1 BOROUGH OF WYOMISSING COUNCIL MINUTES MARCH 13, :00 P.M. Wyomissing Borough Council held its regular monthly meeting at the Borough Hall on the above date. Council President Thomas M. Moll called the meeting to order at 7:00 p.m. with the following persons present: Council Members Thomas M. Bausher, D. Michael Forester, John C. Woodward, Stephen D. Brunner, Gregory L. Portner, and William S. Jenckes; Mayor Frederick C. Levering, Treasurer Paul W. Brass, Solicitor Christopher J. Hartman, Consulting Engineer James C. McCarthy, Police Chief Jeffrey R. Biehl, Public Works Director James V. Babb and Borough Manager/Secretary Marti Hozey. CALL TO ORDER: Council President Moll announced that Council had met in executive session before the Council meeting to discuss contractual matters. PLEDGE OF ALLEGIANCE: ROLL CALL: VISITORS: Michele Bare, Borough Zoning/Codes Officer and Asst. to the Manager Barbara Reeser, Deputy Tax Collector Pat Brandenburg, Fire Commissioner Rob Lewis, Borough Parks & Recreation Director Keith Dmochowski, Reading Eagle PUBLIC COMMENTS: Borough Treasurer Paul Brass commented that Executive Sessions should end before 7:00 p.m. RECEIPT OF REPORTS: On motion duly made, seconded and passed, Council received all reports submitted for consideration. COUNCIL MINUTES: On motion duly made, seconded and passed, Council approved the minutes of the regular meeting of February 13, CONSULTING ENGINEER S REPORT: On motion duly made, seconded and passed, Council accepted the Consulting Engineers report dated February 7, Consulting Engineer James McCarthy updated Council that the 2018 Streets Improvement Project bid results came in well under the projected amount. POLICE CHIEF & MAYOR S REPORT: On motion duly made, seconded and passed, Council approved the Police Chief & Mayor s report of March 1, Police Chief Biehl congratulated Police Officer Scott Schaeffer on receiving an Aggressive Driving Enforcement Award from PennDOT for the second year in a row. 1
2 FIRE DEPARTMENT REPORT: On motion duly made, seconded and passed, Council approved the Fire Dept. report for February Fire Commissioner Brandenburg was present and went over the highlights of the monthly report for February of PERSONNEL COMMITTEE REPORT: On motion duly made, seconded and passed, Council approved the Personnel Committee report of February 20, Councilmember Bausher reported on the meeting. He mentioned that Borough Zoning/Codes Officer Michele Bare has been asked to be on the PABCO Board of Directors and the Personnel Committee has endorsed this request. INFRASTRUCTURE COMMITTEE REPORTS: On motion duly made, seconded and passed, Council approved the Infrastructure Committee report of February 20, Councilmember Bausher reported on the meeting. The Infrastructure Committee discussed three properties in the Borough that require further property maintenance enforcement action. Councilmember Bausher made a motion, seconded by Councilmember Woodward, to recommend that Council authorize the bidding process for the 2018 water main replacement project, all in favor, 7-0. Councilmember Bausher made a motion, seconded by Councilmember Forester, to recommend that Council authorize the bidding process for the 2018 televising and sewer repair project, all in favor, 7-0. Councilmember Bausher made a motion, seconded by Councilmember Brunner, to approve splitting the cost 50/50 with the Wyomissing School District to install pickle ball lines at two of the school district tennis courts, and to amend the agreement with the district so that they are responsible for maintenance of their courts and the Borough will be responsible for the Stone House Courts, all in favor, roll call vote, 7-0. RECREATON BOARD REPORT: On motion duly made, seconded and passed, Council approved the Recreation Board report of February 20, Councilmember Brunner reported on the meeting. Jodi Bukowski has decided that she cannot fill the position of alternate member of the Rec Board. The Board is now recommending Angela Duen to fill the second alternate position. Councilmember Brunner mentioned that residents have until May 27, 2018 to register their children for the playground. After that date a $30 late fee will be incurred. REFUSE AND RECYLING COMMITTEE REPORT: On motion duly made, seconded and passed, Council approved the Refuse & Recycling Committee report of February 21, Councilmember Forester reported on the meeting. The Committee reviewed the refuse and recycling reports from 2017 and noted that all the numbers look normal. The Committee discussed the concern that Advanced Disposal, the new trash hauler, has with picking up trash in the alleys, particularly if 2
