1 TYRONE BOROUGH COUNCIL MINUTES OF REGULAR COUNCIL MEETING MAY 14, 7:00PM ============================================================= The Regular Monthly Council Meeting of the Tyrone Borough Council was held on Monday, May 14, 7:00PM at the Tyrone Borough Municipal Building, 1100 Logan Avenue, Tyrone, PA. Mayor Latchford led the group in the Pledge of Allegiance and Pastor Sharon Erb, First English Lutheran Church offered the Invocation. CALL TO ORDER: Mayor Latchford called the meeting to order and requested roll call. Present: Council members Robert Dollar, Michelle Miller, Charlie Mills, David Snyder, Terry Richardson, Thad Graham and Mayor Latchford. Absent: Council member Sarah Jane Miller. Also present were Borough Manager Ardean Latchford; Solicitor Dan Stants; Police Chief John Romeo; Sewer Superintendent Tim Nulton; Water Superintendent Mike Ashcroft; Highway Superintendent Jim Bywater; Consulting Engineer Kevin Nester; Code Enforcement Officer Marvin Frazell; Finance Director Shannon Wilson; and Administrative Assistant Kimberly Gurekovich. EXECUTIVE SESSION: Mayor Latchford announced an Executive Session was held prior to the Council Meeting to discuss personnel. PUBLIC COMMENT: Steven Elfelt, Fair Districts PA Representative, was again present to address Borough Council regarding ending gerrymandering in Pennsylvania. Mr. Elfelt, explained that Gerrymandering is manipulation of electoral district lines to benefit one political party or person. Mr. Elfelt also advised of proposed Senate and House Bill s, that if approved would enact redistricting reform in Pennsylvania. Mr. Elfelt also advised he had left Council with a Resolution regarding the same. Mr. Elfelt hosted a public meeting at the Tyrone Snyder Public Library on May 1, Introduction of Newly Appointed Part Time Police Officer Chief Romeo introduced newly appointed part time officer, Scott Turnbaugh to Council.a Katelyn Richards, K9 Statue Update Katelyn Richards was present to update Council on her K9 Statue project. Ms. Richards advised the Legion informed her they do not want the statue in Soldiers Park.

2 Page Two (2) Borough Manager Latchford suggested placing the statue in City Hotel Park. He wishes to remove the current water fountain, as it is an obstruction when there are performances held in the corner park. It was the consensus of Borough Council to allow the K9 Statue in City Hotel Park. Ms. Richards advised she still needs to raise $3500. There was no further public comment. APPROVAL OF MINUTES It was moved and seconded the Minutes of the April 9, 2018 Council Meeting be approved. Council unanimously approved said motion. APPROVAL OF MONTHLY FINANCIAL REPORTS It was moved and seconded the financial reports for the monthly accounting period ending April 30, 2018 be approved: (1) The Account Balance Report; (2) Statement of Revenues and Expenses; and (3) Cash Disbursement Journal. Council unanimously approved said motion. BOROUGH MANAGER S MONTHLY REPORT Bid Award - Logan Avenue Streetscape The Borough accepted bids for the Logan Avenue Streetscape project on April 26, Four bids were received and are listed below: Gordon Delozier $ 804, HRI $ 821, M & B Services $ 923, Ventura $1,101, At their April 9 th Council Meeting, Borough Council authorized the Borough Manager to issue a Notice of Intent to Award to the low bidder, since the bid opening fell between council meetings. The bids have been reviewed by Lehman Engineers. It was moved and seconded the Logan Avenue Streetscape bid be awarded to the low bidder, Gordon Delozier at their bid price as listed above. Council unanimously approved said motion.

3 Page Three (3) Award of Polyelectrolyte - WWTP Bids were accepted on May 3, 2018 for Polyelectrolyte (Polymer). Four bids were received and are listed below: Atlantic Coast Polymers Neo Solutions Synthex Organics Coyne Chemical $ 1.65/lb $ 1.769/lb $ 2.55/lb $ 18.85/lb All bidders are required to run their product through the wastewater treatment plant prior to bidding. Sewer Superintendent Tim Nulton has reviewed the bids and recommends award to Atlantic Coast Polymers at their bid price as listed above. It was moved and seconded the Polymer be awarded to the low bidder, Atlantic Coast Polymers. Council unanimously approved said motion. Fire Police Members The Borough has worked diligently to restore the Fire Police organization, as they are a valuable tool to the Borough. The Borough has had several volunteers that have stepped forward and have been sworn in as members. It was moved and seconded that Council approve the following individuals as Fire Police Members: David McGlynn Donald Stringer Karl Gurekovich Carl Rhodes Council unanimously approved said motion. New Utility Billing Software The Borough staff has been working on new utility billing software along with the outsourcing the tax collection. It was moved and seconded that Council approve moving forward with the new utility billing software along with the outsourcing of the tax collection. Council unanimously approved said motion.

