ABSENT: Bob Mata (excused) and Terry Parks (excused) Mayor Lunde opened the meeting with the Pledge of Allegiance. 2A RESPONSE TO PRIOR PUBLIC COMMENT None. 2B PUBLIC COMMENT 1. Antonio Smith, Youth Services Liaison, Recreation Department. Talked about Mr. Donald Jackson, community leader, who passed away on March Nicole Hagberg, 8121 Mount Curve Boulevard. Was in support of the Fire Department and EMTs. 3. Karen Johnson, th Ave North. Was in support of Fire Department and firefighters. At 7:10 p.m. Council Member Pha arrived. 4. Was in support of the Fire Department and firefighters. 3A MOTION GATES, SECOND LUNDE TO APPROVE THE AGENDA AS SUBMITTED BY THE CITY CLERK WITH ITEMS 4.6 PULLED FROM THE CONSENT AGENDA FOR SEPARATE DISCUSSION. MOTION PASSED UNANIMOUSLY. 3B PUBLIC PRESENTATIONS/PROCLAMATIONS/RECEIPT OF GENERAL COMMUNICATIONS 3B.1 Police Chief Todd Milburn introduced new employees to the Police Department.

Finance Director LaTonia Green introduced new employees to the Finance Department. Recreation Services Manager Jan Ficken introduced a new employee to the Recreation and Parks Department. Operations and Maintenance Director Dan Ruiz introduced new employees to the Operations Maintenance Department. Council Member Mark Mata personally thanked Candelaria Anrade Delag for her excellent customer service at the Licensing counter last week. He stated he was getting vehicle tabs and was told that at 10 minutes to 5 p.m., if he was not called to the counter, he wouldn t be served if it went past 5 p.m. He stated that at 5 p.m., they told the person in front of him they were the last person to be served. He stated that while he was on the phone texting the city manager on looking into the policy,. Ms. Andrade Delag called him over to the counter at 5:02 p.m. and said she didn t realize who he was and she provided excellent customer service. He wanted to personally thank her and appreciated what she did. 3B2 Park and Facilities Manager Brad Tullberg briefed the Council on the recognition for the Adopt the Park, Clean Up the Park and Pick Up Your Neighborhood events. 3B2 MOTION LUNDE, SECOND GATES TO RECOGNIZE THE ADOPT A PARK, CLEAN UP THE PARK, AND PICK UP YOUR NEIGHBORHOOD VOLUNTEERS FOR THEIR EFFORTS IN MAKING BROOKLYN PARK A CLEANER AND BETTER PLACE TO LIVE. MOTION PASSED UNANIMOUSLY. 3B3 Mayor and Council presented plaques to outgoing Commissioners for their contributions to the City of Brooklyn Park. 3B4 Recreation Services Manager Jan Ficken briefed the Council on the donation from Edinburgh Pro Am Foundation for youth recreation programs. Jack Umland and Dave Seary, Edinburgh Pro Am Foundation, addressed the Council and presented the $5,000 check to the Mayor. 3B4 MOTION LUNDE, SECOND GATES TO WAIVE THE READING AND ADOPT RESOLUTION# ACKNOWLEDGING A $5,000 DONATION FROM THE EDINBURGH PRO AM FOUNDATION FOR YOUTH RECREATION PROGRAMS. MOTION PASSED UNANIMOUSLY. 3B5 Rose McKinney and Tracee Anderson, Know The Truth/MN Adult and Teen Challenge, addressed the Council. Mayor Lunde proclaimed May 11, 2017 as From Statistics to Solutions Day in the City of Brooklyn Park. 3B6 Mayor Lunde proclaimed the month of April as Safe Digging Month in the City of Brooklyn Park. 3B7 Charter Commission Chair Scott Simmons gave the 2016 Charter Commission Annual

