Call to Order Judge Kris Knochelmann called to order the April 14, 2015 meeting of the Kenton County Fiscal Court. Commissioner Beth Sewell led the invocation and the Pledge of Allegiance. Present: Staff: Approval of Minutes Judge/Executive Kris Knochelmann Commissioner Beth Sewell, District 1 Commissioner Joe Nienaber, District 3 County Attorney Stacy Tapke Joe Shriver, County Administrator Scott Gunning, Assistant County Administrator Roy Cox, County Treasurer Steve Hensley, Emergency Management Director Sue Kaiser, Fiscal Court Clerk Minutes -March 24, 2015 Judge Knochelmann presented the minutes of the March 24, 2015 meeting for approval by the Court. Citizens Address Bill Code addressed the court about the intersection of Courtney and Eads Rd. in Southern Kenton County. He would like to get a three way stop sign and a guardrail installed. He presented a petition to the court, and asked that this be considered. Judge Knochelmann stated that he would take this issue back to his staff, and follow up with Mr. Code personally within the next week. Bill Schneider addressed the court to let the students at UC and Sharmili at OKI know that they have inspired him and his class at NKU to follow in their direction in Urban Development. Just today, he received all his class' papers, and they came up with proposals on the impact of the 536 Development. There is a roundtable planned for Tuesday of next week at 11:00. He is asking people that are interested in attending to let him know.

2 Mr. Schneider continued by reminding everyone of the Farm Heritage Tour on May 9th from 10:00 a.m. to 3:00 p.m. at Piner (Goshen Christian Church). There will be a citizen's group presence there, so if anyone needs an update there will be information available. Also, with the closure of the store in Piner there is a question about dry precincts. There was a request for an update on what is going on, if it is a possibility. In conclusion, Mr. Schneider stated that he has been speaking with John Stanton to work with the Cincinnati Airport Board and the Airport Staff on aeronautics and engineering. There has been a good response, and would like to include the thoughts from our group to interface with Marker Space out of Boone County to see what we can do to make that broader in Northern Kentucky. Commissioner Sewell asked Mr. Schneider if he wanted to say anything about the meteorite presentation that is being planned around Piner? Mr. Schneider stated that in 1873 within a quarter mile of Piner School on July 4th there was a picnic at Goshen Church. During the picnic, a meteorite hit Williamstown. A piece of it hit Piner, and apparently the crash was so tremendous. It turns out that the piece weighed 360 pounds, and was recovered several years later by a scientific group out of Rochester, New York. We were able to find a 1.4 gram slice of it, so it is coming back home a little bit at a time. General Business Claims List A. Claims List - Dated April 10, Roy Cox, County Treasurer No questions on the Claims List. B. A presentation by Andrew Videkovich of Planning and Development Services on the UC/KY 536 Project. Two groups from University of Cincinnati presented their projects in conjunction with Planning and Development Services for the 536 Visioning process, as documented in the Fiscal Court Meeting packet. Commissioner Nienaber asked what class the students were taking. The students answered that they are undergraduate third year Urban Planning students. Commissioner Nienaber asked if they were from Kenton County. The students answered that they were not from Kenton County.

