To correct the rate of pay for Jake Russell, variable hour Correctional Officer for the Jail, to $17.35/hour effective 8/3/18.

ABATEMENT MOTION by Karsky, seconded by Bender, to approve the following abatement representing tax exempt status for 2017 property taxes: Minnehaha County, Parcel ID 52481, E50 Lots 8 & 9 & All Lots 10, 11 & 12 Block 1 West Sioux Falls Addn to City of Sioux Falls, in the amount of $1, ayes. NOTICE Upon the request of Bob Litz, Auditor, MOTION by Karsky, seconded by Barth, to authorize the Auditor to publish a Request for Proposals for Bond Counsel. 5 ayes. PROCLAMATION Amy Carter, Operations Director of Children s Inn, was present to request the Minnehaha County Commission issue a proclamation recognizing the month of October as Domestic Violence Awareness Month. Ms. Carter read the proclamation. Upon the request of Commissioner Beninga, the following members of the Minnehaha County Family Violence Council introduced themselves: Michelle Markgraf, Compass Center Executive Director; Kelli Peterson, Minnehaha County Victim Witness Assistant; Heather Reid, Outreach for Children s Inn; and Travis Stauffacher, Minnehaha County Deputy Sheriff. It was noted that Take Back the Night is on Thursday, October 11, 2018, at 5:30 p.m. at the Multi-Cultural Center. MOTION by Barth, seconded by Bender, to issue a proclamation recognizing the month of October as Domestic Violence Awareness Month. 5 ayes. JAIL BOND Bob Litz, Auditor, gave a briefing on the jail bond investment proceeds to date noting a realized interest earnings of $230,192 through August 31, AGREEMENTS DJ Buthe, Highway Superintendent, presented three agreements between Minnehaha County and the South Dakota Department of Transportation (SDDOT) for the Railroad Crossing Improvement Program (RCIP), State Project Numbers PS 6364(07), PS 6148(04), and PS 8050(75). The agreements would provide funding for three railroad crossing improvements on County Highways 130, 122, and 110. The estimated total cost for improvements are as follows: $44, for HWY 130; $47, for HWY 122; and $56, for HWY 110. The County s share of the cost is 10%, which is estimated to be $14, The work shall include the removal of dilapidated wooden railroad crossing timbers and new concrete pre-cast panels. MOTION by Bender, seconded by Barth, to authorize the Chair to sign three Railroad Crossing Improvement Program Agreements for

6 State Project Numbers PS 6364(07), PS 6148(04), and PS 8050(75) with the SDDOT at an estimated cost to Minnehaha County of $14, ayes. PURCHASE DJ Buthe, Highway Superintendent, requested approval for the purchase of two Henke 12 Snow Plows, two Henke hydraulics and controls, two Henke 10 Underbody Scrapers, and two Henke 10 Wings off of Minnesota State Contract Release S-863(5), Contract from J-Craft by TBEI in Lake Crystal, MN, at a total cost of $51,384. The equipment will be used to finish building the recently purchased sander trucks. MOTION by Beninga, seconded by Karsky, to approve the purchase of two Henke 12 Snow Plows, two Henke hydraulics and controls, two Henke 10 Underbody Scrapers, and two Henke 10 Wings off of Minnesota State Contract Release S-863(5), Contract from J-Craft by TBEI, at a total cost of $51, ayes. SURPLUS DJ Buthe, Highway Superintendent, requested two 2005 Sterling LT9500 (w/underbody) Plow Trucks with their attachments be declared as surplus. One of the plow trucks will be donated to the Sioux Empire Fair with the following attachments: 2008 Henderson Sander, 2004 Falls Express XPR-12 Plow, and 2004 Falls Rear Wing SDL8A. The other plow truck will be sold at auction on Iron Planet with the following attachments: 2008 Henderson Sander, 2004 Falls Express XPR-12 Plow, and 2004 Falls Rear Wing SDL8A. These agreements will allow for additional right-of-way needed during and after the rebuild of County Highway 146 from South Dakota Highway 11 seven miles to the Minnesota border. BRIEFING Craig Dewey, Assistant Commission Administrative Officer, gave an update on County fleet management efforts highlighting the following two areas: 1) vehicle acquisition and motor pool management and 2) inventory management software. In response to a question posed by Commissioner Barth, DJ Buthe, Highway Superintendent, stated the funding for fleet management would be through the Highway Department. LIAISON REPORTS Commissioner Karsky reported on the Thursday, October 4, 2018, Detox Center Advisory Board Quarterly Meeting where action items were discussed. Commissioner Barth reported on the October 4, 2018, Museum Board Meeting where an increased cost to the sidewalk approved for the Irene Hall Museum Resource Center was discussed. Commissioner Barth made comments on a fire at a junk yard south of Hartford. The final report was on a new road in front of the Split Rock Fire Station that may require the fire trucks to turn in one direction. Commissioner Heiberger reported on meeting with a staff member, Lincoln County Commissioners, and the Lincoln County State s Attorney regarding how the Public Safety Assessment may help in controlling their jail population. NEW BUSINESS Commissioner Karsky inquired about how Election Day on Tuesday, November 6, 2018, affects the Commission Meetings. Commissioner Heiberger responded stating the County does not hold a Commission Meeting on Election Day. MOTION by Karsky, seconded by Barth, to recess the Minnehaha County Commission Meeting at 9:29 a.m. 5 ayes. MOTION by Bender, seconded by Karsky, to reconvene the Minnehaha County Commission Meeting at 9:38 a.m. 5 ayes. MOTION by Barth, seconded by Bender, to enter into Executive Session pursuant to SDCL (1) and (3) Executive or closed meetings--purposes--authorization--violation as misdemeanor. Executive or closed meetings may be held for the sole purposes of: (1) Discussing the qualifications, competence, performance, character or fitness of any public officer or employee or prospective public officer or employee. The term "employee" does not include any independent contractor; and (3) Consulting with legal counsel or reviewing communications from legal counsel about proposed or pending litigation or contractual matters. 5 ayes.
