At ts nneteenth sesson the Commsson decded to postpone to ts twenteth sessonÿ due to lack of tmeÿ the consderaton of the agenda tem on freedom of nformaton At ts twenteth sesson the Commsson had before t: a) A report on developments n the feld of freedom of nformaton snce 54 (E/3443)ÿ together wth the comments of Governments and specalzed agences thereon (E/3443/Add.1 and 2)ÿ (b) Annual reports on freedom of nformaton for ÿ and 1ÿ (E/CN.4/822 and Add.l-3, E/CN.4/838 and Add.l-3ÿ and E/CN.4/862 and Add.l-2) Due to lack of tme the Commsson was agan unable to dscuss ths tem and decded to postpone ts consderaton to the twenty-frst sesson (see para. 8 above) Howeverÿ n connexon wth tem 5 of ts agenda "Perodc reports on human rghts"ÿ the Commsson decded to establsh a Commttee whchÿ nter alaÿ was requested "to examne the reports on freedom of nformaton whch are at present before the Commsson andÿ n ther lghtÿ make recommendatons to the Commsson at ts twenty-frst sesson concernng steps whch should be taken wth respect problems of freedom of nformaton by the Unted Natons n co-operaton wth the specalzed agencesÿ partcularly UNESCO" (see pare. 328ÿ resoluton 3 B (XX)) At the request of the Government of Jamaeaÿ an tem enttled f'desgnaton of 1968 as Internatonal Year for Human Rghts" had been ncluded n the Agenda of the General Assembly's eghteenth sesson At that sessonÿ on the recommendaton of the Thrd Commtteeÿ the Assembly had adopted resoluton 1961 (XVIII) on that subject. In the operatve part of that resoluton the General Assemblyÿ n parteularÿ desgnated the year 1968 as Internatonal Year for Human Rghtsÿ and ÿequested the Economc and Socal Councl to nvte the Commsson on Human Rghts at ts forthcomng sesson: (ÿ) to prepare a programme of measures and actvtes representng a lastng contrbuton to the cause of human rghts3 to be undertaken by the Unted Natonsp by Member States and by the specalzed agences durng the year 1968ÿ n celebraton of the twenteth annversary of the adopton of the Unversal Declaraton of Human Rghts; (ÿ) to prepareÿ for consderaton by the General Assemblyÿ suggestons for a lst of goals n the feld of human rghts to be acheved by the Unted Natons not later than the end of 1968; and (ÿ) to submt the programme of measures and actvtes and the [suggestons for the lst of goals n tme for ther consderaton by the at ts twenteth sesson. The Economc and Socal Councl3 at ts resumed thrty-sxth sessonÿ had ÿ3ÿ ÿ cded to transmt that resoluton of the General Assembly to the Commsson on ÿ ÿ Rghts. At ts twenteth sesson3 the Commsson accordngly had thatreÿ before s also a note by the Secretary-ÿthat agenda temÿ Cn March 1964 the representaÿsubmÿted a draft resoluton on that readng as followsÿ "The Commsson on Human Nghtsÿ Notng General Assembly resoluton 1961 (XVIII) desgnatng the year 1968 as Internatonal Year for Human Rghtsÿ Sharng the vew of the General Assembly thatÿ n spte of the substantal measure of progress whch has been acheved n gvng effect to human rghts and fundamental freedoms snce the adopton of the Unversal Declaraton of Human Rghtsÿ the effectve realzaton of these rghts and freedoms remans unsatsfactory n some parts of the worldÿ Bearng n mnd the broad objectves of achevng a set of goals n the of human rghts not later than 1968ÿ and the preparaton of a programme of measures and actvtes n the feld of human rghts to be undertaken by Governments and the specalzed agences durng the year 1968ÿ Decdes that a Commttee consstng of fve of ts members apponted by of the Commsson shall meet two weeks before the 1965 sesson of Commsson on Human Rghts to prepare a programme of measures and to be undertaken by Member States durng 1968 n celebraton of the annversary of the Unversal Declaraton of Human Rghts and n the of Human Rghts and fundamental freedomsÿ

3 Requests the Economc and Socal Councl to recommend the followng draf resoluton to the General Assembly for consderaton at ts nneteenth sess The General Assemblyÿ Recallng ts resoluton 1961 (XVIII) of 12 December 1963 desl the year 1968 as Internatonal Year for Human Rghtsÿ Recognzng the need for effectve measures to be taken at both theÿ nternatonal and the natonal levels to encourage the further of human rghts and fundamental freedoms, Reaffrmng the belef that the cause of human rghts wll be wall served by an ncreasng awareness of the extent of the progress made, the convcton that theyear 1968 should be devoted to ntensfed natonal and nternatonal efforts and undertakngs n the feld of rghts and also to an nternatonal revew of the achevements n ths feldÿ Convnced that an ntensfcaton of efforts n the ntervenng wll