(610) Website: springtwpberks.org MEETING MINUTES AUGUST 13, 2018 OPENING OF MEETING: The regular summer monthly meeting of the was called to order by Vice-Chairman Myer, at 7:00 p.m., on Monday, August 13, 2018, in the Public Meeting Room of the Township of Spring Administration Building, located at 2850 Windmill Road, Spring Township, Berks County, Pennsylvania. Upon roll call, Supervisors Oswald (on the telephone from North Carolina), Myer, Stuck and Ulrich were present. Ms. Smith did not attend. Also present were: Daniel Becker, Esq., Jay Vaughan, Jim Moll, Judy Houck, John Groller, Bryan Ross, Aaron Wozniak, Sheryl Rowan, Chris Morgan (PennDOT), Matt McGough (BCPC), Colin Hackman, Kim Berry, Alan Kreider, Al Moatz, Pat Brandenburg, Fred Levering, Alan Piper, Darryl Dunkelberger, Diane Dunkelberger, Dean Black, Chuck Frantz, Kevin Cramsey, Scott Sweigart, Allan Eberly, Theresa Eberly and Geneva Aulenbach, of the Reading Eagle. OPEN TO THE FLOOR: Darryl Dunkelberger, 95 Gelsinger Road: Mr. Dunkelberger reported there have been serious flooding issues on Gelsinger Road for years. Mr. Vaughan is aware that the shoulders need to be graded in that area. He agreed to meet with Mr. Dunkelberger and report back to the Board at the next meeting. Mr. Dunkelberger was, also, concerned about motorists speeding up the hill. Chief Ross will investigate. Dean Black, 110 Gelsinger Road: Storm water has been flowing forcefully over the grate at the end of his driveway, into the driveway and into his basement for 21 years. Mr. Black is extremely worried about his house flooding since he has no flood insurance, and he is missing work. Mr. Vaughan will address this issue, as well. Kevin Cramsey, Spring Township Library Association: Mr. Cramsey reported the modernization project at the Spring Township Library will officially proceed on Monday, September 20, 2018; the library will be closed that day. Hours for the duration of the project will be 1:00 to 8:00 p.m., and Fridays1:00 p.m. to 4:00 p.m. The summer reading program is going very well and staff members at both libraries are doing a professional job. SR 222 Project Presentation: Chris Morgan, engineering consultant for PennDOT, provided a brief presentation and diagrams regarding improvements to SR 222 between Broadcasting Road and Berkshire Boulevard. 1

2 Basically, they are connecting the interchanges between Broadcasting Road and Berkshire Boulevard, adding a third lane between the two interchanges and a ten-foot wide shoulder for safety. Construction will take approximately three months, beginning in spring of Suburban Berks West Joint Comprehensive Plan Presentation: Matthew McGough, Berks County Planning Commission, explained this update is required by the Pennsylvania Municipalities Planning Code and has not been updated for more than 15 years. There have been changes in the vision for the area with the addition of new businesses, transportation projects and BOSS The plan must be approved by Spring Township, Wyomissing Borough, Sinking Spring Borough and West Reading, following a public hearing. MINUTES: A motion was made by Mr. Stuck, second by Mr. Ulrich, approving the meeting Minutes of July 9, TOWNSHIP MANAGER: Business Office: Bills for Approval: A motion was made by Mr. Stuck, second by Mr. Ulrich, approving payment of bills, as listed by the Township Treasurer: General Fund - $168, Refuse Tax Fund - $103, Sewer District #3 Fund $99, Fire Protection Fund - $29, Capital Fund - $8, ZONING/BUILDING CODES DEPARTMENT: Public Gathering Permit Shocktoberfest: A motion was made by Mr. Stuck, second by Mr. Ulrich, approving a public gathering permit for Shocktoberfest; weekends starting September 8, 2018, and every evening through October. Monthly Report: Mr. Wozniak submitted the July, 2018 report to the Board. Listed in the report: 79 permits issued, value of construction added to the Township $720,000.00, and 44 pre-settlement inspections were performed. PARKS, RECREATION AND PUBLIC WORKS: Award Seasonal Requirements: As recommended by the Manger/Director of Public Works, a motion was made by Mr. Ulrich, second by Mr. Stuck, to award the following: 1. WWTP Chemicals USALCO 250,000 lbs. - $ = $40, Bituminous Material South Reading Blacktop Plant - $55, Fuel Products Petroleum Traders - $237, Aggregate Material- New Enterprise Stone and Lime Co. - $13, Sewer Cleaning and Televising Wyomissing Contract: As recommended by the Infrastructure Committee, a motion was made by Mr. Stuck, second by Mr. Ulrich, granting approval for the Township to piggyback on the Borough of Wyomissing Sanitary Sewer Rehabilitation and Televising Contract to clean and televise the sewer lines in the West Lawn area of the Township as part of this contract. The cost to the Township for 27,250 feet of sewer line will be $83, Recruitment for Public Works Employee: A motion was made by Mr. Stuck, second by Mr. Ulrich, authorizing the Manager/Director of Public Works to begin the recruitment process for a Public Works employee, due to 2

