1 MINUTES OF REGULAR MEETING The City Council of the City of Volga, SD met for a regular meeting Monday, December 17, 2018 at 12:00 PM in the conference room of City Hall; Mayor Randy Santema presiding. Members present: Ken Fideler, Jody Havrevold, Nichole Hofer, Matt Jaquet, Kelly VanderWal, and Doug Wermedal. Also present: City Attorney Steve Britzman, City Administrator Jameson Berreth, Finance Officer Ashley Rentsch, Deputy Finance Officer Mary Ries, District 4 Legislators John Mills, John Wiik, and Fred Deutsch, Luke Muller with First District Association of Local Governments, Aurora Mayor Fred Weekes, Aurora City Council Members Josh Kukral, Patrick Peterson, and Charles Tiltrum, and Kathi Granum with the Volga Tribune. Following the Pledge of Allegiance, Wermedal made a motion to approve the agenda. Havrevold seconded the motion. All in favor; motion carried. Havrevold made a motion to approve the December 3, 2018 regular meeting minutes. VanderWal seconded the motion. All in favor; motion carried. Luke Muller with First District Association of Local Governments appeared before the Council to discuss the Brookings County Pre-Disaster Mitigation Plan, which involves identifying the level of risk associated with potential disasters and City facilities that may be affected. Muller said Volga s plan is being developed in conjunction with the plan for Brookings County. The final report is due in June 2019, and will be brought to the Council for approval in May. District 4 Legislators John Mills, John Wiik and Fred Deutsch were present to discuss the upcoming legislative session with the Council. Of particular interest is potential legislation regarding an electric service territory freeze. Volga staff and Council, as well as city officials from Aurora, expressed concerns regarding how this freeze would negatively affect future growth, as the municipalities would not generate electric revenue on land currently outside service territory that could be annexed into the municipality due to future residential or economic growth. Electric revenue helps to support services such as street maintenance, snow removal, and fire protection. Community Development VanderWal made a motion to approve the second reading of ORDINANCE NO AN ORDINANCE AMENDING THE ORDINANCES OF THE CITY OF VOLGA, SOUTH DAKOTA TO UPDATE BUILDING CODES IN THE CITY OF VOLGA, SOUTH DAKOTA. Hofer seconded the motion. Discussion was held. Berreth stated that Ordinance includes all items specific to the City of Volga, and this simply amends that ordinance to update the edition of the International Building Code to be used. On roll call: Fideler, Yes; Havrevold, Yes; Hofer, Yes; Jaquet, Yes; VanderWal, Yes; Wermedal, Yes. Motion carried. The ordinance reads as follows: ORDINANCE NO AN ORDINANCE AMENDING THE ORDINANCES OF THE CITY OF VOLGA, SOUTH DAKOTA TO UPDATE BUILDING CODES IN THE CITY OF VOLGA, SOUTH DAKOTA. BE IT ORDAINED by the Council of the City of Volga, State of South Dakota that Ordinance , Section 1 of the City of Volga be amended to read as follows: I. Adoption of International Building Code There is adopted by the City of Volga those certain codes known as the 2018 Edition of the International Building Code, the 2018 International Residential Code, the 2018 Edition of the International Mechanical Code, and the 2018 Edition of the International Fire Code, collectively referred to as the International Building Code, building code, or code. In the event of a conflict between the provisions of the International Building Code hereby adopted, and any other provisions of City ordinance, state laws, rules, or regulations of the City of Volga, the provisions of City ordinance, state laws, and the rules and regulations of the City shall prevail. A copy of the above-
2 described 2018 International Codes or any of their particular contents are available upon request of the City of Volga Building Inspector. II. Any or all ordinances in conflict herewith are hereby repealed. Berreth discussed his proposed changes for Chapters 4, 5, 11, 17, & 18 of the City Ordinance as part of his recodification project. All changes will be acted upon at once when the project is complete. Public Safety No report. Electric Discussion was held regarding the possibility for some type of lighting to be installed at Boy Scout Park for the ice-skating rink. Public Works Wermedal mentioned that he had received a request from a resident to look into adding a light at the end of the sidewalk on Lincoln Lane that leads to Sioux Valley School. He said there may also be needs in other areas of town, which may be discussed at a subsequent meeting. Parks, Recreation, and Buildings Hofer made a motion to approve RESOLUTION BE IT RESOLVED that in accordance with SDCL , prior authorization for persons to consume or blend alcoholic beverages on Monday, December 24 th, 2018 at the Volga Community Center is hereby given. Finance & Economic Development Fideler made a motion to approve RESOLUTION SOUTH DAKOTA LOCAL INFRASTRUCTURE IMPROVEMENT PROGRAM MUNICIPAL RESOLUTION. Jaquet seconded the motion. Discussion was held. Berreth stated that passage of this resolution is a step in the process for the State to release funds from the LIIP Grant of $500,000 that the City was awarded to assist with the Wastewater Treatment Facility improvements and the Prairie Aquatech/Wastewater Treatment Facility water main projects. All in favor; motion carried. The resolution reads as follows: RESOLUTION SOUTH DAKOTA LOCAL INFRASTRUCTURE IMPROVEMENT PROGRAM MUNICIPAL RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VOLGA, SOUTH DAKOTA ( CITY ) APPROVING THE SOUTH DAKOTA LOCAL INFRASTRUCTURE IMPROVEMENT PROGRAM GRANT APPLICATION AND DESIGNATING NAMED OFFICERS TO EXECUTE DOCUMENTS AND TO ACT ON ITS BEHALF. WHEREAS, the City of Volga made an Application dated April 28, 2017 to the Board of Economic Development ( BED ) for a grant from the South Dakota Local Infrastructure Improvement Program pursuant to SDCL 1-16G-50, et. seq. and ARSD Chapter 68:02:09; WHEREAS, BED reviewed the Application, determined that the City of Volga is eligible to receive such a grant, and issued a grant Agreement dated December 5, 2017 a true copy of which is attached hereto; and WHEREAS, the City Council has reviewed the proposed grant Agreement and has authorized its acceptance; NOW, THEREFORE, BE IT RESOLVED: (1) That the City of Volga hereby approves the entry into the South Dakota Local Infrastructure Improvement Program Grant Agreement. (2) That the officers of this Corporation named below, or any one of them, or their or any one of their, duly elected or appointed successors in office, be and they are hereby authorized and empowered in the name and on behalf of the City of Volga and under its corporate seal to execute and deliver to BED, in the form required by BED, the Grant Agreement and all reports and other documents described in the Grant Agreement. (3) That the aforesaid officers, or any one of them, or their duly elected or appointed successors in office, be and they are hereby authorized and empowered to do any acts, and to execute in the name and on behalf of the City of Volga and under its corporate seal or otherwise, any instruments or agreements deemed necessary or proper by BED, in respect to the Grant. 4 SDCL , in preparing the annual estimate of expenses provided by SDCL , the auditor or clerk may include in the budget a line item for contingencies. The line item shall be included in the annual budget adopted pursuant to SDCL and shall not exceed five percent of the total municipal budget.
