEETING October 4, 2016 The regular meeting of the Yankton County Commission was called to order by Chairman Todd Woods at 4:00 PM on Tuesday, October 4, Roll call was taken with the following Commissioners present: Donna Freng, Raymon Epp, Debra Bodenstedt and Todd Woods; Absent: Don Kettering. Action 16306C: A motion was made by Bodenstedt and seconded by Epp to approve the meeting agenda with the following additions: CUP permit postponed, bus trip to Baltic, SD, active shooter workshop and smoke road. Action 16312C: A motion was made by Bodenstedt and seconded by Epp to increase the 2016 Napa Junction Project by $1,034, as an automatic supplement, due to unanticipated revenue from the Department of Transportation. All present voted aye; motion carried. Action 16313C: A motion was made by Bodenstedt and seconded by Epp to approve resolution Authorizing county officials and staff to attend educational conferences, meetings, and conventions. Mileage and necessary expenses to attend be allowed if approved by the department head and if the travel budget is sufficient. Said resolution will be effective 2016 moving forward. All present voted aye; motion carried. Highway: Highway Superintendent Brian Gustad appeared before the board to present the Road & Bridge 5-year plan. The plan needs to be approved by the board October 15, 2016, Gustad also stated that all requirements for the 5-year plan have been met. Also discussed was paying off the 2007 Smithco side dump trailer in the amount of $33,000.00, at present the highway is leasing the trailer. Action 16314C: A motion was made by Epp and seconded by Bodenstedt to approve the Road and Bridge 5-year plan. All present voted aye; motion carried. Action 16315C: A motion was made by Epp and seconded by Freng to table the request to buy the dump trailer until the next commission meeting. All present voted aye; motion carried. Page 5

Variance Public Hearing: This was the time and place for a public hearing for a Variance of Minimum Lot Requirement application from George Peterson. Variance of Minimum Lot Requirement from twenty (20) acres to five +/- (5.16) acre and from five hundred (500) feet lot width to three hundred sixty +/- (367.69) feet in an Agriculture District (AG) in Yankton County. 9 Action 16324Z: A motion was made by Bodenstedt and seconded by Freng to adopt the following resolution: Whereas it appears, George Peterson, owner of record, has caused a plat to be made of the following real property: NE2/4, NE1/4, S17-T95N-R57W, hereinafter referred to as Lesterville Township County of Yankton, S.D., and has submitted such plat to the Yankton County Planning Commission and the Yankton County Commission for approval. Now therefore be it resolved that such plat has been executed according to law and conforms to all existing applicable zoning, subdivision and erosion and sediment control and the same is hereby approved. The County Auditor is hereby authorized and directed to endorse on such the proper resolution and certify the same. All present voted aye; motion carried. Napa Junction: Brett Kennedy with Stockwell Engineers appeared before the board to give an update on the progress of the road upgrades for the Dakota Plains Ag Facility. Road & Bridge Levy: Commissioner Epp spoke during meeting time set aside for input about the county road and bridge levy on the general election ballot. Epp said this is a challenging time for the farm economy, but it is still important to maintain our roads and bridges. Epp also said Highway Superintendent Brian Gustad has prepared a good five-year plan for county road and bridge improvements. There was no public input on the levy. Page 9

10 County Liens: John Blackburn appeared before the board to request waiving several county liens in order to sell the individual property to pay for funeral expenses. Pursuant to Mr. Blackburn s argument that administrative cost of the estate has priority over county liens. Action 16327C: A motion was made by Bodenstedt and seconded by Freng to waive the county liens with the stipulation that if there are excess dollars, the county will receive those dollars. All present voted aye; motion carried. Action 16328C: A motion was made by Bodenstedt and seconded by Freng to recess the regular session at 5:45 and convene in Executive Session to discuss Contractual matters. All present voted aye; motion carried. Action 16329C: A motion was made by Epp and seconded by Freng to adjourn executive session at 6:15 pm and reconvene in regular session. All present voted aye; motion carried. Chairman Woods reported no action would be taken as a result of the executive session. Action 16330C: A motion was made by Epp and seconded by Freng to adjourn. All present voted aye; motion carried. Commissioner Bodenstedt touched on the active shooter workshop which was held September 26 th, at Yankton Fire Hall #2. Bodenstedt stated it interesting and important training and time well spent. Chairman Woods commented on a letter that was sent to the commissioners from Yankton School bus drivers.
