1 BOROUGH OF BOYERTOWN COUNCIL MEETING The regular meeting of the Boyertown Borough Council was called to order at 7:00 p.m. by Council President Frank Deery. Council members present in addition to Mr. Deery were Charles Heller, Barry Christman, Lorraine Carnes, Keith Endy, Terry Mest, and Gene Gabel. Also in attendance were Marianne Deery, Mayor; Christopher Hartman, solicitor; Patricia Loder, Borough Manager; Adrianne Blank, Main Street Manager; Allen Steffy, President, Building a Better Boyertown, Corey Kegerise, Pennsylvania Historical and Museum Commission, and interested citizens. All rose for the Pledge of Allegiance. Mr. Deery called for public comments on the agenda; no comments were forthcoming. The first order of business was a presentation concerning Pennsylvania Historic Preservation. Mr. Corey Kegerise, of the Pennsylvania Historical and Museum Commission, distributed information concerning the various types of historic designations made by different government agencies and organizations, and the process, requirements, and benefits of the various designations. A lengthy review of the various designations ensued, and Mr. Kegerise responded to numerous questions posed by Council members. This was an informational presentation only. Mr. Deery called for a motion to approve the minutes of the January 4 th, 2019 meeting of Borough Council. The motion was made by Mr. Heller, second by Mr. Gabel, and approved. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel and Mr. Deery. The Mr. Heller also made a motion, second by Mr. Gabel, to reimburse Tax Collector Sallie Ann Yerger, in the amount of $ for 2018 State Association Tax Collector Dues and attendance at the State Tax Collector Association Convention. The Public Utilities - Water, Keith Endy The following Water Supply and Use Report was submitted for the month of January During the month of January a total of 21,776,000 gallons of water was processed through the water filter plant for an average of 702,000 gallons per day. The totals came from these sources: Trout Run 21,776,000 Ironstone -0- Boyertown Reservoir 21,776,000

4 Pumping from Trout Run Pumping from Ironstone 31 days 0 days Page/4 Trout Run is at a level of feet with approximately 252,000,000 gallons of water. Popodickon Reservoir is at a level of 38 feet with approximately 34,600,000 gallons of water. Precipitation in January was 4.6 inches. Public Works, Barry Christman The following report on the activities of the Street Department personnel during the month of January 2019 was submitted: During the month of January street department personnel removed the leaf pile from the Community Park, plowed and salted streets, patched potholes, swept streets, collected Christmas trees, replaced faded street signs, and performed routine maintenance on borough buildings and equipment. Mr. Christman made a motion, second by Mr. Gabel, to confirm the Borough Manager s execution of the proposal from Fred Beans Ford of Boyertown for the purchase of a 2019 Ford F-550 Chassis Regular Cab DRW 4 x L V10 engine at a cost of $39, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The Mr. Christman then made a motion, second by Mr. Endy, to confirm the Borough Manager s execution of the proposal from E. M. Kutz, Inc. for the purchase of a Galion Steel Body with 7 Gauge Stainless Steel Floor, Tailgate Spreader, and Fisher Stainless Steel Plow Proposal Dated January 11, 2019 at a cost of $43, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. 5 House, Gene Gabel Page/5 No report Public Communication, Lori Carnes No report Park and Recreation Board, Lori Carnes Ms. Carnes reported that the Park and Recreation Board begun plans for the annual Earthfest event scheduled to be held on April 27 th from 11:00 a.m. to 1:00 p.m. Planning, Frank Deery Mr. Deery submitted the Code Enforcement Report for the month of January. The report reflected the issuance of two UCC Permits. In addition, follow up inspections were performed on numerous Notices of Violation issued for general property maintenance code violations, and seventy eight rental unit inspections were performed. Mr. Deery and Mrs. Loder then reviewed with Council the recommendation from the Planning Commission to grant conditional approval of the Harner Minor Subdivision Plan. The Plan proposes the subdivision of a 1.33 acre parcel at 640 Highland Avenue into two lots. The lots being subdivided are primarily in the Borough of Boyertown; the easternmost portion is located in Douglass Township, Montgomery County. The existing lot contains a shed, tennis court, and a utility easement; no buildings exist on either lot. There is no immediate plan to develop Lot 1; however, a single family home is proposed on Lot 2. Following review and discussion, a motion to approve the Harner Minor Subdivision subject to meeting all comments listed in the SSM, Inc. review letter dated January 21 st, 2019 and the SDE, Inc. review letter dated January 22, 2019 was made by Mr. Deery and seconded by Mr. Christman. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The motion was approved. Police and Public Safety, Terry Mest Mr. Mest reviewed a request from Building a Better Boyertown to hold the annual Coming Out of Hibernation Event on Saturday, April 20, There being no objection to the request, Mr. Mest made a motion, second by Mr. Heller, to authorize the Chief of Police to notify PennDOT of the Borough s intent to close East Philadelphia Avenue on Saturday, April 20, 2019 from Chestnut Street to Washington Street between the hours of 10:00 a.m. and 3:00 p.m. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. 6 Page/6 Mr. Mest then made a motion, second by Mrs. Carnes, to reduce the retainage for the Boyertown Police Renovation project from ten percent to five percent. The Mr. Mest made a motion, second by Mrs. Carnes, to authorize the Council President to execute Change Order #1 Electrical Construction Boyertown Police Building Renovation Project in the amount of $3, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The Mr. Mest then made a motion, second by Mr. Gabel, to authorize the Council President to execute Change Order #2 Plumbing Construction Boyertown Police Building Renovation Project in the amount of $343.6l. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The Mr. Mest made a motion, second by Mrs. Carnes, to authorize the Council President to execute Change Order #3 Plumbing Construction Boyertown Police Building Renovation Project in the amount of $3, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The Mr. Mest made a motion, second by Mr. Heller, to authorize the Council President to execute Change Order #2 General Construction Boyertown Police Building Renovation Project in the amount of $37, The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The Police Activities, Mayor Marianne Deery The following Police Activities Report for the month of January was submitted: Calls for Service 274 Traffic Complaints 86 Non-Traffic Complaints 139 Traffic Arrests 40 Non Traffic Arrests 13 The Mayor s activity report for the month of January reflected the Mayor s participation in a meeting of the Boyertown Museum of Historic Vehicles, a meeting to review Pennsylvania Downtown Center comments concerning the community assessment recently completed by the PDC, and officiated a wedding.

7 Page/7 Building a Better Boyertown, Adrianne Blank Main Street Manager Ms. Blank informed the members on numerous matters including volunteer development training scheduled to be held on March 6 th at the Boyertown Library, a volunteer recognition event on February 17 th at the State Theater, and a meeting with the Douglass Township, Berks County, Park and Recreation Board on March 4 th concerning the Trail Feasibility Study. Ms. Blank also advised Council of a new Multi-Cultural event Building a Better Boyertown will hold on June 29 th in the railroad yard; the event will be called Italfest. Ms. Blank also noted that the Anchor Building check has been received and will presented to Mr. Kopicki in the near future. Public Comments Mr. Deery called for public comment; and recognized Ms. Mary Ellen Keller, who stated an interest in holding a 5K Run to raise money for the American Cancer Society. Ms. Keller noted the run would be held in the Boyertown Community Park on the walking trail but would also utilize roads in Colebrookdale and Douglass Townships. Mrs. Loder advised Ms. Keller that a Park Use Agreement will be required to utilize the Community Park, and Colebrookdale and Douglass Township officials must be contacted concerning use of their roadways for the 5K Run. Mrs. Loder will have Boyertown Chief of Police contact Ms. Keller to provide her with some guidance regarding use of a public roadway. Mr. Deery then announced that Council would recess to executive session to discuss a real estate and a potential litigation matter. Upon reconvening, Mr. Deery announced that during executive session Council discussed one matter relating to real estate and one matter related to a potential litigation. Mr. Deery then made a motion, second by Mrs. Carnes, to authorize the Borough Manager and Solicitor Hartman to take any and all appropriate legal action to abate the hoarding issue at 111 East Second Street and property maintenance code violations, as well as other potential violations discovered based on property inspections conducted by the Code Official. The roll call vote reflected the following members voting yes : Mr. Heller, Mr. Christman, Mrs. Carnes, Mr. Endy, Mr. Mest, Mr. Gabel, and Mr. Deery. The There being no public comment and no further business to conduct a motion to adjourn the meeting at 9:24 p.m. was made by Mrs. Carnes and second by Mr. Gabel.
