3 COMMISSIONER BRIEFING: Nicholas Rasmussen from SDN Communications appeared before the Board to request approval of a Utility Occupancy Application and Permit for work to be done on the Lincoln County Courthouse property. Previous lines were laid on the Courthouse grounds and SDN would like to expand from the existing location along the south side of the Courthouse. The $250 application fee has been paid. MOTION by Long and seconded by King to approve the Lincoln County Highway Department Utility Occupancy Application and Permit to allow SDN Communications to extend the lines along the south side of the Lincoln County Courthouse property. Long: Aye King: Aye PUBLIC COMMENT: The Lincoln County Board of Commissioners Public Comment Policy was read aloud by the Deputy Auditor. Commissioner Schmidt provided a hand out to all Commissioners showing information population and economic information for Lincoln County. The median household income is approximately $77,000. Schmidt pointed out the median income in Minnehaha County is $55,000, for an overall average of $63,000 for both counties. He also indicated the average house price in the area is approximately $180,000. REGULAR BUSINESS: COMMISSIONER BRIEFING: Terry Fluit, Highway Superintendent, requested approval to advertise for bids for ice sand. MOTION by Poppens and seconded by Long to authorize Highway Superintendent Terry Fluit to advertise for bids for ice sand. Long: Aye King: Aye COMMISSIONER BRIEFING: Fluit also advised the Board that the Public Meeting for the Lincoln County Five-Year Highway and Bridge Improvement Plan will take place on Tuesday, October 9, 2018 at 10:30 a.m. The kickoff meeting with HDR for work on the Master Transportation Plan will be on October 4. Fluit gave an update on the recent flooding after the constant rain this past week. He noted there were some road closures necessary for a couple days. Most problem areas were in the northern part of the county. For the most part, there was little damage besides some washed off shoulders that will need to be built back up with gravel. Commissioner Schmidt commended Commissioner King for going out to check roads and working to alert TV and radio stations of closures to give residents notice. Commissioner Poppens urged caution for future building projects to avoid further water issues in various areas of the county. Fluit continued with updates on a couple bridge projects. The bridge on 277th Street had a substantial completion date of September 15, 2018, but is taking longer than expected. There has been some feedback on the bridge closure in Delaware Township. Residents are concerned about having only one road to get out of the area. Fluit plans to put this bridge back into the Five-Year Plan. He is hopeful it can be piggybacked with another bridge a couple miles away to save some money. Commissioners inquired about the progress on the Highways 106 & 117 Roundabout project. Fluit advised work had been put on hold for a couple days while waiting for Xcel to finish its portion, but things are looking good. PUBLIC HEARING was held as published at 9:03 a.m. for a request for an Ordinance of Lincoln County to rezone a portion of the property legally described as the Southeast quarter (SE1/4) except Lot H-1 of Section 34, Township 100 North, Range 49 West of the 5th Principal Meridian, Lincoln County, South Dakota from the A-1 Agricultural District and RC Recreation/Conservation District to RR Rural Residential District. The property is located at the intersection of 273rd Street and 480th Avenue Harrisburg. Planning Commission recommends denial (5-0-1). Toby Brown presented background information and the staff report and recommendation regarding this parcel. He also relayed conversations with the SD Game, Fish & Parks since the area in question is adjacent to a game production area. There is no setback for discharge of firearms and the GF&P will not give a recommendation. Brown advised this is an ideal area for Lincoln County/Harrisburg Joint Jurisdiction. Proponent Eric Willadsen is the engineer working with the Petitioners, the Porter family, on the development plan. He advised right now this is pasture land adjacent to Lake Alvin. There have been some concerns with the pasture land and runoff into the lake. The lake was closed for some time this summer due to E. coli issues. There should not be concerns with drainage onto neighboring property as this parcel slopes into the lake. The planned development would be an economic benefit to Lincoln County. GF&P may be interested in purchasing part of the sloped land nearest the lake as a buffer. Commissioner