1 MEETING NOTICE 2014 NEC REPORT ON PROPOSALS JANUARY 9-21,2012 Important Information You Will Need for the Meetings in Hilton Head, SC Note from the Secretary Dear Panel Member: We are very pleased that you will be participating in the processing of the 2014 National Electrical Code. Development of the 53rd edition of the Code would not be possible without the participation ofvolnnteers like you. The Report on Proposals meetings will again be held at the Crowne Plaza Resort, Hilton Head Island, SC. Panel meetings are scheduled to take place January 9-21, A schedule ofthe individual panel meeting dates is located on Page 3. The panel schedules on Pages 4-6 include panel task group meetings scheduled to take place in Hilton Head, if any. Proposals will be sent to all members as soon as possible after the proposal closing date of November 4, 201 I and will be provided in both pdf and FileMaker database formats. If you plan to submit copyrighted material as pali of a proposal, you must provide a copyright release from the copyright holder. Prepared panel actions and statrnenents contribute greatly to the success of each meeting. Please note that legislative text must be applied manually in order for it to be transferred into the NFPA database system; if track changes (revision mode) is used, the nnderline and strike through will be lost. Prepared panel actions and statements should be provided to your staff liaison via memory stick at the start of the meeting. Please be sure to label all files with your name or the name of the task group. When more than one proposal is processed on a paliicular section, action should be taken either in the panel action of one of the proposals or in a separate panel proposal. Action on the other related proposals can then simply refer back to the "master" proposal. 7 Proposals Proposals will be sent to all panel members as part of the meeting agenda by and posted to the NEC document information page: Please be sure to bring acopy of the proposals (electronic or paper) to the panel meeting( s) as copies will not be provided in Hilton Head. The material identified as "For Information Only", if any, consists of proposals assigned to other panels that may affect the work of your panel. The processing schedule to be followed by the panels is outlined on page 3. As the schedule is very tight, no extensions of the deadline for receipt of ballots will be possible. Processing Proposals If a proposal does not comply with Section of the NFPARegulations Governing Committee Projects, the panel may reject the proposal. If a panel does reject a proposal fornot complying with the regulations, the panel statement should reference the specific subparagraph to which it does not comply. Make sure that all panel actions and panel statements result in a complete action that can be readily understood. Editorial Task Groups Editorial Task Groups are charged with identifying proposals that do not comply with Section of the Regulations Governing Committee Projects and proposals that fit into editorial or other categories as directed by the chair. The task group shall develop a report containing recommended panel actions and panel statements (for all actions other than accept) for presentation to the full panel at the ROP meeting. If the panel accepts the task groups full report, those proposals acted on by the task group will not require further discussion during the full panel meeting. However, a single panel member can place any proposal back on the agenda for consideration by the full panel. Task Group Chairs are requested to provide an electronic file of the proposed actions and statements to the staff liaison at the beinning of the meeting. Regulations and Operating Procedures All actions at and following the panel meetings will be governed in accordance with the NFPA Regulations Governing Committee Projects and with the NEC Style Manual, 2011 edition. Failure to comply with the Regulations and/or style manual could result in challenges to the standards-making process. A successful challenge on procedural grounds could prevent publication of the NEC. Consequently, panels must follow the regulations and operating procedures. Panel Actions The following are the actions permitted by the Regulations Governing Committee Projects. Accept - The panel accepts the proposal exactly as written. Only editorial changes such as paragraph and section numbering, and corrections to spelling, capitalization, and hyphenation may be made. If the action is to accept the proposal as written, but the panel wishes to indicate a more suitable location in the document, this directive. can be added in the Panel Action text and no Panel Statement is required. If the panel does not agree with all of the substantiation or supporting data or if the panel has a number of different reasons for acceptance other than those stated in the substantiation or supporting data a Panel Statement should be added. The absence of such a statement could mislead the reader by giving the impression that the panel agreed with all of the substantiation within the proposal. Reject - The proposal is rejected by the panel. If the principle or intent of the proposal is acceptable in whole or in part, the proposal should not be rejected, it should be accepted in principle or accepted in principle in part. A complete reason for rejection of the proposal must be supplied in the panel statement. Please note that lack of the use oflegislative text is not valid reason for rejection. Accept in Principle -Accept the proposal with a change in wording. The panel action must indicate specifically what action was taken to revise the proposed wording, and where the wording being revised is located (i.e., in the proposed wording or in the document). If the details are in the action on another proposal, no Panel Action text is required but reference to the specific proposal detailing the action must be supplied in the Panel Statement. 7