3 they are icy. Marti Hozey and Jim Babb will make a decision on alley pickup during weather events and then discuss this with Advanced Disposal. ECONOMIC DEVELOPMENT COMMITTEE REPORT: On motion duly made, seconded and passed, Council approved the Economic Development Committee report of February 22, Councilmember Woodward reported on the meeting. He said that he has four businesses who will sponsor the Business Meet and Greet that has been scheduled for April 26, 2018 at 5 p.m. at the Courtyard by Marriott. Councilmember Woodward is working on the agenda. FIRE & POLICE COMMITTEE REPORT: On motion duly made, seconded and passed, Council approved the Fire & Police Committee reports of February 26, 2018 and March 9, Councilmember Forester reported on the meetings. The Committee discussed amendments to the current ordinance which addresses the regulations of firework displays and consumer fireworks. The revised ordinance will be brought back to the F&P Committee for further discussion at their next meeting. There was also discussion at both meetings regarding the purchase of a new fire apparatus. LIBRARY BOARD REPORT: On motion duly made, seconded and passed, Council approved the Library Board report of February 26, Council President Moll reported on this meeting, which he had attended. He also reported on a meeting that took place on February 9, 2018 with Alan Rosenberg from Restore Core, the company that replaced the library s roof after the hail damage of The group discussed a punch list of items that needed to be fixed at the library because of water damage. Muthard Roofing is doing the repairs. There will also be a meeting on Tuesday March 20, 2018 to discuss the Borough s possible purchase of the library building. PLANNING COMMISSION REPORT: On motion duly made, seconded and passed, Council approved the Planning Commission report of March 5, Councilmember Woodward reported on this meeting. Preliminary/Final Subdivision Plan 2029 Regency Drive Mr. Thomas Ludgate of Ludgate Engineering, presented a plan to subdivide the lot at 2029 Regency Drive. The existing 34,995 s.f. lot at the corner of Greenbriar Court and Regency Drive would be reduced to 21,230 s.f., by the creation of Lot 2 which will measure 13,763 s.f. The proposed Lot 2 was part of the Spruce Lane Plan of Lots that was approved in The recorded plan was revised in 1990 to annex the now proposed Lot 2 with Lot 1. 3
4 Councilmember Woodward made a motion, seconded by Councilmember Forester, for Council grant a waiver from Section 303 and of the Subdivision and Land Development Ordinance, all in favor, 7-0. Councilmember Woodward made a motion, seconded by Councilmember Portner, for Council to grant conditional final plan approval for the Preliminary/Final Subdivision Plan for 2029 Regency Drive, subject to all items in McCarthy Engineering s review letter dated March 2, 2018, being addressed, all in favor, 7-0. Councilmember Woodward made a motion, seconded by Councilmember Jenckes, for Council to reaffirm the previously granted approval of the addition to The Highlands at Wyomissing s Final plan, subject to all items in the McCarthy review letter, all in favor, 7-0. Councilmember Woodward made a motion, seconded by Councilmember Jenckes, for Council to reaffirm the previously granted approval of the Hall s N. Wyomissing Blvd Annexation and Land Development Plan, The Vanity Fair Land Development Plan and the Wawa Land Development Plan, all in favor, 7-0. Councilmember Woodward also mentioned the webinar that several Planning Commission and Council members and staff watched called The Benefits of an Effective Planning Commission. The webinar was provided by the Pennsylvania State Association of Boroughs. The webinar was informative and also mentioned that an annual report of the Planning