6 Upon a motion by Member Mendoza, and seconded by Member Shuklian, the Tulare County Transportation Authority unanimously approved the Authority Consent Calendar Action Items III-A through III-C. Absent: Vander Poel, Petty, Macareno, and Sayre. IV. AUTHORITY ACTION/DISCUSSION ITEMS A. Information: Measure R Revenue for November and December 2018 and Treasury Loan Update Mr. Smalley gave and update with the year to date amount of $17,105,526 compared to $16,069,769 which represented an increase of 6 percent. Mr. Smalley provided an update on the procurement of the Treasury Loan from the County Treasurer in the amount of $20,000,000. Mr. Smalley explained that the loan would continue to deliver regional projects timely and wanted to publicly thank the County Treasury for being very cooperative and helpful. B. Information: Local Consultant Utilization, 2017/2018 Fiscal Year Mr. Smalley stated that the Board requested to get a report of local consultants that were used on design and environmental jobs and that TCAG encouraged the use of local firm when possible. Mr. Smalley also shared that local firms had benefited from Measure R in the amount of $508,490. C. Information: Measure R Revenue for November and December 2018 and Treasury Loan Update Ms. Boling reported that the allocation for the month of November and December were $2,803, and $2,790,961.34, making the year to date amount $17,105,526, representing a 6% increase from the previous year. Ms. Boling also stated that the procurement of cash flow funding from the County Treasurer had been successful to ensure the timely and continuous delivery of regional projects. B. Information: Local Consultant Utilization, 2017/2018 Fiscal Year Mr. Smalley provided a brief summary on the Measure R local preference policy and reported on the agencies that utilized local consultants during the 2017/2018 fiscal year. C. Information: Conflict of Interest Code (Form 700) Due April 1, 2019 Ms. Kane stated that the item was simply a repeat from the earlier item reported for TCAG. 9 Tulare County Association of Governments Sitting as the Tulare County Transportation Authority AGENDA ITEM IV-A February 25, 2019 Prepared by Leslie Davis, TCAG Staff SUBJECT: Action: Adoption of Resolution: Measure R Project Supplemental for City of Visalia Houston Ave Rehabilitation Project BACKGROUND: On April 2, 2018 the City of Visalia s City Council approved the award of the construction contract for the Houston Ave Major street rehabilitation that included funding from Federal Surface Transportation Funding (STP), Measure N and a request to submit a supplemental with TCAG for the use of Measure R. The rehabilitation project covered Houston Ave from Demaree to west of Dinuba and included traffic signal interconnect. The Measure R expenditure plan includes an allocation to the City of Visalia for the use of signals and synchronizations in the amount of $11,000,000. DISCUSSION: It was the intent of the City to request the Measure R supplemental, but due to staffing changes at the City of Visalia, the request to TCAG for the funding did not take place. Had the supplemental been submitted, staff would have approved by delegated authority. However, because the project is complete, all post MR supplementals are required to come to the Board for approval. The project is complete and the City of Visalia is ready to file the notice of completion (NOC). The City of Visalia is requesting the ability to provide a supplemental request for Measure R to assist with the funding of the project as presented to their Board on April 2, The total project cost of $3,975, was funded 76% with STP, 17% with Measure N and 7% with Measure R or $300, RECOMMENDATION: It is recommended that the Board approve the supplemental in the amount of $300,000 to fund the Houston Ave project for the City of Visalia. TCAG staff would have approved the supplemental pre-completion by delegated authority as outlined in the expenditure plan. FISCAL IMPACT: No fiscal impact outside of the approved expenditure plan. 10 BEFORE THE TULARE COUNTY TRANSPORTATION AUTHORITY COUNTY OF TULARE, STATE OF CALIFORNIA In the matter of: APPROVE MEASURE R SUPPLEMNTAL FOR) CITY OF VISALIA HOUSTON AVE ) Resolution No. [ ] REHABILITATION PROJECT ) WHEREAS, on November 7, 2006, the citizens of Tulare County approved Measure R and the Measure R Expenditure Plan; and and WHEREAS, on April 16, 2007, the Measure R Policies and Procedures were adopted; WHEREAS, the Measure R Expenditure Plan and the Policies and Procedures serve as a guide for the use of transportation funds that will be generated through the Tulare County halfcent transportation sales tax over the next thirty years; and WHEREAS, the City of Visalia will submit a supplemental for the Houston Ave rehabilitation project in the amount of $300,000 for approval, post project completion; and WHEREAS, Tulare County Transportation Authority authorizes TCAG staff to approve and sign supplemental for $300,000 to assist with the funding of the Houston Ave rehabilitation project for the City of Visalia, post completion. 5

13 Tulare County Association of Governments Sitting as the Tulare County Transportation Authority AGENDA ITEM IV-B February 25, 2019 Prepared by Leslie Davis, TCAG Staff SUBJECT: Information: Measure R Revenue for January 2019 and Bond Rating BACKGROUND: On November 7, 2006, the voters of Tulare County approved Measure R, imposing a ½-cent sales tax for transportation within the incorporated and unincorporated area of Tulare County through The transportation sales tax funds are spent in accordance with the Expenditure Plan that resulted from a joint effort among all the cities and the County of Tulare. The Expenditure Plan reflects the transportation needs of the residents of Tulare County. The plan includes funding for Regional Projects, Local Programs, Transit/Bike/Environmental Programs and Administration. The funds are distributed as follows: 1. Regional Projects (50%) 2. Local Programs (35%) 3. Transit/Bike/Environmental (14%) 4. Administration and Planning Program (1%) Measure R revenue collection began on April 1, Monthly Measure R advancements are received by TCAG from the State Board of Equalization followed by quarterly clean-up disbursements. In total, TCAG receives eight advancements and four clean-up disbursements throughout a fiscal year. The Measure R 2018 Strategic Work Plan was approved by the Authority on June 18, 2018 with Resolution No The Work Plan serves as a guide for the delivery of Measure R projects in the upcoming five-year period. DISCUSSION: Status of Measure R Revenues Fiscal Year 2018/ Measure R allocations have been received for January 2019 and requested distribution made through January The allocation for the month January is $2,793, compared to $2,200,400 for the same period last year. The year to date amount is $19,899,266 compared to $18,270,169 for the same 12 month period last year, representing a 8.9% increase. See attached revenue chart covering fiscal years 2014/2015, 2015/2016, 2016/2017, 2017/2018 and 2018/2019 year to date. 7
