1 BOROUGH OF BOYERTOWN COUNCIL MEETING The regular meeting of the Boyertown Borough Council was called to order at 7:00 p.m. by Council President Frank Deery. Council members present in addition to Mr. Deery were Charles Heller, Barry Christman, Keith Endy, and Terry Mest. Council member Gene Gabel was absent and member Lorraine Carnes arrived at approximately 7:05 p.m. Also in attendance were Marianne Deery, Mayor; Christopher Hartman, solicitor; Patricia Loder, Borough Manager; Allen Steffy, Building a Better Boyertown, Adrianne Blank, Main Street Manager; concerned citizens, and a press representative. All rose for the Pledge of Allegiance. Mr. Deery called for public comments on the agenda; no comments were forthcoming. Mr. Deery called for a motion to approve the minutes of the June 4, 2018 meeting of Borough Council. The motion was made by Mr. Endy, second by Mr. Heller, and approved. Finance, Charles Heller Mr. Heller made a motion, second by Mr. Mest, to approve the lists of Revenues, Expenditures and Bills for June The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mr. Endy, Mr. Mest, and Mr. Deery. The motion was approved. 3 Page/3 Land Development Escrow Balance in Bank 5/31/18 $ 6, Receipts 0.00 Balance in Bank 6/30/18 $ 6, Mr. Heller then made a motion, second by Mr. Endy, to approve Ordinance Number setting forth the Borough s intent to issue a General Obligation Note, Series 2018, in the maximum principal amount of $3,665, The roll call vote reflected the following Public Utilities - Water, Keith Endy The following Water Supply and Use Report was submitted for the month of June 2018: During the month of June a total of 20,011,000 gallons of water was processed through the water filter plant for an average of 715,000 gallons per day. The totals came from these sources: Trout Run 12,716,000 Ironstone -0- Boyertown Reservoir 7,295,000 Pumping from Trout Run 28 days Pumping from Ironstone 0 days Trout Run is at a level of feet with approximately 321,000,000 gallons of water. Popodickon Reservoir is at a level of 38 feet with approximately 34,600,000 gallons of water. Precipitation in June was 5 inches. Public Utilities Sewer, Keith Endy The following Wastewater Treatment Report was submitted for the month of June 2018: Average Effluent NPDES Maximum Allowed B.O.D mg/ mg/1 Ammonia Nitrogen.1 mg/1 4.8 mg/1 Phosphorus 1.15 mg/1 1.5 mg/1 Suspended Solids 6.3 mg/ mg/1 Fecal Coliform 2/100 mg/1 200/100 mg/l The average daily flow at the Wastewater Treatment Plant during the month of June was 440,000 gallons. Public Works, Barry Christman The following report on the activities of the Street Department personnel during the month of June 2018 was submitted:

4 Page/4 During the month of June street department personnel prepared the Community Park for the annual Fun Days event, repaired a concrete storm sewer pipe in the Town Center Parking Lot, mowed grass, patched potholes, attended a flagger recertification course, and performed routine maintenance on borough buildings, equipment and vehicles. House, Gene Gabel Mr. Endy made a motion, second by Mr. Christman, to authorize the Boyertown Midget Baseball League to file an application for grant funding with the Pottstown Health and Wellness Foundation for improvements to the Mackey Field at the Boyertown Community Park as depicted on the Mackey Field Renovation Plan prepared by Architerra, p.c. dated May 16, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, and Mr. Mr. Endy then made a motion, second by Mr. Heller, to appoint Theresa Heist, 146 West Philadelphia Avenue, to the Municipal Employees Pension Board to complete the unexpired term of Bob Eichert, term to expire January The roll call vote reflected the following Mr. Endy made a motion, second by Mr. Christman, to accept the resignation of Joshua Smith from the Zoning Hearing Board. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, and Mr. Deery. The motion was approved. Public Communication, Lori Carnes No report Park and Recreation Board, Lori Carnes Mrs. Carnes reported that Boyertown Fun Days was well attended and a financial report will be available upon receipt of all outstanding revenues and expenditures related to the event. Planning, Frank Deery Mr. Deery submitted the Code Enforcement Report for the month of June. The report reflected the issuance of twelve UCC Permits, and nine zoning permits. In addition, follow up inspections were performed on numerous Notices of Violation issued for general property maintenance code violations, seventeen new Notices of Violation were issued, and thirteen rental unit inspections were performed. The Miscellaneous Permits Report reflected the issuance of one yard sale permit. Mr. Deery then made a motion, second by Mr. Endy, to approve the Iezzi s Bar Expansion Preliminary/Final Land Development Plan conditioned on the Zoning Hearing Board granting the variance appeal and conditioned upon execution of an Improvements Agreement and Security. Discussion was held on the plan, and Iezzi s owner Mr. Paul Bauer briefly