MCCROSSEN CONSTRUCTION, INC. 4.8 TO WAIVE THE READING AND ADOPT RESOLUTION # TO APPROVE CHANGE ORDER NO. 1 FOR THE 2017 VILLAGE CREEK POLICE STATION WALL REPAIRS AND WINDOW REPLACEMENT PROJECT TO JPMI CONSTRUCTION CO. 4.9 TO WAIVE THE READING AND ADOPT RESOLUTION # APPROVING CONSTRUCTION COOPERATIVE AGREEMENT NO. PW WITH HENNEPIN COUNTY FOR FUNDING, CONSTRUCTION AND MAINTENANCE OF THE 63RD AVENUE MILL AND OVERLAY BETWEEN BOONE AVENUE AND LOUISIANA AVENUE, CIP MOTION PASSED UNANIMOUSLY. 4.6 Council Member M. Mata stated he was onboard with Crystal for the project because they would already be in the area and the City would have a cost savings with joining them on the project. His issue with it and his intent was to help reduce the budget, save dollars and not impact people. He stated the trail park they were talking about as shown on Google Maps, it was a tarred path that went around the park. He stated the park didn t have amenities and half of it was not accessed by a trail. He stated that one side of it faced the airport and the other side faced commercial buildings and the third side faced 62 nd Avenue, which was basically the City of Crystal s neighbor. He stated there were four houses that backed up to it on the north side, which was in the City of Brooklyn Park. He stated there was a park, and half a block south of that park was a playground area, that was zoned out and had a mowed soccer field in the middle for playing and believed there was a grass diamond on the northwest corner. He suggested the motion to be to do the road project and not do the trail reconstruction. He stated that talking Director Ruiz, the Council would revisit the project in He stated it would be a savings of over $100,000. Director Ruiz stated the trail project was $125,000 and funded from the Heritage infrastructure fund which was used for long term replacement and rehabilitation of the city s infrastructure. Council Member Pha agreed with Council Member M. Mata. She stated that as they looked at the city budget being so high they were always looking for ways to cut expenses. She stated she wasn t there last week when they talked about the Fire Department but was in favor of doing what they could to support the Fire Department because the community needed them and the lifesaving services they received. She stated that $125,000 on that particular project thought they could do without and agreed with Council Member M. Mata to wait and not spend money on it. Council Member Gates stated he was all about saving money. He stated that one of the things

5 BROOKLYN PARK COUNCIL MEETING; APRIL 10, 2017 Page 5 they kept hearing was about a more livable city and that included trails, sidewalks and was one way to bike and walk in the community. He stated they kept hearing about gaps in the trail system and if they were going to be working on the project now, it made sense to do it. He stated if they waited five years, the $125,000 could be $175,000. He stated he would like to see the project continue. Council Member Jacobson stated the city was known for its parks and trails. She stated if they were going to be there anyways thought Director Ruiz knew best on the project and whichever way he believed the Council should go, she was willing to vote for it. Director Ruiz stated the bidding climate had been the best he had seen in four years and was surprised to see the prices come in low on that project and street overlay program. He gave an example that they planned on the street overlays coming at $150,000 to $170,000 per mile and they came in $120,000 per mile when they included the pedestrian ramps. He stated his biggest fear with not completing the project and waiting four years until there was substantial work in that area was the prices going up 20 percent. He stated they rated the trail as one of their worst trails in the system and was in the southern part of city. He stated they heard from more and more people they wanted the city to reinvest in the southern part of town. He stated it was a nice looped trail and didn t know the usage numbers. He stated he talked to Recreation and Parks Director Yungers by phone and she highly recommended the replacement of trail to continue to give good access and recreational opportunities for people in that part of town. Mayor Lunde stated he was okay with waiting. If it was at 63 rd Avenue, he would say no because 63 rd Avenue was going to tie into it and played a role with Brooklyn Center doing their work on their trail on 63 rd Avenue. He stated when it was in their city, they had a trail that kind of dead ended at the Brooklyn Park border. He asked if there were going to be changes at the Crystal Airport because the trail went into the Crystal Airport. He asked if they should invest that money knowing that at some time it could change. He stated it was right between Highway 81 and their airport and he could go either way. He was just curious if there was a plan so if they made a trail that it didn t lead into a berm or something that was not there anymore. Council Member M. Mata stated it was a trail that went around the park. The roads to the south of 62 nd Avenue, was Crystals on the other side and it abutted itself into the northern street, Florida Avenue, with no trail access to it. He stated that anyone going down 63 rd Avenue which was not a trail, wouldn t have a clue how to go back to the park to ride around it in a circle and at best it was a walking path. He stated he was going to make a motion and was going to end the motion at 62 nd Avenue and would not include in the motion and Southbrook Park Trail Reconstruction Project, CIP He stated the motion would not include the trail going around the park. 4.6 MOTION M. MATA, SECOND LUNDE TO WAIVE THE READING AND ADOPT RESOLUTION

