In accordance with the NFPA Regulations Governing the Development of NFPA Standards, attached are the preliminary ballot results for your review. These results include explanation of negative votes, abstentions and affirmative votes with comments. 17 Members Eligible to Vote 5 Ballots Not Returned (Jensen, Johnson, McCoy, McNamara, Murphy) 0 Abstain 5 Disagree (Bish, Ohde, Moore, Pirkle, Zieman) 7 Agree Changes in vote may be submitted to kshea@nfpa.org no later than Friday, February 5, Members who did not initially return a ballot may do so now. The return of ballots is required by the Regulations Governing the Development of NFPA Standards.

4 NATIONAL ELECTRICAL CODE PANEL 16 SUPPLEMENTARY LETTER BALLOT NEC Second Draft (A2016) As a result of Second Revision No failing ballot, this supplementary ballot is issued to determine whether the committee continues to support the related First Revision No I AM IN SUPPORT OF FIRST REVISION NO AGREE XX DISAGREE* ABSTAIN* Explanation of Negative or Abstaining Vote: We are voting negative on this supplementary ballot based only on the First Draft language which contains incorrect legislative formatting by Terra View. As approved by the panel during the First Draft Meeting FR 4518 in the fourth sentence of should have read The installation shall conform to 300.4, with (D) through (G) as strikethrough, and We support the remainder of the revisions as indicated in FR4518 (but not the error in the legislative formatting as stated above). Based on panel actions taken by CMP 16 during the first draft meeting including but not limited to the supporting committee statement which reads in part CMP-16 revises the text to reference in its entirety as optical fiber cables need to be protected from all sources of damage and the fact the legislative formatting obviously appeared incorrect in Terra View, we recommend the Correlating Committee at its Feb.23-26, 2016 meeting create a Correlating Revision on FR4518 with correct legislative formatting as intended and approved by CMP-16. Addition of the last sentence in accordance with (C) along with new Informational Note No. 3should remain as accepted. The Correlating Committee recognized this error and submitted PC #1869 which was addressed by CMP-16 in SR #4509. Just because optical fiber cable is not carrying any current the circuits being fed by this cable in a number of situations are critical. Therefore, the installation of these optical fiber cables should conform to all of I recommend that the Correlating Committee create a correlating revision at their February 23-26, 2016 meeting to address this error.
