Brown Municipal Bldg.: 5:30 p.m. One Grand Street (517) Coldwater, Michigan CALL THE MEETING TO ORDER PLEDGE OF ALLEGIANCE ROLL CALL CITY COUNCIL MINUTES REGULAR MEETING Mayor Kramer called the meeting to order with the following Councilmembers present: Councilmembers Cisco Ortiz and Travis Machan, representing the 1 st Ward; Councilmembers Chris Pierce and Jim Knaack, representing the 2 nd Ward; Councilmembers Michael Beckwith and John Petzko, representing the 3 rd Ward; and Councilmembers Randall Hazelbaker and Scott Houtz, representing the 4 th Ward. OTHERS PRESENT: Keith Baker, Megan Angell, Mark Bartell, Tom Eldridge, Jeff Budd, Dave Sattler, Dave Schmaltz, Dean Walrack and Susan Heath, Paul Plant; Eddie Miller and Don Reid. PUBLIC COMMENTS Eddie Miller, 163 S. Monroe Street, commented on a new County Road Deputy for next year. CONSENT AGENDA (Item Numbers 1-11): The items listed in the Consent Agenda are considered to be routine by the City Council and the City Manager and will be enacted by one motion. There will be no separate discussion of these items unless requested by a Councilmember or citizen. In this event, the item will be removed from the Consent Agenda and Council action will be taken separately on said item. Those items so approved under the heading Consent Agenda will appear in the Council minutes in their proper form. 1. 3 November 26, 2018 Page 3 Recreation Department The 2019 City of Coldwater Recreation Department Winter Activity Guide was distributed last week and is available on the City s website. Please take a look to see what our recreation department programs have to offer for the upcoming winter season. I am pleased to announce that Mariah Welke will expand her role with the Recreation Department team beginning in December, 2018, as a full time Recreation Coordinator. Mariah first started with the City back in 2005, working at Heritage Pool and officiating league games while attending Siena Heights University where she played volleyball and softball. Mariah went on to graduate from Siena with a degree in Mathematics in After working within her field for a year, Mariah was drawn back to the Recreation Department working at the front desk and programming activities which she discovered was where her passion lies. Mariah continued to work for the City while she attended Spring Arbor University to obtain a degree in Parks, Recreation, and Leisure Management. Mariah brings significant knowledge and experience to the recreation department where she will continue to grow and provide more community programs and special events. Please join me in congratulating Mariah on her new position. Police Department Officer Michael Tripp has resigned from the City of Coldwater Police Department to take a position with the Calhoun County Sheriff s Department. We wish Officer Tripp and his family well in their new endeavor. Every year Facebook ignites and calls are received concerning why there are so many emergency vehicles at one of the local retail stores. On December 6, 2018, CPD and CFD will be participating in the annual Shop with a Cop event sponsored by the Branch County Sheriff s Department. CPD officers have raised over $600 toward the program by participating in a No Shave November challenge. Before and after pictures are forthcoming! Municipal Services Department Christmas decoration installation is nearly complete. Leaf collection is ongoing weather permitting. DMS crews have made one pass through the City and will begin again in the 1st Ward shortly. Anyone wishing to have leaves collected should have them to the curb or in paper bags by Monday, November 26, Holiday Activities This year s community holiday parade will be held at 7:00 p.m. Saturday, December 1, Other holiday events that night include the Tree of Lights tree lighting in Four Corners Park, Branch County Community Chorus concert 7:30 p.m. at St. Mark s Church and crafts, warming center and other activities downtown. Further information about holiday events can be viewed at the Chamber s website at Coldwater Holiday Decoration Endowment Fund The Branch County Community Foundation (BCCF) is actively marketing the Christmas Holiday Decoration Endowment Fund to help raise money to repair, replace and further improve the holiday decorations in downtown Coldwater. Donations are tax deductible and can be forwarded to the BCCF. Please see the attached flyer for more information.

Presentation by Paul Plant of Taylor, Plant & Watkins, P.C. and Finance Director Tom Eldridge of the City and CBPU Financial Report for Year Ending June 30, Council Action: Motion by Councilmember Hazelbaker, seconded by Councilmember Houtz, to accept and place on file the City and CBPU Financial Report for Year Ending June 30, 2018 (attached in Addendum A), as presented. 15. Letter from Keith Baker, City Manager, regarding proposed sale of 31 Pelton Avenue Consider adoption of Resolution No and approval of purchase Agreement No. A Council Action: Motion by Councilmember Knaack, seconded by Councilmember Beckwith, to adopt Resolution No and approve Agreement No. A18-18 (attached in Addendum B), as presented. Budd, Director, regarding Defeasance of 2004 Electric Bonds Consider adoption of Resolution No and approval of Agreement No. A Council Action: Motion by Councilmember Beckwith, seconded by Councilmember Knaack, to adopt Resolution No and approve Agreement No. A18-22 (attached in Addendum C), as presented. 18. Letter from Keith Baker, City Manager, regarding proposed ordinance pursuant to the Michigan Regulation and Taxation of Marihuana Act, Initiated Law 1 of 2018 Consider introduction of Ordinance No City Manager Baker presented information and asked for Council direction. Even if the City Council desires to authorize and regulate marihuana establishments staff recommends adopting an ordinance to opt out during an interim period of time for the following reasons: 1. Allow time for the State of Michigan to establish and promulgate rules, including a process to accept and license applications under the new law. 2. Allow staff time to draft ordinance language regulating the location, number and operation of marihuana establishments in the City of Coldwater. 3. Prevent speculative purchase of land or buildings to establish establishments prior to the adoption of regulatory language thus creating a possible legal nonconforming use status and attempt at becoming a grandfather location or use.

Prevent existing tobacco stores, greenhouses, retail stores or other businesses from immediately opening prior to the establishment of a regulatory framework for licensing marihuana establishments. 5. Prohibit use of marihuana on publicly owned property (parks, sidewalks, etc.) Council discussion included opting out via the proposed ordinance for the interim approximately six months while the state of Michigan establishes and promulgates rules and procedure for the new law, and to direct staff and the Planning Commission to develop zoning rules and regulations for future review. Council Action: Motion by Councilmember Beckwith, seconded by Councilmember Hazelbaker, to introduce for first reading Ordinance No. 817, as presented. PUBLIC COMMENTS BPU Director Jeff Budd presented information and asked if Council were interested in review of a developing pilot program for waste water treatment currently taking place in the City.