3 the intent of an employee to retire at the end of the year. Upon roll call, all Supervisors present voted affirmatively. HRG Proposal for Township Roads: A motion was made by Mr. Ulrich, second by Mr. Stuck, authorizing the appropriate Township official to sign a proposal from HRG (Herbert, Rowland and Grubic, Harrisburg, PA) to prepare a pavement management plan for the Township, at a cost of $82,700.00, contingent upon review of the proposal by the Solicitor. HRG intends to collect data for the remainder of 2018 for use in Municipal Engineering Proposals: A motion was made by Mr. Ulrich, second by Mr. Stuck, appointing Great Valley Consultants as Municipal Engineer, with the expectation that GVC and HRG will work together on future roadwork specifications and bidding. Winter Maintenance of Municipal Properties Contract: Two contractors submitted bids, which were determined to be incomplete. Therefore, a motion was made by Mr. Stuck, second by Mr. Ulrich, rejecting all bids and authorizing the Director to re-bid the contract immediately. Upon roll call, all Supervisors present voted affirmatively. Fuel Management and Dispensing System Purchase Order: A motion was made by Mr. Oswald, second by Mr. Ulrich, approving Purchase Order #PR , to Hafer Equipment, for a new Gilbarco Veeder- Root/Gasboy fuel management and dispensing system, in the amount of $24, Upon roll call, all Supervisors present voted affirmatively. (2018 Budget) Fuel Management and Dispensing System Installation Authorization to Bid: A motion was made by Mr. Ulrich, second by Mr. Stuck, authorizing the Director to advertise, accept and open bids for installation of the above Fuel Management and Dispensing System. (2018 Budget) ADA Path Project Cornwall Terrace and LenOak Parks: As recommended by the Parks & Recreation Board, a motion was made by Mr. Ulrich, second by Mr. Stuck, to apply the remaining $25, from the pavilion roof projects at Breneman and Drexelwood Parks toward completion of the ADA accessible paths at LenOak Park. Construction of the paths at Cornwall Terrace will be deferred until Upon roll call, all Supervisors present voted affirmatively. Monthly Report: Ms. Houck submitted the written P&R July, 2018 monthly report to the Board. During the meeting, she shared photographs of flood damage to fields and parks and flooding at Cacoosing Meadows Park, as well as, the renovated basketball courts at Red Caboose Park. ENGINEERING/PLANNING DEPARTMENT: Comprehensive Plan Update Schedule Hearing: A motion was made by Mr. Ulrich, second by Mr. Stuck, authorizing advertisement of the required public hearing for adoption of the Joint Comprehensive Plan update as September 10, 2018, at 7:15 p.m. Achenbach Annexation Final Plans: As recommended by the Planning Commission, a motion was made by Mr. Stuck, second by Mr. Ulrich, approving the Achenbach Annexation final plans, contingent on the applicant paying any outstanding Township invoices. Reading Dermatology Land Development Plans: As recommended by the Planning Commission, a motion was made by Mr. Stuck, second by Mr. Ulrich, approving the Reading Dermatology land development plans, subject to the applicant obtaining signatures of the Planning Commission on the plan, and with the following conditions: 3

4 Construction details of the wall should be provided prior to the issuance of the building permit; a structural design of the wall may be necessary, Section 603(P). The applicant will be required to prepare and execute an Operations and Maintenance Agreement with the Township. The applicant will be required to contribute to the Township s Stormwater Control and BMP Operation and Maintenance Fund. All outstanding issues cited under the Public Safety Review must be addressed prior to the issuance of an occupancy permit. Mavis Discount Tire Waivers: As recommended by the Planning Commission, a motion was made by Mr. Ulrich, second by Mr. Stuck, granting the following waivers: a) Waiver of the requirement to submit Preliminary Plans, Part 5. b) Waiver to allow a plan scale of 1 = 30, Section 503)(C)(B)(2). c) Waiver of the 15-inch minimum storm sewer pipe diameter to allow an 8-inch diameter pipe to convey roof drainage, Section 1007(F)(2)(C) and Stormwater Management Ordinance Section 310(C)(6)(D). Sunoco Pipeline Butane to Pentane Conversion Waivers: As recommended by the Planning Commission, a motion was made by Mr. Oswald, second by Mr. Ulrich, granting the following waivers: a) Waiver to allow a single-stage review