1 CITY COUNCIL MEETING September 4, Lakeview Avenue North Robbinsdale, Minnesota 7:00 p.m. A G E N D A CITIZEN PARTICIPATION The City Council is meeting as a legislative body to conduct the business of the City according to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL. Unless so ordered by the Mayor, citizen participation is limited to the following times and always within the prescribed rules of conduct for public input at meetings. A) PUBLIC HEARINGS: Public hearings are conducted so that the public affected by a proposal may have input into the decision. During hearings, all affected residents will be given an opportunity to speak pursuant to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL. B) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS NOT ON THE AGENDA Any member of the public may speak at this time on any item NOT on the agenda. In consideration for the public attending the meeting for specific items on the agenda, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued under Other Business at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof. No person other than members of the Council and the person having the floor shall be permitted to enter into any discussion without permission of the presiding officer. Credit card payments are made using the ACH payment method directly to the bank, no check is issued, and payment is required by a certain date to avoid finance charges. The attached listings are the credit card payments made in the month of August 2018 representing charges for the period July 10, 2018 through August 10, 2018, for expenses for City operations. 53 Exhibit 1 Member moved and Member seconded a motion that the following ordinance, which was given its first reading on September 4, 2018, be given its second reading on, 2018 and that it be adopted. ORDINANCE NO. 18- AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE FEE SCHEDULE THE CITY OF ROBBINSDALE DOES HEREBY ORDAIN: Section 1. That Appendix B Robbinsdale Ordinance Code and General Fee Schedule be amended as shown in Attachment 1 and described hereafter: Planning and Land Use Regulations Chapter V is amended to add a note indicating that fees are base fees and that there may be additional charges for legal fees and/or additional staff time. Base fees for Conditional Use Permits and Zoning Variances & Appeals are also increased. Streets, Alleys and Public Ways Chapter VIII is amended to increase fees for street repair. Public Works/Public Utilities Misc. is amended to increase fees for water meter & Vactor, and to add a Street Light Knockdown Fee is added providing a set cost for damage to city street lights. Schedule of Offenses and Fees Administrative Penalty System Attachment I Hearing Request fee is amended to match city code. Section 2. That the following summary clearly informs the public of the intent and effect of the ordinance and is approved for publication: The purpose of this ordinance is to update current city fees in the areas of applications for planning commission review, street repairs, new water meter, Vactor, damage to street lights and application of hearing request fee following appeal of administrative fines. 60 New Business A TO: FROM: DATE: RE: Mayor and City Council Marcia Glick, City Manager September 4, 2018 Appeal of zoning language concerning the use of 2721 Parkview Blvd. BACKGROUND: Dr. Paul & Hillary Kyle are the owners of the property located at 2721 Parkview Boulevard (the "Property"). The Kyles recently received an administrative citation for their use of the Property, which is located in the R-1 zoning district. The City's zoning code permits property in the R-1 zoning district to be used as a single-family residence. The code further defines a "family" as no more than four unrelated persons. Because the Kyles regularly allow as many as 4 or 5 unrelated persons to stay in their home, along with the two primary residents who are related by marriage, a citation was issued. The Kyles appealed that citation, which was upheld by the administrative hearing officer. The Kyles then appealed the staffs interpretation of the City's zoning code definition of the term "family" as it applies to the use of Property within the R-1 zoning district, which is the matter now before the City Council. On August 16, 2018, the Planning Commission conducted a public hearing related to the appeal and voted 3-0 (with two members absent) to deny the appeal. The meeting minutes are included as Exhibit 1. ANALYSIS/CONCLUSION: The report prepared for the Planning Commission is included as Exhibit 2. The report provided detail concerning the Kyles' use of the Property, as well as the applicable ordinance standards contained in the R-1 single family residential zoning district. Of particular relevance are the following facts: In addition to the four Kyle family members, the Kyles regularly allow up to four or five non-related persons to reside on the Property for various periods of time. While the R-1 zoning code provides several permitted uses, the one applicable to the Property is that of a "single-family dwelling." "Family" is defined in the zoning code as: "... one or more persons each related to the other by blood, marriage, or adoption, or a group of not more than four persons not all so related maintaining a common household and using common cooking and kitchen facilities." The R-1, single family residential zoning district allows as a permitted accessory use the "boarding or renting of rooms to not more than two persons." The R-1 single family residential zoning district allows as a conditional use boarding houses or boarding home for foster children subject to certain conditions. While the City Code does not define "boarding", it does define a "boarding house" as "a building other than a hotel where, for compensation and by arrangement for definite periods, meals or lodging, or both, are provided for persons, not members of the family, as defined herein, pursuant to previous arrangements and not to anyone who may apply, but not including a building providing these services for more than 10 persons." v2 AMB RB

The check register dated August 22, 2018 through September 4, 2018 is a list of vouchers requiring payment for City funds, Deputy Registrar, liquor, and miscellaneous purchases. The payments are required prior to the next Council meeting.
