1 BOROUGH OF BOYERTOWN COUNCIL MEETING February 5, 2018 The regular meeting of the Boyertown Borough Council was called to order at 7:00 p.m. by Council President Frank Deery. Council members present in addition to Mr. Deery were Charles Heller, Lorraine Carnes, Keith Endy, Terry Mest, and Gene Gabel. Council member Barry Christman was absent. Also in attendance were Marianne Deery, Mayor; Christopher Hartman, solicitor; Patricia Loder, Borough Manager; Adrianne Blank, Main Street Manager; Allen Steffy, President Building a Better Boyertown, and a press representative. All rose for the Pledge of Allegiance. Mr. Deery called for public comments on the agenda; no comments were forthcoming. Mr. Deery called for a motion to approve the minutes of the January 2 nd, 2018 meeting of Borough Council. The motion was made by Mr. Gabel, second by Mr. Heller, and approved. Finance, Charles Heller Mr. Heller made a motion, second by Mr. Mest, to approve the lists of Revenues, Expenditures and Bills for January The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. 3 Page/3 Mr. Heller then made a motion, second by Mrs. Carnes, to authorize the Council President to execute the Professional Services Contract with Campbell Thomas & Company in the amount of $70,000 for the Secret Valley Trail Feasibility Study subject to receipt of matching funds required in the amount of $35,000 from Building a Better Boyertown. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Heller made a motion, second by Mr. Gabel, to approve Escrow Release No. 1 in the amount of $230, for the Boyertown Area Senior High School Land Development Project; the remaining Letter of Credit amount after this release should be $29, The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Public Utilities - Water, Keith Endy The following Water Supply and Use Report was submitted for the month of January 2018: During the month of January a total of 22,357,000 gallons of water was processed through the water filter plant for an average of 721,000 gallons per day. The totals came from these sources: Trout Run 9,225,000 Ironstone 7,785,000 Boyertown Reservoir 5,347,000 Pumping from Trout Run 25 days Pumping from Ironstone 23 days Trout Run is at a level of feet with approximately 168,000,000 gallons of water. Popodickon Reservoir is at a level of 35 feet with approximately 27,100,000 gallons of water. Precipitation in January was 2.8 inches. Public Utilities Sewer, Keith Endy 2018: The following Wastewater Treatment Report was submitted for the month of January Average Effluent NPDES Maximum Allowed B.O.D mg/ mg/1 Ammonia Nitrogen.2 mg/1 4.8 mg/1 Phosphorus.84 mg/1 1.5 mg/1 Suspended Solids 6.8 mg/ mg/1 Fecal Coliform 6/100 mg/1 200/100 mg/1 The average daily flow at the Wastewater Treatment Plant during the month of January was 396,000 gallons.

4 Page/4 Public Works, Barry Christman The following report on the activities of the Street Department personnel during the month of January 2018 was submitted: During the month of January street department personnel salted and plowed streets and borough owned sidewalks in response to three small snowfalls, cleaned catch basins, removed the leaf pile at the Community Park, patched potholes, completed curbside Christmas Tree pickup, and performed routine maintenance on borough vehicles, equipment and property. Mr. Endy made a motion, second by Mr. Heller, to authorize Systems Design Engineering, Inc. to advertise for bids for the Second Street Bridge Repair Project. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Endy also made a motion, second by Mr. Carnes, to authorize Systems Design Engineering, Inc. to advertise for bids for the 2018 Street Reconstruction Project. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Endy then made a motion, second by Mr. Mest, to authorize the solicitor to advertise for adoption at the March 5 th meeting of Council Ordinance Number authorizing the Borough to enter into an Intergovernmental Agreement with other municipalities to participate in the Berks County MS4 Steering Committee for the purpose of collaboratively meeting the educational requirements of the MS4 NPDES Permit. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. House, Gene Gabel No report Public Communication, Lori Carnes Mrs. Carnes made a motion, second by Mr. Gabel, to authorize the Council President to execute the Park Use Agreement with Lewis and Clark Circus for use of the Boyertown Community Park on June 18 th, Discussion was held on the motion; Mr. Deery commented that he understands that the Relay for Life may approach the Borough to use the Community Park for the 2018 Relay for Life because of the recent closing of the grandstand at the Boyertown Senior High School. Following discussion, Mrs. Carnes amended her motion to state that execution of the Park Use Agreement with Lewis and Clark Circus is contingent upon there being no conflict with the Boyertown Relay for Life 2018 event. The motion was seconded by Mr. Gabel. The roll call vote on the amendment to the motion reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved.

