1 BOROUGH OF BOYERTOWN REORGANIZATION AND REGULAR COUNCIL MEETING January 2, 2018 The reorganization meeting of the Boyertown Borough Council was called to order at 7:00 p.m. by Mayor Marianne Deery. Council members present were Frank Deery, Charles Heller, Barry Christman, Lorraine Carnes, Keith Endy, Terry Mest, and Gene Gabel. Also in attendance were Patricia Loder, Borough Manager; and Christopher Hartman, solicitor. All rose for the Pledge of Allegiance. Mayor Deery called for public comment on the agenda; no comments were forthcoming. Mayor Deery then opened nominations for the election of President of Boyertown Borough Council for the two-year term ending the first Monday of January Mr. Gabel nominated Frank Deery. Mr. Christman seconded the nomination. No further nominations were made; the ballot was unanimously approved and Mr. Deery was declared President. Mayor Deery then opened nominations for the election of Vice President of Boyertown Borough Council for the two-year term ending the first Monday of January Mr. Deery nominated Keith Endy. Mr. Heller seconded the nomination. No further nominations were made; the ballot was unanimously approved and Mr. Endy was declared Vice President. Mr. Deery then announced the appointment of members to the following committees of Borough Council: Public Works, Barry Christman, Chairman; Keith Endy and Gene Gabel Public Utilities, Keith Endy, Chairman; Gene Gabel and Barry Christman House, Gene Gabel, Chairman; Barry Christman and Keith Endy Finance, Charles Heller, Chairman, Lori Carnes and Terry Mest Police & Public Safety, Terry Mest, Chairman, Lori Carnes and Charles Heller Public Communication, Lori Carnes, Chairman, Charles Heller and Terry Mest Mr. Deery then made a motion, second by Mr. Gabel, to appoint the following individuals to Boards, Commissions and Offices: Fire Marshal Deputy Fire Marshal Emergency Management Coordinator Deputy Coordinator Park & Recreation Board Employees Pension Board Water Authority Dave Shainline, 1-year term Corey Heimbach, 1-year term John Rambo, 1-year term Jason Wood, 1-year term Tracey Neubauer, 5-year term Ruthann Trate, 5-year term William Schlegel, 4-year term Keith Endy, 5-year term

Mr. Deery then made a motion, second by Mr. Endy, to approve Resolution Number appointing Joshua Smith to a three year term on the Zoning Hearing Board. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery made a motion, second by Mr. Heller, to appoint BB&T Bank and Pennsylvania Local Government Investment Trust as depositories of the Borough funds for the years 2018 and The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery made a motion, second by Mr. Mest, to name the Tax Claim Bureau of the County of Berks as the tax collector of all delinquent real estate taxes in the Borough. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery then made a motion, second by Mr. Gabel, to appoint the law firm of Hartman/Valeriano/Magovern/Lutz, 1100 Berkshire Blvd., Suite 301, Wyomissing, PA, to a twoyear term as solicitor with primary representation provided by Christopher Hartman. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery made a motion, second by Mrs. Carnes, to appoint The Pidcock Company, Incorporated, 2451 Parkwood Drive, Allentown, PA, to a two-year term as engineer with primary representation provided by Ronald Gawlik. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved.

3 Page/3 Mr. Deery then made a motion, second by Mrs. Carnes, to appoint SSM Group, 104 North Park Road, Reading, PA, to a two-year term as engineer for MS4 Permitting and Planning Commission with primary representation provided by Mark Stabolepszy and Kent Morey. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery made a motion, second by Mr. Gabel, to appoint Systems Design Engineering, Inc., 1032 James Drive, Leesport, Pennsylvania, to a two-year term as Zoning Officer and Building Code Official with primary representation provided by Thomas Unger, Matthew Davenport, and Keith Yeager. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery made a motion, second by Mrs. Carnes, to appoint Systems Design Engineering, Inc., 1032 James Drive, Leesport, Pennsylvania, to a two-year term as engineer for street and storm water projects with primary representation provided by Thomas Unger and Craig Momose. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery then made a motion, second by Mr. Christman, to adopt the Rules and Regulations for the conduct of Borough Council and Committee Meetings. The roll call reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Mr. Deery then made a motion, second by Mr. Heller, to approve Resolution Number A setting the fees charged for permits, licenses, and water and sewer rates. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Deery called for a motion to approve the minutes of the December 4 th and 27 th, 2017 meetings of Council. The motion was made by Mr. Endy, second by Mr. Heller, and approved. Finance, Charles Heller Mr. Heller made a motion, second by Mrs. Carnes, to approve the lists of Revenues, Expenditures and Bills for December The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The totals came from these sources: Trout Run 8,076,000 Ironstone 7,128,000 Boyertown Reservoir 1,924,000 Pumping from Trout Run 25 days Pumping from Ironstone 23 days

6 Page/6 Trout Run is at a level of feet with approximately 168,000,000 gallons of water. Popodickon Reservoir is at a level of 35 feet with approximately 27,100,000 gallons of water. Precipitation in December was 2 inches. Public Utilities Sewer, Keith Endy The following Wastewater Treatment Report was submitted for the month of December 2017: Average Effluent NPDES Maximum Allowed B.O.D 2.00 mg/l 20.0 mg/l Ammonia Nitrogen.1 mg/l 4.8 mg/l Phosphorus.71 mg/l 1.5 mg/l Suspended Solids 3.3 mg/l 20.0 mg/l Average Effluent NPDES Maximum Allowed Fecal Coliform 17/100 mg/l 200/100 mg/l The average daily flow at the Wastewater Treatment Plant during the month of December was 300,000 gallons. Public Works, Barry Christman The following report on the activities of the Street Department personnel during the month of December 2017 was submitted: During the month of December 2017 street department personnel completed the curbside leaf collection program, salted streets and borough owned sidewalks in response to three small snowfalls, cleaned catch basins, began leaf clean up at the Community Park, and performed routine maintenance on borough buildings, equipment and vehicles. House, Gene Gabel No Report Public Communications, Lori Carnes Mrs. Carnes made a motion, second by Mr. Mest, to authorize the Council President to execute the Park Use Agreement with the Boyertown Museum of Historic Vehicles for use of the Community Park on September 1, 2018 for the annual Duryea Day event. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The motion was approved. Park and Recreation Board, Lori Carnes No Report

7 Page/7 Planning, Frank Deery The following Code Enforcement Report for the month of December 2017, as provided by Systems Design Engineering, Inc. and the Miscellaneous Permit Report were submitted: SDE issued two UCC Permits and four Zoning Permits during the month of December. The Code Enforcement Officer handled numerous property maintenance code concerns, and inspected twenty three rental units. The Miscellaneous Permit Report reflected the issuance of one street opening permit. Police and Public Safety, Terry Mest Mr. Mest made a motion, second by Mr. Heller, to approve Resolution Number B approving Oktoberfest The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Police Activities, Mayor Marianne Deery The following Police Activities Report for the month of December 2017 was submitted: Calls for Service 272 Traffic Complaints 120 Non-Traffic Complaints 119 Traffic Arrests 81 Non-Traffic Arrests 29 The Mayor s activity report for the month of December reflected attendance at numerous meetings of Building a Better Boyertown, participation in the Holiday Open House Tour, attendance at a public meeting concerning an application before the DEP for expansion of the landfill located in Earl Township which is owned by the Delaware County Solid Waste Authority, and officiated at three weddings. Building a Better Boyertown, Adrianne Blank, Main Street Manager No Report. There being no further business to conduct, a motion to adjourn the meeting at 7:23 p.m. was made by Mrs. Carnes and seconded by Mr. Gabel.
