3 To: Council Submitted by: For: Agenda Item # Meeting Date: Nancie Irving Action Dec Clerk Subject: Committees and Boards Mayor Elect Currie received input from all Council Elect members in his review of Council confirming appointments to Committees and Boards. Council members have been assigned to specific area of responsibility as the Council contact for the area of interest. In addition, members will be appointed to specific Committees and Boards by By-law. Areas of Responsibility The Town s Procedure By-law states: Each member of Council, except the Mayor will be assigned to a specific subject area or area of responsibility and would be the Council contact for that area of interest. Coundiors would ensure they are up to date on activities in their area of interest and able to lead discussions on topics at Committee and Council meetings if required. The areas of interest are based on the functional responsibilities of each of the Standing Committees (or Council) and are summarized under that Committee s (or Council s) functional responsibilities in Schedule A of this By-Law. Accordingly, the area of responsibility for Council members will be: Planning, Economic Development and By-law Enforcement Community Services Property/Parks Recreation Transportation/Environment/Water Public Safety Finance and Administration Personnel Councillor T. McDonald Councillor S. Andrews Councillor B. A. Laur There are four appointments where Council will need to further discuss: (a) Council appointee to the ERTH Corporation Board of Directors Currently the representative is former Councillor John Vandermeersch. Jeff Pettit, ERTH has requested that Mr. Vandermeersch continue to represent the Town as the Town s appointee until the Annual General Meeting. Following this time, then Deputy Mary French will be the Council appointee to the Board. There is a recommendation below, for consideration. (b) Council appointee to the Police Services Board Currently it is Robert Andy Anderson. Council will need to decide if it wishes Mr. Anderson to continue to be the citizen appointee on behalf of the Town, or ask the Clerk to advertise to seek another individual to serve in this capacity. 4 (c) Council appointee as Fence Viewers Currently there is only 1 individual, that being Larry Jeffery. The Clerk is asking for direction to advertise for two vacancies. There is a recommendation below, for consideration. (d) County Land Division Committee The County has changed the composition of this Committee from one member appointed to represent both the Town and the Township of Malahide, to each of the municipalities now having their own elected or non-elected representative. The letter from the County is attached. In addition, the Clerk has received a submission from Kathleen Schaper, requesting to serve on this Committee. Council will need to decide if it wishes Ms. Schaper to be the Town s appointee (non-elected), or to appoint an elected official, or to ask the Clerk to advertise to seek additional interested parties, for Council to consider with Ms. Schaper s submission. RECOMMENDATIONS: Note: each recommendation to be considered separately. Note: direction is required for (2) and (4). (1) ERTH Corporation Board of Directors That Council appoint John Vandermeersch to serve as the Town s representative on the ERTH Board of Directors until the day after the 2015 Annual General Meeting, following which date Deputy Mayor Mary French will be the Town s representative on this Board. (2) Police Services Board (Direction Required) That the following actions be taken with respect to the Town s appointment to the Police Services Board: (3) Fence Viewers That the Clerk be requested to advertise to fill the vacancies for two Fence Viewers. 9 7 ElgrnCou.nty November24, 2014 Elgin Municipal Partners Subject: Nominations to Elgin County Land Division Committee Dear Mayor and Members of Council: On June 10 th, 2014, in response to feedback from Elgin municipalities, Elgin County Council reconstituted the Land Division Committee as depicted in the following resolution which reads in part: That the new Land Division Committee consist of one appointee, either elected or nonelected, from each of Elgin s constituent municipalities. In effect, the committee will now be expanded to seven members (instead of five) and, unlike before, elected officials are eligible for appointment. For those who may not be familiar with Land Division, the committee acts as a quasijudicial body similar to a minor court of law. It must be unbiased and has a duty to act fairly. Ideally it operates at arms length, free of political interference, in an effort to maintain credibility. In 2014 the committee will have met on ten occasions, with seven of those meetings lasting a full day. In 2013, the committee met nine times, five full days and four half days. In addition to attending meetings, members have a duty to perform site reviews based on applications for severances within their municipality. A working knowledge of the municipality s Official Plan, Zoning By-laws, and the County s Official Plan is also expected over time. In terms of remuneration, committee members receive a meeting stipend of $150, and a $60 site inspection fee. 10 Nominations to Elgin County November 24, 2014 Land Division Committee There is an important distinction in the appointment process that must be highlighted for your reference. That is, according to the Planning Act [Section 44(3)] members of the committee who are not members of a municipal council shall hold office for the term of council and members who are members of an elected council shall be appointed annually. Please keep these terms of office in mind when selecting your nominee(s). In view of the information presented above, please provide the name of your nominee(s) to my attention by no later than January 2015 so that Elgin County Council may consider the appointment at its meeting to be held on January 27, Shortly thereafter an orientation session will be convened with the first official meeting to take place in mid-february. tr, 16 If you have any questions relative to the above, then please call. Since it s formation, in 1971, there have been 5 members, with one member appointed to represent both the Town of Aylmer and the Twp. of Malahide. Historically, the Township of Malahide has been responsible for appointing that member. With the recent change, Aylmer and Malahide will have their own, separate representatives on the Land Divisions Committee. At present, I am representing the Town of Aylmer and the Township of Malahide on Land Divisions. lam hereby submitting my request to be considered to continue to represent the Town of Aylmer for the upcoming council term. I feel my knowledge and experience in this field make me the best candidate for the position. During my terms on Aylmer Council, first as a Councilor and subsequently as Deputy Reeve, I served as Chair of Planning. Following my move to Springfield with my late husband, I was again elected, this time to serve as a Councilor for the Township of Malahide, and again was appointed Chair of Planning. Following my retirement from that council position I served 8 years as your representative on Land Divisions. Although I no longer live in town, there is no residency requirement for appointees to this position. This information was confirmed by Mark MacDonald, the CEO of Elgin County and Mayor Dave Mennill through consultation with the Ministry of Municipal Affairs and Housing at Queen s Park. We investigated the legislation at the time of my re-marriage and subsequent move to Thamesford. The legislated requirements are, instead, a working knowledge of the Provincial Policy Statement, the Official Plan and Zoning By-laws of the municipality to be represented, as well as an intimate knowledge of the area to be represented. I possess all of that. I remain today to be a recognized fixture in the Town of Aylmer. I still do my banking here. Professional services, such as medical, legal, insurance and pharmacy needs as well as social club membership still bring me to this beautiffil town. Having moved to Aylmer from Toronto in 1977, all of my friends and acquaintances are in this area. I may lay my head down in a geographical location that s 30 minutes away, but Aylmer is my home. I greatly appreciate the experiences I have had as a representative of this beautiful town and hope you will consider allowing me the honour of continuing to act on your behalf for the upcoming term of Council.
