Capitol Dr. from Goodwin Ave. to intersection of E. Capitol/Hill/North Applicant has provided the proper Certificate of Insurance for this event. Barricades will be provided by the DPW has requested. 5 Motion by Meyers/Landwehr to approve the Temporary Class "B"/"Class B" Beer and Wine License for the applicant as listed below. Carried. TEMPORARY CLASS "B"/"CLASS B" LICENSE Applicant: Cystic Fibrosis Foundation, Danelle O'Neill, Ex. Director Event: Annual Tent Event to benefit Cystic Fibrosis Foundation Date: Sunday, August 25, 2013 Time: 1 pm - 9 pm Motion by Landwehr/Wallschlager to approve the Street Use Permit for the applicant as listed below. Carried. STREET USE PERMIT Event: Annual Hartland Lights Tree Lighting Date: Friday, November 22, 2013 Time: 6-6:30 pm Location: Intersection of E. Capitol/Hill/North Ave. The Police Department will close off the intersection and manage crowd control during this event. 4. Motion by Meyers/Swenson to adopt Resolution No. 06/24/ "A Resolution Authorizing Beer Sales in Municipal Parks as allowed by Wisconsin State Statues. Carried. 5. Consideration of a motion to approve a concession agreement with Endter s Bar and Grill for Nixon Park. Recreation Director Yogerst stated that at the direction of the Park and Recreation Board she had advertised for the possible rental of the concession stand at the Fine Arts Center. Contacts had been made with the local restaurants as well as the service clubs to see if there was any interest in renting the concession stand on the weekends during the summer months. The only applicant was Pat Endter, owner of Endter's Bar and Grill. Mr. Endter had prepared his offer and part of the agreement would include the right of first refusal for the concession stand operation in Motion by Swenson/Landwehr to approve a concession agreement with Endter's Bar and Grill for the concession stand at the Fine Arts Center in Nixon Park for weekends, Friday through Sunday and holidays beginning Thursday, July 4 through Labor Day, Monday, September 3, Carried. 6. Consideration of a motion to adopt Resolution No. 06/24/ "A Resolution Authorizing the Issuance and Sale of $5,090,000 General Obligation Refunding Bonds, Series 2013A". Finance Director Bailey and Administrator Cox addressed the cancellation of the bond refunding. Over the past few weeks there has been a dramatic change in interest rates, and the refunding of the Village's 2010 Build America Bonds debt issue has been cancelled. There would have been no savings on the refunding at this time. Ehlers and Associates, the Village's financial 5
6 consultants have been discussing another option for the Village to consider. The option would be for the Village Board to adopt a Parameter Resolution at the July 8th Village Board meeting. This Resolution adopted in advance of a sale of bonds would allow for the immediate sale provided that it meets the parameters stated in the Resolution. We have 60 days to conduct another sale based on the Moody's rating, etc. Motion by Meyers/Swenson to authorize Staff to work with Ehlers and Associates to create the Parameter Resolution for possible adoption at the July 8 Village Board meeting. Carried. Motion by Swenson/Landwehr to dismiss adoption of Resolution No. 06/24/ A Resolution Authorizing the Issuance and Sale of $5,090,000 General Obligation Refunding Bonds, Series 2013A". Carried. 7. Consideration and possible action to authorize Staff to complete and submit a Simplified Rate Case Water Utility Rate Increase on behalf of the Hartland Water Utility and to annually review the possible need for a full rate case study. Finance Director Bailey had prepared a Simplified Water Rate Increase for the Board to review. During 2012 a simplified rate case application was granted by the Public Service Commission with a 3.2% rate increase to water users. If the Village pursued a full rate case study the rates could possible go up between 10-50%. The Village can continue to apply for the simplified water rate increase on a yearly basis which is an inflationary adjustment. This rate increase would affect the average household with an increase of approximately $1-3 on their quarterly water bill. Motion by Swenson/Landwehr to authorize the preparation of a Simplified Water Rate Increase for the year Carried. 8. Consideration of a motion to adopt Resolution No. 06/24/ "A Resolution Adopting the Compliance Maintenance Annual Report (CMAR)." DPW Operation Supervisor Gerszewski informed the Board that the Village will receive another "A" rating for the operation of the Sanitary Sewer system. The maintenance of the system plus the financial stability of the sewer fund contribute to the "A" rating. Trustee Wallschlager complimented the DPW utility personnel for the quick response and professionalism in dealing with a problem in the building in which her business is located. Motion by Meyers/Swenson to adopt Resolution No. 06/24/ "A Resolution Adopting the Compliance Maintenance Annual Report (CMAR)." Carried. 9. Consideration of a motion to approve a Fire Department Automatic Response Agreement with the Pewaukee Fire Department. President Lamerand noted that the Village had always has had formalized agreements with the Town of Merton and the Town of Delafield Fire Departments but had never had a formal agreement with the Village/City of Pewaukee Fire Department. The agreement presented this 6
7 evening would formalize the Automatic Mutual Aid Agreement with the Pewaukee Fire Department. Motion by Meyers/Compton to approve the Fire Department Automatic Response Agreement with the City of Pewaukee Fire Department. Carried. 10. Discussion and possible action regarding Sewer Back-up Insurance. Administrator Cox and Finance Director Bailey have researched the topic of self-funding a Sewer Back-up insurance for the Village. The Village has historically referred all back-up claims to our insurance company which always denies the claim since the Village properly maintains our system. The proposed policy would cover those occurrences in which the back up into a property owner's home comes from a problem in our main and not in their lateral. If a back up occurs due to a blockage in their lateral they would still be responsible. The funding for this policy could be an additional fee of $1-$2 on the quarterly sewer bill. Discussion followed. Trustee Wallschlager had researched this topic and believes the property owner should invest in a policy to cover backups into the basement area. A rider on the Homeowners Policy should cover this at an annual cost of $35-$40. This includes damage caused by a sump pump as well. Trustee Swenson also believed that the individual property owner should review their homeowners policy to see if it includes coverage for these types of occurrences. Finance Director Bailey indicated that the self-insurance would be used to assist the property owner if the backup occurred due to a failure in our system. The cost is minimal to the property owner. Motion by Wallschlager/Meyers to not pursue a sewer back up insurance policy for the Village. Carried. 11. Announcements: The following individuals will be given an opportunity to make announcements at the meeting in regards to (1) activities taken since the previous meeting on behalf of the community, (2) future municipal activities, and (3) communications received from citizens. It is not contemplated that these matters will be discussed or acted upon. The following individuals may provide announcements: Village President or individual Village Board members or Village Administrator or other Village Staff members. President Lamerand reviewed the Hartland Hometown Celebration weekend events. He encouraged everyone to participate. Recreation Director Yogerst noted that the Grand Opening of the Splash Pad will occur during the Saturday event. The ceremony will be held at 1 pm, but the Splash Pad will be open from 10 am - 7 pm. This will be the normal operational hours for the Splash Pad in the future. 12. Motion by Compton/Wallschlager to adjourn. Carried. Meeting adjourned at 7:55 pm.
