1 MINUTES The Brandon City Council met in regular session at 6:00 p.m. on October 15, 2018 in the Council Chambers at 308 S. Main Avenue, Brandon, South Dakota. Present were Brett Bastian, Dana Clark, Barb Fish, Jo Hausman, Chuck Parsons and Mayor Paul Lundberg. Others present were: City Administrator, Bryan H. Read; Finance Officer, Christina Smith; City Attorney, Lisa Marso; City Engineer, Tami Jansma; Police Chief, Dave Kull and Public Works Director, Rollie Hoeke. Absent: Tim Wakefield, Jr. Alderwoman Hausman moved Alderman Bastian seconded to approve the agenda as amended. Motion carried. Maywood Street, was present for discussion. Jim was present to discuss the current fireworks ordinance, and his concerns with the impact on the public and family pets with noise and debri left behind. TJ Cameron, 2417 E. Lopez Lane, owner of Brandon Fireworks, was present for discussion. TJ was present to discuss the current fireworks ordinance. TJ is an advocate to the safety risks of
4 fireworks, and recommends banning rockets & artillery shells, but with proper enforcement & education the public can still enjoy fireworks without a complete ban. John & Krystal Burkman, 102 N. Chestnut Blvd, were present for discussion. John & Krystal were present to discuss the Burkman Letter which was on the October 1, 2018 City Council agenda. Krystal discussed their property on the east side of Brandon, and how they no longer have their access easement to their property. Mayor Lundberg directed City Administration to handle outside of a public meeting setting. Riley McKeown, 913 S. Parkview Blvd., was present for discussion. Riley was present to discuss ways to make crosswalks in the City of Brandon safer, as he was recently hit by a vehicle while crossing in a crosswalk near the Middle School. Suggestions made to have a crosswalk monitor during school hours & till 5pm, change crosswalk signals from yellow to red and change the timing of street lights to allow pedestrians to cross safely before vehicle traffic can proceed. MODERN WOODMAN HOMETOWN HERO PRESENTATION John Murawski, Representative from Modern Woodman, was present. John presented the Modern Woodman Hometown Hero award to the Brandon Police Department. Police Chief Kull was present to accept the award on behalf of the Brandon Police Department. GOLF RATES PROPOSED FOR 2019 The Golf Course Committee report was heard. Proposed golf rates for the 2019 season were presented. A resolution will be drafted and presented at the next regular City Council meeting. OFFICER PROMOTION The Police Committee report was heard. Alderwoman Hausman moved Alderwoman Clark seconded to approve the promotion of Officer Austin Peterson to the position of Sergeant, at a rate of $26.93 per hour. Motion carried. CROSSWALK CROSSING SAFETY Staff will look into the recommendations made by Riley McKeown in regards to improving safety at crosswalks within the City of Brandon. Will update at the next regular City Council meeting. CHIEF KULL RETIREMENT LETTER Alderman Parsons moved Alderman Bastian seconded to accept the retirement letter from Police Chief Kull effective April 26, Motion carried. RESOLUTION #17-18 The Park & Recreation Committee report was heard. Alderwoman Fish moved Alderwoman Hausman seconded to approve Resolution #17-18 for a grant application to be used to further develop Stone Ridge Park. A roll call vote showed Bastian, Clark, Fish, Hausman, Parsons aye. Motion carried.
5 RESOLUTION #17-18 WHEREAS, the United States of America and the State of South Dakota have authorized the making of grants from the Land and Water Conservation Fund (LWCF) to public bodies and to aid in financing the acquisition and/or construction of specific outdoor recreation projects; NOW, THEREFORE BE IT RESOLVED: 1. That the Mayor is hereby authorized to execute and file an application on behalf of the City of Brandon with the National Park Service, US Department of the Interior, through the State of South Dakota, Department of Game, Fish and Parks, Division of Parks and Recreation, for an LWCF grant to aid in financing the Park Improvement project for the City of Brandon, South Dakota and its Environs. 2. That the Mayor is hereby authorized and directed to furnish such information as the above mentioned federal and/or state agencies may reasonably request in connection with the application which is hereby authorized to be filed. 3. That the City of Brandon shall provide a minimum of 50% of the total cost of the project; and will assume all responsibility in the operation and maintenance of the project upon completion of construction, for the reasonable life expectancy of the facility. Motion carried.
6 UPDATE WEBSITE PROPOSAL The Administration Committee report was heard. Alderwoman Hausman moved Alderman Parsons seconded to approve the proposal from GovOffice for the updated City website, Premium Plan in the amount of $8, Motion carried. FIREWORKS City Administrator explained the current city ordinance pertaining to fireworks in the city limits of Brandon. Alderwoman Clark gave an update on discussions held by the Fireworks Committee. Discussion held on limiting certain types of fireworks, ways to communicate the Ordinance rules, enforcement, possible ban of all fireworks. City Attorney Lisa Marso will draft a proposed Ordinance to ban most fireworks within city limits, similar to the City of Sioux Falls, to be presented at the next regular City Council meeting. TJ Cameron, 2417 E. Lopez Lane, spoke in reference to the City of Sioux Falls fireworks ordinance. APPOINTMENT TO BRANDON DEVELOPMENT COMMITTEE Alderman Parsons moved Alderwoman Hausman seconded to approve the appointment of Jarrod Johnson to the Brandon Development Committee. Motion carried. WAGE & BENEFIT STUDY City Administrator Bryan Read will work on the benefit study and schedule a work session to discuss. CODE OF CONDUCT & COUNCIL/MAYOR POLICY CHANGES UPDATE City Attorney Lisa Marso presented some proposed policy changes for City Council and Mayor. It was the consensus of the Council to have a work session to go over in further detail. SOCIAL MEDIA POLICY Alderwoman Hausman and Alderwoman Clark met with staff to discuss/review the social media policy. Will discuss at a future meeting. RESOLUTION #18-18 Alderwoman Clark moved Alderman Parsons seconded to approve Resolution # A roll call vote showed Bastian, Clark, Fish, Hausman, Parsons aye. Motion carried. RESOLUTION #18-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRANDON, SOUTH DAKOTA ESTABLISHING AN ACCOUNTING POLICY WHEREAS, the City of Brandon, SD (the City ) is a municipality in South Dakota; and WHEREAS, the City desires to establish a policy to utilize for accounting procedures; and
7 NOW THERFORE BE IT RESOLVED by the City Council of Brandon, SD that the attached City of Brandon Accounting Policy, attached hereto, is hereby adopted. Lundberg Mayor Christina Smith Municipal Finance Officer (SEAL) MEETING WITH SIOUX FALLS CITY COUNCIL The City of Sioux Falls would like to reconvene the joint Brandon and Sioux Falls city council dinner, to be held twice a year. It was the consensus of the City Council to schedule the next dinner for December 20, City Administrator Bryan Read will contact the City of Sioux Falls to schedule. WATER LINE WINTER TRICKLE POLICY & LETTER The Street Committee and Water & Sewer Committee reports were heard. A letter will be sent to properties that typically trickle their water during the winter months reminding them of the policy. GREASE TRAP INVITATION LETTER & AGENDA A meeting will be held on October 24, 2018 at 2:00pm at the City Council chambers to discuss the implementation of a grease trap inspection program. Letters will be sent to businesses that prepare and serve food. At 7:16 p.m. Alderwoman Fish moved Alderman Bastian seconded to go into executive session to discuss contract negotiations, per SDCL Motion carried. At 7:58 p.m. Mayor Lundberg declared the executive session ended.