3 Resolutions A. Resolution No.15-0lG (Action Requested) A Resolution for the Kenton County Fiscal Court concerning Fiscal Year budget adjustments. Roy Cox explained that there will be more adjustments as the Fiscal Year comes to a close. This is due to the fact that we tightened the budget down so much last year. The last adjustment is because we have such a good medical plan, and have more participants in the plan. In the past when we had vacancies during the budget season, they were budgeted at minimal levels. Since we have such increased participation in the healthcare plan, there are more adjustments. This year when doing the budget, all vacancies will be budgeted at the family level. If anyone wants the details, Mr. Cox has them broken down by person. Joe Shriver and his group did a great job with the insurance this year. It was mandatory for everyone to attend the health care meeting, and that is what sold the program. Even though the premium cost we accrue now is higher, we should reduce our overall health care costs going forward. Joe Shriver stated that we offered a narrow network with local providers (St. Elizabeth, Tri Health and Children's). The health care plan doesn't follow a fiscal year. We introduced that on a calendar year because of deductibles and co-pays. It was introduced mid-year, so we couldn't have anticipated the impact of this program. If we had 100% of our claims run through this plan, it would save us about $800,000 over what it cost us the year prior. We had 169 employees switch to the new plan. We shouldn't have this problem going forward. Judge Knochelmann added that the work that Joe Shriver has been doing the past couple of years has saved the county a lot of money. Joe Shriver stated that we are trying to be aggressive due to the health care cost continuing to rise. The impact of health care reform continues to hit us in waves each year. We are just trying to fend those off with some innovations. We have to keep moving, and make incremental changes. Commissioner Sewell stated that it is good to see that when we do go over budget our staff is finding places within their budget to find the funds instead of taking it out of reserve. Thank you to the department heads for doing that. Judge Knochelmann pointed out that he added a $10,000 adjusted for the Covington 200 celebration. That is additional to the request that has already been put through. We had committed $10,000, and they came back to the county asking for the additional $10,000. It is a big step to support the bicentennial for Covington. He fully supports this, and wanted the Commissioners to know this is why he put this on the adjustments. Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber.

Resolution No (Action Requested) A Resolution of the County of Kenton, Kentucky adopting the County Road Maintenance List as identified in Exhibit A, effective April 14, Nick Hendrix explained that this is a routine procedure. It hasn't happened since The only big notes include routes in Latonia Lakes. We have removed routes in Ryland Heights due to a new agreement that is on the Consent Agenda. Also included are all new routes that were forced on us statutorily. Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber. C. Resolution No (Action Requested) A Resolution authorizing an application to the Kentucky Transportation Cabinet for reimbursement of expenditures for the transportation of Non-Public school students. Roy Cox stated that this is just a formality. This is for entering into the non-public student transportation agreement. We contract with other agencies and provide bus service for nonpublic schools. We get reimbursed by the state, depending on how much money they have to allocate. In order for us to file that claim, we have to apply. Commissioner Sewell asked what the history is on the reimbursement. Roy Cox stated that the amount has been going up the last couple of years. Three years ago it was around 50%, and it has gone up to almost 75%. $900,000 is the cost that we budget. Judge Knochelrnann called for a voice vote, and the motion passed unanimously 3-0. D. Resolution No (Action Requested) A Resolution authorizing an application to the Ohio-Kentucky-Indiana (OKI) Regional Council of Governments for matching Federal SNK Funds for Phase II of the Bromley-Crescent Springs Road Project. Judge Knochelmann stated that this project was on track to be completed within the next couple of years, but it would end at the church. It doesn't continue on past Blue Rock Cafe. So we dug into it, and asked what the next process may be. Nick Hendrix explained that the second phase takes us from short Amsterdam to Amsterdam East or St. John's intersection. This is one of the toughest intersections on the road. It is 1560 feet, and our commitment on the 80/20 match on the SNK Funds would be right at $700,000. He has a lot of back up data, but would like to open it up for questions. Commissioner Sewell asked what this does to the road budget in 2017? How do we pay for this? Is it coming out of reserves? Nick Hendrix stated that they had hoped to appropriate from reserves, and that is going to be up to the court.

