1 January 3, 2011 The Board of County Commissioners met in regular session January 3, 2011 at the Courthouse in. Upon roll call the following were present: Steve Tompkins, Chairman; James E. Covey, Member; Lyle K. Miller, Member; Karen Fry, County Clerk; Ronald Wright, County Extension Agent; Sheriff Bruce Peoples; and Local News Representatives. The meeting proceeded in the Custer County Courtroom for the official swearing into office of James E. Covey as Commissioner for District #1 and Lyle K. Miller as Commissioner for District #3. The meeting reconvened in the County Commissioner s Office following these proceedings. Motion was made by James E. Covey and seconded by Lyle K. Miller to elect Steve Tompkins as Chairman of the Board of County Commissioners. Vote: James E. Covey, Aye; Steve Motion was made by Lyle K. Miller and seconded by Steve Tompkins to elect James E. Covey as Vice-Chairman of the Board of County Commissioners. Vote: James E. Covey, Aye; Steve The Board approved appointment of the following agents for T Highway Cash, District #3: Requisitioning Agent - Lyle K. Miller; Assistant Requisitioning Agent - Annette Reed; Receiving Agent - DeAnne Shelton; and Assistant Receiving Agent - Kirk Spencer. The Board approved appointment of Steve Tompkins as the Requisitioning Agent for the following accounts: Jail Bond Fund, Custer County Miscellaneous Accounts; Custer County General Accounts; and Civil Emergency Management Accounts. The following officer s reports were examined and approved by the Board: Board of Prisoners Report; County Clerk Report; Election Board Report; Court Clerk Report; Assessor Report; Health Department Report and Rural Convenience Report. The allocation of alcoholic beverage tax for December, 2010 was approved for distribution by the Board of County Commissioners as certified by the County Treasurer: CUSTER - $241.83; THOMAS - $761.78; WEATHERFORD - $ ; CLINTON - $ ; BUTLER - $212.29; and ARAPAHO - $ The Board approved T Highway Cash Fund Appropriations for the month of January, 2011 as follows: Personal Services - $ ; Travel - $500.00; Maintenance & Operation - $ ; Capital Outlay - $0.00; County Bridge & Road Improvement Fund - $ ; and Lease - $ Motion was made by Steve Tompkins and seconded by James E. Covey to approve minutes for the County Commissioner meetings for the previous month. Vote: James E. Covey, Aye; Steve Motion was made by Steve Tompkins and seconded by James E. Covey to recess this portion of the Commissioner meeting for a special meeting of the Custer County Law Enforcement Center Trust. Vote: James E. Miller to recess this portion of the Commissioner meeting for a special meeting of the Custer County Economic Development Authority. Motion was made by Steve Tompkins and seconded by Lyle K. Miller to reconvene into the regular Commissioner meeting. Vote: James E. Covey, Aye; Steve Tompkins, Aye; and Lyle K. Miller, Aye. The Board approved a Resolution declaring the following Custer County equipment in the Sheriff s Department as surplus property: 2004 Ford Crown Victoria Car, ID# B ; SN# 2FAFP71W54X129897, Original Cost - $21, Said item is to be sold at auction on March 12 & 13, There was no action taken on the agenda item to declare a burn ban for Custer County. Motion was made by James E. Covey and seconded by Lyle K. Miller to approve the following

2 Resolution: Notice is hereby given by the Board of County Commissioners of Custer County, State of Oklahoma, that there shall be an election of three members to the Board of Directors of the Custer County Free Fair in accordance with the laws of the State of Oklahoma, Title 2 Sections 15-68, OS Supp 2001 relative to Free Fairs. One member from each commissioners district will be elected for a 3 year term. Whereas, February 1, 2011 at 10:00 a.m. has been designated as the date for said election, with each County Commissioner presiding over his respective district. Locations for each election will be as follows: District No.1 - The County Shop located in ; District No.2 - The County Shop located at 2071 W. Lawter Rd in Weatherford, Oklahoma; and District No.3 - The County Shop in Butler, Oklahoma. Whereas, the filing period for said election shall consist of five consecutive days, commencing on Monday, January 24, 2011 at 8:00 o'clock a.m. and ending on Friday, January 28, 2011 at 4:00 o'clock p.m. Prospective candidates must file with the County Clerk of said Custer County. The form for declaration of candidacy will be prescribed by the Board of County Commissioners for uniformity purposes. Whereas, the requirements for filing for said position shall be as follows: (1) Only registered voters of Custer County are eligible to file as a candidate. (2) Any person filing for said position must reside in the Commissioner's district they seek to represent. Whereas, in the event there is not a candidate, or candidates, for election to the Fair Association Board of Directors, the County Commissioner shall appoint a director for each position for which no candidates have filed by the close of the filing period. The appointment(s) will be announced no later than two weeks from the closing of the filing period. Motion was made by Lyle K. Miller and seconded by James E. Covey to accept Circuit Engineering District Auction Policies to participate in the disposal of surplus equipment. Vote: James E. Covey, Aye; Steve There being no further business the Board recessed. The Board approved Utility Permit in favor of Markwest OK Gas LLC for permission to establish a gas pipeline crossing county roads between Sections 32 and 29, T14, R19WIM. The Board approved Utility Permit in favor of Markwest OK Gas LLC for permission to establish a gas pipeline crossing county roads between Sections 21 and 28, T14, R19WIM. Motion was made by Steve Tompkins and seconded by Lyle K. Miller to enter into executive session at 9:15 a.m. to discuss John and Joyce May vs. Board of Custer County Commissioners with council. Covey to accept settlement in the case of John and Joyce May vs. Board of Custer County Commissioners. This settlement establishes an easement on the related property with the plaintiff accepting all liability due to proximity of the road with the agreement no county possessions will remain on said property.
