1 TYRONE BOROUGH COUNCIL MINUTES OF REGULAR COUNCIL MEETING OCTOBER 8, 7:00PM ============================================================= The Regular Monthly Council Meeting of the Tyrone Borough Council was held on Monday, October 8, 7:00PM at the Tyrone Borough Municipal Building, 1100 Logan Avenue, Tyrone, PA. Mayor Latchford led the group in the Pledge of Allegiance and Pastor Aaron Jeffrey, Grace Baptist Church, gave the Invocation. CALL TO ORDER: Mayor Latchford called the meeting to order and requested roll call. Present: Council members Robert Dollar, Charlie Mills, David Snyder, Terry Richardson, Thad Graham, Sarah Miller and Mayor Latchford. Absent: Councilmember Michelle Miller. Also present were Borough Manager Ardean Latchford; Solicitor Dan Stants; Police Chief John Romeo; Sewer Superintendent Tim Nulton; Water Superintendent Mike Ashcroft; Highway Superintendent Jim Bywater; Consulting Engineer Kevin Nester; Code Enforcement Officer Marvin Frazell; and Administrative Assistant Kimberly Gurekovich. EXECUTIVE SESSION: Mayor Latchford announced Council held an Executive Session prior to tonight s meeting to discuss personnel. PUBLIC COMMENT: Jen Powell, Executive Director of Tyrone-Snyder Public Library Ms. Powell was present to update Council on their ongoing and upcoming events. Library staff is currently working on a Wall of Fame, honoring kids learning to read; October 9 is a College workshop for kids and parents; October 17 Pizza Hut will be doing another fundraiser with 20% of orders that night going to the Library; the WIC program will be starting at the Library in December. There was no further public comment. Certificate of Appreciation Mayor Bill Latchford presented a Certificate of Appreciation to James Bywater, commemorating his 40 years of continued full time employment with the Borough.

2 Page Two (2) APPROVAL OF MINUTES It was moved and seconded the Minutes of the September 17, 2018 Council Meeting be approved. Council unanimously approved said motion. APPROVAL OF MONTHLY FINANCIAL REPORTS It was moved and seconded the expense report for September, 2018 be approved. Council unanimously approved said motion. BOROUGH MANAGER S MONTHLY REPORT Speed Limit Reduction - Route 453 (W 15th Street) In response to complaints received regarding speeding on W. 15 th Street, the Borough requested an Engineering and Traffic study to be done. PennDOT reviewed the area and approved the Borough s request for reduced speed limit. It was moved and seconded by Borough Council to approve the reduction of speed limit from 35 to 25 mph. Council unanimously approved said motion. It was noted the Borough is responsible for purchasing signage. Approval of 2018 CDBG Cooperative Agreement Council had previously allocated the FY2018 funds to Housing Rehabilitation. The Cooperative Agreement is the administrative agreement that dictates who is responsible for what. It was moved and seconded that Council approve signing the Cooperative Agreement. Council unanimously approved said motion. Request for Payment No. 4 - Logan Avenue Streetscape Council was in receipt of Payment Request No. 4 for Logan Avenue Streetscape in the amount of $ 77, This request has been reviewed by Borough staff and the County Grant Coordinator, Trina Illig and is recommended for payment. It was moved and seconded that Council approve Payment Request No. 4. Council unanimously approved said motion. Approval of Change Order Nos. 3, 4 and 5 - Logan Avenue Streetscape Council was in receipt of Change Order Nos 3, 4 and 5. This change order represents decreases in the amount of $3, Decreases are from the removal of trees, 29 of curbing, blue street markings, seeding and meter posts. It was moved and seconded

3 Page Three (3) that Council approve Change Order Nos. 3, 4 and 5. Council unanimously approved said motion. Tree Removal in City Hotel Park Council was informed of two overgrown trees located in City Hotel Park. It was the suggestion of the Borough Manager to remove the large trees on each end of the park and discuss replacement at a later time. It was noted that Bennetti Tree Service will be planting the Streetscape trees and they are willing to also remove these two trees. It was moved and seconded that Council approve the removal of two trees from City Hotel Park. Council unanimously approved said motion. Tyrone-Snyder Public Library Allocation Ms. Jen Powell addressed Council last month and requested an increase to their yearly allocation. Ms. Powell noted that 62% of their income must come from fundraising. The Borough currently allocates $5,500/year. It was suggested the Borough increase the allocation to $10,000. Council members Terry Richardson and Sarah Miller were not in favor of this increase, while the others members present were. Borough Manager Ardean Latchford advised these funds would come out of the Community Enrichment line item. It was the consensus of the majority of Council that Borough staff include this increase in the 2019 Budget process. Hiring-Additional Full Time Police Officer Council discussed wishing to move forward with Civil Service testing procedures for a new full time police officer. It was moved and seconded that Borough staff begin the Civil Service process for hiring a full time police officer. This item was not on the Agenda. Mayor Latchford called for public comment and there was none. Council unanimously approved said motion. Informational: Volunteers from the Albemarle Foundation (approx. 35) and Borough employees will be assisting in the building of the new all abilities playground equipment on October 11 and 12, the may be postponed to the following week due to the weather. The November meeting is scheduled for Tuesday, November 13 due to the Veteran s Day holiday. This meeting will also begin at 6pm to accommodate the Proposed Digester discussions. 4 Page Four (4) Trunk or Treat, October 20, 6-8pm Trick or Treat, October 25, 6-8pm Veteran s Day Parade, November 2pm SOLICITOR S RERORT: Solicitor Dan Stants presented the Council with following: Ordinance No Feral Cat Ordinance An Ordinance Of The Borough Of Tyrone Amending The Borough Of Tyrone Code Of Ordinances Chapter 61 Entitled Animals By Adding Additional Provisions To Article I Entitled "Cats"; Provide For Severability Of Provisions, Establish Enforcement And Penalties For Violations; And Establish An Effective Date. It was noted that enforcement will be complaint driven. This Ordinance will allow the police department and/or any other Borough designated individual to enforce this Ordinance. It was moved and seconded that Council approve Ordinance No regarding Feral Cats. Council unanimously approved said motion. Resolution No CDBG Application At the October Borough Council Meeting, Council members elected to designate the 2018 CDBG Funds to Housing Rehabilitation. Resolution No authorizes that activity and authorizes the submission of the application. It was moved and seconded that Council approve Resolution No Council unanimously approved said motion. CONSULTING ENGINEER: Mr. Kevin Nester presented his report to Borough Council. CODE ENFORCEMENT: Council was in receipt of Mr. Frazell s report. Mr. Frazell thanked Council for the Feral Cat Ordinance. POLICE DEPARTMENT: Council was in receipt of Chief Romeo s report. Chief thanked Council for their support. SEWER DEPARTMENT: Council was in receipt of Mr. Nulton s monthly report. WATER DEPARTMENT: Council was in receipt of Mr. Ashcroft s monthly report. HIGHWAY DEPARTMENT: Council was in receipt of Mr. Bywater s report.

5 Page Five (5) MISCELLANEOUS: Kim Gurekovich thanked Council member Bob Dollar for preparing a spreadsheet with all Borough ordinances listed. This will be very helpful to everyone while searching for past information. Councilmember Richardson wanted the public to know the November 13 th meeting is for the public to be informed about the proposed Digester project. Mr. Richardson requested that all Councilmembers be in attendance and would like it advertised numerous times in the news media. This meeting will also be a question and answer period for the public.