4 Page Four (4) Tyrone Borough Operating Accounts While the Borough is switching to more modern billing software, Borough staff also looked into simplifying the Borough s banking structure. All operating funds are currently held with First National Bank and has an investment account at Reliance Bank for general and water fund reserves. After receiving quotes from both First National Bank and Reliance Bank, the Borough has found it to be more fiscally responsible to move the Borough s operating account to Reliance Bank. At this time Borough staff is requesting to move the Borough s operating funds to Reliance Bank. Members of Reliance Bank were in attendance to answer any questions. No questions were asked. It was moved and seconded that Council approve moving the Borough s operating funds to Reliance Bank. Council unanimously approved said motion. Appointment of Council Member to Personnel Committee It was moved and seconded that Council appoint Thad Graham to the Personnel Committee. A roll call vote was taken. Ayes: Council members Miller, Snyder, Dollar, Mills, Richardson and Mayor Latchford. Council member Graham abstained. The motion carried. Informational Items: The Borough was approved for a grant from the Blair County Parks & Recreation in the amount of $2, This grant will go towards playground equipment for the Borough Abilities Park, to be installed at Reservoir Park. The Refuse and Recycling Contract has been placed for bid, bids will be accepted on June 26, 2018 at 11am. A local Church has reached out to the Borough wishing to do a beautification project within the Borough. Borough Manager Ardean Latchford will be meeting with the group. Mr. Latchford also advised that anyone located in the floodplain should contact their mortgage lenders since the remapping was recently completed. However, it was noted, the Borough is NOT telling residents to drop their flood insurance. SOLICITOR S RERORT: approval: Solicitor Dan Stants presented the following for Council s

5 Tyrone Borough Council May 14, 2018 Page Five (5) Resolution No Intermunicipal Relations Committee (IRC) It was moved and seconded that Council approve Resolution No , amending the Rules and Regulations for Refuse and Recycling since the Borough has withdrawn from the IRC. Council unanimously said motion. Resolution No Donation of Unclaimed Bicycles It was moved and seconded that Council approve Resolution No , authorizing donation of 5 unclaimed bicycles to Helping Hands, a charitable organization. Council unanimously approved said motion. Resolution No Sale of Old Tasers It was moved and seconded that Council approve Resolution No , authorizing the sale of the Department s old tasers to Blair Constable Services, Inc., in the amount of $50 each. Council unanimously approve said motion. Resolution No Fair District Mapping It was moved and seconded that Council approve Resolution No , supporting legislative efforts for redistricting to an independent citizens redistricting commission. A roll call vote was taken. Ayes: Council members Miller, Snyder, Graham, Dollar and Mayor Latchford. Nayes: Council members Mills and Richardson. Ordinance No Revision to 2018 Compensation Ordinance It was moved and seconded that Council approve Ordinance No. 1416, revising the 2018 Compensation Ordinance. Council unanimously approved said motion. Ordinance No Revision to 2018 Fee Ordinance It was moved and seconded that Council approve Ordinance No. 1417, revising the 2018 Fee Ordinance. Council unanimously approved said motion. CONSULTING ENGINEER: Mr. Nester reviewed his report with Borough Council. Mr. Nester presented Council with a proposal for engineering services to Rehabilitate Secondary Clarifiers & Exterior of the Primary Clarifiers at the Wastewater Treatment Plant. Cost of Engineering Services are not to exceed $34,000. It was moved and seconded that Council approve said Engineering Agreement. Council unanimously approved said motion.

6 Tyrone Borough Council May 14, 2018 Page Six (6) CODE ENFORCEMENT: Council was in receipt of Mr. Frazell s report. Mr. Frazell advised of two recent zoning hearings held by the Zoning Hearing Board and are as follows: (1) Port Pizza, LLC, requested a variance for side yard setbacks for a proposed Domino s Pizzeria. The request was granted. (2) Joseph Hagg, requested a Use Variance for the raising of farm animals. The request was granted with a ten animal limit from a list of animals submitted by the applicant. Mr. Frazell also proposed an Annual Business Inspection program to Council for all businesses located within the Borough limits. A question of liability was asked. Solicitor Stants does not feel the Borough would be held liable in the event something went wrong with a building. While Council member Snyder was in agreement, he also does not want this to be a deterrent for new business. Council is not in favor of high fees; however, Mr. Frazell he is in favor or high fines for noncompliance. The Borough Manager is also not in favor of fees for this and does not feel it will be a lot of manpower. Council gave their consensus for Mr. Frazell to draft a program for Council to review. POLICE DEPARTMENT: Council was in receipt of Chief Romeo s report. Chief Romeo advised the electronic filing of citations began this date. Chief also advised the Police Department and some staff members will participate in the Special Olympics Police Torch Run scheduled for May 31 st. Our leg of the race will be from Tri-Start Motors to Tyrone Sheetz. SEWER DEPARTMENT: Council was in receipt of Mr. Nulton s monthly report. WATER DEPARTMENT: Council was in receipt of Mr. Ashcroft s monthly report. HIGHWAY DEPARTMENT: Council was in receipt of Mr. Bywater s report. MISCELLANEOUS: Mayor Latchford advised that May 13-May 19 is Police Week and offered gratitude for our Police Department.
