1 CITY COUNCIL MEETING November 20, Lakeview Avenue North Robbinsdale, Minnesota 7:00 p.m. A G E N D A CITIZEN PARTICIPATION The City Council is meeting as a legislative body to conduct the business of the City according to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL. Unless so ordered by the Mayor, citizen participation is limited to the following times and always within the prescribed rules of conduct for public input at meetings. A) PUBLIC HEARINGS: Public hearings are conducted so that the public affected by a proposal may have input into the decision. During hearings, all affected residents will be given an opportunity to speak pursuant to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL. B) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS NOT ON THE AGENDA Any member of the public may speak at this time on any item NOT on the agenda. In consideration for the public attending the meeting for specific items on the agenda, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued under Other Business at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof. No person other than members of the Council and the person having the floor shall be permitted to enter into any discussion without permission of the presiding officer. Attached is a list of applicants requesting a license or license renewal to operate within the City. All appropriate fees have been paid and certificates of insurance and bonds, if required, have been filed with the City Clerk. 25 Old Business TO: FROM: DATE: RE: Mayor and City Council Marcia Glick, City Manager November 20, 2018 Alley Reconstruction 4000 block between Shoreline Drive and Beard A venue BACKGROUND: A letter was sent out in June to inform property owners on the 4000 block between Shoreline Drive and Beard Avenue about a potential reconstruction project for their alley. Property owners were informed that they would be assessed for 100% of the reconstruction costs. They were invited to come to the public hearing on August 6 th at the City Council Meeting to hear more about the project and to voice their opinions. A Feasibility Report for the alley was presented to the City Council on August 6 th Exhibit 1 followed by the Public Hearing (minutes in Exhibit 2.) The City Council accepted the Feasibility Report and directed staff to collect additional information from residents through a survey. Staff sent out the survey, requested responses by August 31, and received the 15 responses attached as Exhibit 3. A resident, Karen Thereau, 4034 Shoreline Drive, appeared at the Opportunity for the Public on September 4 th and noted that the letter and survey had not provided information about financing options and had not jndicated when th item would be back on the council agenda for discussion. A lhird letter was sent out on October 1 J 1h (Exhibit 4.) The letter noted that the item would be back on tonight's agenda. Six comments were received, only one of which was from a new property. These letters are attached as Exhibit 5. Council Member Rogan obtained a list of which addresses had responses and which had not on November 13 th and he indicated that he would try to contact all of the missing parties. Analysis Overall, responses were received from 16 of the homes. The results were: eight yes eight no, including all four of the corner properties responding "no, unless they could receive a prorated rate because they do not need to use the alley." As the Feasibility Report has already been adopted, the next action would be to set a date for the improvement hearing if this project is to move forward. As noted in the letter, failure to reconstruct the alley will ultimately impact the city's ability to maintain the alley (clear snow) and collect garbage from the alley. RECOMMENDATION: 1. 47 Exhibit 2 Minutes from NEW BUSINESS Feasibility Report Alley in the 4000 Block between Shoreline Drive and Beard Avenue. 1. Richard McCoy reviewed the information in the staff report and explained that alley projects are 100% assessed to the home owners whose properties reside on the alley. The alley was originally constructed in the 1950 s and was reconstructed with an experimental overlay in Richard approximated that each homeowner would be assessed about $3,600. He noted a prior discussion of whether the asphalt overlay was an option and concrete was determined to be the proper application. If specially assessed, financing is typically over 10 years. 2. Bill Thereau 4034 Shoreline Drive They have been living in the home for 44 years. Bill did some research and he is in favor of doing minimal reconstruction, such as adding a 1 thick layer of asphalt. 3. Karen Thereau 4034 Shoreline Drive would like to see a petition to get the opinions of more neighbors, several of their neighbors have expressed to her that they are not in favor of this project. 4. Dennis Appleman 4056 Shoreline Drive He has noticed for years that the asphalt is breaking apart and he takes pride in where he lives and would like to see the alley replaced 5. Gail Grant 4044 Shoreline Drive No strong opinion one way or the other. She agrees she wants the neighborhood to look nice. She asked if corner properties that didn t have access would have the same assessment. 6. Brandon Vesel 4070 Shoreline Drive Home is located on a corner and doesn t have direct access to the alley. He is neutral in his opinion, but is curious if he would be assessed even if he does not have a driveway leading out to the alley. 7. David Cox 4001 Zenith Ave N His home is located on a corner lot and also doesn t have direct access to the alley. Stated that the alley is in rough shape. His garbage is picked up in the alley. 8. Gail Grant 4044 Shoreline Drive Inquired about financing and wanted to point out that over 10 years it would be a minimal amount each month. Many of the neighbors have sticker shock and would feel more at ease knowing an estimated monthly payment. 9. Brandon Vesel 4070 Shoreline Drive Expressed a comment that his father, who has been in the asphalt business forever, made about the alley being fix. He said he would not want to take on that project because it would likely be a difficult and expensive. 10. There was discussion on whether there should be a policy update regarding corner 40

48 lot assessments where there was no alley access and a consensus for gathering information from the rest of the owners on the alley through a survey. 11. Murphy also pointed out that construction costs will continue to rise and to move forward sooner than later would be at the benefit of the homeowners. 12. Member Rogan MOVED, seconded by Selman to accept the City Engineer s feasibility report on improvements to the alley in the 4000 block between Shoreline Drive and Beard Avenue. The vote was unanimous and the motion carried. 13. Staff will collection additional information from other residents through a survey and the item will come back at a later meeting. It was noted that this project would not be undertaken until 2019 in any case. 41
