1 BOARD OF EDUCATION CHILLICOTHE CITY SCHOOL DISTRICT CHS / CMS Cafeteria 5:30 p.m. Members Present: Mr. Hartmus, Mrs. Lowe, Mr. Markley, Mr. Mullins, Mrs. Shoemaker Staff Present: Mr. Saxton, Mrs. Lawwell Call to Order Mr. Mullins called e meeting to order and Mrs. Lawwell called e roll. Mr. Mullins announced e meeting was being recorded. Pledge of Allegiance The Pledge of Allegiance was led by Chillicoe Middle School Principal Aaron Brown Approval of Board Agenda It was moved by Mr. Hartmus and seconded by Mrs. Lowe to adopt e agenda for e July 27, 2015 Board of Education Regular Meeting as presented. Roll call: Mr. Hartmus - yes, Mrs. Lowe - yes, Mr. Markley - yes, Mr. Mullins - yes, Mrs. Shoemaker - yes. The motion carried. PRESENTATION CAPA Program Update Curriculum and Instruction Director Alissa Putnam gave a presentation to update e Board on e Format, Enrollment, Programming and Costs of last year s CAPA Program. Her update included Projected Costs for e school year maintaining e current programs; along wi recommendations for ways to improve e CAPA Program for e new school year. She recommended hiring a full-time Language Arts teacher, a full-time Ma teacher, a coordinator for e program, and changing e digital curriculum. Wi e employment of full-time teachers for major subject areas, a program coordinator, having an intervention specialist on site and offering expanded / flexible hours and programs we should be able to provide a unique experience to meet e needs of any student and lead em to college and career preparation. Her recommendations also included projected costs wi e new program recommendations at reflected $15, in cost reductions for e program. Honors and Recognitions Mr. Mullins was presented a Milestone Service Award for his years of service as a board member by Kim Miller-Smi from e Ohio School Boards Association. The meeting recessed for ten minutes for a short reception to congratulate Mr. Mullins. Public Participation Mr. Mullins welcomed all visitors to e meeting and opened e floor for public participation. There was none Approval of a Resolution of Acceptance in e OSFC Classroom Facilities Assistance Program It was moved by Mr. Markley and seconded by Mr. Hartmus to adopt e following resolution as presented. RESOLUTION AUTHORIZING THE SCHOOL DISTRICT BOARD TO ENTER INTO A RESOLUTION OF ACCEPTANCE IN THE OHIO SCHOOL FACILITIES COMMISSION CLASSROOM FACILITIES ASSISTANCE PROGRAM WHEREAS, e Ohio School Facilities Commission ( Commission ) made a determination in favor of proceeding wi a Master Facilities Plan for Classroom Facilities under ORC Section and conditionally approved a Scope of Project for e School District; and -1-

2 WHEREAS, e Ohio Controlling Board approved e determination and conditional approval of e Commission and approved e amount of e State s portion of e project cost; and WHEREAS, e Commission has certified e State s conditional approval and reservation of funds for e project to is School District s Board of Education pursuant to ORC Section based on e following funds: STATE SHARE: $25,687,894 LOCAL SHARE: $21,017,367 TOTAL BUDGET: $46,705,261 WHEREAS, e 120 day time limitation pursuant to ORC Section has not lapsed since e State s certification of conditional approval. NOW, THEREFORE, BE IT RESOLVED by e Board of Education of e Chillicoe City School District, Ross County, Ohio at e conditional approval as granted by e Commission for e Classroom Facilities Project be hereby accepted in accordance wi e provisions of ORC Section Roll call: Mr. Hartmus - yes, Mrs. Lowe - yes, Mr. Markley - yes, Mr. Mullins - yes, Mrs. Shoemaker - yes. The motion carried Approval of a Resolution to Proceed wi e Issuance of Bonds It was moved by Mrs. Lowe and seconded by Mr. Hartmus to approve e following Resolution as presented. RESOLUTION DETERMINING TO PROCEED WITH THE ISSUANCE OF BONDS IN AN AMOUNT NOT TO EXCEED $22,450,000 AND CERTIFYING THE SAME TO THE BOARD OF ELECTIONS (Ohio Revised Code Section ) WHEREAS, e Board adopted a resolution (e Resolution of Necessity ) at its meeting on June 22, 2015 at determined at it is necessary to issue bonds in an amount not to exceed $22,450,000 (e Bonds ) for e purpose of constructing and renovating school facilities and locally funded initiatives under e Classroom Facilities Assistance Program of e Ohio School Facilities Commission; furnishing and equipping e same; improving sites ereof; and acquiring land and interests in land as necessary, and