heghten the progress that ean be made by 1968ÿ 3. Decdes to complete the consderaton of the Declaratons and Recommendatons outstandng n the feld of Human Rghts now before the General Assembly by 1968; 4. Recommends n prncple tee convenngÿ n of an Internatonal Conference to () revew the progress whch has been made n the feld of human rghts snce the adopton of the Unversal Declaraton of Human Rghtsÿ () evaluate the effectveness of the methods and technques used by the Unted Natons n the feld of human rghts and () formulate and prepare a programme of further measures to be taken subsequent to the celebraton of Human Rghts Year; 5. Requests the Secretary-General to ascertan from Member States ther atttude to such a conference and the place and date of meetng of the Conferenceÿ and to report on hs consultatons to the General Assembly at ts twenteth sesson." 351. A statement of the fnancal mplcatons of the Costa Rcan draft resoluto ]-717) was transmtted to the Commsson by the Secretary-General 1. Recommends that all Member States be nvted to ratfy or durng 1968 the Conventons already concluded n the feld of humanÿ rghts, and n partcular the followng: Supplementary Conventon on the Abolton of Slaveryÿ the Slave and Insttutons and Practces Smlar to Slaveryÿ IL0 Conventon Concernng the Abolton of Forced Labour; IL0 Conventon on Dscrmnaton n Respect of Employment and Occupaton; UNESCO Conventon Aganst Dscrmnaton n Educaton. 2. Recommends the concluson of the followng draft Conventons before 1968 so that they may be open for ratfcaton and accesson before 1968: Draft Covenant on cvl and poltcal rghts; Draft Covenant on economc, socal and cultural rghts; Draft Internatonal Conventon on the elmnaton of all forms of racal dscrmnaton] Draft Internatonal Conventon on the elmnaton of all forms of relgous ntolerance; Draft Conventon on freedom of nformaton. 3. Decdes to complete by 1968 the consderaton and preparaton of the followng draft declaratons: Draft declaraton on the elmnaton of dscrmnaton n the matter of poltcal rghts; Draft declaraton on the elmnaton of dscrmnaton n relaton to women." Commsson consdered ths agenda tem, ncludng the drafts before tj at meetng on 14 March was agreement n prasng the ntatve taken by Jamaca and Trndad whch had led to the adopton of resoluton 1961 (XVIII) by the Assemblyÿ and n recognzng that the Commsson on Human Rghts should, n wth that resoluton, gve ts full attenton to the preparaton of and lsts of goals wth a vew to ntensfyng natonal and nternatonal n the feld of human rghts n connexon wth the celebraton n 1968 of annversary of the adopton of the Unversal Declaraton. -lo1-

None of the rsprcsentatves expressed any objecton to the proposal for a meetng of a Commttee whose genezal terms of reference3 under both the orgnal and the revsed Costa Ncan draft resoluton (E/CN.4/L.717 and E/CN.4/L.717/Rev.1), would call for t to recommend a programme of measures and actvtes to be undertaken by Member States, the Unted Natons and specalzed agences, 357- A dscusson took place on the queston of whether consderaton should be gven to the convenng, n 1968, of an nternatonal conference to revew progress, make an evaluaton and formulate programmes, as provded n the Costa Rcan draft / resolutons One representatve qÿestoned whether such a conference could carry out the proposed evaluaton and sad that t would be preferable for that dffcult task /< to be entrusted to a study group. Several representatves expressed reservatons concernng the convenng of the conference, emphaszng the extent of the mplcatons ndcated by the Secretary-General (E/CN.4/L.717/Add.Iÿ para. 6) The] Costa Rcau representatve revsed hs draft n the lght of those varous reservatons: whereas under the orgnal draft (E/CN.4/L.717, part B) the Generalÿ Assembly would, at ts nneteenth sessonÿ recommend "n prncple the convenlngj n 1968," of such a conference, the revsed text (E/CN.4/L.717/Rev.I, operatve paragraph 2) called for the Commttee, whch would meet n 1965ÿ to "gve specal thought to the consderatons relevant to the holdng" of the conference n Snce several representatves had objected that, even n ts revsed verson, the resoluton could be nterpreted as mplyng approval n prncple of the plan for an nternatonal conferenceÿ the Costa Rcan representatve fnally decded on formula under whch "as a part of ts terms of reference, the Commttee should specal thought to the possblty of holdng an Internatonal Conference n 1968ÿ The sponsor of the draft resoluton contended that the new wordng n no way prejudged the advsablty of holdng the conference and would leave the all the freedom t wshed to study the