6 BROOKLYN PARK COUNCIL MEETING; APRIL 10, 2017 Page 6 # APPROVING THE 2017 PHASE 16 SKYWAY PARK STREET RECONSTRUCTION CRYSTAL BROOKLYN PARK JOINT POWERS AGREEMENT FOR THE 62ND AVENUE. Mayor Lunde asked if it would go back in the CIP or would it go back in to the planning for the future and had to be reintroduced. He stated he was fine with holding it over. Director Ruiz stated they would reevaluate it with staff and bring it back recommendations. He stated that anything they brought through the CIP, the Council got several chances to look at it. He stated they would also take a closer look at what if any other trail connections might or might not happen in that area. He stated that if the Council still moved forward with the street piece of it and separating it, they could still revisit it and consider it in a few weeks or months. Mayor Lunde asked if it would impact the agreement with the City of Crystal. Director Ruiz stated that was bid as an alternate and provided that if the agreement was passed, he believed they were in good shape. City Engineer Struve stated the Council should be able to pass the agreement and not affect it. He stated the project had not been awarded by the City of Crystal yet and could move forward with it. He stated that piece was an alternate add and would call their engineer to verify it. Mayor Lunde stated he knew the trades unions had their training center on the corner of 62 nd Avenue and Highway 81. He stated he was just looking for partners about that trail because it was very local and maybe an opportunity to explore local partners for something on that trail because it was serving just some people in that neighborhood. Council Member Jacobson stated that since it still looked like they had answers to come back to the Council, asked if they could table the Southbrook Park Trail Reconstruction project piece or having it come back in the CIP was enough. She stated she would like to make a friendly amendment to the motion to pass the first half and table the Southbrook Trail reconstruction project, CIP City Attorney Thomson recommended voting on the pending motion and doing a follow up motion to direct staff to come back with further information. He stated it was possible it would be too late depending on if they already awarded the contract without that add on but it was something that was outside their control. He stated that would be additional information that staff could come back to the Council with. He stated that rather than doing an amendment to the motion, he recommended to vote on the motion and then do a follow up motion. Council Member M. Mata stated he wanted to vote on motion and following that motion he would direct staff.

He asked for a roll call vote. 4.6 THE VOTE ON THE MOTION PASSED ON A ROLL CALL VOTE AS FOLLOWS: YES PHA, M. MATA, JACOBSON, LUNDE; NO GATES. 4.6 MOTION M. MATA, SECOND LUNDE TO DIRECT DIRECTOR RUIZ TO COME BACK TO THE COUNCIL WITHIN TWO WEEKS TO ADDRESS THE ISSUES COUNCIL MEMBER JACOBSON HAD. Council Member M. Mata stated that hopefully two more Council Members would be present to weigh in on anything they might have to add to the issue. 4.6 THE VOTE ON THE MOTION PASSED UNANIMOUSLY. At 8:20 p.m., Mayor Lunde recessed to the Board of Appeal and Equalization meeting. At 9:17 p.m., Mayor Lunde reconvened the Regular Council meeting. 5.1 Finance Director LaTonia Green briefed the Council on the Street Reconstruction Plan, Authorization for Issuance of Street Reconstruction Bonds, Adopting a Capital Improvement Plan and Preliminary Authorization for Issuance of Capital Improvement Bonds for the Replacement of O&M Building D. 5.1 Mayor Lunde opened the public hearing to consider the Street Reconstruction Plan and Authorization for Issuance of Street Reconstruction Bonds. 5.1 The following individuals addressed the Council. None. 5.1 Mayor Lunde closed the public hearing and returned the item back to the table for consideration. 5.1 MOTION JACOBSON, SECOND LUNDE TO WAIVE THE READING AND ADOPT RESOLUTION # ADOPTING A STREET RECONSTRUCTION PLAN AND AUTHORIZING ISSUANCE OF GENERAL OBLIGATION BONDS, SERIES 2017A IN AN ESTIMATED ORIGINAL PRINCIPAL AMOUNT OF $4,075,000 FOR 2017 STREET RECONSTRUCTION. Finance Director Green stated it was $4,070,000 because there was a change that happened and was a $5,000 reduction. Mayor Lunde asked Council Member Jacobson if she was agreed with the amendment and she stated yes. Second Lunde also agreed with the amendment to $4,070,000.

