1 17 The Supervisors Monthly Meeting was held in the Municipal Building with Supervisors Tony L. Brubaker, David L. Staaby and Roy H. Zartman. Atty. Jason Ulrich, Engineer Michael S. Keffer and 13 persons were also present. The meeting was called to order at 7:03 p.m. by the Chairman Tony L. Brubaker. The minutes of the previous meeting were distributed to the Supervisors prior to the meeting. A motion was made by David L. Staaby, seconded by Roy R. Zartman, to approve the April 26, 2012 minutes. On a roll call vote, motion unanimously carried. A motion was made by David L. Staaby, seconded by Roy R. Zartman, to pay the May bills. On a roll call vote, motion unanimously carried. 4 20 Public comment - Kelly Cox - Richland Rd. - asked if properties that have not been mowed have been contacted. The properties discussed last month have been taken care of, and two properties on Main Street were contacted yesterday. One of the properties was being mowed as the Zoning Officer was coming to the meeting. Another property was given; he will contact them. We received the PSATS Alert. The bids have been received for the 2012 Road Project. There are two bid packets. The first is to widen Scharff Rd. using township funds with several options. The second is to widen, resurface and line paint the lower section of Scharff Rd. using Community Development funds. Zartman, seconded by David L. Staaby, to approve and accept the bid of $26, from Burkholder Paving and sign the contract for the 2012 Road Project. On a roll call vote, motion unanimously carried. Last month we received a letter and Promissory Agreement to be executed between the County and the township for the Emergency Services Radio System. The Board had questions about the agreement. Secretary Lisa A. Brubaker contacted the county and was told not to do anything with the agreement as it is going to be revised again. We received a letter stating there is a solicitors meeting on June 5, 2012 to discuss the Promissory Note and other issues related to the project. The township solicitor will attend. The FEMA ordinance has been advertized for adoption. A motion was made by David L. Staaby, seconded by Roy H. Zartman,to approve and adopt the FEMA Ordinance On a roll call vote, motion unanimously carried. Last month we received a request from Dutch Valley Food Distributors for a reduction to the Letter of Credit they have for their project. The reduction was granted. A revised Letter of Credit had been received. The Township Solicitor had prepared a new Improvements Agreement. The Board approved the document and it was sent to Dutch Valley for execution. The executed documents have been received.

7 23 Thursday, May 31,2012 We received the first mowing cycle notice for the State Roads. The mowing must be completed between June 1-30,2012. The Road Master will contact Tulpehocken Township to schedule the mowing together. The Dumpster Exemptions need to be discussed. According to the 2011 list, several property owners have not submitted the exemption form. The office would like to send a Final Notice Letter to these owners. A motion was made by Roy H. Zartman, seconded by David L. Staaby, to authorize the township office to send a Final Notice Letter with a Dumpster Exemption Form giving a deadline of June 15,2012. On a roll call vote, motion unanimously carried. The Zimmerman Sketch Plan needs an extension of time. They are requesting 90 days which is one day short of the August meeting. The Planning Commission is recommending the Board grant a 92 day extension. A motion was made by David L. Staaby, seconded by Roy H. Zartman, to grant a 92 day extension of time to the Zimmerman Sketch Plan. On a roll call vote, motion unanimously carried. The MS-4 Annual Report has been completed. A motion was made by David L. Staaby, seconded by Roy H. Zartman, to approve the MS-4 Annual Report and authorize the Township Engineer to notarize and submit the report on behalf of the township. On a roll call vote, motion unanimously carried. We received a letter from South Heidelberg Township regarding the Community Shredding Event. The tentative date is Saturday, September 15,2012. They would like to know if the township is interested in participating again this year. A motion was made by Tony L. Brubaker, seconded by David L. Staaby, to authorize the participation in the Community Shredding Event. On a roll call vote, motion unanimously carried. The Township Treasurer has several items to discuss with the Board. The History Group will have the rooms opened on Saturday, June 2, 2012 during the community yard sale. There was an article in the Early American Life magazine on the property of Roy Zartman. There was a walking tour a few weeks ago and there is a barn tour through the Agricultural Coordinator Sheila Miller's office scheduled in June. The web page is working and there are some items she would like to add to the site. The Board agreed to add items to the web page. Any community events must be submitted 30 days in advance for review and approval of the Board before it is placed on the web page. She would like to apply for a grant for signs. The township had applied for this grant before for the guard rail along William Penn Blvd. The township did not get the grant for that project, but signs are another item that can be applied for. She may need some help from the computer support company the township uses. Supervisor David L. Staaby asked if the township could apply for radar speed detectors for each end of Main Street, this maybe an item to look into along with the application. A motion was made by David L. Staaby, seconded by Roy H. Zartman, to authorize Treasurer to submit the grant application and allow the use of the computer support company if needed for the submission. On a roll call vote, motion unanimously carried. A playground grant was discussed before and she would like to know if the Board would like to proceed. She would like to meet with a representative from the Bureau of Recreation to review an

