3 Minutes of a Regular Meeting of the Verona Township Council on Monday, March 21, 2016 beginning at 7:00 P.M. in the Municipal Building, 600 Bloomfield Avenue, Verona, New Jersey. Call to Order: Township Manager reads notice of Open Public Meetings law. Roll Call: Mayor Kevin Ryan; Deputy Mayor Michael Nochimson; Councilman Bob Manley; Councilman Alex Roman and Councilman Jay Sniatkowski. Township Manager Matthew Cavallo, Township Attorney Brian Aloia are also present. Municipal Clerk Jennifer Kiernan is absent due to illness. The Township Manager will be taking the position of Municipal Clerk for this meeting. Mayor Ryan leads the Pledge of Allegiance. Approval of Minutes: Minutes from the March 3, March 7 and March 10, 2016 meetings are moved for approval by Councilman Manley; seconded by Councilman Roman. Councilman Sniatkowski abstains. Vote: 4 ayes. Mayor s Report: Mayor Ryan welcomes County Liaison Jay Coltre to the lectern. Mr. Coltre reminds the public that the 40 th Annual Cherry Blossom Festival will be from April 9 th through April 24 th. He informs the Council that he will not be present at the next regularly scheduled meeting. Mayor Ryan reports that he and the Township Manager have met with the County Executive regarding the Community Pool parking property. He states it was a positive meeting and more information will be given in the future. The Health Department has received a $10,000 grant for Partners for Health. Exercise equipment for the Community Center will be purchased with those funds. Connie Pifher has applied for an additional $5,000 for the purchase of outdoor exercise equipment. Manager s Report: Matthew Cavallo reports that the VTV bulletin board is malfunctioning and is currently offline. The vendor is currently looking into the issue. He reports that traffic and parking issues are bubbling up in town. He advises the public that new traffic enforcements are taking place as well as parking meter enforcements. Mr. Cavallo states that Township has met with the County regarding a plan to develop a section of County property at the exits of the VCC to create up to 60 parking spots. He states that the County Executive is receptive to working out a lease or development agreement. VMAC will sponsor Family Night on March 23, Local restaurants are offering discounts to residents that evening. Sustainable Verona is sponsoring a rain barrel sale. Information can be obtained in the Municipal Clerk s office or on the Township s website. The container is placed at the end of the drainage spout to collect rain water which can then be used to water plants, etc. Mr. Cavallo invites Chief Stern and Captain DePoe to the lectern to discuss the recently completed speed hump study done on Oakridge Road. Captain DePoe presents the survey to the Council. He states that although residents are in favor of the speed tables, other residents are against the implementation of speed humps citing concerns over response times to emergencies. 1

4 Township Engineer James Helb explains that speed tables must meet state parameters set by the Attorney General s office and therefore he is recommending two tables be placed in the same location originally identified a few years ago when this issue first came to light. At that time the project was put aside due to many residents objection to the project. Councilmembers Reports: Deputy Mayor Nochimson reminds the public that Family Night will take place on March 23, Councilman Sniatkowski comments that frequently real estate signs are placed in violation of the current code. He suggests the Township send a letter to local realtors advising them of the ordinance. Councilman Manley has no report this evening. Councilman Roman states he has a document to present to Council for consideration which he has already sent to the Town Manager and CFO regarding suggestive changes to the draft budget. He gives his recommendations of major and minor reductions which would avoid an increase in the tax levy. Township Manager Matthew Cavallo announces that Ordinance #3-16, Regulating Steep Slopes in the Township has been pulled from tonight s agenda in order for proper notification to be made. A public hearing on the ordinance will be on the April 4, 2016 meeting agenda. ORDINANCE NO.8-16 WATER/SEWER UTILITY CAPITAL BOND ORDINANCE PROVIDING FOR THE ACQUISITION AND INSTALLATION OF A RADIO AND COMMUNICATIONS SYSTEM FOR THE, IN THE COUNTY OF ESSEX, NEW JERSEY, APPROPRIATING $175,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $175,000 BONDS OR NOTES OF THE TOWNSHIP TO FINANCE THE UTILITY SHARE OF THE COST THEREOF. 3

ORDINANCE NO.9-16 AN ORDINANCE TO AMEND CHAPTER OF THE CODE OF THE TOWNSHIP OF VERONA THEREOF ENTITLED FEES IN ORDER TO AMEND BASIC WATER CONSUMPTION RATES AND ESTABLISH A CONTINUING SCHEDULE OF RATES. The Township Manager reads Ordinance #9-16 by title into record as same had been posted for the Motion to move Ordinance #9-16 is moved by Councilman Manley; seconded by Councilman Roman. ROLL CALL: Ordinance #9-16 is approved unanimously and will be published according to law. Consent Agenda: RESOLUTION No A motion was made by Councilman Manley; seconded by Councilman Roman that the following resolution be adopted: DISPOSAL OF OBSOLETE TOWNSHIP EQUIPMENT WHEREAS, the Township Manager has advised the Township Council that there is obsolete equipment that is no longer needed for public use; and WHEREAS, N.J.S.A. 40A:11-36 authorizes the disposition of personal property not needed for public use without public sale when the fair market value of the property is less than $6,000.00; and WHEREAS, the equipment set forth on the attached Exhibit A, have a value of less than $6,000.00; and 4

7 WHEREAS, it is in the best interest of the Township to dispose of said equipment. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Verona, in the County of Essex, New Jersey that the obsolete equipment referenced by the Township Manager which is no longer needed for public use by the Township shall be disposed of according to the manner as prescribed by law. RESOLUTION NO A motion was made by Councilman Manley; seconded by Councilman Roman that the following resolution be adopted: WHEREAS, the Construction Code Official determined that the owner of the Block 98, Lot 1, commonly known as 6 Morningside Road, Verona, New Jersey failed to comply with the Township property maintenance code, specifically non removal of snow; and WHEREAS, clean up was performed by Green Valley Landscape Design & Maintenance on behalf of the Township on January 23, 24 & February 5, 2016 totaling the amount of $165.00; and WHEREAS, these charges shall be imposed on the property in the form of a municipal lien for above services pursuant to N.J.S.A. 54:5-8 and to any other applicable State of Federal regulation. all appropriate actions to impose on the property commonly known as 6 Morningside Road, Verona, New Jersey (Block 98, Lot 1) a municipal lien in the amount of the tax lien certificate ($165.00), where upon the Tax Collector shall, within ten (10) days of encumbering of the property, send official notice of said encumbrance via certified mail, return receipt requested and regular mail to any and all other lien holders or creditors with a secured interest in the property. Prospect Avenue, Verona, New Jersey (Block 18, Lot 33) a municipal lien in the amount of the tax lien certificate ($100.00), where upon the Tax Collector shall, within ten (10) days of encumbering of the property, send official notice of said encumbrance via certified mail, return receipt requested and regular mail to any and all other lien holders or creditors with a secured interest in the property. 10 RESOLUTION No A motion was made by Councilman Manley; seconded by Councilman Roman that the following resolution be adopted: PERMITTING ITEMS TO BE DISCUSSED IN EXECUTIVE SESSION WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975, permits the exclusion of the Public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Verona, County of Essex, State of New Jersey, as follows: 1. The public shall be excluded from discussion of an action upon the hereinafter specified subject matter. 2. The general nature of the subject matter to be discussed is as follows: a. Personnel Matters pursuant to N.J.S.A. 10:4-12(8) 3. It is anticipated at this time that the above stated subject matter will be made public when said subject has been fully discussed by the Council, and the attorney rules this matter may be brought before the public without jeopardizing any pending litigation. 4. This resolution shall take effect immediately.
