Call to Order Judge Kris Knochelmann called to order the August 23, 2016 meeting of the Kenton County Fiscal Court. Treasurer Roy Cox led the invocation and the Pledge of Allegiance. Approval of Minutes from the meeting of July 26, B. Approval of Minutes from the Public Hearing of June 14, 2016 regarding Goshorn Road. Commissioner Nienaber made the motion for approval; seconded by Commissioner Draud. C. Approval of Minutes from the Special Meeting of August 18, Citizens Address No citizens came before the court at this time.

2 General Business A. Claims List-Dated August 11 and August 19, 2016-Roy Cox, County Treasurer. There were no questions on the Claim's List. B. Presentation of a plaque by Dan Allen honoring the Kenton County Farm Harvest Tour's recognition by Kentucky Monthly. Judge/Executive Kris Knochelmann was presented a plague by Dan Allen honoring the Kenton County Farm Harvest Tour's recognition by Kentucky Monthly in their "Best of Kentucky" edition.. C. Presentation of the Cooperative Extension District's Tax Rate. Treasurer Roy Cox stated that the Cooperative Extension District Board voted unanimously to increase their tax rates by 4%. Their rates will move from.93 cents per $100 to.954 cents per $100 for real property. For personal property the rates will move from 1.03 cents per $100 to cents per $100. This amounts to a realized increase of $47,800, and will impact the citizens of Kenton County on a $100,000 home by 24 cents. Commissioner Sewell asked how many years it has been since there has been an increase? Treasurer Roy Cox answered that last year 4 % was taken, but before that it was many years since an increase was taken. Commissioner Draud stated that paying 24 cents for all of the work that they do is minimal. Judge Knochelmann thanked the board for all of their service. D. Presentation of the Kenton Fire District's Tax Rate No one showed up to the meeting to present. E. Presentation of Planning and Development Services' (PDS) Tax Rate, and Review of the Fiscal Year 2017 Kenton County Planning Commission (KCPC) budget. Dennis Gordon from PDS stated that he is at the meeting for three bodies. One is Planning and Development Services, one is the Kenton County Planning Commission and one is the LINK GIS Kenton County Partnership. He explained that they have held their rate at the compensating rate or less for the seventh year. Judge Knochelmann asked what the specific rate is right now?

3 " Dennis Gordon answered that the actual rate is decreased from last year. Last year it was cents per $100 assessed valuation, and now it will be ,,_ Commissioner Draud asked Mr. Gordon to explain how they are able to keep these rates low. Dennis Gordon stated that their budget has grown due to coming out of the recession. The budget is just about as high as it was prior to the recession. Dennis Gordon then stated that the Kenton County Planning Commission is funded largely out of the PDS budget, in addition to fees that are charged for the services provided. That budget does not include any fee increases. Lastly, the Kenton County Partnership is made up of the Fiscal Court, the Water District, SDl and PDS. PDS is the managing partner for this partnership. There are no increases in fees. F. Presentation by Human Nature regarding the Parks Master Plan. Gary Wolnitzek from Human Nature reviewed his recommendations for the Kenton County Parks. He stated that the county should partner with schools, heath insurance providers and hospitals, as well as private partners to help fund projects for the parks. He then discussed how the county has already exceeded the expectations of the 2020 master plan, and Kenton County is behind Boone and Campbell Counties on open space land. Mr. Wolnitzek then discussed conservation, and suggested that the county could have private land donations, easements and grants. Potential partners could be the Conservation District, Kenton Conservancy or the Banklick Watershed. He suggested that the county link the existing open space, parks and recreation areas, promote connections in the Banklick Creek corridor and support the KY-536 development. His suggestion for potential partners with this project be the Kentucky Transportation Cabinet, Northern Kentucky Health Department, Southbank Partners, Tri-State Trails and the Licking River Greenway. Mr. Wolnitzek then stated that Doe Run has great trails, but could use more attention. It would take some significant geotechnical investigation to upgrade this. It may be beneficial to connect Doe Run to Pioneer Park. This could be done by adding pavement along the side of 17. Also, he suggested that the lake at Latonia Lakes be removed. This would create a community open space on that site. He then discussed ideas for some open space in Piner for parks. Mr. Wolnitzek then gave some recommendations for the county to study further. A user survey would help update the demographics. A county park assessment would be an idea as well. Judge Knochelmann stated that he had asked Mr. Wolnitzek and Mr. Manning for ideas, so this is an overview. This is no plan for anything to be done soon. This is a good first step for us. Commissioner Draud recommended that a facility subcommittee be formed to evaluate proposals, and come up with a five year plan and budget. Scott Gunning stated that the county has a Recreation Commission that is comprised of seven members. They were involved in this plan, and they will present the plan to the Fiscal Court

