1 November 10, 2015 The Lincoln County Board of Commissioners met at 9:00 a.m. on November 10, 2015 with members Dale Long, David Gillespie, Dan King and Jim Schmidt present. Michael Poppens joined the meeting at 9:12 a.m. The meeting was called to order with the Pledge of Allegiance to the Flag. The Deputy Auditor was Clerk of the Board. ROUTINE BUSINESS: Motion by King and seconded by Long to approve the agenda with the amendment that the claims amount listed on the agenda be changed from $1,497, to $1,368, Long: Aye Gillespie: Aye King: Aye Schmidt: Aye. Motion carried. Motion by Gillespie and seconded by King to approve the minutes of November 3, Long: Aye Gillespie: Aye King: Aye Schmidt: Aye. Motion carried. Motion by Gillespie and seconded by Long to approve the minutes of the October 1, 2015 Joint Meeting. Long: Aye: Gillespie: Aye King: Aye Schmidt: Aye. Motion carried. The Register of Deeds Report for October 2015 was presented in the amount of $73, The Auditor s Account with the County Treasurer for the month ending October 31, 2015 was presented as follows: Total amount of deposits in banks $26,879, Total amount of actual cash $8, Total amount of checks and drafts in Treasurer s possession not exceeding three days $1,607, Total cash items $ Funds invested $15,739, Total cash $44,235, Lincoln County Mileage Logs for the month of October were presented. PERSONNEL ACTIONS: Human Resources Generalist Julia Disburg visited with the Commission to revisit two compensation items from the November 3, 2015 meeting for clarification purposes. These two items were the 2016 Compensation for Employees on and off the Matrix and the 2016 Compensation for Elected Officials. Regarding Compensation for Employees on and off the Matrix, Disburg reiterated that the motion they voted on at the previous meeting included both a 2.5% matrix adjustment, which includes CPI, and a 2.5% increase with good performance. Approval was requested for both matrix adjustment and the step increase for both full time and part time employees who are paid on the matrix. Motion by Long and seconded by King to approve the 2016 Compensation for Employees to support a 2.5% increase matrix adjustment for staff as well as a step increase, as presented by Julia Disburg, Human Resources. Motion carried Regarding the 2016 Compensation for Elected Officials, Disburg sought approval for specific amounts presented for elected officials. Motion by Poppens and seconded by Gillespie to approve the 2016 Compensation for Elected Officials as follows: State s Attorney: 2015 Salary: $102, Salary: $105,459.12; Sheriff: $84, Salary: $86,853.00; Auditor: 2015 Salary $73, Salary: $75,410.40; Treasurer: 2015 Salary: $66, Salary: $67,966.08; Register of Deeds: 2015 Salary: $64, Salary: $66, Long: Aye Gillespie: Aye King: Aye Poppens: Aye Schmidt: Aye. Motion carried. NOTICES AND REQUESTS: OPPORTUNITY FOR PUBLIC COMMENT: Commissioner Gillespie brought a thank you note from the Canton Senior Center regarding the increase granted by the Commission to their 2016 budget. He also noted the 4-H Recognition event in Tea the previous Saturday was a success. Commissioner Schmidt gave a summary of the Forward Sioux Falls breakfast he had attended that morning. REGULAR BUSINESS: Motion by Gillespie and seconded by Long to authorize the Chairman to execute the Animal Control Services and Impoundment Facility Operations Agreement by and between Lincoln County and the Sioux Falls Humane Society for Lincoln County for the year Long: Aye Gillespie: Aye King: Aye Deputy State s Attorney Mike Nadolski addressed the Commission with concerns presented to him regarding the alcoholic beverage renewal of CSJ Enterprises LLC. Commissioner Schmidt suggested to the Commission they delay the renewal of CSJ Enterprises alcoholic beverage license until they can address the license holder specifically at the November 24, 2015 Commission meeting. Motion by King and seconded by Long to delay the approval of the alcoholic beverage license for CSJ Enterprises, LLC, Carlson Tract Two (2) in the South one half of the Southwest Quarter (S ½ SW ¼) of Section Thirty one (31) Township Ninety-Six (96) North Range Fifty (50), West of the 5 th PM, Lincoln County, SD until the November 24, 2015 meeting and to invite a representative from CSJ Enterprises to be present at the meeting. 2 RESOLUTION: The Board of County Commissioners have considered the applications for renewal of alcoholic beverage licenses and facts given to them, NOW THEREFORE BE IT RESOLVED that the applications for renewal of Alcoholic Beverage License for 2016 be approved for the structure only for the following: Lenkota Country Club, Lennox, SD, part of Section 31, Township 99 North, Range 51 West of the 5th PM, Lincoln County, SD; HyVee Inc., Tea, SD, East One-Half of Lot 1A, Block 2, and East One-Half of Lot 1, Block 3 Kerslake Add n W1/2SE1/4 of Section 24, Township 100 North, Range 51 West of the 5th PM, Lincoln County, SD; Hungry s Restaurant d/b/a Marlin s Family Restaurant at Lot 1 SE1/4 (Ex H2-3) and South 50 East Mullers Lot 2 SE1/4 in Section 19, Township 100 North, Range 50 West of the 5th PM, Lincoln County, SD; Spring Creek Country Club, Inc. Motion by Gillespie and seconded by Long. Long: Aye Gillespie: Aye King: Aye The second reading and public hearing was held as published at 9:00 a.m. on the petition to rezone approximately 