8 24 application. The Board agrees she can meet with him but they cannot commit until more information is received due to the unknown of the sewer project. The township funds could be needed for that project first. Chairman Tony L. Brubaker stated the fire company asked why the newsletter was reduced and did not include them. He explained to them it was for cost and that next year it will be on the web page and not mailed. They expressed that many of them and elder residents do not have computers and they would like it still mailed. The Board will review that at the time of the next newsletter. We received information from PSA TS regarding the Pennsylvania Public Utility Commission. The township office will contact PSATS for more information. We received information from the Berks Municipal Partnership regarding a communication task force. The partnership will be establishing a commission to assist with the implementation of the new radio system. They are asking the township to identify any officials who would be interested in serving on the commission. We received the Berks County Public Works Association meeting information. The meeting is being held Thursday, July 19,2012 at the Oley Fairgrounds. Let the office know if anyone will be attending to make the reservation. The Act 537 Plan needs to be discussed. The Planning Commission members are reviewing the plan. They met with PennDot on April 27, 2012 at 1:30 p.m. to discuss the placement of sewer along Route 422. The open trench scenario was discussed. The position of the trench, as long as an open trench is more than 5 feet from the edge of the payment Penn Dot does not have any critical requirements for backfill and placement. Inside of the 5 feet distance, backfill would require all stone and around the utility poles. The intersection issue regarding the ADA Handicap Accessibility was discussed. If there is no existing pedestrian path, they do not look for intersection improvements. A bored installation is not going to disturb the intersections. Open cuts could require improvements. The culverts are Penn Dot's. If any modifications or damage occur, they would become the townships. Penn Dot does not have an automatic turnover of culverts just because there is a sewer project. Crossings would be bored and casing pipe would be placed. Traffic control was discussed. There are companies that specialize in this and can be bid separately from the sewer bid or as part of the bid. The Penn Dot permit that is issued is the townships. It is the townships permit, township sewer line, the townships lateral under the highway, and anything that is constructed or easements in the right-away is the townships. Outside of the right-a-way, the township ordinance can make it the property owner's responsibility. Penn Dot does not require one type of system over another or which contractor, when they can start or when they can work. That is the townships decision. The Ordinance verbiage is what is being reviewed by the Commission currently and there are some questions on what the Board wants. After discussion, the Township Engineer will add wording for the Boards review. They are requesting more time to review the ordinance for the plan. The Board agreed to give the Planninz Commission a" much time a" thev need for review.

9 .: 25 Supervisor Roy H. Zartman stated an engineer from the County contacted him regarding guard rail and maintenance work for the Hickory Road Bridge. He will be meeting with him for more information. He stated the work completed on Forge Road looked great and commended the workers. Supervisor David L. Staaby stated there was an article regarding the two-way phones system and that Sprint may be doing away with the system. The township will discuss options if that happens. Chairman Tony L. Brubaker reopened the floor for public comment. Township Worker Richard A. Webber stated a new flag is needed for outside. The township office will contact Senator Folmer's office to get a new one. Kelly Cox - Richland Rd. - asked some questions on the Hickory Rd. Bridge work. Chairman Tony L. Brubaker stated the work is maintenance work being done. She asked what the status on the line painting. The current agreement was up for renewal. The County was putting the bid packet together and no information on if it was awarded has been received as of yet. As there was no further business, a motion to adjourn was made by David L.
