1 MINUTES OF REGULAR MEETING The City Council of the City of Volga met for a regular meeting at 5:30 PM on Monday, July 6, 2015 in the conference room at City Hall, Mayor Randy Santema presiding. Members present: Rod Hageman, Ken Fideler, Roger Anderson, and Kelly VanderWal. Members absent: Dave Rankin and Wendell Karlstad. Also present: City Attorney Steve Britzman, City Administrator Andrew Bremseth, Finance Officer Ashley Rentsch, Dennis Hanson, Kathy Hanson, Erik Schlimmer, Jim Noem, Joel Edman, Roger Jensen, Andrew Kangas with Civil Design Inc., and Kathi Granum with the Volga Tribune. Following the Pledge of Allegiance, Bremseth noted two changes to the agenda. Under Public Works, discussion and possible action to authorize legal action to abate a nuisance at 215 E 7 th Street was added, and Executive Session was removed. Anderson made a motion to approve the agenda as amended. VanderWal seconded the motion. All in favor; motion carried. Anderson made a motion to approve the minutes of the June 15, 2015 regular meeting. Fideler seconded the motion. All in favor; motion carried. Fideler made a motion to approve ORDINANCE NO AN ORDINANCE ESTABLISHING PARKING RESTRICTIONS IN THE CITY OF VOLGA, SOUTH DAKOTA. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF VOLGA, SOUTH DAKOTA, AS FOLLOWS: I. Sec Parking prohibited. It is unlawful for the driver or any owner of any motor vehicle, trailer or implement to park or leave standing or permit to be parked or left standing, any motor vehicle, trailer or implement on both the north side and south side of Third Street between the existing driveways located nearest to Hansina Avenue on both sides of the street and Hansina Avenue in the City of Volga. II. Any and all other ordinances in conflict herewith are hereby repealed. FIRST READING: June 15, SECOND READING: July 6, PUBLISHED: July 16, CITY OF VOLGA BY /s/randy Santema, Mayor ATTEST:/s/Ashley Rentsch, Finance Officer. Anderson seconded the motion. A public hearing was held at 5:30 PM, and residents Dennis and Kathy Hanson spoke in support of the ordinance. They also raised several questions regarding parking and pedestrian safety near the entrance of Sioux Valley Elementary. Bremseth stated that the current ordinance only focuses on one particular area and another ordinance would have to be passed if other changes were to be made. He advised them to speak with their neighbors and come up with some ideas for improvements to bring to the Council. The public hearing was closed, and Council discussion was held. All in favor; motion carried. At 5:40 PM, Jim Noem addressed the Council, stating that he had spoken with Banner regarding the drainage issue that his proposed eight-plex would have created. He said he is now looking at building two duplexes on the property instead. Noem also asked if the alley south of 8 th street behind Kasan Avenue could be paved and used to access the property. He is in the early stages of this project and is still reviewing his options. Bremseth stated that the Council would need to consider two separate issues. The current zoning ordinance only allows one building per lot, so the Council would need to approve a variance to allow this. They would also have to approve the

2 alley access, as it would be the only entrance to the property. The Council advised Jim to invest in a study by Banner before he proceeds with the plan. City Attorney Britzman said that he should begin applying for the variance and get his approvals before it is time to begin building so that the process can move along more quickly. At 6:00 PM, Joel Edman informed the Council of a potential drainage issue in his development on the west side of Volga. He stated that he would like to take the funding that was allocated to curb and gutter on the south side of 6 th street and use it to place a storm sewer in the northwest corner of his development to divert water to the creek north of the development. Andrew Kangas of Civil Design Inc. presented an overview of this plan and said that the drainage is a much more urgent issue than the curb and gutter on the south side of the road. He said not placing curb and gutter on the south side would not have any negative effects. VanderWal made a motion to approve the funding change in Project Plan #3 from curb and gutter on the south side of 6 th street to placing a storm sewer in the northwest corner of the development. Fideler seconded the motion. Kangas said that due to no curb and gutter on the south side of the road, the width would be decreased on the south side. City Attorney Britzman stated that the motion should be amended to include the change in road width. VanderWal made an amended motion to include approval of the change in road width based on an engineering study and final approval from the City Administrator. Fideler seconded the motion. All in favor; motion carried. Discussion was held regarding South Dakota Soybean Processors power factor correction. They would like to be able to correct their plant power factor at the substation and also want a guarantee that any other businesses who would use the substation in the future would need to correct the power factor directly at their own business. Bremseth said this arrangement would be mutually beneficial for both SDSP and the City of Volga. There were no objections from the Council. Bremseth presented Change Order #2 and Change Order #3 to the West Substation improvements project. The changes would add $2,250 to the Myers Controlled Power invoice for work that was originally supposed to be done by Harold K. Scholz Co. In turn, $2,250 was deducted from the Scholz invoice total. Anderson made a motion to approve Change Order #2, adding $2,250 to Myers Controlled Power Co. Fideler seconded the motion. All in favor; motion carried. Anderson made a motion to approve Change Order #3, deducting $2,250 from Harold K. Scholz. Fideler seconded the motion. All in favor; motion carried. Bremseth gave an update on the SDSP standby rate development, stating that he has a meeting with DGR and Heartland next week to discuss the status. Bremseth mentioned that the 2015 Heartland Summer Conference would be held on Tuesday, July 7 and that he and Rentsch would be attending. He encouraged others to attend.

