THE SPEAKER (KEITH R. McCALL) PRESIDING PRAYER The SPEAKER. The prayer today will be offered by Rev. Wilbur C. "Bill" Albright, who is the guest of Representative Day and was a former pastor in the Speaker's hometown of Summit Hill. So welcome, Reverend Albright. REV. WILBUR C. "BILL" ALBRIGHT, Guest Chaplain of the House of Representatives, offered the following prayer: Mr. Speaker, honorable members of the House, friends, and any guests, it is a singular honor but a challenging few moments to appear here before you for prayerful meditation. I fail in that task if first I do not thank you. I express the gratitude of the citizens of this Commonwealth for all you do and all you have in your charge. I ask you now to join me in a time of prayer and reflection. People are confused, frightened, and feel threatened in these days, and so we ask our creator that You would empower us through Your many names since You call us to be a one people living in this place and time. Make all of us responsive to and responsible for one another in these difficult days. Make us dedicated to shaping a vision for making of this world and this State a better place for those who come before us, that they know they follow a proud example. Sustain us, Jehovah, God, who is in all times and places. Keep us steadfast in our commitment, open to the validity of all options in resolving the issues coming before us, honest in our dealings with one another, especially in the knowledge that we are accountable for all we say and do, both for the people who have entrusted these Representatives to serve in this body, and to You, our creator, give all serving Your strength and Your shalom. Remember this is Your time, Your world, and we but live in this world to serve. It is therefore to You we pray. Amen. JOHN BOSCO ELEMENTARY SCHOOL STUDENTS INTRODUCED The SPEAKER. For what purpose does the gentleman from Montgomery County, Representative Murt, rise? Mr. MURT. Mr. Speaker, I would like to welcome students from my alma mater, St. John Bosco Elementary School, from Hatboro, Pennsylvania. They are sitting in the gallery. This is a special visit, Mr. Speaker, because this is the final year that St. John Bosco School will be open, and I would like to welcome them to the House of Representatives, and I would ask everyone to give them a warm welcome. Thank you, Mr. Speaker. The SPEAKER. The Chair thanks the gentleman. Welcome to the hall of the House. Will the guests please rise. Welcome to the hall of the House. RON JONES INTRODUCED The SPEAKER. We have a number of presentations, and the Speaker would like to recognize and welcome to the hall of the House, in the back of the House, a group of individuals, but in particular Ron Jones. He has been married to his wife, Cathy, for 42 years, and they have eight children. Ron is a United States Vietnam veteran. He was awarded a Purple Heart and Army Commendation of Valor Medal. He was also activated in Operation Desert Storm and retired from the Army in Ron has also served his community as a firefighter with Aston-Beechwood Fire Company in Aston Township. He has served in numerous positions within the fire company for the

2 336 LEGISLATIVE JOURNAL HOUSE MARCH 22 past 34 years and has been awarded a life membership. Ron also serves on the Aston Township Planning Board and has been named the Aston Township "Person of the Year." He is the guest of Representative Barrar. STATEMENT BY MR. BARRAR The SPEAKER. The Speaker would like to recognize Representative Barrar under unanimous consent. Without objection, the unanimous consent will be authorized. Mr. BARRAR. Thank you, Mr. Speaker. I invited Ron Jones and his family up here today to present him with a flag flown over the Capitol in his honor. Ron has been a lifelong firefighter in Aston Township, a Vietnam vet, and he exemplifies everything that is great about the communities that we live in here in Pennsylvania. But really, I wanted to invite him here Ron is in the fight of his life with an illness and I wanted to invite him here today to say thank you, on behalf of all the people of this Commonwealth, for his service to our Commonwealth, his community, and his country and thank him. Thank you, Mr. Jones. EMMAUS HIGH SCHOOL GIRLS CROSS COUNTRY TEAM PRESENTED The SPEAKER. The Chair recognizes the gentleman from Lehigh County, Representative Reichley, for the purpose of a presentation. Joining Representative Reichley is Representative Karen Beyer from Northampton County. Mr. REICHLEY. Thank you very much, Mr. Speaker. Ladies and gentlemen of the House, Representative Beyer and I are very honored to present to you for the third year in a row the PIAA State AAA Girls Cross Country Champions from Emmaus High School. And I do appreciate the members' attention to this because Representative Beyer and I are very proud of these young ladies who have so distinguished themselves with their athletic accomplishments. The Emmaus High School Girls Cross Country Team is here for the fourth year in a row. Four years ago they were the first runners-up, but now they have demonstrated their great tenacity, their skill, their endurance, and their dedication to these