1 City Commission Minutes Regular Session City Commission Chambers 101 S Lincoln Ave. Chanute, KS CALL TO ORDER PLEDGE OF ALLEGIANCE Mayor Sam Budreau presided and called the meeting to order at 6:30 p.m., the Pledge of Allegiance was recited. Commissioners Present: Staff Present: Mayor Sam Budreau and Commissioners Phillip Chaney, Tim Fairchild, Randy Galemore, and Jacob LaRue. Jeff Cantrell, City Manager; David Brake, City Attorney; Tina Bailey, City Clerk; Cory Kepley, Chief Finance Officer; Rick Willis, IT Director; and Todd Newman, Cemetery and Parks Director. INVOCATION The invocation was given by Pastor Tom Eastman, First Christian Church. AGENDA The Agenda was approved on motion by Commissioner Galemore, seconded by Commissioner Fairchild. Voting Aye: All. Motion carried unanimously. CONSENT AGENDA The Consent Agenda is used to approve non-controversial or routine matters by a single motion and vote. The Consent Agenda consisted of the following: Minutes City Commission August 27, 2018 Warrant Register dated August 29, 2018 Warrant Register dated September 5, 2018 Request to Hold Annual Kiwanis Spook Parade Approval of Senior Lane Request to Hold Annual Veterans Day Parade November 10, 2018 Request from American Legion to hold 9/11 Memorial Ceremony CHS Senior Class President Isaac Lewis provided a brief summary of their request. Motion made by Commissioner LaRue, seconded by Commissioner Galemore, to approve the Consent Agenda. Voting Aye: All. Motion carried unanimously. PUBLIC COMMENTS Ernie Shepard, 1208 Osa Martin Blvd., commented on the railroad crossings on West Main Street and south of 14 th Street on South Plummer Avenue. Page 1 of 5

2 Commission consensus was for the City Manager to send a letter to the railroad to report that the City Commission has received a complaint pertaining to the railroad crossing on Main Street. CITY MANAGER S REPORT City Manager Jeff Cantrell reported that the City received a thank you letter from the Chamber for City staff s assistance with the Chanute Blues Blast event. City Manager Cantrell requested that City Engineer Brian Spano provide the Commission with an update on the City s Sewer Projects. Brian Spano, Wilson and Company distributed two handouts to the Commission for review. He provided a brief update on the City s Sewer Projects and also provided an overview of a City Wastewater Treatment Facility Influent Flows and Rainfall Report. General discussion was made. OLD BUSINESS FIRE PROTECTION ORDINANCES FOR TIOGA, BIG CREEK, AND CANVILLE TOWNSHIPS At the August 27, 2018 Chanute City Commission meeting the Commissioners voted to increase the fire protection contract costs to Tioga Township, Big Creek Township, and Canville Township by 2.5%. Based on the action by the Commission, the required Ordinances are back before the Commission for approval. A copy of the Ordinances was provided to the Commission for review. Motion made by Commissioner Galemore, seconded by Commissioner LaRue, to pass the Ordinances establishing 2019 Fire Protection Contract Price reflecting a 2.5% increase for Tioga, Big Creek, and Canville Townships. Voting Aye: All. Motion carried unanimously. The Ordinances were assigned: No. S-521, No. S-522, and No. S-523 U.S. HIGHWAY COALITION 169 RESOLUTION The proposed resolution reflects recent revisions that were acted on by the regional committee. Motion made by Commissioner Chaney, seconded by Commissioner Galemore, to rescind Resolution No and to adopt Resolution Supporting the U.S. Highway 169 Corridor Coalition s Key Priorities for Consideration by the Kansas Joint Legislative Transportation Vision Task Force as presented. Voting Aye: All. Motion carried unanimously. The Resolution was assigned: No REVIEW ORDINANCE NO GOLF CARTS & UTILITY VEHICLES At the regular City Commission meeting on August 27, 2018, Commissioner Chaney requested review of the City s ordinance for golf carts and utility vehicles. 3 A copy of the City s Steps for Obtaining Special Purpose Vehicle Annual Permit, Application for Registration and License for Special Purpose Vehicle, and City Ordinance No was provided to the Commission for review. General discussion was made. Comments were made by City Attorney David Brake and City Manager Jeff Cantrell. Motion made by Commissioner Chaney, to rescind City Ordinance No Providing for the Operation of Golf Carts and Utility Vehicles on the Streets with the Corporate Limits of the City of Chanute. Motion died for the lack of second. NEW BUSINESS FISCAL SUSTAINABILITY PLAN At their regular meeting on April 8, 2018 the City Commission authorized the execution of a loan agreement between Chanute, Kansas and The State of Kansas, acting by and through the Kansas Department of Health and Environment for the purpose of financing a Wastewater Treatment Project for Phases 2-5. As part of the loan agreement the City is required to develop and implement a Fiscal Sustainability Plan that includes an Asset Management Plan. A copy of the proposed Fiscal Sustainability Plan was provided to the Commission for review. The Governing Body needs to adopt the plan in order for the City to stay in compliance with the loan agreement. General discussion was made. Comments were made by City Engineer Brian Spano, City Manager Jeff Cantrell, and City Attorney David Brake. Motion made by Commissioner Chaney, seconded by Commissioner Galemore, to approve the Fiscal Sustainability Plan for the City of Chanute, Kansas Wastewater Collection and Treatment System as presented. Voting Aye: All. Motion carried unanimously. APPLICATION FOR SPECIAL EVENT PERMIT TO SELL CEREAL MALT BEVERAGE It is the City s policy to inspect the premises of any business applying for a Cereal Malt Beverage License. The American Legion Post 170 has applied for a Special Event License to Sell Cereal Malt Beverages. They will be hosting a beer garden at the parking lot located at 216 E Main during Artist Alley on Saturday, September 29, Motion made by Commissioner LaRue, seconded by Commissioner Fairchild, to approve the application for a 2018 Cereal Malt Beverage License upon inspection and approval from the City Building Inspector and Fire Department. Voting Aye: All. Motion carried unanimously. NEIGHBORHOOD REVITALIZATION APPLICATION MURTHY & RAJAN, LLC Murthy & Rajan, LLC, has submitted an application under the Neighborhood Revitalization Program. It has been verified that the property listed under the scope of the application, 1601 S Santa Fe, parcel identification number is within the scope of the city limits of Chanute. The application has been approved by the Neosho County Appraisers office along with the Neosho County Treasurer s office. The application is now being submitted to the City Commission for consideration and approval. General discussion was made. Comments were made by City Attorney David Brake. Page 3 of 5