varous aspects of the matter. After oral amendment and those explanatons had been madej the above-mentoned to the Costa Rcan draft resoluton were wthdrawn Under the orgnal Costa Rcan draft resoluton (E/CN.4!L.717, part A), General Assembly would have recommended that all Member States should be nvted to ratfyÿ before or durng 1968, the Conventons already concluded n the of human rghts; and n partcular certan specfed Conventons] t would also have recommended the concluson before 1968 of a number of specfed draft conventonsÿ ncludng the draft Couvenants, so that they mght be open for ratfcaton and accesson before or durng 1968] and t would, fnally, have decded to complete by 1968 the consderaton of the Declaratons and Recommendatons outstandng n the feld of human rghts now before the In the revsed Costa Rcan draft resoluton (E/CN.4/L.717# operatve paragraphÿ these specfc recommendatons to the Assembly were omtted and there was no any reference to the draft Declaratons now before the Assemblyÿ but the was called upon further to "consder the convenence of nvtng all Member to sgn, ratfy and apply the conventons already approved n the feld of rghts" The Ukranan draft resoluton (E/CN.4/L.721) was desgned to part A of the orgnal Costa Ecan draft (E/CN.4/L.717). Under the draft, the General Assembly would nvte all Member States to ratfy beforel the Conventons already concludedÿ nter ala# certan specfed conventoÿsÿ of specfed draft Conventons would be concluded so that they mght be open for ratfcaton and accesson before 1968, and the Assembly would decde to complete by 1968 the preparaton of draft declaratons. The only dfferences between the two texts were the followng: mn the Ukranan draft resoluton (operatve paragraph ), as orally amendedÿ Member States were nvted to ratfy "before 1968'' the Conventons already concluded, rather than "before or durng 1968", as provded n the orgnal Costa Rcan draftÿ the same pont appled to ratfcaton of, and accesson to, conventons whch were to be drafted and concluded n the meantme (operatve paragraph 2)] n the Ukranan draftÿ the lst of Conventons already concluded whch were to be gven specal attenton ncludedÿ n addton to the four referred to n the Costa Rcan draft, the IL0 Conventon concernng Equal Remuneraton for Men and Women Workers for Work of Equal Value3 the Conventon on the Preventon and Punshment of the Crme of Genocde, and the Conventon on the Poltcal Rghts of Women] whereas the orgnal Costa Rean draft (E/CN.4/L.717, part A) called n general terms for the Assembly to complete by 1968 the preparaton of the draft Declaratons and Recommendatons before t, the correspondng Ukranan proposal (E/Clÿ.4/L.721) related specfcally to the draft Declaraton on the elmnaton of dscrmnaton n the matter of poltcal rghts and the draft Declaraton on the elmnaton of dscrmnaton n relaton to women The representatve of the Ukranan SSR stressed that hs draft (E/CN.4/L.721) should n no way be consdered as at varance or n competton wth the revsed submtted by Costa Pca (E/CN.4/L.717/Rev.I)] on the contrary, the two texts n hs vew complementaryj and hs sole purpose n submttng hs own draft been to rentroduce the correspondng provsons of the orgnal Costa Rean (E/CN.4/L.717, part A), whch he consdered essental. The Costa Rcan representatve sad that he supported the Ukranan draft esoluton n ts man lnes] whle he had modfed hs oÿn draft n order to greater agreement wthn the Commsson, he felt that the draft relatng to the conventons and recommendatons on human rghts n hs orgnal text and rentroduced n the Ukranan draft were of mportance for the mplementaton of General Assembly resoluton 1961 (XVIII). A number of representatves also supported the Ukranan draft resolutonÿ that maxmum partcpaton n Unted Natons legslatve actvty by es Members and the acceleraton of the Organzaton's work n connexon wth and declaratons relatng to human rghts should clearly be regarded most mportant of the measures and actvtes mentoned n General Assembly 1961 (XVIII). In partcularÿ t was most desrable that emphass should on the need for expedtng work on the draft Convenants, n vew of the of the twenteth annversary of the adopton of the Unversal L support of the Ukranan draft resoluton (E/CN.4/L.721), a representatve out that fÿ as that draft resoluton proposedÿ the General Assembly as early as 1964ÿ at ts nneteentÿ sesson, recommendatons concernng lo3-