3 Bremseth reported that he is working with Bob Hill, Brookings County Emergency Management Director, to have a simulated tornado disaster training on August 13. The staff will be involved in the process, and the Council is encouraged to be involved as well. City Attorney Britzman gave an overview of the nuisance situation at 215 E 7 th Street. He said there is a pile in the back of the garage that qualifies as a nuisance, as well as some unlicensed vehicles on the property. Other areas of the property may appear to be cluttered or an eye sore but are not legally considered a nuisance because they do not create a health or safety hazard under South Dakota state law. He asked the Council for approval to begin legal action to remove the nuisances from the property and obtain a court order to be granted the right to be on private property. Fideler made a motion to authorize legal action to abate the nuisance at 215 E 7 th Street. VanderWal seconded the motion. All in favor; motion carried. Bremseth stated that the signage on Fourth Street and Jefferson Avenue may need to be changed as Fourth Street will go straight through to Caspian Avenue when the development on the east side of Volga is completed. This will be a busy street, and he recommended placing stop signs on Jefferson Avenue and making Fourth Street a thoroughfare. The development to the west will also require new speed signs coming into town. Bremseth updated the Council on Public Works projects, including the installation of a valley gutter between Valley Motorsports and C&W Repair to alleviate a drainage issue. Timmons Construction will not be able to make the repairs at the intersection of Fourth Street and Lincoln Lane this year, so the City will either hire a different company or wait and budget for this in Hydro Klean had an issue with relining the sewer at Second Street, and they will replace the line at their cost. Bremseth said that he had recently learned that the City of Volga s lease from Sioux Valley School District for the ball fields has been expired since The school is working on a new lease to pass at the next school board meeting. The issue was identified when the Volga Baseball Association applied for a temporary malt beverage license from the City for an upcoming tournament. Bremseth indicated that the new lease will specifically identify who is able to make decisions regarding alcohol at the ball fields and will spell out the terms of usage by the City. Bremseth brought community concerns to the Council regarding golf carts driving around the ball fields. He said the school has ordered signs to prohibit golf carts on their property. He also made it clear that the City ordinance states that carts can only be driven on city streets, and that drivers must have a valid driver s license, proof of insurance, and a golf cart permit issued by the City. The lease agreement before the School Board may address this concern. Hageman made a motion to approve RESOLUTION BE IT RESOLVED that in accordance with SDCL , prior authorization for persons to consume or blend alcoholic beverages on Saturday, July 18, 2015 in the Volga Community Center is hereby given. All such consumption or blending shall occur during the private party Wilson. Said property shall be considered for purposes of the Resolution to be the location of a special license and shall not constitute a public place as defined by Ordinance 145 of the City of Volga. Sale of alcohol beverages shall not be permitted at any time at the above described location by this party. There

Anderson seconded the motion. All in favor, motion carried. Bremseth stated that a window in the auditorium hand been broken over the past weekend. The outside half of the pane was badly broken presumably by a rock, but no glass was broken inside the building. He has contacted Midwest Glass for an estimate and there is a police report on file. He also stated that he noticed standing water in the gym from leaks in the ceiling as well as water in the two bathrooms in the basement. The Auditorium task force is meeting next week to review cost estimates provided in a recent study by Banner. Fideler made a motion to approve the following claims and ordered them paid. Expenditures for several other capital projects will be coming in over the next month. Revenue and expenditure guidelines indicated that the City is on track with the budget so far this year, and the year to date profit and loss summary showed a favorable difference of $124, compared to June Bremseth stated that budget work will begin within the next couple of weeks and that any funding requests should be made as soon as possible. The Council will set up a special meeting for a work session closer to the end of July to discuss priorities for Roger Jensen of 107 Washington Road asked for clarification regarding RV parking in driveways and vehicles being parked on the road. The Council answered those questions. Kathi Granum also brought up safety of middle school aged children and riding bikes around town. She also asked about internet service providers in town and the City s role in deciding who serves the area. The Council stated that many providers have territories, but there are no regulations as to who can provide services within the City of Volga. Anderson made a motion to adjourn at 7:42 PM.