None. 5.1 Mayor Lunde closed the public hearing and returned the item back to the table for consideration. Finance Director Green stated the correct amount was $4,975, MOTION JACOBSON, SECOND GATES TO WAIVE THE READING AND ADOPT RESOLUTION # ADOPTING A CAPITAL IMPROVEMENT PLAN AND PROVIDING PRELIMINARY APPROVAL FOR THE ISSUANCE OF GENERAL OBLIGATION CAPITAL IMPROVEMENT BONDS, SERIES 2017A IN AN ESTIMATED ORIGINAL PRINCIPAL AMOUNT OF $4,975,000 FOR THE REPLACEMENT OF O&M BUILDING D. MOTION PASSED UNANIMOUSLY 5.2 Finance Director LaTonia Green briefed the Council on the issuance of revenue bonds for Amarce I Limited. 5.2 Mayor Lunde opened the public hearing to consider the issuance of revenue bonds for Amarce I Limited. 5.2 The following individuals addressed the Council. None. 5.2 Mayor Lunde closed the public hearing and returned the item back to the table for consideration. 5.2 MOTION LUNDE, SECOND GATES TO WAIVE THE READING AND ADOPT RESOLUTION # AUTHORIZING THE ISSUANCE, SALE, AND DELIVERY OF MULTIFAMILY HOUSING REVENUE OBLIGATIONS IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $15,000,000 TO FINANCE A MULTIFAMILY HOUSING DEVELOPMENT TO BE LOCATED IN THE CITY; ADOPTING A HOUSING PROGRAM PURSUANT TO MINNESOTA STATUTES, CHAPTER 462C, AS AMENDED; APPROVING THE FORMS OF AND AUTHORIZING THE EXECUTION AND DELIVERY OF THE

MOTION PASSED UNANIMOUSLY. 7.1 LRT Senior Project Manager Jennifer Jordan briefed the Council on the development investment level for West Broadway Streetscape and Maintenance. 7.1 MOTION LUNDE, SECOND GATES TO DIRECT STAFF TO CONTINUE WORKING ON DEVELOPING AN INVESTMENT LEVEL FOR THE WEST BROADWAY STREETSCAPE AND MAINTENANCE IN ACCORDANCE WITH WEST BROADWAY STREETSCAPE COST ESTIMATE SUMMARY WORKING DOCUMENT. MOTION PASSED UNANIMOUSLY. 9A COUNCIL MEMBER REPORTS AND ANNOUNCEMENTS Council Member Gates stated the City was bombarded with illegal signs over the weekend. He stated spring time was worse and it had always been an issue. He stated the Council needed to have a discussion on it because there wasn t a way to fine them and was not in the ordinance. He stated he wanted the Council to have a discussion on it, either at a work session or regular meeting and he would also like to know how other cities dealt with illegal signs and fines. Council Member Pha thanked Council Members and staff for the kind card she received with messages of condolences. She stated her grandmother had passed away and they had a great celebration of life for her. 9B CITY MANAGER REPORTS AND ANNOUNCEMENTS Acting City Manager Woke Freeman stated there were a number of events in the community: Tomorrow from 5:00 to 7:00 p.m., there was an open house for the CenterPoint Energy beltline replacement project and would be held in the Council Chambers. On Wednesday, April 12, Cornerstone Minnesota would be hosting a discussion on human trafficking in Hennepin County and would be held at the Brooklyn United Methodist Church, 7200 Brooklyn Boulevard in Brooklyn Center. On April 13, from 4:30 to 7:00 p.m., there was a public open house for the Metro Blue Line Extension project update that would be held at the Brooklyn Park Library, on West Broadway Avenue in the Mississippi Room. From April 17 through May 5, will be fire hydrant flushing beginning at 6:00 a. m. to 5:30 p.m. On April 18, the Police Department is hosting a women s personal safety class, from 6:30 to 8:30 p.m.