at it is necessary at a direct tax be annually levied on all e taxable property in e School District outside of e ten-mill limitatin to meet e debt charges on e Bonds and any securities issued in anticipation ereof; NOW, THEREFORE, BE IT RESOLVED by e Board of Education of e Chillicoe City School District, Ross County, Ohio, a majority of all of e members ereof concurring, at: Section 1. It is necessary to proceed wi e issuance of e Bonds in e amount and for e purpose described in e preamble to is Resolution, and to levy, outside of e ten-mill limitation provided by law, an annual tax on all e taxable property in e School District to pay debt charges on e Bonds and any securities issued in anticipation ereof. Section 2. The Bonds shall be dated approximately December 1, 2015; shall bear interest at e estimated rate of 4.75% per annum; and shall be paid over a period not to exceed 38 years as calculated under Ohio Revised Code Chapter 133. Section 3. The question of issuing e Bonds shall be submitted to e electors of e School District at e election to be held at e usual voting places wiin e School District, on November 3, Section 4. The form of e ballot to be used at said election shall be substantially as follows: -2-

3 AFFIRMATIVE VOTE IS NECESSARY FOR PASSAGE Shall bonds be issued by e Chillicoe City School District, Ross County, Ohio for e purpose of constructing and renovating school facilities and locally funded initiatives under e Classroom Facilities Assistance Program of e Ohio School Facilities Commission; furnishing and equipping e same; improving e sites ereof; and acquiring land and interests in land as necessary, in e principal amount of $22,450,000, to be repaid annually over a maximum period of 38 years, and an annual levy of property taxes be made outside e ten-mill limitation, estimated by e county auditor to average over e repayment period of e bond issue 2.99 mills for each one dollar of tax valuation, which amounts to 29.9 cents ($0.299) for each one hundred dollars of tax valuation, commencing in 2015, first due in calendar year 2016, to pay e annual debt charges on e bonds, and to pay debt charges on any notes issued in anticipation of ose bonds? FOR THE BOND ISSUE AGAINST THE BOND ISSUE Section 5. The Treasurer of e Board is hereby directed to certify a copy of is Resolution, along wi copies of e Resolution of Necessity and e certificate of e Ross County Auditor, to e Board of Elections of Ross County, Ohio on or before August 5, Section 6. The motion carried Approval of a Resolution Declaring Intent to Cease Collection of a Portion of an Emergency Levy It was moved by Mr. Mullins and seconded by Mr. Hartmus to approve e following Resolution as presented. RESOLUTION DECLARING INTENT TO CEASE COLLECTION OF A PORTION OF AN EMERGENCY LEVY UPON APPROVAL OF BOND ISSUE WHEREAS, R.C auorizes school districts to impose voter approved emergency levies upon eir residents; and WHEREAS, e voters of e School District approved a $2,740,000 emergency levy (e Emergency Levy ) on May 7, 2013, for five years for e following period: Tax Collection Years ; and WHEREAS, e School District intends to place a bond issue (e Bond Issue ) before its voters at e election scheduled for November 3, 2015; NOW, THEREFORE, BE IT RESOLVED by e Board of Education of e Chillicoe City School District, Ross County, Ohio, at: Section 1. If e Bond Issue is approved by e voters of e School District, e Board shall cease collection of $1,227,500 of e Emergency Levy for Tax Collection Year In Tax Collection Years 2017 and 2018, e Emergency Levy shall also be reduced in dollar amount. Such reduction shall equate to millage commensurate wi e debt service millage required for e Bond Issue. -3-

A copy of is resolution shall be certified to e Ross County Budget Commission and e Treasurer of e School District is auorized to provide any additional documentation required by said Budget Commission in order to effectuate is resolution. Section 3. It is hereby found and determined at all formal actions of is Board concerning and relating to e passage of is resolution were taken in an open meeting of is Board, and at all deliberations of is Board and of any of its committees at resulted in such formal action were in meetings open to e public, in compliance wi all legal requirements, including Section of e Ohio Revised Code. APPROVAL OF FINANCIAL REPORTS To approve e financial reports for e mon of June 2015 as presented. C. APPROVAL OF TEMPORARY APPROPRIATIONS To approve e temporary appropriations for FY2016 as presented. D. APPROVAL OF A RESOLUTION FOR POST-ISSUANCE COMPLIANCE POLICY To approve e following Resolution for Post - Issuance Compliance as presented. -4-