PROPERTY RESOLUTION 305 S RUTTER PROPERTY RESOLUTION 201 S WILSON PROPERTY RESOLUTION 222 S KANSAS Motion made by Commissioner Galemore, seconded by Commissioner Fairchild, to adopt resolution declaring that the above properties are in violation of Chanute Municipal Codes and authorizing abatement of certain nuisances as presented. Voting Aye: All. Motion carried unanimously. The Resolutions were assigned: No , No , and No COMMISSION COMMENTS Commissioner Chaney requested follow-up on his request to review the City s Pseudoephedrine Ordinance. City Manager Cantrell reported that this item will be placed on a future Agenda for City Commission review. Commissioner Chaney commented on complaints of inoperable vehicles parked on City streets. He reported that these complaints can be directed to the Chanute Police Department. Commissioner Chaney expressed his condolences to the family of Larry Gates and commented on his years of service with Chanute and that his passing will be a huge loss for our community. Commissioner Galemore agreed that Larry will be missed. Commissioner Galemore commented on the City s electric demand meter charge. General discussion was made. Comments were made by IT Director Rick Willis, City Attorney David Brake, and City Manager Jeff Cantrell. Mr. Willis will provide follow-up information on this item to the City Manager s office for distribution to the City Commission. Commissioner LaRue commented on cats. Mayor Budreau requested that the City Commission consider a future agenda item to discuss construction of a new animal shelter and funding options. General discussion was made. Page 4 of 5

5 Commission consensus was to place this item on the Agenda at the next regular City Commission meeting for review. Mayor Budreau reported that he had received complaints/concerns of homeless people staying at the property located on North Washington that is owned by Neosho County and that he is requesting potential dialogue with Neosho County. City Manager Cantrell will reach out to the Board of County Commission (BOCC) and request potential action to address this concern. Mayor Budreau reported that the City has exhausted their efforts in obtaining traffic signals at the intersection of Plummer Road & Cherry Street and that the State has denied the City s request. Commissioner Chaney requested that City staff research tree removal options with the radio station to assist northbound traffic with their line of sight. Commission consensus was for City Manager Cantrell to reach out to the property owner and discuss tree removal options.