8 Accept in Part - If part of a proposal is accepted without change and the remainder is rejected, the proposal should be. "Accepted in Part." The panel action must indicate what part was accepted and what part was rejected and the panel statement must indicate the reasons for rejecting that portion. Accept in Principle in Part - This is a combination of "Accept in Principle" and "Accept in Part". Panel Statements No Panel statement is necessary for proposals that are "Accepted". Proposals that are "Accepted in Principle", "Accepted in Part", "Accepted in Principle in Part", or "Rejected" must include a panel statement, preferably technical in nature, that provides the reasons for the action. All panel statements must be sufficiently detailed so as to convey the panel's exact justification for its action. This will assist members of the Association in their deliberations at the Annual Meeting of the Association and permit the submitter to develop additional material for rebuttal, if so desired. Panels should add a panel statement on an accepted proposal where the panel disagrees with the substantiation. If the rej ection or change was for the same reason that another proposal was rejected or changed, the panel statement may refer to that proposal giving the same reason for rejection or change. Please verify that cross references to other proposals are correct. The panel statement should not refer to another panel statement which, in turn, refers to some other panel statement. There may be a situation where the panel will want to refer to two, three, or more panel statements if they are all appropriate. If the panel rejects an incomplete proposal, the panel statement should reference the specific subparagraph of Section to which the proposal did not comply. References to the requirements of other documents as a reason for rejection should be to the specific sections ofthe document including the requirements. Ifthere is more than one such section, the reference should include a least one, identified as an example. It is a violation of the regulations for a panel to reject a proposal simply because it accepted a different proposal on the same subject. Reference in the panel statement to another panel action is inappropriate unless the referenced proposal contains all of the applicable technical justification for the action. When the panel develops a panel action for a proposal that is "Accepted in Principle", the rationale must indicate why the wording submitted was not accepted. This reason should be technical in nature, unless the panel has simply rewritten the submitter's text, in which case the panel can state that the revised wording should meet the submitter's intent. The panel statement on a proposal that is "Accepted in Part" must indicate the reason(s) for rejecting that part of the proposal. Easy Procedures for Handling a Motion NFPA Committee Meetings are conducted in accordance with Roberts' Rules of Order. In order for a proposal to be discussed, a motion must be made. A simplified procedure for discussion of motions is as follows: Member Member Addresses the Chair Receives Recognition from the Chair Introduces the Motion (Another Member) Seconds the Motion Chair (Presiding Officer) States the Motion Calls for Discussion Takes the vote Announces the Result of the Vote A procedure known as "Unanimous Consent" can also be used. Unanimous consent enables a motion to be adopted without the necessity of having the chair state the motion and put the motion to a vote. It even permits taking action without the formality of a motion being made. The chair may simply ask the panel ifthere is any objection to taking the desired action, and ifno member then objects, the chair declares that the action has been agreed to. For example, a chair may simply ask, "Is there any objection to the proposed action of Reject and the committee statement shown on the screen?" If no objections are voiced, the chair then states "hearing no objection the motion to reject passes. Another more streamlined procedure is for the chair to say "If there are no objections, the panel action will be Reject with the panel statement as shown on the screen" and then proceed unless a member interrupts with an objection. 8

9 NFPA Meeting Policies Use of tape recorders or any other means capable of producing verbatim transcriptions ofnfpa Committee Meetings is not permitted. Attendance at all NFPA Committee Meetings is open to the public. All guests must sign in and identify their affiliaiton. Participation at NFPA Committee meetings is generally limited to committee members and NFPA staff. Participation by guests is limited to individuals who have previously requested of the chair time to address the committee on a particular item, or individuals who wish to speak regarding proposals that they submitted. Note to Special Experts: Particular attention is called to Section 3-3(e) of the NFPA Guide for the Conduct of Participants in the NFPA Codes and Standards Development Process in the NFPA Directory that directs committee members to declare their interest representation if it is other than their official designation as shown on the committee roster, such as when a special expert is retained and represents another interest category on a particular subject. If such a situation exists on a specific issue or issues, the committee member shall declare those interests to the committee, and refrain from voting on any proposal, comment, or other matter relating to those issues. The chairman reserves the right to limit the amount of time available for any presentations. No interviews will be allowed in the meeting room at any time, including breaks. All attendees are reminded that formal votes of committee members will be secured by letter ballot. Voting at this meeting is used to establish a sense of agreement, but only the results of the formal letter ballot will determine the official position of the committee on any proposal. 9

10 Coordinating Requirements with other NFPA Technical Committees Several code-making panels deal with technical topics that affect or are affected by other technical committees. Examples include Article 517 (NFPA 99), Article 695 (NFPA 20), and Article 760 (NFPA 72). There are frequent questions as to which committee has jurisdiction over specific technical requirements. To help sort this out, the NFPA Standards Council appointed a Council task group on Intercommittee Coordination. The task group has developed the following definitions: Performance Requirement. A specification of the manner in which equipment or a system is intended to function or operate. Installation Requirement. A specification of the materials and process associated with putting equipment in place and making it ready for use in accordance with performance requirements. The following Table provides examples utilizing the above definitions: Performance Requirement Maintenance Periodic Testing Grounding Reliability (i.e., redundant grounding) Prevention of Cascading Outages Reliability of Source Auxiliaries Protection from Damage Response to Failure of Power Source Reliable Source of Water Pressure Reliability of Back-up Power Source Installation Solution Commissioning Multiple grounding methods Initial Acceptance Testing Selective Coordination Selection of Source for Auxiliaries Fire Protection, Fire Barriers, Physical Protection, Location/Separation Means for Connecting Portable Source Fire Pump Driver Runs to Destruction Selective Load Pick-up, Load Shedding, Peak Load Sharing The National Electrical Code contains installation rules. Rules developed by code- making panels should be based on the installation definition. The committee can also develop an installation rule that responds to performance criteria that another technical committee has developed: In all such cases, the Code-Making Panel should coordinate the requirement in consultation with the responsible technical committee.