5 Judge Knochelmann stated that while we are in the budget process, there is no question that there isn't $500,000-$800,000 a year for SNK projects. Our state money has been cut about $150,000. If we do this, it will likely have to come from the reserve. It is a challenge. These SNK Funds are limited to the number of roads we can access from the county. If we are going to participate, we are going to have a 20% match. We have Crescent Springs and Ft. Mitchell that have a stake in the game. We thought maybe Bromley had a piece, but it is all us. If this were approved, it could very well go into the next term. If we get approved for this application, we can turn it down. Now that we are all in on this project, either we do it now or leave it forever. The possibility of having the first phase end where it will doesn't make sense. We could wait two or three years, and reapply after seeing how the county finances are at that time. But, we can always apply and then turn it down. Nick Hendrix stated that there is a cap on the amount that can be reimbursed at five million dollars. We would love to see this project go to Highwater Rd., but getting through to St. John's and Amsterdam East intersection is more logical. We had to get cut short on the last project, because we were going to reach that five million dollar cap. Logically, getting to the end of this section would make more sense for connectivity. OKI has the difference of the section on the unscheduled projects list at $12.76 million. Judge Knochelmann stated that Phase 3 will take it essentially from Blue Rock Cafe to Highwater all the way down the creek. Commissioner Sewell stated that this is a big commitment. She has given her voice in discussions with folks in Latonia Lakes, and asking them to share in the burden of the costs in paving their roads. There are very few citizens that ultimately would be impacted in this area, although there are a lot of folks that drive through it that would benefit. Again, it is one of those things. Trying to find justice and it is difficult. She understands that these funds aren't applicable to other parts of the county. So the rural area would not be able to take advantage of them. When they come along, you feel compelled to grab a hold of them. We ask ourselves, can we ultimately afford it? The good news is that this can be turned down. If it wasn't affordable when push comes to shove, we could say no. Commissioner Nienaber stated that this carries a tremendous amount of traffic through his beloved city of Ft. Wright. He recalls a hill slippage on Amsterdam Rd. around one of the bends. It started a match between the county, Ft. Mitchell and Ft. Wright. Ultimately the cities of Ft. Wright and Ft. Mitchell closed Amsterdam Rd. until there was a consensus. It created a tremendous amount of stress. It carries a lot of traffic throughout the day. In Ft. Wright we are used to the county taking care of the section right by General Dr. and Ft. Henry. At one point, there was a ruling that required us to assume the maintenance. It was halfway through Phase 1 of a project. So Phase 2 never got done in Ft. Wright. We milled and paved it on the cities dime. We are obligated to find a way to pay for these important roads that are used so often. He hates that we have to take the money out of reserves, but until the situation on road funding is fixed we must fix these roads. By the time this is awarded, hopefully we will have figured out some creative funding solutions. He supports the application process. Judge Knochelmann stated that the challenge of the 80% Federal funds, these first two phases of a three phase project would end up being almost $8 million. Out of that $8 million, the local

6 match would be $1.5 million. One of these days, the creek going down to Bromley is going to fall in and this is worthwhile. Ordinances (Action Requested) A. First Reading-Ordinance No (No Action Required) An Ordinance of Kenton County Fiscal Court providing for a credit of its Occupational License Fee for new employees as part of an economic development project by MUBEA, Inc. under the Kentucky Business Investment Program (KRS KRS ). Kevin Donovan from Tri-Ed explained that Mubea has been a great corporate citizen. They have employed over 1,000 people. This particular project is a $2.5 million investment with 50 new jobs. Judge Knochelmann stated that what Tri-Ed does is talks to the Judge Executive to gauge what level of participation the Fiscal Court would like. Generally, it is pretty consistent. This is a good process. We would like to have 30 of these a year. Commissioner Nienaber asked what the threshold is to meet the criteria of the Cabinet? Mr. Donovan answered that there is a 10 new resident job threshold. It is also a $100,000 investment. There are stipulations as to what applies as an investment. There is also a wage requirement, which is 115% of the poverty level before benefits. This Mubea job is well over that. They are at about $23 average per hour. Judge Knochelmann stated that this has the City of Elsmere' s participation. Consent Agenda (Action Requested) A. Exhibit No Request approval to extend the lease agreement for 3920 Richardson Road with Gregory and Charlene Combs for one year, effective May B. Exhibit No Request approval to surplus one (1) Glock 22, Serial Number DVG475 service weapon to be purchased by Brian Capps upon his retirement from Kenton County. C. Exhibit No Request approval to award the Food Service Program to Aramark Correctional Services for the Kenton County Detention Center. D. Exhibit No Request approval to extend the contract between Hilltop Stone LLC for the Kenton County Public Works Department, with a price increase of $0.20 per ton on all products.