4 when it comes about. One thing that can be taken away tonight is the partnerships. They have been working towards this with the Conservancy, the Conservation District and the schools. Tomorrow morning, he has a meeting at Ryland Heights Elementary to walk some trails. The Morningview property is now open to the public. Commissioner Draud asked jf the committee has plans to develop an improvement process? Scott Gunning answered that a plan is something that the committee can work on to present to the Fiscal Court. Judge Knochelmann stated that there would be some preliminary meetings to get some ideas on this issue. Commissioner Nienaber stated that it would be nice to have the recommendations so that a plan can be in place. ', Commissioner Sewell stated that everyone impacted would become involved. Commissioner Nienaber asked il the other counties have an ongoing capital improvements plan? Gary Wolnitzek answered that they do have a plan. ', Chris Manning stated that there are three parts to an annual budget. There is capital, operations and land acquisition. Commissioner Draud suggested seeking out some of the potential partners as part of the committee. Judge Knochelmann stated that the report didn't come back that we need 50 more soccer fields, or 20 more baseball fields. The community needs some of that as well, but this plan is looking at more passive space. Gary Wolnitzek stated that this plan is looking at open space in general. Resolutions A. Resolution No A Resolution for the Kenton County Fiscal Court concerning Fiscal Year budget adjustments. Treasurer Roy Cox stated that the budget adjustments are for the following: new accounts that were moved in to do costing by departments (purchase for gasoline), a small adjustment for IT, unused sick pay for the Police Department, gcards from the Golf Course, annual season passes from the Golf Course and gilt cards from the Golf Course. Kenton County received money for the items at the Golf Course earlier in the year, and Davey Golf is honoring all of the items that were sold. Kenton County has to reimburse Davey Golf for these items. The annual

5 ~. passes are being tracked to give us an exact number. As the passes are being used, Kenton County will be billed by Davey Golf. If only 70,000 are used, we will only be billed for 70,000. If 150,000 are used, we will only be billed 81,000. Commissioner Draud made the motion for approval; seconded by Commissioner Nienaber. \ B. Resolution No A Resolution of the County of Kenton, Kentucky, making declaration of official intent with respect to reimbursement of temporary advances made for capital expenditures from subsequent borrowings. Treasurer Roy Cox explained that this is regarding money spent to buy Bavarian. Resolution gives the county the opportunity to roll money over into a bond. This Commissioner Draud made the motion for approval; seconded by Commissioner Nienaber. C. Resolution No A Resolution authorizing, adopting, approving, accepting and ratifying the execution of a grant agreement and any other subsequent grants between the County of Kenton, Kentucky, and the Kenton County Airport Board that may be received pertaining to Fiscal Year 2016 for the funding of the Common use Apron Rehabilitation Project. Rob Ziegler from the Kenton County Airport explained that this Resolution is seeking approval for a grant agreement. The estimated amount to be received would be $4.5 million. D. Resolution No A Resolution honoring the life of Steve Preston by naming the street entering the Football Complex at Middleton-Mills Park "Steve Preston Way". \, Judge Knochelmann read the Resolution honoring the life of Steve Preston, who was a dedicated volunteer for the Kenton County Parks and Recreation deparhnent who passed away recently. The Judge presented the Resolution to Mr. Preston's wife.

6 ~., Ordinances A. Second Reading of Ordinance No An Ordinance of the Kenton County Fiscal Court relating to the levy and adoption of the 2016 tax rates of 14.8 cents per hundred dollars valuation on real property, cents per hundred dollars valuation on personal property and 15.8 cents per hundred dollars valuation on motor vehicles to provide such revenue as has been budgeted and approved for expenditure in the current fiscal year. Judge Knochelmann called for a voice vote, and the motion passed rmanimously 4-0. B. First Reading of Ordinance No An Ordinance of the Kenton County Fiscal Court approving the execution of a Local Development Area agreement relating to the establishment and implementation of a Local Development Area tax increment financing district known as the Walton Kentucky Industrial Park Local Development Area within the City of Walton Kentucky. Jim Parsons explained that the City of Walton is creating an industrial park development area. This is 290 acres of property owned by Omaha Enterprises, LLC. Incremental tax revenues that are generated from the project are to reimburse site development costs and infrastructure costs. A new access road will be built off of Mary Grubbs highway. This site generates $671 to Kenton County in taxes. It has a low assessment. There is a possibility that the industrial park would be valued at about $150 million, which would generate a significant amount of taxes to the county. About 250 acres of this property is in Kenton County, so they would ask the county to partner with the City of Walton. Judge Knochelmann asked what the percentage that Walton is doing, and is being proposed for Kenton County is how much? Jim Parsons answered that the City of Walton is pledging 65% of its real estate increment. There is a provision under the act that allows the creator of the district to create a special payroll tax. Joe Shriver asked if Boone County has taken action on this as well? Jim Parsons answered that they have not yet.,, Commissioner Nienaber asked if the $15.5 million that will be recognized from the TIF be over 30 years? Jim Parsons answered that this is correct. That is the capped amount that could be recovered. It is somewhat limited, as this is exclusively for site development and infrastructure costs. One

