The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Part I of Title of the Pennsylvania Consolidated Statutes is amended by adding a chapter to read: Subchapter CHAPTER LAW ENFORCEMENT ACTIVITIES A. Preliminary Provisions (Reserved) B. General Provisions SUBCHAPTER A PRELIMINARY PROVISIONS (Reserved)

11 SUBCHAPTER B GENERAL PROVISIONS Sec.. Release of law enforcement officer information when firearm discharged or use of force.. Release of law enforcement officer information when firearm discharged or use of force. (a) General rule.-- (1) Except as provided under paragraphs (), () and (), if an official investigation has been initiated into the discharge of a firearm or use of force by a law enforcement officer during the performance of the law enforcement officer's official duties that results in death or serious bodily injury of an individual, the name and identifying information of the law enforcement officer may not be released to the public by: (i) A public employee of the law enforcement officer's employing agency. (ii) The agency conducting or participating in the official investigation. (iii) A person acting on behalf of a public employee under subparagraph (i) or an agency under subparagraph (ii). () A public employee of the officer's employing agency, the agency conducting or participating in the official investigation or a person acting on behalf of the public employee or agency shall release the name or identifying information of the law enforcement officer at the conclusion of the investigation if the law enforcement officer is charged with a criminal offense arising out of the discharge 0HB00PN00 - -

12 of the firearm or use of force. () Except during any period in which the release of the information can reasonably be expected to create a risk of harm to the person or property of the law enforcement officer or an immediate family member of the law enforcement officer, a public employee of the officer's employing agency, the agency conducting or participating in the official investigation or a person acting on behalf of the public employee or agency may release the name or identifying information of the law enforcement officer: (i) thirty days after the discharge of the firearm or use of force; or (ii) after completion of the official investigation. () The name or identifying information of the law enforcement officer may be released if: (i) the law enforcement officer consents in writing to the release of the information; or (ii) disclosure is made pursuant to court rules. (b) Penalty.--A person who violates this section commits a misdemeanor of the second degree. (c) Exception.--This section shall not apply to the Office of Attorney General or a district attorney's office. (d) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection unless the context clearly indicates otherwise: "Law enforcement officer." Has the meaning given to the term "peace officer" in 1 Pa.C.S. 01 (relating to definitions). "Serious bodily injury." As defined in 1 Pa.C.S. 01 (relating to definitions). "Use of force." Payment of court costs, restitution and fines. (a) [Use of credit cards] Method of payment.--the treasurer of each county may allow the use of credit cards and bank cards

43 in the payment of court costs, restitution and fines[.], and may provide for automatic periodic deductions from a bank account, subject to the agreement of the owner of the account. (a.1) Wage attachment.--a court may, at sentencing, assign an amount not greater than % of the defendant's gross salary, wages or other earnings to be used for the payment of court costs, restitution or fines. (b) Procedures regarding default.-- (1) If a defendant defaults in the payment of [a fine,] court costs [or], restitution or fine after imposition of sentence, the issuing authority or a senior judge or senior magisterial district judge appointed by the president judge for the purposes of this section may conduct a hearing to determine whether the defendant is financially able to pay. () If the issuing authority, senior judge or senior magisterial district judge determines that the defendant is financially able to pay the [fine or] costs, restitution or fine, the issuing authority, senior judge or senior magisterial district judge may enter an order for wage attachment, turn the delinquent account over to a private collection agency or impose imprisonment for nonpayment, as provided by law. () If the issuing authority, senior judge or senior magisterial district judge determines that the defendant is without the financial means to pay the [fine or] costs, restitution or fine immediately or in a single remittance, the issuing authority, senior judge or senior magisterial district judge may provide for payment in installments. In determining the appropriate installments, the issuing authority, senior judge or senior magisterial district judge 0HB0PN00 - -

