Commute Connection Monthly Report March Federal TIGER Grant Application for Campus Parkway Matt Fell gave a brief review of the TIGER Grant application for Campus Parkway. Director Pedrozo moved to direct staff to submit a TIGER Grant application for the Campus Parkway project with statements of matching funds from Regional Transportation Impact Fee and State Transportation Improvement Program sources. Seconded by Director Samra. Noes - None

3 9. Fiscal Year 2015/16 Final Work Program and Budget Director Pedrozo moved to approve the MCAG Fiscal Year 2015/16 Work Program and Budget. Seconded by Director Samra. Minutes of the April 16, 2015 Regional Waste Management Authority Board meeting Director Walsh moved to approve the minutes of the April 16, 2015 Regional Waste Management Authority Board meeting. Seconded by Director O Banion. 11. Oral Report Monthly Update 12. Proposed Fiscal Year 2015/16 Operation Budget, 2015/16 Fleet Budget, and Capital Project Status Brooks Stayer gave an in-depth presentation on the significant strides in improving the overall financial well-being of the Regional Waste Authority within the past two fiscal years and on the proposed Operation Budget, Fleet Budget, and Capital Budget for fiscal year 2015/16. Director Kelsey moved to approve: a. The Fiscal Year Operation Budget; b. The Fiscal Year 2015/16 Fleet Budget; c. The transfer of $2 million from Operating Funds into the Capital Projects Fund to fund future expansion projects before June 30, 2015; and d. Authorize the Executive Director to execute a purchase agreement with Holt of California for the purchase of a 2015 D7E Dozer (Tier 4), not to exceed $760,000. Seconded by Director Oliveira. Minutes of the April 16, 2015 Transit Joint Powers Authority for Merced County meeting Director O Banion moved to approve the minutes of the April 16, 2015 Transit Joint Powers Authority for Merced County meeting. Seconded by Director Pedrozo. 14. Oral Report Transit Monthly Update 15. Transit Joint Powers Authority for Merced County Budget Fiscal Year 2015/16 Director O Banion moved to approve the Transit Joint Powers Authority for Merced County Final 2015/16 Budget. Seconded by Director Oliveira. 16. Transportation Development Act Triennial Performance Audit for the period July 1, 2011 June 30, Transit Operations and Maintenance Bidder Selection Rich Green gave an in-depth presentation on the bidder selection for Transit Operations and Maintenance. Rich stated that there were five bidders that were deemed financially viable enough to review. A review panel of other transit managers from Fresno, Clovis, Upland and Big Bear Lake independently scored each of the five proposals on completeness of responses and technical review for both operations and maintenance. Curtis Riggs, Merced Transportation Company, spoke on the selection process. Curtis also had questions regarding the scoring and if the other proposals included wage increases. Kathy Pennycuff, MTC bus driver, stated a letter had been sent to the Board requesting the Board consider hiring Merced Transportation Company. Gaylord Phillips, Teamsters 386, stated the employees are very happy and he wants to make sure they stay that way. Gaylord feels the wages for the bus drivers needs to be increased. Mark Foster, National Express, spoke briefly on how hiring National Express would bring jobs to Merced.

8 The Directors discussed at length the process that was involved in the staff recommendation of hiring National Express to provide the Transit Operations and Maintenance. The Directors also discussed the fueling vendor contract for gas and diesel fuel and requested staff to go out to bid for this service and bring back the results for final consideration. Director Samra moved to approve authorizing the Executive Director to negotiate and enter into an agreement with National Express for Transit Service Operator and Bus Maintenance. Seconded by Director Thurston. The Chair called for a roll call vote: Director Pedrozo No Director Walsh No Director McDaniel No Director Kelsey No Director O Banion No Director Price No Director Oliveira Yes Director Samra Yes Director Villalta Yes Director Thurston Yes MOTION FAILED. There was additional discussion by the Directors and Legal Counsel on the pre-award/ post-award process for protesting the recommendation of staff to hire National Express. Director Walsh moved to approve: a. Withdrawing the current Notice of Intent to Award; b. Authorize the Executive Director to negotiate the agreement with National Express but also affording the other vendors a debrief including the Chair and Vice Chair; and c. Upon completion of the debriefs, issue a Notice of Intent to Award and bring final agreement back to the Board. Seconded by Director Price. 9 18. Purchase and Improvements of a Transit Operations and Maintenance Facility Director Pedrozo moved to approve: a. The purchase agreement; and b. Authorize the Executive Director to sign all necessary documents for the purchase of property and the building and/or improvement of a maintenance and operation facility.