7 '\ of the big costs is stream mitigation. The stream mitigation cost is estimated to be around five million dollars or more. None of the costs here are to directly benefit the private developers. Commissioner Nienaber asked if it is $30 million that is expected in revenue? Jim Parsons answered that 1300 new jobs will be created, and this will help contribute to payroll taxes. Judge Knochelmann thanked Mr. Knock for his effort on this project. He appreciates the risk that he is taking. Mr. Knock said it has been overwhelming getting it to this point. Commissioner Sewell asked if there is going to be a need for more roadway accessibility? Mr. Knock answered that he sees it as a distribution center. There is a developer that may be interested in three of the four sites. A road has to be created from Mary Grubbs into the property. Jim Parsons stated that the transportation study that has been done does support this road. When the extension of Mary Grubbs was done, it was upsized to support development like this one. This site is close to the 1-75/Walton interchange. Mr. Knock stated that a potential pathway is opened up to Southern Kenton County. C. First Reading of Ordinance No An Ordinance of the Kenton County Fiscal Court relating to the proposed Improvement of Goshorn Road located in Unincorporated Kenton County, The benefitted properties thereof, providing for the undertaking of said Project according to the" Assessed Value Basis" set forth in KRS Chapter 107 (the "Second Ordinance") County Attorney Stacy Tapke stated that this is the same procedure as was done for Latonia Lakes. ' D. First Reading of Ordinance No An Ordinance Relating to the amendment and reenactment of Chapter 90 of the Kenton County Code of Ordinances regulating animals. Judge Knochelmann stated that this is just updating the existing Ordinance. There may be some additional changes to be made.

8 Consent Agenda A. Exhibit No Request approval to enter into an agreement between the Kenton County Fiscal Court and Sanitation District No. 1 (SDl) regarding private sewer lateral repairs. B. Exhibit No Request approval to enter into an affiliation agreement between the Kenton County Fiscal Court and the Northern Kentucky Regional Hazmat/WMD Unit, Incorporated to operate in the public interest as a volunteer hazardous materials response unit. C. Exhibit No Request approval to enter into an agreement between the Kenton County Fiscal Court and the Catalytic Fund for consulting, advisory and development services. D. Exhibit No Request approval to surplus air tanks for the Kenton County Fire Chief's association. E. Exhibit No Request approval to surplus various equipment for the Kenton County Police Department. F. Exhibit No Request approval to surplus a 2008 Ford Crown Victoria for the Sheriff's Department, to be sold to the Covington Independent School Board. G. Exhibit No Request approval to issue an RFP with the City of Covington and Boone County Fiscal Court for Fleet repair parts. \, H. Exhibit No Request approval to award the bid for three (3) 2017 Chevrolet Equinox LS AWD vehicles from McCluskey Chevrolet, Inc. for the Kenton County Public Works Department and Buildings and Grounds. I. Exhibit No Request approval to surplus various computer equipment belonging to the Kenton County Fiscal Court, Sheriff and Detention Center. J. Exhibit No Request approval to reject all bids for the Cold Shelter Roof Project, and to rebid the project.

