1 *REPORT OF THE MOTIONS COMMITTEE ON CERTIFIED AMENDING MOTIONS FOR PRESENTATION AT THE 2013 ASSOCIATION TECHNICAL MEETING JUNE 12-13, 2013 CHICAGO, IL FOR THE NFPA 70, NATIONAL ELECTRICAL CODE I. Introduction. This is the third s Committee Report listing Certified Amending s that may be presented at the 2013 Association Technical Meeting in Chicago, IL on June 12-13, The s Committee, consisting of NFPA Standards Council Members J. Pauley (Chair), K. Bell, R. Bradley, J. Harrington, D. McDaniel, J. Milke, R. Owen and J. Rickard has been appointed by the Chair of the Standards Council to certify proper amending motions and otherwise review and act, in accordance with 2.1 through 2.7 of the NFPA Technical Meeting Convention Rules (Convention Rules), on Notices of Intent to Make a (NITMAMs) that have been submitted on NFPA 70, National Electrical Code, (NEC ) which is being processed in the Annual 2013 Revision Cycle. This Report is the third of three reports addressing motions submitted for consideration at the 2013 Association Technical Meeting, and is specific to the NEC. A Consolidated Final s Committee Report (the Consolidated Report) will be posted on the NFPA website prior to the Association Technical Meeting. The Consolidated Report will include the three s Committee Reports related to the 2013 Association Technical Meeting, namely: the present Report for the NEC; the Final Report for Annual 2013 Revision Cycle Documents (excluding the NEC), (posted May 5, 2013) and the Report for the Fall 2012 Revision Cycle Documents (posted November 2, 2012). The Consolidated Report will contain all of the certified amending motions contained in the three base Reports. However, the s Committee may refine or revised the sequencing and/or grouping of previously published motions to facilitate the fair, orderly, and efficient consideration of the subjects presented by the motions. Please check the NFPA website to obtain the Consolidated Report. Under NFPA rules, persons wishing to make an allowable amending motion at an NFPA Technical Meeting must declare their intention to do so by filing, within the published deadlines, a NITMAM setting forth information about the intended motion. The s Committee, in accordance with NFPA rules, reviews each NITMAM to determine whether the intended motion is a proper motion. The s Committee can also, in consultation with the submitter of the NITMAM, clarify the intent of, and, if appropriate, restate the motion, and, in certain circumstances, group motions that are dependent on each other together so that they can be made as a single motion. In addition, the s Committee may take such other action or make such other recommendations as will facilitate the fair, orderly, and efficient consideration of motions within the available time. The s Committee certifies for presentation at the appropriate Association Technical Meeting all proper Amending s, either as submitted or as clarified, restated or grouped, as explained above. 2 authorized to make such motions, and the recommended order in which motions should be entertained. In addition, the Report may include s Committee notes or comments aimed at assisting the Presiding Officer or facilitating the understanding of or the orderly and efficient consideration of the motion when presented at the Association Technical Meeting. The Certified Amending s for the NEC reporting in the Annual 2013 Revision Cycle are set forth in Part II of this Report; Part III of this Report summarizes motions on the NEC that were not certified by the s Committee. In reviewing this Report, the following should be considered: The only Amending s allowed at an Association Technical Meeting are Certified Amending s set forth in a report of the s Committee and any Follow-Up s, that is, motions that may become necessary as a result of a previous successful Amending. (See Convention Rules at ) Certified Amending s can only be made by person(s) listed in this Report as authorized to make the motion, or by person(s) they have designated in writing to the Standards Council Secretary as their Designated Representative. See Regulations Governing Committee Projects (Regs.) at The Certified Amending s set forth in this Report are proper and permissible; they will, however, only be presented for consideration of the membership at the 2013 Association Technical Meeting if a person authorized to make the motion (or their Designated Representative) actually appears, signs in no later than one hour before the beginning of the session (see Convention Rules at 2.7), and makes the motion in accordance with NFPA rules. This Report concerns only the NEC which is reporting at the Annual 2013 Association Technical Meeting in Chicago, IL on June 12-13, As further set forth for the above, other Documents reporting to the 2013 Association Technical Meeting are treated in separate Reports. The information presented above provides a general introduction to some of the relevant features of the NITMAM process and the presentation of Certified Amending s. For a full and complete understanding of the process, participants should consult the rules themselves, including the Convention Rules and the Regs. In particular, the rules concerning the submission of NITMAMS and the Certification of Amending s can be found at 2.0 of the Convention Rules and 4.5 of the Regs. The rules concerning membership action at Association Technical Meetings can be found, generally, in the Convention Rules and in 4.6 of the Regs. 3 II. Certified Amending s. Table A summarizes the s on the NEC that have been reviewed by the s Committee and certified as Certified Amending s. These motions can be presented for consideration at the 2013 Association Technical Meeting in Chicago, IL on June 12-13, Previously, the s Committee had ruled that six Annual 2013 Revision Cycle Documents (other than NEC) and three Fall 2012 Revision Cycle Documents have certified amending motions (See the Final Report of the s Committee on Certified Amending s for Presentation at the 2013 Association Technical Meeting (For the Annual 2013 Revision Cycle Documents, Except for NFPA 70, National Electrical Code ), and the Report of the s Committee on Certified Amending s: Fall 2012 Revision Cycle Documents). Note: In accordance with 1.6.2(a) of the Regs, anyone who is dissatisfied with the results of the floor motions from the June 2013 Association Technical Meeting and/or the result of the Technical Committee amendment ballots [see Regs at 1.6.2(b)] have the right to appeal the results. Appeals shall be filed no later than twenty days after the Association Technical Meeting at which Association action on the issuance of the Document was recommended. The final date to file any such appeal is July 3, III. NITMAMs that were not Certified by s Committee. Table B summarizes the s for the NEC in the Annual 2013 Revision Cycle that have been reviewed by the s Committee and not certified.