King questioned the length of the cul-de-sac. Willadsen stated it is well over a mile, but there are plans for a second, emergency way in. Proponent Andrew Harr met with the Game, Fish & Parks and agreed they are indeed open to purchasing a portion of the property. No Opponents spoke. Commissioner Long stated he grew up in this area and has never seen anyone hunting there as it can t be accessed without a boat or swimming or trespassing to get there. Commissioner Poppens advised using extreme caution in more changes to this area, especially since Lake Alvin is part of the Ninemile Creek drainage system. This is an undisturbed portion of the lake and may be best to leave it as such. MOTION by Schmidt and seconded by Poppens to uphold the decision of the Planning Commission for 17-REZ-014 and deny the rezone of a portion of the property legally described as the Southeast quarter (SE1/4) except Lot H-1 of Section 34, Township 100 North, Range 49 West 3

4 of the 5th Principal Meridian, Lincoln County, South Dakota from the A-1 Agricultural District and RC Recreation/Conservation District to RR Rural Residential District.. Long: No King: Aye MOTION by Poppens and seconded by Long to bring off the table Appeal of 18-CUP-025, tabled at the meeting on September 12, Long: Aye King: Aye Discussion was held on the Appeal of 18-CUP-025, Conditional Use Permit proposing to allow the construction and operation of a Class C Swine CAFO (2,499 head). The property is a portion of the property legally described as the Northeast quarter (NE1/4) of Section 3, Township 96 North, Range 50 West of the 5th Principal Meridian, Lincoln County, South Dakota. Location: Southwest corner of the intersection of 291 st Street & 474 th Avenue Beresford. Planning Commission approved (4-1-1). Commissioner Long asked for a quick recap of the discussion held previously among the other Commissioners since he appeared by phone for the Public Hearing and heard all the public input, but not the comments by the Commissioners. Commissioner Schmidt reiterated that the Planning & Zoning Department has put several conditions in place. He also stated he is aware the Petitioner may go directly to the State and bypass Lincoln County s stipulations and conditions regarding odor, trees, etc. He would rather the County have control over these items. He does have concerns about owners not living on-site and would like to have the current ordinances reviewed to confirm compliance. Commissioner King appreciates the progress in farming with modern technology (trees, odor control, etc.) and is in favor of traditional ag. He understands allowing farmers to do what s necessary to survive, but also believes the status quo needs to be followed. Commissioner Poppens is of the opinion that guidelines are in place and Planning & Zoning passed the Conditional Use Permit with current guidelines. He also understands keeping the status quo, but believes these type of operations are the new status quo in today s swine production. Poppens is also agrees with following technology recommendations, but not until science is proven. Commissioner Schmidt spoke on the need to find balance between ag and non-ag acreages, which is harder to do in more densely-populated areas such as Lincoln County. These operations are not as controversial in more rural counties. Poppens agreed that it is important to not push out existing farms that have been here for generations. Schmidt said other states have set solved the problem by setting dedicated ag-only areas that cannot be rezoned so ag stays ag. Commissioner Long stated that Lincoln County is ag, period and people need to understand that. He has a hard time telling a young producer no who is trying to make it work and raise a family. Since the ordinances were reviewed not long ago, he thinks Planning & Zoning should be allowed to do their job and their recommendation should be followed. Schmidt does not disagree with famers making a go, but wants to avoid non-owner occupied operations. Poppens does not want to see barns pop up all over in random places, which could be avoided by reviewing setbacks, etc. RESOLUTION: BE IT RESOLVED to uphold the decision of the Planning Commission and approve 18-CUP-025, with the amendment that the additional conditions (#15-17) be added as recommended by Planning & Zoning, Conditional Use Permit proposing to allow the construction and operation of a Class C Swine CAFO (2,499 head). The property is a portion of the property legally described as the Northeast quarter (NE1/4) of Section 3, Township 96 North, Range 50 West of the 5th Principal Meridian, Lincoln County, South