championships by winning this for the third year in a row. Representative Beyer and I are joined up here on the dais by Amanda Faust, Brianna Faust, Christina Faust, and Kelsey Coates, and yes, the Faust girls are triplets. They are all sisters and they are all going to Quinnipiac. So anybody attending other universities should be prepared to lose in your girls cross-country races at the collegiate level. We are also joined by their teammates, Lydia Brough, Kelli Steinert, and Megan Smolinski, who are in the back of the House, along with head coach Dan Wessner and assistant coach Doug Finley. Would you all please rise, and please recognize these young ladies for their wonderful athletic accomplishments. Thank you very much. CLAIRTON HIGH SCHOOL FOOTBALL TEAM PRESENTED The SPEAKER. The Chair recognizes the gentleman from Allegheny County, Representative Levdansky, for the purpose of a presentation. Mr. LEVDANSKY. Thank you, Mr. Speaker. Mr. Speaker and members of the House, on December 18 of 2009 history was made in Clairton, Pennsylvania, when the Clairton Bears Football Team brought home the Class A PIAA Football Championship. After handing my good friend, Representative Barbin's home team of Bishop McCort a 15-to-3 defeat, the Bears made history by defeating 15 teams throughout their most successful season ever. Coach Monch was certainly looking down from above with a smile on his face when the Bears won their last defensive struggle of the season. Today we are here to honor the Clairton Bears Football Team for their athletic prowess, but I also want to acknowledge the school's academic success as well. The students of the Clairton School District have made tremendous progress since the challenges that have been posed statewide with the No Child Left Behind law. In both 2008 and 2009, the district met their AYP (adequate yearly progress) goals as well as its attendance and graduation targets. I am proud to represent the city of Clairton in the Pennsylvania House of Representatives and ask you to join me in recognizing both the athletic and academic success of the Clairton Bears Football Team. Mr. Speaker, I also want to point out that this team, the Clairton Bears, have won three of the last four WPIAL League Championships. This year marked their second appearance in the State championship football game. They came up just a little bit short the year before, but I happen to think that that just whetted their appetite and their determination to make this year a victorious one. This team is only the third team in Pennsylvania history to score over 600 points 2 years in a row, and this year this team and this is the definition of a shutdown defense, if I ever heard one in 16 games their opponents did not score 1 point in 8 of the 16 games. The average score for this team this year was the Bears 41 and their opponents 4, and again, they pitched a goose egg in 8 of the 16 victories. This 2009 team was obviously first in team defense overall in the State. I am joined here today by the wonderful strong coach, Coach Tom Nola. Also joining us today in the rear of the floor are the defensive coordinator, Mike LeDonne; the athletic director, Tony Ferrare. Up here in the front is the principal of the high school, Debra Maurizio; also the players behind me, Kevin Weatherspoon is the wide receiver these are the cocaptains of the Bears Chanze James cannot be with us today, but we are joined by Kevin Weatherspoon, the wide receiver and defensive back; Deontae Howard, who is an outstanding running back for the Bears; and Ed Ball, who is an outstanding linebacker for the Clairton Bears. So again, I want to congratulate this team and this school not just for their outstanding athletic accomplishments but their continued improvements on the academic front as well. The SPEAKER. Samuel Stack, who recently returned from his second tour of duty in Iraq. During his first tour in Iraq, Sam was a corporal in the U.S. Marine Corps. During his most recent tour, Sam served as a specialist in the 2d/104th for the Army National Guard, the Nomads. They are the guests of Representative Tim Krieger. Will the guests please rise. Thank you, Mr. Speaker. What this amendment would do would be to insert language at the end of the budget to establish a moratorium on the leasing of any more State forest land for gas drilling. It obviously would only become effective when the budget is effective, so it would not affect any proposed leasing which may occur in the next months. The purpose of this amendment, Mr. Speaker, is to prevent the continued use of our State forest lands as a cash cow to fund the budget, to prevent the industrialization, as it were, of our State forests. This is a heritage that we really want to pass on to our children in its current state. I am not sure if everyone knows this, but right now 692,000 acres of our State forest land is subject to Marcellus drilling. That is a lot of drilling. We do not really know what the impact of all that drilling is going to be on, once the drilling starts and once the thousands of wells come online, what the impact is going to be on local water quality and on the character of the forests, on