7 E. Exhibit No Request approval for an agreement between the Kenton County Fiscal Court and the City of Ryland Heights for Routine Maintenance on City Streets. F. Exhibit No Request approval to award the Inmate Telephone System bid to Combined Public Communications for the Kenton County Detention Center. G. Exhibit No Request approval to extend the Cleaning and Janitorial Supplies contract with HP Products with a request of an increase on some bid items. H. Exhibit No Request approval to extend the Uniforms and Body Armor contract with Galls, LLC for the Kenton County Police Department, and the Kenton County Detention Center with a request of an increase on some bid items. All items on the Consent Agenda were voted on together. Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber. Executive Orders A. Executive Order No (Action Requested) An Executive Order relating to the Fiscal Court approving the appointment of various individuals to various positions for the Kenton County Golf Course, effective April 15, Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber. B. Executive Order No (Action Requested An Executive Order relating to the resignation of Chris Huhn as an Equipment Operator for the Public Works Department, effective March 31, Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber. C. Executive Order No (Action Requested) An Executive Order relating to the Fiscal Court approving the appointment of Adam Ryan to the position of Public Works Crewleader, effective March 23, 2015.

8 D. Executive Order No (Action Requested) An Executive Order relating to the appointment of Matt Mattone to the Conservancy Board for a three year term, expiring on March 8, E. Executive Order No (Action Requested) An Executive Order relating to the Fiscal Court approving the appointment of Ian Byrne to the position of Emergency Communications Dispatcher, effective May 3, F. Executive Order No (Action Requested) An Executive Order relating to the Fiscal Court accepting the resignation of Brian Capps as the Kenton County Police Chief, effective April 30, Commissioner Sewell made the motion for approval; seconded by Commissioner Nienaber. G. Executive Order No (Action Requested) An Executive Order relating to the Fiscal Court accepting the Homeland Security and Emergency Operations Plan and Support Plans, effective April 14, Administrative Reporting A. Police - Brian Capps Chief Capps reported that he received a few acknowledgements from a couple of agencies over the last month or so. Lakeside Park/Crestview Hills had a fatality accident on Turkeyfoot Rd. in March. They asked for our accident reconstruction team to handle this. Chris Shutte was very accommodating. Ultimately, our investigation resulted in criminal charges. Edgewood Police Chief gave his thanks for our evidence collection team that came up earlier in the month to assist his officers in a home burglary case. Chief Capps stated that our officers received training from the Northern Kentucky Health Department in collaboration with the Northern Kentucky Heroin Impact Response Task Force. They came to our office, and trained all our officers on the new legislation that was passed along with how to safely collect the needles. They are going to provide us with some free Sharp containers and safety gloves. Chief Capps continued with an update on our grants. He has applied for a state grant for vests. It may take a year to eighteen months to hear back from the state. We go ahead and budget for those vests now, but then we get awarded the grant. So, it could be the next fiscal year before