44 shall consider the defendant's financial resources[, the defendant's ability to make restitution and reparations and the nature of the burden the payment will impose on the defendant] and ability to pay. If the defendant is in default of a payment or advises the issuing authority, senior judge or senior magisterial district judge that default is imminent, the issuing authority, senior judge or senior magisterial district judge may schedule a rehearing on the payment schedule. At the rehearing the defendant has the burden of proving changes of financial condition such that the defendant is without the means to meet the payment schedule. The issuing authority, senior judge or senior magisterial district judge may extend or accelerate the schedule, leave it unaltered or sentence the defendant to a period of community service as the issuing authority, senior judge or senior magisterial district judge finds to be just and practicable under the circumstances. () A decision of the issuing authority, senior judge or senior magisterial district judge under paragraph () or () is subject to section (relating to right to appellate review). (c) Prohibition against adverse action.--no employer may discharge, refuse to hire or take any other adverse action against any person based in whole or in part on an order for the attachment of wages or the possibility thereof. An employer who violates this section may be held in contempt of court and shall be liable to the person for actual damages resulting from the violative action. Section. Each sponsor must be verified by an affidavit form provided by the department. () A trainee classification is nonrenewable and shall be limited to a: (i) two-year time period for residential and accessibility certification categories; and (ii) three-year time period for all other certification categories. () Individuals with trainee classifications may learn the duties of a certified individual while under the supervision of a sponsor described in paragraph (). () The department may establish fees and applications and registration procedures to establish the trainee classification system. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Section 0 of Title of the Pennsylvania Consolidated Statutes is repealed: [ 0. Counseling. (a) List of counselors.--any hospital or other facility providing maternity care shall provide a list of available counselors and counseling services compiled pursuant to subsection (b) to its maternity patients who are known to be considering relinquishment or termination of parental rights pursuant to this part. The patient shall sign an acknowledgment of receipt of such list prior to discharge, a copy of which receipt shall be provided to the patient. (b) Compilation of list.--the court shall compile a list of

52 qualified counselors and counseling services (including all adoption agencies) which are available to counsel natural parents within the county who are contemplating relinquishment or termination of parental rights pursuant to this part. Such list shall be distributed to every agency, hospital or other facility providing maternity care within the county and shall be made available upon request to any intermediary or licensed health care professional. (c) Court referral.--prior to entering a decree of termination of parental rights pursuant to section 0 (relating to hearing) or 0 (relating to alternative procedure for relinquishment), if the parent whose rights are to be terminated is present in court, the court shall inquire whether he or she has received counseling concerning the termination and the alternatives thereto from an agency or from a qualified counselor listed by a court pursuant to subsection (b). If the parent has not received such counseling, the court may, with the parent's consent, refer the parent to an agency or qualified counselor listed by a court pursuant to subsection (b) for the purpose of receiving such counseling. In no event shall the court delay the completion of any hearing pursuant to section 0 or 0 for more than 1 days in order to provide for such counseling. (d) Application for counseling.--any parent who has filed a petition to relinquish his or her parental rights, or has executed a consent to adoption, and is in need of counseling concerning the relinquishment or consent, and the alternatives thereto, may apply to the court for referral to an agency or qualified counselor listed by a court pursuant to subsection (b) for the purpose of receiving such counseling. The court, in its 0HB00PN01 - -

53 discretion, may make such a referral where it is satisfied that this counseling would be of benefit to the parent. (e) Counseling fund.--except as hereinafter provided, each report of intention to adopt filed pursuant to section 1 (relating to report of intention to adopt) shall be accompanied by a filing fee in the amount of $ which shall be paid into a segregated fund established by the county. The county may also make supplemental appropriations to the fund. All costs of counseling provided pursuant to subsection (c) or (d) to individuals who are unable to pay for such counseling shall be paid from the fund. No filing fee may be exacted under this subsection with respect to the adoption of a special needs child who would be eligible for adoption assistance pursuant to regulations promulgated by the Department of Public Welfare. In addition, the court may reduce or waive the fee in cases of demonstrated financial hardship.] Section. Title is amended by adding a section to read: 0. Adoption-related counseling services. (a) Purpose of counseling.--counseling under this section shall provide a birth parent with assistance in understanding the adoption process, the birth parent's rights and obligations, the consequences of a decision to relinquish parental rights and the alternatives to relinquishment and adoption. (b) Right to counseling.--a birth parent or presumptive father, putative father or an agency or attorney acting on behalf of the parent may apply for counseling under this section if the individual: (1) is considering relinquishing parental rights with respect to a child or placing a child for adoption; or () has relinquished parental rights with respect to a 0HB00PN01 - -

54 child or placed a child for adoption. (c) Compilation of list.--each court shall compile a list of qualified counselors and counseling service providers, including agencies, which are available within the county and surrounding area to provide counseling under this section. (d) Distribution of list.-- (1) Each court shall provide the list compiled under subsection (c) to the following: (i) Each agency within the county. (ii) Each health care provider of obstetrical or maternity care within the county. (iii) Any person upon request. () An agency or a health care provider of obstetrical or maternity care that receives the list compiled under subsection (c) shall provide the list to any individual it knows is considering relinquishing parental rights with respect to a child or placing a child for adoption. (e) Notice of availability of list.--the Department of Human Services shall provide notice of the availability of the list compiled under subsection (c) to any person filing either an acknowledgment of paternity or a claim of paternity under section (relating to acknowledgment and claim of paternity). (f) Referral for counseling.-- (1) If a parent decides to receive counseling, the parent shall contact the court for a referral authorizing counseling.