5 A RESOLUTION APPROVING A WRITTEN POST-ISSUANCE COMPLIANCE POLICY IN CONNECTION WITH THE ISSUANCE OF TAX-EXEMPT AND TAX-PREFERRED OBLIGATIONS BY THE SCHOOL DISTRICT WHEREAS, e School District has previously issued, or intends to issue in e future, bonds and oer obligations for e purpose of financing various capital improvements in e School District; and WHEREAS, such obligations were issued, or will be issued as, tax exempt and tax-preferred obligations (collectively, e Obligations ) under e Internal Revenue Code of 1986, as amended; and WHEREAS, in connection wi e issuance of e Obligations, it is advised at e Board have a formal written policy outlining e policies and procedures necessary to promote compliance wi federal income tax and securities laws, as well as e requirements set for in e documents for each issue of Obligations; and WHEREAS, e Board desires to formally approve a written policy outlining such policies and procedures; NOW, THEREFORE, BE IT RESOLVED by e Board of Education of e Chillicoe City School District, Ross County, Ohio, at: Section 1. Approval of Written Post-Issuance Compliance Policy. The Board hereby approves a written post issuance compliance policy (e Policy ) in connection wi e issuance of e Obligations of e School District. On behalf of e Board, e Treasurer is hereby auorized to execute e Policy, which Policy shall be in e form attached hereto as Exhibit A. The Treasurer is also hereby auorized to execute any oer documents necessary in connection wi e Policy. The Treasurer s execution of such documents shall be conclusive evidence of e Board s approval of such documents. a) Open Meeting. APPROVAL OF WORXTIME CONTRACT To approve e contract wi Worxtime rough e MEC / American Fidelity for a fee of $.45 per employee per mon for tracking and a one-time fee annually of $3.50 per employee for reporting. This will allow e district to stay in compliance wi e Affordable Care Act. The motions carried Appointment of OSBA Delegate and Alternate It was moved by Mrs. Lowe and seconded by Mr. Markley to appoint Mr. Hartmus as e Official Delegate and Mr. Mullins as e Alternate Delegate to e Ohio School Boards Annual Business Meeting to be held November 10, 2015 in Columbus, Ohio at e Convention Center. APPROVAL OF A RESOLUTION OF INTENT NOT TO PROVIDE CAREER-TECHNICAL EDUCATION CLASSES IN GRADES 7 AND 8 To approve e following Resolution as presented: RESOLUTION OF INTENT NOT TO PROVIDE CAREER - TECHNICAL EDUCATION IN GRADES 7 AND 8 WHEREAS, Ohio Revised Code Secton (A) requires each city, local and exempted village school district to provide for students in grades seven rough twelve career - technical education by means of establishing and maintaining a program, by being a member of a joint vocational school district (JVSD), or by contracting wi a JVSD or anoer school district; and WHEREAS, Division (B) of Section provides at a board of education may adopt a resolution not to provide career - technical education to students enrolled in [grade seven] [grade eight] [bo grades seven and eight] and will receive a waiver from e Ohio Department of Education so long as said resolution is filed by September 30 of at particular school year; NOW, THEREFORE, BE IT, AND IT IS, HEREBY RESOLVED at, while e Chillicoe City School District Board of Education recognizes e importance of providing adequate training for students to enter eir selected occupations, e Board hereby adopts is resolution notifying e Ohio Department of Education of its itent not to offer career - technical education for students enrolled in [grade seven] [grade eight] [bo grades seven and eight] during e school year; and BE IT FURTHER RESOLVED at e Chillicoe City School District Board of Education respectfully requests at e Ohio Department of Education issue e waiver required by Ohio Revised Code Section (B) and BE IT FURTHER RESOLVED at e Treasurer / CFO is hereby directed to certify and submit a copy of is resolution to e Ohio Department of Education at e earliest opportunity so as to ensure its receipt by e Department on a date which is in no event later an e 30 day of September, C. APPROVAL OF SAFE SCHOOL HELPLINE FOR THE SCHOOL YEAR To approve e Safe School Helpline Program for e school year as presented. D.