9 we hear back about the grant. Also, he has the completion report for a grant for the tasers. It is worth $27,730. Once the Judge signs it tonight, it will be mailed. A check will be received in about 5-7 days from the state. Finally, Chief Capps thanked the court for the tremendous opportunity that he has had in Kenton County. Over the past 17 years it has been a true blessing to serve the citizens of Kenton County. He has worked with some outstanding individuals at the Police Department. Not only are they great officers, there are a lot of really good people. Judge Knochelmann stated that Chief Capps has been nothing but a class act. He said that Chief Capps has done such a great job. He cares about the finances, his people and he has been able to look at himself and point out what he does well, and what may be a challenge for him. This new role will be great for him and his family. We will miss him. The word professional comes to mind ever since they met. B. Public Works - Nick Hendrix Nick Hendrix stated that we have now officially hired our new crew leader. Adam Ryan has a little over 16 years of experience. Also, the spring clean up for solid waste was the 2nd thru the 4th. There were 732 patrons, and unloaded about 24 dumpsters. That was successful by all measures. Nick Hendrix stated that the first phase of Bromley-Crescent Springs Rd. is still in preliminary design. We are looking to have a public meeting mid May. Finally, Mr. Hendrix wanted to personally thank Chief Capps for his service. Anytime he has needed anything, he just made a phone call and the Chief dropped everything to help. C. External Affairs - John Stanton John Stanton stated that last week Senator McConnell and the National Director of Drug Policy visited. One of the things that was addressed is that we are getting the maximum cooperation that we could ask for from both the Senator and his staff. His Chief of Staff Brian McGuire, Terry Carmack his State Director, as well as Field Representative Shane Noem have put in a tremendous amount of work prior to the Senator's visit last week. The Judge had the opportunity to brief them on issues, including the redevelopment of the IRS facility in Covington and erosion issues along the Licking River. We have gotten tremendous support from all of the staff. John Stanton then stated that the Legislative Session is over, and the weather has changed. It is nice to be on the road, and he has started visiting with the city and neighborhood associations. Also, he has started visiting with the school districts. Last night, he visited with the Austinburg Neighborhood Association. Much thanks to Dawn Dotson and Steve Ward for the time they have spent with him over the last week. One thing that he wanted to add was that it is a very impressive neighborhood group. There is not much that goes on there that their eyes aren't watching. He also had a great meeting with Alvin Garrison, the Superintendent of the Covington School District. This was to open up the line of communication in terms of us working with them going forward. Over the next couple of months, he will keep everyone up to date on his visits.

10 John Stanton stated that it is great when there is an institution like Mubea to add jobs. He wanted to compliment Tri-Ed for their Advanced Manufacturing Workforce Taskforce. At anytime there could be between 700 and 2500 open jobs with our manufacturers here in Northern Kentucky. It is important to bring the high paying jobs to the region that can pay anywhere from $60,000 to $80,000 a year. It is important to have the trained workforce to be able to take those jobs, hold them and continue to develop our reputation as a center for manufacturing. Dan Tobertge at Tri-Ed and Ed Hughes at Gateway are doing a tremendous job. This is probably an area that we are going to spend a lot of time on in the next three to four years. Finally, John Stanton announced the Catalytic Funds "Beyond the Curb" event this weekend. They are organizing an event that is $15 for the early bird price, and $20 the day of the event. You would have the opportunity to tour all the hot spots in Covington. It is this Sunday, and the website beyondthecurb.org will give information. D. Buildings & Grounds/Golf/Parks - Scott Gunning Scott Gunning stated that Buildings and Grounds has been busy switching over to the chillers for the summer months. The chiller at 303 Court St. is up and running with no problems. We are in the process of transitioning to outdoor maintenance items. One example is the landscaping improvements at 303 Court St. We are taking out some bushes, and making everything more aesthetically pleasing. Last week we were notified of some problems with our generator at Kenton Land's power site. We were able to use a spare generator from the Devou power site. This saved the county a couple thousand dollars. Scott Gunning moved on to the Parks and Recreation Department. He stated that last week we were inspecting the playgrounds at Lincoln Ridge Park for safety concerns, and we did find one area that was damaged. We are looking at about $3,500. That playground is blocked off for a couple of weeks. Also, at Lincoln Ridge we have had some minor graffiti. On a positive note, baseball season has started. Our daily maintenance is dragging the fields. The kids are enjoying the fields, and they are busy. We are taking a target approach to updating the parks master plan. This will be discussed further in the budget meetings. Scott Gunning discussed the upcoming events which include the Great American Cleanup on April 25th at Doe Run Lake. On April 28th we will be hosting our first Touch a Truck, presented by the Boy Scout Troop 808 from 6:30-8:00 P.M. at Mill's Rd. Park. Judge Knochelmann asked what this Touch a Truck is with the Boy Scouts? Scott Gunning answered that trucks and heavy equipment are brought out to the park, and the kids are able to touch and get up close to the equipment. Dan Moening reported on the Golf Course. He stated that the sidewalk was replaced in front of the building. Thank you to Nick Hendrix and his staff for fixing this. Leagues are starting now, and have added some junior programs. One of the junior programs is a team from Kenton County, and they will go to other courses and play other teams. Four out of the five spots have been filled already, and the kids are excited. Summitview Elementary has expressed a lot of interest in expanding the junior's program. Last year, we reached out to all the schools to start

