1 Woodward Council Minutes July 9, 2018 Mayor Devick called the Council meeting to order at 7:00pm. Roll Call: Present; Bustad, Folkerts, Gough, Luke, Patel. Motion Bustad approve the agenda 2 nd Patel MCU. Motion Bustad approve the minutes for Jun 11 th, with a correction Grubbs donated land change 50 to 25, 2 nd Luke MCU. Motion Bustad approve the minutes Jun 21SS 2 nd Luke MCU. Open Forum: Shawd; drainage issue are still a problem on his street, and who is paying for it. City employee mowed the area and cleaned it up. Dept. Reports: Griffith, Library; many adult and children activities planned this month. Luncheon on Monday fund raising for computer technology. Bustad, wiring and meter transferred to a pole at Centennial Park. Luke, Streets; Speck Co repaired and did crack sealing around the manholes. Grimes asphalt will be taking care of the bill. The alley behind city hall will be repaired and also an area on Birch Street. Gough, Compliance; they will be focusing on junk vehicles and swimming pools. Folkerts, Sewer; Veenstra & Kimm on the Bidding process 20 plans have been drawn. Folkerts talked to Veenstra & Kimm they are looking at the drainage issue ditch on the west side of town. Mayor Report: Worked on the Labor Contract the report has been returned to the Union. The Business Park on the S side of town has finished the certification process. Announcement with the Governors office is being arranged. The Greater Dallas County Alliance is marketing the area to interested builders. Mayor Devick has been appointed to the Greater Dallas Co. Alliance Board of Directors to represent the small cities in Dallas County. Code Compliance 3 turned over to the Police; 2 lawns mowed. He met with Gough about code compliance. Also have verbal complaint about property where fire was on East 1 st and rental house on West 2 nd. Gough is trying to work with owner to help clear the trees where there was a house fire. Joe will reach out to the property owner on West 2 nd. Last Council meeting a Council person submitted a resignation letter to the Mayor, then verbally asked to Mayor to let them know if they wanted them to stay on council. The mayor responded in writing that it was not up to him to make that decision. That Council person then rescinded his resignation and will continue on the Council. There are therefore no changes to the City Council at this time. New appointment of Dave Luke as Mayor Pro Tem. Changes to Personnel committee members are now the mayor, along with Luke & Bustad. At the last Special Session council meeting; Mayor Devick was accused of not completing building permits for property he used to own on East 1st. He converted a single family he owned to a duplex. Mayor stated at that meeting he had done everything correctly and would provide copies of permits to the city council to verify. He provided copies of permits except trade permits which where not found when looked for at city hall. Trade permits were to be pulled by the contractors hired by the mayor. There are three possible trade permits mechanical, electrical, and plumbing.

2 Mechanical work was only replacing and installing a new furnace. No duct work was done, no gas lines were installed, and no venting or penetrations were made. Therefore, mayor was told to have the system inspected by the electrical contractor and no need for mechanical permit. A copy of the inspection from the electrician in 2016 was provided to the council. Electrician pulled a permit from the City in Devick paid $75.00 to the electrician in his bill. A copy of the invoice was provided to the council as proof of this. The Plumber did not provide a detailed bill to show the permit fee. It was assumed by the mayor that it was pulled by the plumber. When Devick found out that the permits did not exist at city hall, he was frustrated and pulled the permits himself and paid for all of them. He did not cheat the system. He pays for a cell phone just for City Business without any reimbursement from the city. He does not turn in a bill for mileage reimbursement. Uses his own computer paper ink, does not turn a bill into the City. Morality and Integrity means more to him than anything else. He is putting the issue to bed. Mayor further stated he does not like the personal attacks on himself or anyone else that are going on in town and on social media etc. The people of Woodward should have a sense of community, neighbors helping one another. That is what makes a Community good. He likes that you can ride around town and wave at everyone. An example was a recent complaint yard was not mowed. It was not mowed because the owner works everyday and is taking care of his dying Mother in his home. He simply can t keep up. A couple of neighbors volunteered to keep his lawn mowed. This is the kind of behavior that needs to happen in our community. This is the type of leadership we need to help people in this community and it needs to start at this table. Motion Luke approve Liquor License for Flower s by Donna Jean, 2 nd Patel. Cox, there are no violations, MCU. Motion Luke approve Cayannes Café, 2 nd Gough. Cox, there are no violations, MCU. Mayor Devick appoints Sandy Seeman and Sue Moran to the Library Board. Motion Luke approve appointments to the Library Board, 2 nd Bustad MCU. Motion Bustad discuss Resolution Grubbs property donation, 2 nd Luke MCU. Sandy & Scott Grubbs wish to donate a 25 section on the corner by the Trestle Inn, for a memorial of some sort get the Community involved. No building built as to block the vision coming around the corner. Also recognize Gary Ellett who sold the property very reasonable. Motion Bustad approve Resolution to receive donated land at 304 S Main Street, 2 nd Bustad. Roll Call: Ayes; Gough, Folkerts, Luke, Bustad, Patel. Motion Luke, discuss wages, 2 nd Folkerts. Mayor Devick, Union contract 2% minimum city can add merit increases. The Personnel Committee has met. Comparable and comparisons have been made COL. They recommend 2.5% across the board. Once the passage of the Union Contract has been accepted it will be retroactive back to Jul 1 st. Folkerts and Luke the reviews need to be in the Council packets before the next session in 2 weeks, 2 reviews have not been received. Motion Patel table until the next Council meeting on Jul 23, 2018, 2 nd Folkerts MCU. Motion Folkerts discuss city server replacement, 2 nd Luke MCU. Mayor met with J&D Computers the server is 5 years old it is time for maintenance backup antivirus updates of the

3 operating software. It is time to electronically change out routinely to keep the operations of the City running smoothly. Motion Folkerts approve purchase of the server and labor for the new server upgrade, 2 nd Bustad. Roll Call: Ayes; Folkerts, Luke, Gough, Patel, Bustad. Motion Luke approve the 3 rd and final Consideration of Ordinance to Restrict Oversized Vehicles Inside the City Limits, 2 nd Folkerts. Patel for the record is not a conflict of interest, he can vote. Roll Call: Ayes; Bustad, Folkerts, Patel, Luke, Gough. A Resolution will be on the next regular Council agenda to address the fees for escorting oversized vehicle through town. Motion Folkerts discuss Veestra & Kimm Building Inspections, 2 nd Luke MCU. People have been complaining about the cost of building fees. Council recognizes Jason VanAusdall Zoning and Building Inspection Director. Process builder obtains a permit, submits site plan application electronically. He checks the Zoning to make sure it fits the permitted use. Plan review compliance structure. IBC 2015 building rates are published annually multiplier square footage. The Council can decide the rates people are charged. You can have the city guys do the smaller structures sheds, decks, fences, pools and keep the fees. The city agreed to the fee s charged. He just inspected a shed no hurricane anchors for the roof not secured. VanAusdall will meet with Devick, Luke and Folkerts to look at fee structures. Motion Luke, to Discuss swimming pool regulations, 2 nd Folkerts. Devick, need to take a look different rules, the new IBC Code was adopted by the City. Need to protect small kids from getting into the pools. A lot of insurance companies refuse to insure if there is not a fence around the pool. Ordinance compliance committee Jim Gough; will look at pools and hot tubs. They will meet with VanAusdall. Recommendation will go to Planning & Zoning for Authority approval.