14 TCTA/TCAG Bond Rating from S&P On February 6, 2019, our most recent S & P bond rating was updated and released. S&P Global Ratings raised its long-term rating on the Tulare County Transportation Authority, Calif.'s series 2014 sales tax revenue bonds to AA from AA-. The outlook is stable. Additionally, S & P Global Ratings assigned its AA- issued credit rating (ICR) to the Tulare County Association of Governments (TCAG), Calif. The outlook is stable. The ratings reflect their view of TCAG s: Strong adjusted fund balances, including restricted funds, reflecting both its strong ability to generate and accumulate funds as well as its limited expenditures beyond dispersing funds to eligible claimants supporting transportation-related projects within our county; and Limited operating risk as an entity with limited operations beyond funding generation and remittance, and other planning-related functions. 17 AGENDA ITEM IV-C February 25, 2019 Prepared by Leslie Davis, TCAG Staff SUBJECT: Tulare County Association of Governments Sitting as the Tulare County Transportation Authority Information: Tulare County Transportation Authority Audit Year Ending June 30, 2018 BACKGROUND: Tulare County Transportation Authority (TCTA) audit was completed for the year ending June 30, 2018 and issued January 28, The audited financial statements of the governmental activities and the major funds of the Tulare County Transportation Authority (TCTA) can be found at The audit was conducted in accordance with auditing standards generally accepted in the United States of America and the standards applicable to financial audits contained in Government Auditing Standards, issued by the Controller General of the United States. The TCTA audit by Brown Armstrong Certified Public Accounts did not identify any instances of noncompliance or other matters that are required to be reported under Government Auditing Standards. DISCUSSION: Member Agencies: Tulare County Transportation Authority (TCTA) did not have any material weaknesses for the year-ended June 30, The audit is provided to the Citizens Oversight Committee (COC) and is reviewed and reported on by the COC Audit/Finance/Budget committee member. The City of Dinuba, City of Lindsay, City of Exeter, City of Farmersville, City of Porterville, City of Tulare, City of Woodlake, County of Tulare, and the City of Visalia Measure R audits have not been completed. 19 Tulare County Association of Governments Sitting as the Tulare County Transportation Authority AGENDA ITEM IV-D February 25, 2019 Prepared by Leslie Davis, TCAG Staff SUBJECT: Information: Status of Feasibility Study at SR 216 and Ave 328 in Ivanhoe BACKGROUND: May of 2018, TCAG staff met with Caltrans to discuss a feasibility study at SR 216 and Ave 328 in Ivanhoe to review the operations and deficiencies at the intersection and how it affects the citizens of Ivanhoe and possible recommendations for improvement. DISCUSSION: TCAG staff contacted California Walks and partnered with them to provide a site visit in Ivanhoe at the Ivanhoe Elementary School as a result of our original discussion with Caltrans in May of The original site visit was attended by California Walks staff, Tulare County Staff and several leading community members to discuss the issues, walk the community and plan a Safe Streets Workshop and Bike Rodeo. The workshop along with a bike rodeo took place on September 29, 2018 (attachment 1) with a good turnout by citizens and provided a venue to discuss community wide concerns. The information gathered from the workshop and bike rodeo resulted in a formal report of recommendations (see attachment 2, pages 15-16) to improve pedestrian & bicycle safety for the town of Ivanhoe produced by California Walks in conjunction with Berkeley Safe Transportation Research and Education Center (SafeTREC) and California Office of Traffic Safety (OTS). This report was also shared with Caltrans to assist and enhance the feasibility study. January 25, 2019, TCAG staff met with Caltrans staff to discuss updates on the feasibility study and review potential improvements to the intersection and possibly the Road 160 corridor as well. Identifying other entities with which we can partner to make the necessary improvements at this intersection for the town of Ivanhoe was also discussed. The final Feasibility Study is expected in April Staff will update the Board at that time. Because of this collaborative effort from Caltrans, Tulare County Health and Human Services, Tulare County RMA, the Ivanhoe Community Group, California Highway Patrol, Leadership Counsel for Justice and Accountability, California Walks, SafeTREC, OTS and TCAG, the possibility of meaningful improvements for this intersection and the Road 160 corridor for Ivanhoe s citizens has a much greater possibility of coming to fruition and competing for grant funding. 23 Tulare County Association of Governments AGENDA ITEM IV-E February 25, 2019 Prepared by Amie Kane, TCAG Staff SUBJECT: Information: Conflict of Interest Code (Form 700) due April 1, 2019 BACKGROUND: The Tulare County Association of Governments is required to adopt and maintain a conflict of interest code. This code outlines who must disclose information on an annual basis, and what type of information must be disclosed. DISCUSSION: The Political Reform Act requires certain officials and employees who serve in positions designated in an agency s conflict of interest code to file a Statement of Economic Interest (Form 700). Appendix A of this staff report provides a listing of positions that are designated to provide a Form 700 by April 1, Appendix B lists the disclosure categories for those designated positions.