Commission should be done each year. Michele Bare prepared an annual report for 2107 and distributed it. FINANCE AND ADMINISTRATION COMMITTEE REPORT: On motion duly made, seconded and passed, Council approved the Finance & Administration Committee report of March 13, Councilmember Portner reported on the meeting. The Committee met earlier today. Nick Bieber from Herbein was present to review the 2017 financial audit with the Committee. He said that the audit report gives a clean opinion which is the highest level Councilmember Portner made a motion, seconded by Councilmember Forester, to authorize the signing of the audit representation letter to Herbein by the Council President and Borough Manager, all in favor, 7-0. Councilmember Portner made a motion, seconded by Councilmember Woodward, to continue the process to purchase an E-1 single axle Quint, after Borough Staff and the Borough Solicitor have negotiated and approved the best lease options available for this purchase, all in favor, roll call, 7-0. BOROUGH MANAGER S REPORT: On motion duly made, seconded and passed, Council approved the Borough Manager s report of March 7, Borough Manager Marti Hozey said that the pension Act 2015 Valuation reports were submitted to the Auditor General in late February. She reminded Council that Resolution was added to the Council Agenda. 4
5 TREASURER S STATEMENT OF OPERATION: On motion duly made, seconded and passed, Council approved the Treasurer s Statement of Operation and all financial statements. ACCOUNTS PAYABLE REPORT: On motion duly made, seconded and passed, Council approved the Accounts Payable Report outlining the following invoices paid: General Fund $ 334, Water Fund 82, Sewer Fund 119, Refuse Fund 55, Liquid Fuels Fund 51, Total of all Funds $ 644, TAX COLLECTOR S REPORT: On motion duly made, seconded and passed, Council approved the Tax Collector s report for the month of February ORDINANCE NO : PENNSYLVANIA, TO AMEND THE CODE OF ORDINANCES OF THE BOROUGH OF WYOMISSING, CHAPTER 15 MOTOR VEHICLES AND TRAFFIC, PART 8 LARGE VEHICLE PARKING TO APPLY THE LARGE VEHICLE PARKING REGULATIONS IN THE C-1 NEIGHBORHOOD COMMERCIAL ZONING DISTRICT. Councilmember Woodward made a motion, seconded by Councilmember Forester, to adopt Ordinance # , all in favor, 7-0. ORDINANCE NO : PENNSYLVANIA, AMENDING CHAPTER 15, MOTOR VEHICLES AND TRAFFIC BY AMENDING PART 4 GENERAL PARKING REGULATIONS, SECTION 401 PARKING PROHIBITED AT ALL TIMES IN CERTAIN LOCATIONS TO ADD LOCATIONS WHERE PARKING IS PROHIBITED, AND SECTION 403 PARKING TIME LIMITED IN CERTAIN LOCATIONS, CERTAIN DAYS AND HOURS, TO AMEND THE PARKING REGULATION FOR THE NORTH SIDE OF THE 800 BLOCK OF PENN AVENUE. Councilmember Jenckes made a motion, seconded by Councilmember Bausher, to adopt Ordinance # , all in favor,
6 ORDINANCE NO : PENNSYLVANIA, TO AMEND THE CODE OF THE BOROUGH OF WYOMISSING, CHAPTER 1 ENTITLED ADMINISTRATION AND GOVERNMENT, PART 20 ENTITLED INTERGOVERNMENTAL COOPERATION AGREEMENT TO PARTICIPATE WITH OTHER BERKS COUNTY MUNICIPALITIES IN THE BERKS COUNTY MS4 STEERING COMMITTEE, BY FULLY AMENDING AND RESTATING SUCH PART 20, TO ENTER INTO A NEW INTERGOVERNMENTAL COOPERATION AGREEMENT WITH OTHER MUNICIPALITIES, TO PARTICIPATE IN THE BERKS COUNTY MS4 STEERING COMMITTEE FOR THE PURPOSE OF COLLABORATIVELY MEETING THE EDUCATIONAL REQUIREMENTS OF THE MS4 NPDES PERMIT. Councilmember Woodward made a motion, seconded by Councilmember Brunner, to adopt Ordinance # , all in favor, 7-0. ORDINANCE NO : PENNSYLVANIA, TO AMEND THE CODE OF ORDINANCES OF THE BOROUGH OF WYOMISSING, CHAPTER 1 ADMINISTRATION AND GOVERNMENT, PART 1 APPOINTED OFFICIALS TO AMEND PROVISIONS RELATING TO THE BOROUGH MANAGER S POWERS AND DUTIES, AND BOROUGH MANAGER S ABSENCE. Councilmember Bausher made a motion, seconded by Councilmember Jenckes, to adopt Ordinance # , all in favor, 7-0. RESOLUTION NO : A RESOLUTION OF THE COUNCIL OF THE BOROUGH OF WYOMISSING, BERKS COUNTY, PENNSYLVANIA AUTHORIZING AN AGREEMENT BETWEEN THE COMMONWEALTH OF PENNSYLVANIA, DEPARTMENT OF TRANSPORTATION, AND THE BOROUGH OF WYOMISSING FOR THE BOROUGH TO PROVIDE CERTAIN ROUTINE MAINTENANCE INCLUDING GRASS AND WEED MOWING ON CERTAIN STATE HIGHWAYS LOCATED IN THE BOROUGH OF WYOMISSING.
