1 Constructors Association of Western PA s 2009 Legislative Scorecard CAWP s Legislative Scorecard Developed by the CAWP Legislative Committee CAWP Legislative Committee Mission Statement To review the legislative efforts of the Association and, where appropriate, recommend policy on legislative proposals. Identify critical legislative priorities important to the union heavy and highway construction industry. Assist in the development of legislative strategies to promote the union heavy and highway construction industry. Attend and promote others to attend CAWP legislative receptions. Provide industry testimony at public hearings. To urge that members become involved in legislative matters, to know their legislators, state and federal.

2 Constructors Association of Western PA s 2009 State Legislative Scorecard CAWP s State Legislative Scorecard PA House of Reprentatives No Recorded Removing State Police Funding from Motor License Fund: House Bill 4 gradually shifts funding for the PA State Police from the Motor License Fund to the General Fund, which would free up approximately $500 million to be spent on road and bridge improvements. While no vote has yet been taken on this legislation, a concerted effort has been made by the industry to enlist legislators to co-sponsor the bill. CAWP PREFERRED POSITION: SUPPORT Removing Prevailing Wage from Road Repair Work: House Bill 787 would remove prevailing wage rate requirements from road repair work, such as milling, paving and patching. No vote has yet been taken on this legislation, but cosponsors of this legislation will be recorded as not supporting CAWP s position. Suspending PA Prevailing Wage Act: House Bill 1923 amends the Pennsylvania Prevailing Wage Act stipulating it will have no application during the period after June 30, 2009, and before July 1, The sponsors of the bill claim that this will make stimulus funds go further. No vote has yet been taken on this legislation, but co-sponsors of this legislation will be recorded as not supporting CAWP s position. PA Senate No Recorded Pennsylvania General Assembly Pennsylvania s General Assembly is the legislative branch of government. Commonly called the state legislature, it consists of two bodies the Senate and the House of Representatives. It is comprised of the men and women elected by the people of the Commonwealth to serve as our state Senators and Representatives. Local Business Privilege Tax: Senate Bill 601 would prevent contractors from having to pay the local business privilege tax in any municipality where they have a project. This reverses a 2007 State Court ruling that expanded a municipality s ability to tax anyone conducting business within city limits. The State Supreme Court ruling in V.L. Rendina v. Harrisburg found that a contractor can be required to pay the local business privilege tax even if the contractor does not have a permanent office within city limits. No vote has yet been taken on this legislation, but co-sponsors will be recorded as supporting CAWP s position. 5 Constructors Association of Western PA s 2009 Federal Legislative Scorecard CAWP s Federal Legislative Scorecard KEY TO VOTES 111th Congress House of Representatives American Recovery and Reinvestment Act of 2009 (H.R. 1): Vote on the $819 billion economic stimulus with approximately $150 billion of the proposed spending for infrastructure investment. (Passed ) Highway Trust Fund Fix (H.R. 3357): Transferred $7 billion of general fund revenue to the Highway Trust Fund to provide enough revenue to ensure state transportation departments will continue receiving full reimbursements for federal-aid highway projects through the end of the current federal fiscal year September (Passed ). Health Care Reconciliation Act of 2010 (H.R. 4872): A vote on a reconciliation bill that makes changes to the Patient Protection and Affordable Care Act (H.R. 3590), a bill that fails to expand health care opportunities and innovation, while increasing the cost of health care to both the government and the private sector. (Passed Mar. 21, 2010, ) CAWP/AGC s PREFERRED POSITION: OPPOSE Repeal of 3% Withholding (H.R. 275): The bill would repeal a law that goes into effect in 2012 requiring federal, state, and local governments to withhold 3 percent from all payments for goods and services as a guard against possible business tax evasion. Employee Free Choice Act (H.R. 1409): The bill would create a fundamental shift in labor policy by approving legislation that would rely solely on card check rather than a secret ballot election to decide representation when organizing a union and would also impose mandatory mediation and biding arbitration. CAWP/AGC s PREFERRED POSITION: AGAINST 111th Congress - Senate American Recovery and Reinvestment Act of 2009 (H.R. 1): Vote on the $819 billion economic stimulus with approximately $150 billion of the proposed spending for infrastructure investment. (Passed 61-37) United States Congress The United States Congress is the legislative branch of the federal government of the United States, consisting of two houses, the Senate and the House of Representatives. Both senators and representatives are chosen through direct election. Each of the 435 members of the House of Representatives represents a district and serves a two-year term. House seats are apportioned among the states by population. The 100 Senators serve staggered six-year terms. Each state has two senators, regardless of population. Every two years, approximately one-third of the Senate is elected. Highway Trust Fund Fix (H.R. 3357): Transferred $7 billion of general fund revenue to the Highway Trust Fund to provide enough revenue to ensure state transportation departments will continue receiving full reimbursements for federal-aid highway projects through the end of the current federal fiscal year September (Passed 79-17). Patient Protection and Affordable Care Act (HR 3590): Procedural vote on nearly $1 trillion health care bill that shifts rather than contains costs. Bill fails to expand health care opportunities and innovation while increasing the cost of health care to both the government and the private sector. (Passed 60-40) CAWP/AGC s PREFERRED POSITION: OPPOSE Jobs Bill: (H.R. 2847): A vote on a jobs bill that would extend highway program authorization, provide additional Highway Trust Fund revenue, restore highway spending authority, allow public bodies to convert tax credit bonds to Build America Bond, exempt unemployed workers hired from payroll taxes and extend expensing thresholds.