9 . K. Exhibit No Request approval to enter into a lease agreement with Millennium Business Systems for copiers and printers for various departments in Kenton County. L. Exhibit No Request approval to award the gasoline and diesel fuel to Lykins Energy Co. for the Kenton County Fleet Department. Judge Knochelmann asked that item be voted on separately from the Consent Agenda. This item is for assistance on 303 Court St. and the new administration building. This will give assistance on development ideas, financing and other areas. Commissioner Draud how much the contract will cost? Judge Knochelmann answered that the total is $19,500. Jeanne Schroer has been a great asset to the community. Judge Knochelmann asked for a motion to approve item Conunissioner Sewell made the motion for approval; seconded by Conunissioner Nienaber. All of the other Consent Agenda items were voted on together. Conunissioner Draud made the motion for approval; seconded by Conunissioner Sewell. Judge Knochelmann called for a voice vote, and the motion passed unanimously 4-0. Judge Knochelmann then asked for motion to approve going out to bid again for the Cold Shelter roof project. Conunissioner Nienaber made the motion for approval; seconded by Conunissioner Sewell. Executive Orders A. Executive Order No An Executive Order relating to the Fiscal Court approving the termination of Tina Hacker as a Call Taker from the Emergency Communications Department, effective August 3, ~- Conunissioner Nienaber made the motion for approval; seconded by Conunissioner Sewell. B. Executive Order No An Executive Order relating to the Fiscal Court approving the reassignment of Jim Underdown from Full-Time to Part-Time Dispatcher for the Emergency Communications Department, effective August 11, 2016.

10 Commissioner Nienaber made the motion for approval; seconded by Commissioner Sewell. 't_, C. Executive Order No An Executive Order relating to the Fiscal Court approving the retirement of Jake Noe as a Sergeant for the Kenton County Police Department, effective September 1, Judge Knochelmann stated that he is very appreciative of Jake Noe's service to Kenton County. D. Executive Order No An Executive Order relating to the Fiscal Court approving the hiring of Rachel White as a Police Officer for the Kenton County Police Department, effective September 8, E. Executive Order No An Executive Order relating to the Fiscal Court approving the hiring of Daniel Merrell as a Police Officer for the Kenton County Police Department, effective September 26, Commissioner Nienaber made the motion for approval; seconded by Commissioner Sewell. F. Executive Order No An Executive Order relating to the Fiscal Court approving the appointment of Karen Finan to the Tri-County Economic Development Board (Tri-Ed), with the term expiring on June 30, Commissioner Draud asked who Ms. Finan is replacing on the Tri-Ed Board? \, Judge Knochelmann answered that Robert Carlisle has resigned from the Tri-Ed Board. G. Executive Order No An Executive Order relating to the Fiscal Court approving the appointment of Paul Ritter to the Kenton County Airport Board, with term expiring on July 1, Commissioner Draud asked who Mr. Ritter will be replacing on the Airport Board?

11 , Judge Knochelmann answered that Mr. Ritter will be replacing Tim Mauntel. H. Executive Order No An Executive Order relating to the Fiscal Court approving the transfer of Timothy Shields from Laborer to Trustee for the Kenton County Parks and Recreation Department, effective July 2, Commissioner Nienaber made the motion for approval; seconded by Commissioner Sewell. Administrative Reporting Emergency Management - Steve Hensley Steve Hensley stated that the Emergency Management Department is funded by Federal dollars that come through the state, providing that they are in compliance with all the procedures required. Last week, an audit was performed by the state Emergency Management Office with the assistance of Brenda Spare and Roy Cox. They audited the financial component and former projects, policies and training that is required. The department received 100% compliance. So funding will continue, and if other departments across the Commonwealth don't meet compliance their funding will go into a Special Project Pool that will be available to us. We will be receiving funding for half the cost of the storm warning siren batteries, and half of Rick Watkin's salary from this Special Project Pool. He thanked Kirk Reinhart and Rick Watkins for their help making this happen. Steve Hensley then stated that the Fire Chief's recruit class has begun. There are 25 students in this class. Also, the Riverfest event is in the planning process, and the new equipment that was acquired thanks to the Fiscal Court will be used during this event. Emergency Communications - Tommy Thompson. Tommy Thompson stated that he is very blessed to have a great group of tele-communicators at the Emergency Communications Center. Dispatcher positions will be posted, and there will be perpetual testing to fill all of the open positions. The radio project is going well. He is working with the consultants, and the RFP should go out on October 1st. The other counties that he is working with are showing tremendous excitement. Tommy Thompson then stated that this week they were successfully able to migrate Covington Fire over to the county dispatch channel. There were a couple of issues, but those were resolved and it is working well.