the fragile ecosystems. We have leased I believe what we responsibly can. I believe this is a good amendment, but at this point, Mr. Speaker, after discussions with leadership, after listening to the thoughts of my colleagues in caucus, after discussing some constitutional issues relating to this, although I commit steadfastly to maintaining my efforts to secure moratorium legislation, I am going to withdraw this amendment at this time. The extraction or other removal of natural gas from the soil or water of this Commonwealth. "Stripper well." A producing site or a nonproducing site that is not capable of producing and does not produce more than 60,000 cubic feet of natural gas per day. "Unit." A thousand cubic feet of natural gas measured at the wellhead at a temperature of 60 degrees Fahrenheit and an absolute pressure of pounds per square inch in accordance with American Gas Association Standards and according to Boyle's law for the measurement of gas under varying pressures with deviations as follows: (1) The average absolute atmospheric pressure shall be assumed to be 14.4 pounds to the square inch, regardless of elevation or location of point of delivery above sea level or variations in atmospheric pressure from time to time. (2) The temperature of the gas passing the meters shall be determined by the continuous use of a recording thermometer installed to properly record the temperature of gas flowing through the meters. The arithmetic average of the temperature recorded each 24-hour day shall be used in computing gas volumes. If a recording thermometer is not installed, or if installed and not operating properly, an average flowing temperature of 60 degrees Fahrenheit shall be used in computing gas volume. (3) The specific gravity of the gas shall be determined annually by tests made by the use of an Edwards or Acme gravity balance, or at intervals as found necessary in practice. Specific gravity determinations shall be used in computing gas volumes. (4) The deviation of the natural gas from Boyle's law shall be determined by annual tests or at other shorter intervals as found necessary in practice. The apparatus and method used in making the test shall be in accordance with recommendations of the National Bureau of Standards or Report No. 3 of the Gas Measurement Committee of the American Gas Association, or amendments to the Standards or Report. The results of the tests shall be used in computing the volume of gas delivered under this article. Amend Bill, page 194, lines 26 and 27, by striking out all of said lines and inserting Section Implementation legislation. Upon enactment of a natural gas severance tax imposed at the rate of 5% of the gross value of units severed at wellheads during a calendar month, plus 4.7 per unit severed, but not imposed on units severed from a stripper well, the following apply: (1) The Secretary of the Commonwealth shall submit notice of the enactment to the Legislative Reference Bureau for publication in the Pennsylvania Bulletin. (2) Upon receipt of the notice under paragraph (1), the bureau shall file the notice for public inspection without regard to 1 Pa. Code (relating to filing for public inspection) and (relating to effectiveness prior to publication). Section Effective date. This act shall take effect as follows: (1) The following provisions shall take effect immediately: (i) Section (ii) This section. (2) The remainder of this act shall take effect upon the date of filing of the notice for public inspection under section 2001(2). Will the House agree to the amendment? What this amendment does is makes the passage of this budget contingent upon the enactment of a severance tax in an amount exactly as the Governor proposed last year. Mr. Speaker, the purpose of this amendment is to ensure that before we pass this budget, we have raised moneys in a responsible way to pay for that budget. Mr. Speaker, as mentioned before, I am very concerned about the use of our State forests as a cash cow to fund this budget. The more appropriate way to make up that revenue and other needed revenues is through a severance tax on natural gas drilling. Mr. Speaker, the events have shown that the gas industry can well afford this severance tax. As events have developed, it has become apparent that the value of this leased land, this Marcellus leased land, for drilling is enormously valuable. One company's leasehold assets were purchased by ExxonMobil for the equivalent of $41 billion. This is not an industry, a fledgling industry, nor an industry that cannot afford to do its fair share. Mr. Speaker, I believe that good public policy dictates that a severance tax be enacted. It is only fair; it is only right. It is a good source of revenue, but, Mr. Speaker, I am not convinced that based on discussions with the Speaker, with my colleagues, and based on representations that they will continue to support legislation like this, I do not think today is the day to have this vote. So therefore, I will be withdrawing both this amendment and a very similar amendment, amendment The SPEAKER. The Chair thanks the gentleman. Will the House agree to the bill on second consideration?