9.66 acres (more or less) described as Tract 4 of the Jongeling s Addition located in the Northwest Quarter (NW ¼) of Section Twenty-five (25), Township One Hundred (100) North, Range Fifty-one (51) West of the 5th P.M., Lincoln County, South Dakota, from the A-1 Agricultural District to the C Commercial District. Petitioner Gerry Goldammer was not present. Deputy State s Attorney Mike Nadolski informed the Commission that Mr. Goldammer had contacted the Planning & Zoning Director to inform him of his intention to not move forward with the rezone. There were no opponents or proponents. Motion by Long and seconded by King to deny the petition to rezone approximately 9.66 acres (more or less) described as Tract 4 of the Jongeling s Addition located in the Northwest Quarter (NW ¼) of Section Twenty-five (25), Township One Hundred (100) North, Range Fifty-one (51) West of the 5th P.M., Lincoln County, South Dakota, from the A-1 Agricultural District to the C Commercial District. Luella DeJong and Jim Lammers were present to discuss the placement of a historical marker on a property north of Tea, recognizing the Old Yankton Trail. Discussion was held on the logistics of the proposed project. The Commission expressed their approval of the project, but requested DeJong and Lammers visit with the Historical Society and Department of Transportation regarding funding options and Highway Superintendent Steve Williams regarding safe options for a pull-off leading to the marker. The Commission requested DeJong and Lammers return to the November 24, 2015 meeting with information from the listed entities. RESOLUTION: WHEREAS unanticipated grant funds have been received in the amount of $468, from the South Dakota Department of Transportation NOW THEREFORE BE IT RESOLVED that pursuant to SDCL a budget supplement be hereby approved for the Highway Road and Bridge Fund in the amount of $468, Motion by Poppens and seconded by King. Long: Aye Gillespie: Aye King: Aye Deputy State s Attorney Mike Nadolski presented a request from Peter Hoogendoorn to amend the executed purchase agreement between Lincoln County and Peter Hoogendoorn for the purchase of real property by changing the closing date from on or before December 1, 2015 to on or before January 31, Nadolski explained Hoogendoorn s reason for the request was that he had a window of time in which he had hoped to find replacement land to purchase, which he was not able to do. Auditor Marlene Sweeter explained that if the request were granted, the only change for the County would be a need to re-advertise for supplementing the budget in January. The Autditor estimated $110 would cover the cost. Motion by Long and seconded by King to amend the executed purchase agreement between Lincoln County and Peter Hoogendoorn for the purchase of real property to be legally described and platted as: Tract A in the Northwest Quarter of Section 21, Township 98 North, Range 49 West of the 5 th P.M., Lincoln County, South Dakota, by changing the closing date from on or before December 1, 2015 to on or before January 31, 2016 with the condition that advertising costs in the amount of $110 be covered by Mr. Hoogendoorn. Long: Aye Gillespie: Aye King: Aye Poppens: Aye Schmidt: Aye. Motion carried. Mr. Nadolski then gave the Commission an update on the physical plant strategic plan for the court system. He informed the Commission that he had visited with the Unified Judicial System regarding plans for accommodating the two circuit court judges. There are plans in place to visit with the architect in terms of reconfiguring and they hope to advertise soon for bids. He mentioned smaller requests, including clean-up and uses for the empty expansion area above the commission chambers. A request was made to look into rearranging Court Services and the Clerk of Courts. The Commission plans to visit with the architect at the November 24, 2015 meeting and hopefully move forward with the project. The hope is to have something executed in the 2016 fiscal year. Discussion was held on the possibility of moving forward with the new highway shop. Auditor Marlene Sweeter was called upon by the Commission to present funding options. The Auditor gave a brief overview of the bonding process, informing the Commission that Toby Morris and Tom Grimmond could be asked to appear at the November 24, 2015 Commission

3 meeting, if the Commission voted to move forward with the shop, to further explain and present what the bonding process would involve. A resolution involving payment of the shop would be presented at the November 24, 2015 meeting for approval, should the Commission vote to move forward. The Commission was made aware that a vote to move forward would not mean an approval of this resolution and could still be discussed at the November 24, 2015 meeting. Discussion was held regarding concern over other costly projects looming for Lincoln County, and how payment for the highway shop would fit in with these. Discussion was also held on the cost, potential longevity, size and who the new shop would benefit. Highway Superintendent Steve Williams was present to participate in discussion and answer questions. Motion by King and seconded by Long to move forward with the next step for the new highway shop and receive information on the bonding process and a proposed resolution at the November 24 th, 2015 meeting.