12 '... Information Technology- Fred McKinley Fred McKinley gave an update on his project list. His department is looking at implementing a remote support tool that will help them look at other PCs while they are working on them. They will be implementing an IT service desk, which will turn s into work tickets that can be tracked. Also, they will be bringing up a new host server that will replace five of the physical servers. The timecard system will be upgraded to keep this updated. Fred McKinley then stated that on August 9th at 5:30 p.m., seven servers were lost. The backup and recovery system worked, and by 8:00 a.m. the next morning they were all back up and all the data was restored. Only one days worth of data was lost. He commended Joe Pflum and Tom Singleton for working a 24 hour day to get this done. This shows that the back ups and restores is improving. Animal Shelter - Elizabeth Cochran Elizabeth Cochran stated that during the peak summer months the average for rescues and adoptions was about 56 dog adoptions per month, which is up about 30% from last year. There was an average of 53 cat adoptions per month, which is up about 120% from last year. The shelter has been receiving an average of 155 cats per month during that peak season. The utilization of Facebook, foster homes, reduced adoption days, cat isolation, utilizing space in pet stores and the generous donation from the Joni Bernard Foundation of the cat condos has helped this number be manageable. Commissioner Draud asked what they are doing differently to increase the adoptions? Elizabeth Cochran answered that Facebook has helped them a lot. Also, the amount of space that is allotted for cats is larger due to the use of the cat condos. Recently, Facebook has been used to get the information out to the public to help with injured animals. An example is a dog named Penelope who needed eye surgery. Within three weeks, $300 was received towards the eye surgery. Theme days on Facebook have also increased the adoption rate. The adoption album is up to date, showing what animals are up for adoption. Advertisements on Facebook help increase foster families that are willing to house animals. Elizabeth Cochran then stated that the live release rate for July was 51 %. She believes the decrease in this rate is due to the large amount of cats and kittens that are being received this time of year. Ms. Cochran then explained that the Ordinance changes have come about by people in the community who feel that changes need to made. Liz Johnson and Katie Sharp from Ohio Alley Cat Rescue were introduced to the Fiscal Court. They are knowledgeable on community cat diversion, which is included in the Ordinance. The Ordinance will support the life saving efforts that are important. Commissioner Sewell asked who is doing all of the Facebook work?

13 Elizabeth Cochran answered that Sara Mize is doing the Facebook work, and she is outstanding. She is part of the team. Commissioner Draud complimented Ms. Cochran on how much she has grown in her position. He feels that she is an outstanding director of the Animal Shelter. She has the passion, and has developed some good administrative skills as well. Treasurer - Roy Cox Treasurer Roy Cox asked that the minutes reflect that the July Financial Statements have been submitted. The Fiscal Court's copies will be given out shortly. County Attorney's Report County Attorney Stacy Tapke had nothing to report. County Administrator Joe Shriver asked the Fiscal Court to approve a Grant of Easement to keep the Latonia Lakes Project moving forward. There will be a small change by the County Attorney. Judge Knochelmann asked for a motion to approve the Grant of Easement, which is Resolution Commissioner Draud made the motion for approval; seconded by Commissioner Nienber.. Commissioners' Reports Commissioner Ton Draud Commissioner Jon Draud stated that he feels it is important to point out that the tax rate has not increased in seven years. Also, he is interested in the concept of naming rights to the new building. He is thinking that bids should be solicited to give companies a chance to have their name affiliated with the new building. Northern Kentucky got $6 million from the Bank of Kentucky for naming rights. County Attorney Stacy Tapke stated that her office has done some preliminary research, and they will come back with something formal at a later date. Commissioner Draud then stated that his intent was never to remodel the Bavarian site. He would like to keep some historical base to the building, but would like most of the building torn down. Commissioner Knochelmann stated that the next steps in the process are going to be to put out an RFP for a project manager. There will be a meeting set up for ideas from the Fiscal Court to go over different ideas for the project. Down the road, the community will be involved in the idea process.

14 Commissioner Beth Sewell Commissioner Sewell had nothing to report. Commissioner Joe Nienaber Commissioner Nienaber had nothing to report. Judge/Executive's Report Judge Knochelmann asked if there are any additional ideas that anyone wants to be researched, please let him know. Also, there was a preliminary meeting to go over the report that was presented by the architect regarding the Independence Courthouse. This will be presented at the next meeting or two. Judge Knochelmann then asked everyone to visit Latonia Lakes to see the progress going on out there. Commissioner Draud asked when the project at Latonia Lakes is scheduled to be completed? Judge Knochelmann stated that it will likely go past next summer. Lastly, Judge Knochelmann congratulated Commissioner Draud for being inducted into the Eastern Kentucky University Hall of Fame. Commissioner Nienaber congratulated Commissioner Draud on the accomplishment. Adjournment Having completed all business before the Court, Commissioner Draud offered a motion to adjourn which was seconded by Commissioner Nienaber. Judge Knochelmann requested a voice vote whereupon all members present voted in the affirmative with a 4-0 vote.