Dakota. Date and time were set for the First Reading and Second Reading/Public Hearing for an Ordinance of Lincoln County to rezone a portion (proposed Lot 1 Ponderosa Park 2 nd Addition consisting of 5.8 acres +/-) of the property legally described as the Northwest quarter (NW1/4) (except Lots H-1 and H-4, Tower Estates Lots 1 through 8, Tract 1 Neeman s Addition and Ponderosa Park Addition Lots 1, 2, 3A and 3C) of Section 6, Township 99 North, Range 50 West of the 5th Principal Meridian, Lincoln County, South Dakota from the A-1 Agricultural District to the C Commercial District. Planning Commission recommends approval (5-0). First Reading will be held on October 9, 2018 and the Second Reading & Public Hearing will be held on October 23, 2018 at 9:00 a.m. MOTION by Poppens and seconded by Long to approve the dates and times for 18-REZ-003. COMMISSIONER BRIEFING: Pat McGill, advisor to the Beresford Chamber of Commerce gave a presentation on the funding drive for the Everything Beresford website and asked for Lincoln County s support. MOTION by Long and seconded by King to approve funding in the amount of $1,500 to the Beresford Chamber of Commerce for the Everything Beresford website. Long: Aye King: Aye COMMISSIONER BRIEFING: John Rombough, Buildings and Grounds Superintendent, presented the contract with Pride Neon for the purchase of the Highway Shop sign and gave an update on the electrical work on the Courthouse 2nd Floor project, which work will be done by Albers Electric. MOTION by Long and seconded by King to authorize Chair to execute the contract with Pride Neon for purchase of the Highway Shop sign, which purchase was previously approved on May 22, Long: Aye King: Aye Schmidt: Aye Poppens: Aye Gillespie Aye. COMMISSIONER BRIEFING: John Rombough, Buildings and Grounds Superintendent, requested the Commission establish a policy disallowing animals other than service animals in the Courthouse buildings. 4

5 WHEREAS, the Americans with Disabilities Act (ADA) has established rules regarding Service Animals (see 28 C.F.R ); and WHEREAS, Lincoln County, South Dakota desires to be compliant with ADA rules, while also considering the health and welfare of the general public and County employees; NOW, THEREFORE, BE IT RESOLVED, that Lincoln County shall adhere to the ADA s established rules regarding Service Animals, but hereby declares that any and all other animals not working as service animals shall not be allowed in Lincoln County Courthouse buildings. Long: Aye King: Aye COMMISSIONER BRIEFING: Chief Civil Deputy State s Attorney Michael Nadolski advised the Board that Canton Economic Development Corporation has expressed interest in purchasing the Optimist Building outside of auction. The building would still be sold as is and conveyed via Quit Claim Deed with the conditions set forth in the title work. MOTION by Schmidt and seconded by Long to surplus the Optimist Building, but not dispose of it at auction as previously decided. MOTION by Schmidt and seconded by Long to authorize the Chair to execute the Petition for Vacation of Streets regarding all of Williams Street and Grummand Avenue lying north of Mindy Street near Airport Tract 1A of Sky Haven Heights in the NW¼ of Section 30, Township 100, Range 50. Commissioners Gillespie and Poppens said they had been invited to the meeting as well and will represent Lincoln County. MOTION by Schmidt and seconded by Poppens to authorize Chair to execute the Notice of Intent and Certification of Applicant to the SD DENR for the Delaware Township road project. Auditor Marlene Sweeter advised the Board of changes made: Human Resources changed from $80,000 to $100,000; Property Taxes changed from $12,283,430 to $12,193,755 (reduction in growth due to utilities); Rural Fire $1,000 cash balance applied with Property Taxes changing from $84,210 to $82,710 and $500 Intergovernmental Revenue. Total cash applied is $5,092,140. Commissioner Schmidt raised questions about a looming opt-out and making residents aware of costs and needs. Discussion was held as to the differences between an opt-out and Senate Bill 1 funding. Commissioner Poppens brought up the need for serious discussion about Lincoln County s jail needs and possible locations. Commissioner Long recommended setting up a meeting after election so the Sheriff-elect and current Sheriff can be involved to discuss the initial process. Sweeter also reviewed all changes made to the Budget since discussions began. Commissioner King left the meeting at 11:10 a.m. MOTION by Long and seconded by Schmidt to approve and adopt the 2019 Lincoln County Provisional Budget as presented.