6 the conventons relatng to human rghts, States Members would have the tme to ntate ther consttutonal ratfcaton procedures so as to accede to the conventons before whereas the procedure proposed n the revsed Costa Reÿ draft (ÿ/cÿ.4/l.t17/rev.1) mght wall result n delay The orally revsed Ukranan amendment to the revsed Costa Rcan draft resoluton was adopted by the Commsson by 13 votes to 8j wth no abstentons. At the request of the USSR representatve, the vote was taken by roll-call and the votng was as follows: I 365. On the other handÿ a number of representatves expressed the vew that the Ukranan draft (E/CN.4/L.721) and the orgnal Costa Rcan draft (E/Cÿ.4/L,717) had the defect of gnorng certan mportant conventons and draft recommendatons whch deserved menton. Examples cted were the conventon on the natonalty of marred women and the conventon and recommendaton on consent to marrage, mnmÿ age for marrage and regstraton of marrages. The representatve of the IL0 suggested - and ths suggeston was repeated by a representatve - that the lst contaned n the Ukranan draft should be supplemented by reference to the IL0 conventons relatng to the rght of assocaton and combnaton of agrcultural workers, freedom to form trade unons and the protecton of trade unon rghtsÿ and the applcaton of the prncples of the rght of organzaton and collect barganng. Certan representatves argued that any attempt at enumeraton ra dffcultes: to comple such lsts of conventons and recommendatons was a hghly complex task for whch the Commsson had not enough tme, and study of queston would best be left to the Commttee. The representatves who supported the Ukranan draft repled that they saw no need to add references to other nstruments to t) snce the lst of examples mentoned n the draft was n no to be regarded as exhaustve. In order to dspel msgvngs on ths pont the Ukranan representatve drew attenton to the words "n partcular" n paragraph 1 of hs draft. In addton, he accepted the oral proposal of the Unted States representatve to add references to the draft declaraton on the rght of asylum and the draft declaraton on freedom of nformaton to operatve paragraph 3 of hs draft (E/CN.4/L.721) A representatve crtczed the text of the Ukranan draft rentroduced the orgnal Costa Rcan draft on the ground that, n operatve paragraph 2, General Assembly would be appearng to address recommendatons concernng the concluson of draft conventons to tself. Thatÿ he held, was as unusual a procedure, as t was pontless, snce - at least so far as concerned the dÿraft Covenants - the Assembly had never faled to gve prorty to the consderatonÿ of the drafts. In order to mprove the text, the representatve of the Ukranan SSR accepted a suggeston by the Ecuadoran representatve that the words "Recommends the concluson of the followng draft Conventons before should be replaced by the words "Decdes to hasten the concluson of the draft Conventons". The reference to the need to hasten the ÿorkÿ t was stres by the sponsor of the draft, was an essental aspect of hs proposal. Canada, Denmarkÿ France, Italy, Netherlands, Turkeyÿ Unted Kngdom of Great Brtan and Northern Ireland, Unted States of Amerca. None The Costa Rcan draft resoluton (E/CN.4/L.717/Rev.I), as orally revsed and smendedÿ was unanmously adopted by roll-call vote requested by the USSR representatveÿ all members of the Commsson beng present and votng. ]70. In agreement wth the Costa Rcan representatveÿ the Ukranan submtted the draft resoluton for the Economc and Socal Councl contaned hs own text (E/CN.$/L.721, orally revsed) as an amendment to be added part to the revsed Costa Rcan draft resoluton (E/CN.4/L.717/Rev.1, revsed); and the Costa Rcau representatve declared that f that amendment adopted by the Commsson, he would delete the second sentence of operatve paragraph 2 of hs resoluton3 provdng that the Commttee should consder convenence of nvtng Member States to sgnÿ ratfy and apply the already approved n the feld of human rghts. 1. Decdes that a Commttee consstng of thrty-four members1-ÿ/ apponted from Permanent Delegatons shall meet pror to theÿ1965 sessonafter consultaton wth the Secretary-General to recommend a programme of measures and actvtes to be undertaken by Member Statesÿ the Unted Natons and specalzed agences n celebraton of the Twenteth Annversary of the Unversal Declaraton of Human Rghts and n the furtherance of human rghts and fundamental freedoms; For the fnancal mplcatons relatng to the resoluton see annex III. States Partes shall assure to everyone wthn ther jursdcton effectve protecton and remedes through the competent natonal trbunals aganst any acts of racal dscrmnaton whch volate hs human rghts and fundamental freedoms contrary to ths Conventon, as well as the rght to seek from such trbunals just and adequate reparaton or satsfacton for any damage suffered as a result of such dscrmnaton.