Mrs. Carnes then made a motion, second by Mr. Mest, to appoint Deborah Bertolet to the Park and Recreation Board to complete the unexpired term of Nicole Bohner, term to expire The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Park and Recreation Board, Lori Carnes The Park and Recreation Board is working on the Sensational Summer Sponsorship mailing and the Earthfest event. Planning, Frank Deery Mr. Deery submitted the Code Enforcement Report for the month of January. The report reflected the issuance of three UCC Permits. In addition, follow up inspections were performed on numerous Notices of Violation issued for general property maintenance code violations. Numerous new violation notices were issued for failure to remove snow and ice from the public sidewalk, and nineteen rental unit inspections were performed. The Miscellaneous Permits Report reflected the issuance of one soliciting permit. Police and Public Safety, Terry Mest Mr. Mest made a motion, second by Mrs. Carnes, to authorize Meister/Cox Architects to advertise for bids for renovation of 16 West Philadelphia Avenue for relocation of the Boyertown Police Department. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Mest then made a motion, second by Mr. Heller, to authorize the Chief of Police to notify the Pennsylvania Department of Transportation of the Borough s intent to close East Philadelphia Avenue between Chestnut Street and Washington Street on April 21, 2018 between the hours of 10:00 a.m. and 3:00 p.m. for the Building a Better Boyertown Coming Out of Hibernation Event. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Mr. Mest also made a motion, second by Mr. Endy, to authorize a 5K Run to be held in conjunction with Building a Better Boyertown s Oktoberfest Event on Saturday, September 15 th at 9:00 a.m. in accordance with the course map provided to the Borough, conditioned upon participants signing an acknowledgment that the course is to be run on the public sidewalk, and subject to receipt of a certificate of liability insurance naming the Borough of Boyertown additional insured. The roll call vote reflected the following members voting yes : Mr. Heller, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved.

6 Page/6 Police Activities, Mayor Marianne Deery The following Police Activities Report for the month of January 2018 was submitted: Calls for Service 274 Traffic Complaints 128 Non-Traffic Complaints 92 Traffic Arrests 98 Non Traffic Arrests 39 The Mayor s activity report for the month of January reflected the Mayor s attendance at meetings of Building a Better Boyertown, the Holiday Open House Committee, Carl A. Spaatz Memorial Association Board Meeting, Regional Police Committee Meeting, and attendance at a workshop hosted by PA Downtown Center. In addition, Mayor Deery spoke at Chestnut Knoll s recognition celebration, hosted a luncheon for State Representative David Maloney, and attended a meeting of the Berks County Commissioners to discuss expansion of the Rolling Hills Landfill. Mayor Deery also officiated a wedding on January 27 th. Building a Better Boyertown, Adrianne Blank Main Street Manager Ms. Blank reported that the first meeting with the consultant concerning the Trail Feasibility Study was held on Friday, February 2 nd. The Tourism Committee Meeting will be held at Dancing Tree, 220 South Reading Avenue, on February 12 th. The BBB annual Board of Directors meeting will be held on March 27 th, and a new business opened at 31 East Philadelphia Avenue, Opal Rose Artisanal Wellness. Public Comments There being no further business to conduct a motion to adjourn the meeting at 7:30 p.m. was made by Mrs. Carnes and second by Mr. Mest.