procedure, Section 302. b) Waiver of requirement to have a registered surveyor perform a property survey, Section 503(C)(C)(6). Stormwater Agreements: A motion was made by Mr. Stuck, second by Mr. Ulrich, authorizing the appropriate Township official to execute the stormwater agreements for the following projects: 419 Calco Avenue, 1126 Old Fritztown Road, 183 Gelsinger Road Emergency Repair Contract Authorization: A motion was made by Mr. Stuck, second by Mr. Ulrich, authorizing the Director to advertise, receive and publicly open bids for the Emergency and Routine Maintenance, Repairs and Replacement Contract. The Borough of Wyomissing has requested to be included in the bid documents. Reserve at Grings Mill - Land Development Plans: Pedestrian Connection Waivers/Walking Trail: The Reserve at Grings Mill consists of 210 garden apartments, originally proposed as student housing, along Tulpehocken Road. Garden Apartments are permitted in the POB zoning district, only if they are located on college-adjacent properties. The Subdivision and Land Development Ordinance (SALDO) requires that the development include pedestrian connections to the adjacent college campus. However, the applicant has been unable to obtain approval from Penn State for said connections, and has requested waivers of the pedestrian connection requirements of Sections 503(O)(17) and 1013(C)(2) of the SALDO. The Planning Commission has recommended that the Board of Supervisors grant the requested waivers contingent upon the following: The applicant being responsible for construction and maintenance of a proposed walking trail from the development to the red Covered Bridge. Review of an agreement covering such trail by Township Solicitor and Engineer. Posting of escrow to cover construction of the proposed walking trail. 4

5 In a publicly-read statement (attached to these Minutes), and by presentation during the meeting, Vice- Chairman Myer strongly recommended that the Township negotiate with Penn State to help build a trail connecting the Township trail system through the Penn State campus to the red Covered Bridge. A motion was made by Mr. Stuck, second by Mr. Ulrich, granting the requested waivers, contingent upon the following: The applicant shall be required to provide funds in an amount sufficient to cover the construction of a trail from the proposed apartment development to the covered bridge. The costs shall be based upon a 10-foot wide trail located on the opposite side of the existing tree row from Tulpehocken Road. The Township shall negotiate with Penn State University (PSU) to create a trail system leading from the existing Township system on the eastern end of the PSU property, through the college campus, to the proposed development and the covered bridge along Tulpehocken Road. Sanitary Sewers/Planning Module Resolution # /WQM Permit Application: As recommended by the Infrastructure Committee, a motion was made by Mr. Oswald, second by Mr. Stuck, (1) approving that the proposed pump station and force main are to be dedicated to the Township; (2) authorizing preparation of an operations and maintenance agreement assigning financial responsibility to the developer; (3) readopting a revised Resolution for the PA DEP Planning Modules; and (4) authorizing the Township Manager to sign the Water Quality Management Permit application for submission to PA DEP. Upon roll call, all Supervisors present voted affirmatively. PUBLIC SAFETY: Police Department: Monthly Report: Chief Ross reported 57 incidents were investigated during the month of June, There were 96 traffic incidents, 36 arrests and the Department answered 833 service calls. Road Closure Block Party: A motion was made by Mr. Ulrich, second by Mr. Stuck, approving a road closure on Marcor Drive for a block party on September 1, 2018, between 5:00 p.m. and 11:00 p.m. Upon roll call, all Supervisors present voted affirmatively. Citizens Police Academy: Applications are being accepted until September 7, Township of Spring Fire Rescue Service: Monthly Report: During the month of July, 2018, Chief Hackman reported 229 responses, consisting of 98 medical calls and 131 fire calls. The TSFRS gave mutual aid 44 times and received mutual aid 56 times. The department completed 65 fire safety inspections. NEW BUSINESS: Berks County Hazard Vulnerability Assessment and Mitigation Plan: A motion was made by Mr. Stuck, second by Mr. Ulrich, adopting Resolution # adopting the Hazard Vulnerability Assessment and Mitigation Plan Update for the Township of Spring. ANNOUNCEMENTS: 1. An Executive Session was held prior to the meeting on matters of personnel. 2. Mr. Vaughan announced the 2018 roadwork has started and stopped due to rain. Heister Boulevard is next on the schedule. 5