5 Page/5 reviewed the plan to add a patio dining area and bar at the rear of the property, improve the parking lot, and construct some new sidewalk and curbing. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, and Mr. Police and Public Safety, Terry Mest No Report Police Activities, Mayor Marianne Deery The following Police Activities Report for the month of June was submitted: Calls for Service 299 Traffic Complaints 126 Non-Traffic Complaints 121 Traffic Arrests 69 Non Traffic Arrests 24 The Mayor s activity report for the month of June reflected the Mayor s attendance at meetings of Building a Better Boyertown, attendance at the Carl A. Spaatz Memorial Association Meeting, participation in the dedication of a portion of Route 562 as the Carl A. Spaatz Memorial Highway, attended an Open House for Gateway Ticketing systems, performed a wedding ceremony and administered the Oath of Office to newly appointed Tax Collector Sallie Ann Hess. Building a Better Boyertown, Adrianne Blank Main Street Manager Ms. Blank reported on numerous activities relating to Building a Better Boyertown. She noted that Boyertown is now ranked number 3 among Mainstreet organizations in the state, the Trail Feasibility Steering Committee will meet at the end July, the meeting date will be circulated shortly, Cruise Night is scheduled for July 21 st 4:00 to 9:00 p.m., the Kiosk in the Town Center Parking Lot is scheduled to be installed on July 5 th, Weidner s Meats and Deli is opening at 10 South Reading Avenue, and a Piano Studio is opening at 9 South Washington Street. Ms. Blank also noted that planters have been placed along the curb on East Philadelphia Avenue and Reading Avenue. Solicitor Mr. Deery made a motion, second by Mr. Endy, to authorize advertising Ordinance Number vacating a portion of Pine Street for adoption at the August 6, 2018 meeting of Council. Discussion was held on the motion. Mr. Deery inquired about regaining the vacated portion of the alley if in the future the electric panel box encroaching in the alley is removed. Solicitor Hartman stated that would require an agreement with the property owner. There being no further discussion Mr. Deery called for the vote. The roll call vote reflected the following

6 Page/6 Mr. Deery made a motion, second by Mrs. Carnes, to authorize advertising Ordinance Number , for adoption at the August 6, 2018 meeting of Council, authorizing the Borough of Boyertown and Colebrookdale Township to enter into an Intergovernmental Cooperation Agreement for police Mutual Aid. The roll call vote reflected the following Zoning Appeals Mrs. Loder reviewed with the members three zoning appeal applications which will be heard by the Zoning Hearing Board on July 10 th beginning at 5:30 p.m. The first appeal is filed by Boyertown Oral & Maxillofacial Surgery Properties, LLC. equitable owner of 239 South Reading Avenue. The applicant is seeking a special exception or alternatively a variance to allow a medical/dental office in the General Residential District. Roy M. Bramm, Jr. owner of 219 South Washington Street, is seeking a variance for expansion of a non-conforming structure. The applicant proposes to construct a larger roof overhang which will protrude approximately 9 into the required front yard setback. The property is located in the Light Industrial Zoning District. 61 S Reading Avenue, LLC, owner of 61 S Reading Avenue, is requesting a variance for the number of off-street parking spaces and a variance to permit parking spaces serving a preexisting structure to be reduced in number below the number required by the Ordinance. Applicant proposes to add a new patio dining area and reconfigured parking area to an existing restaurant. The property is located in the Town Center Zoning District. A brief discussion was held on the applications; Council took no action related to the appeals. Public Comments Mr. Deery called for public comment; no comments were forthcoming. There being no public comment and no further business to conduct a motion to adjourn the meeting at 8:00 p.m. was made by Mrs. Carnes and second by Mr. Christman.