11 an afterschool program. This worked out well, and they may be doing this again this year. Also, on May 8th we will be hosting a Special Olympics Golf Outing. It is the biggest event for the Kenton County Golf Course. There will be roughly 400 players starting at the same time. E. County Treasurer - Roy Cox Roy Cox wanted to make sure the record reflected that the financial reports for March, 2015 have been submitted. County Attorney's Report County Attorney Stacy Tapke had nothing to report. Commissioner's Report Commissioner Beth Sewell Commissioner Sewell stated that she was reading through our County Line magazine, and they had a section about how counties matter. April is National County Government Month, and would like something posted on Facebook. Also, they listed three county courthouses that were celebrating 100 years in the Commonwealth of Kentucky, and we should be listed for celebrating 175 years. Commissioner Joe Nienaber Commissioner Nienaber stated that although he didn't get to work with Chief Capps much, the county Police Department is extremely professional. Commissioner Nienaber stated that in the River City News, cities like Taylor Mill, Edgewood and a few other cities are going to go out to bid on their trash collection. He believes it is a great idea. If we support that, and the rest of the cities would communicate with each other through the Mayor's Group or something. Joe Shriver stated that a lot of those discussions came out of the Kenton County Manager's Group. Brian Dehner took charge of getting that group together. We are trying to reconcile all the differences in their bids, but have been in contact with him and Megan Sandfoss. Mr. Dehner is going to come to the May Mayor's Group meeting to present the results of those bids. Nick Hendrix is going with Joe Shriver to the next meeting to discuss asphalt, and how we should be bidding those things to get the maximum benefits. Judge/Executive's Report Judge Knochelmann stated that this week is National Public Safety /Telecommunications week. He wanted to publicly say that our Public Safety /Telecommunicators are unsung, and we appreciate them. He will be out on Friday to give his appreciation. We don't say thank you enough for all that they do. Unlike a lot of other organizations or businesses, when things are crazy, you have the ability to call in new people to step in. With dispatch, everything can go to pot in about two seconds and there is no time to bring in more people. It is expensive to have

12 these services, but it is more expensive to not have these services. We have a very dependable and top notch system in Kenton County. Secondly, Judge Knochelmann stated that Ed Butler will be speaking at the Mayor's Meeting this Saturday. He will be presenting the radio study and the costs. Lastly, Judge Knochelmann stated that there haven't been many Chief's in Kenton County that would have dealt with the tornado we had in his first three months of his position in such a great way. Dispatch was critical during this time as well. Executive Session Judge Knochelmann called an Executive Session pursuant to KRS (1) (F) Personnel related issues within the Police Department, and all pertinent court members convened in the upstairs administrative offices. Commissioner Sewell made the motion for approval of Executive Session; seconded by Commissioner Nienaber. Judge Knochelmann called for a voice vote, and the motion passed unanimously 3-0. Judge Knochelmann called for a voice vote, and the motion passed unanimously 3-0. Adjournment Having completed all business before the Court, Commissioner Nienaber offered a motion to adjourn which was seconded by Commissioner Sewell.
