3 No.6 2 Saya County Publc Appontments Approval 2014 TE SAYA COT]NTY P]BLC APPONTMENTS APPROVAL ACT,?fr14 AN ACT of the Saya County Assembly to provde for procedures for County Assembly approval of consttutonal and. statutory appontments and for connected purposes BNACTED by the County Assembly of Saya, as follows- Short ttle 1. Ths Act may be cted as the Saya County Assembly Publc Appontments (County Assembly Approval) Act, nterpretaton 2. n ths Act, unless the context otherwse requrest'appontng authorty" means any person who, under the Consttuton or any other law, s requred to make an appontment for whch the approval of the County Assembly s requred; ttappontmenttt ncludes any re-appontment to the same body, whether or not n the same capacty; ttcanddatet'means a person who has been proposed or nomnated for appontment to a publc offce; "Clerk" means the Clerk of the County Assembly; and ttcommtteett means the relevant commttee of the County Assembly or such other commttee as the Speaker may, for good reasons, drect. Exercse of powers of appontment 3. An apponer-rent under the Consttuton or any other law for whch the approval of the County Assembly s requred shall not be made unless the appontnrent s approved or deemed to have been approved by the County Assembly n accordance wth ths Act. Notfcaton of vettng requrements 4, Any advertsement nvtng applcatons for nomnaton for appontment to an offce to whch ths Act apples shall ndcate that canddates so nomnated shall be requred to appear before a commttee of the County Assembly for vdttng. Notfrcaton of nomnaton 5.(1) An appontng Authorty shall, upon nomnatng a person for an appontment to whch ths Act apples, notfy the County

(3) notfcaton of appontment shall be accompaned by nformaton concernng the nomnee, havng regard to the ssues mentoned n secton 7. (4) For putposes of ths Act, a notfcaton of nomnaton shall be deemed to be duly gven on the day on whch t comples fully wth subsectons (2) and (3). Approval hearng 6. (l) Upon recept of a notfcaton of appontment, the Clerk shall nvte the commttee tohold an approval hearng. No.6 (2) The commttee shall determne the tme and place for the holdng of the approval hearng and shatl nform the Clerk. (3) The Clerk shall notfy a canddate of the tme and place for the holdng of an approval hearng. (a) The commttee shall notfy the publc of the tme and place for holdng an approval hearng at least seven days pror to the hearng. (5) to ths Act, all com.mttee proceedngs on publc appontments shall be open and transparent. (6) Despte subsecton (5), a commttee may, on ts own moton er on the applcaton of a canddate or anj other concerned person, determne that the whole or part of ts sttngs shall be held n camera. (7) An approval hearng shall focus on a canddate's academc credentals, professonal tranng and experence, personal ntegrty and background. (8) The crtera specfed n the Schedule shall be used by a commffee durng an approval hearng for the puq)oses of vettng a canddate. (9) Any person may, pror to the approval hearng, and by wrtten statement on oath, provde the Clerk wth evdence contestng the sutablty of a canddate to hold the offce to whch the canddate has been nomnated. (10) A canddate may, at any tme, by notce n wrtng addressed to the Clerk, wthdraw from the approval process and the canddate's

5 No.6 4 Saya County Publc Appontments Approval 2Al4 nomnaton shall thereupon lapse. ssues for consderaton 7.The ssues for consderaton by the County Assembly n relaton to any nomnaton shall be- (a) the procedure used to arrve at the nomnee; (b) any consttutonal or statutory requrements relatng to the offce n queston; and (c) the sutablty of the nomnee for the appontment proposed havng regard to whether the nomnee's abltes, experence and qualtes meet the needs of the body to whch nomnaton s beng made. Perod for consderaton and report 8. (1) Unless otherwse provded n any 1aw, a comrnttee shall consder a nomnaton and table ts report n the County Assembly for debate and decson wthn fourteen days from the date on whch the notfcaton of nomnaton was gven n accordance wth secton 5. s (2) At the concluson of an approval hearng, the commttee shall prepare ts report on the sutablty of the canddate to be'apponted to the offce to whch the canddate has been nomnated, and shall nclude n the report, such recommendatons as the commttee may consder necessary. Falure of the County Assembly to act on nomnaton 9. f, after expry of the perod for consderaton specfed n secton 8, the County Assembly has nether approved nor rejected a nomnaton of a canddate, the canddate shall be deemed to have been approved. Rejecton of nomnaton 10.'Where the nomnaton of a canddate s rejected by the County Assembly, the appontng Authorty may submt to the County Assembly the name of another canddate, and the procedure for approval specfed n ths Act shall apply accordngly. Notfcaton of decson 11. The Clerk shall notfy the appontng authorty of the decson of the County Assembly wthn seven days of the decson. Powers of the commttee 12.
