Gary Peal and Andy Lyman at the front desk, with Tom DeBrosse greeting, had a busy morning as we had a very welcome rush of visiting Rotarians and guests. Dave Heagerty led off with God Bless America and Zippity Do-dah, followed by Pete Chatard with the pledge and Gary Bockhold with the four-way test. Jerry Cauley said the invocation. MISSING: Susan Brothers, Chris Caldwell, Bill Henry, Bill Lawrence, John Potvin, Larry Riley and Frank Willett. BIRTHDAYS We serenaded Len Wilson and Jerry Cauley (at left alongside Gary Bockhold) with a traditional Happy Birthday verse and they had checks for the Sunrise Foundation. Mike Daigle (below right with Gary B) also handed a birthday check to the Foundation and had Terrie sing to him in French; some members tried valiantly to join in! SERGEANT-AT-ARMS Gary Bockhold had no absentee or late fines to collect. Brian Bain paid a dollar for misreading the previous week s attendance sheet and listing Bob Stevens as missing; Bob, who joined Rotary more than a half century ago, continues his perfect attendance. Happy $s were plentiful. Contributors were Len Wilson (just back from great weekend in Naples), Bob Stevens, Tom DeBrosse, Jack Donaghy, Ray Pontoni, Sandie Stamey, the Archbold, OH, group (all sitting together), Bob Cunningham, Tom Smith, Howard Shand, Terry Rawson (visits over past three weeks by his three kids), Bob Banwell, Jim Martin (heading home), Art Hall (will miss breakfasts with Jim), Pete Chatard (weather better here than in Seattle), Jud Werbelow, Dave Heagerty (daughter in Pennsylvania snowed in, no shovel), Keith Lindgren ($5, knee surgery went well, lots of snow back home in Virginia), Sunrise President Carolyn Eliades (remains on time, brother visiting next week), Brian Bain, guest speaker Paul Rosen, Bill Isbister (Sunrise breakfast $13 v $14 at home club, reimbursed extra dollar when submits receipts), Jan Clemens (visited Richmond, VA, for grand-daughter s 9 th birthday), Charlie Clemens, Doug Smoot, Martin Salsman, Al Conners, Terrie Hoops, Mike Daigle (can talk French with Terrie), Gary Peal, Andy Lyman (Detwiler s open on University Parkway), Gary B. 3 MISCELLANY Quote of the Week was drawn by Carolyn from Sigmund Freud: Sometimes a cigar is just a cigar. Pineapple Antique Show: Tom DeBrosse said dealer numbers for this year s show (March 7, 8) are down slightly but expected to pick up next year when a professional organizer will handle arrangements for Sunrise. A Rotary information table is planned near the hall entrance. GUEST SPEAKER Paul Rosen, a trial lawyer for more than 45 years who lectures at the University of South Florida s Lifelong Learning Academy, had interesting historical insights on the Supreme Court and asked, rhetorically, How many of you think the government is broken? A graduate of Wayne State University Law School, he was co-recipient in 2013 of the Lawyer of the Year designation in the Detroit region by the peer review guide Best Lawyers. And, as a member of the Supreme Court Bar who has orally argued before the nation s highest, he is in a unique position to talk knowledgeably about it. In 1789, he said, there were no struggles so [the government was not broken. But in early 1801, John Adams, just before handing over the presidency to Jefferson, made midnight appointments, created a circuit court of appeals and the Alien Sedition Act, the latter purportedly to strengthen national security but criticized as a move against voters who disagreed with the Federalist party. Adams also attempted to appoint William Marbury as a Justice of the Peace but did not complete the formalities before his presidency ended, and Paul said the subsequent Marbury v (James) Madison case was one of the most cited legal events in U.S. history. Marbury v Madison dealt with the process of appointing highranking government officials which requires completion within a president s term. Marbury s appointment was not completed before Adams left office. Marbury sought to assume the post but Jefferson and his Secretary of State, Madison, refused to complete the appointment process. Marbury took the case before the Supreme Court where Chief Justice John Marshall wrote the unanimous ruling that helped define the boundary between the constitutionally separate executive and judicial branches and formed the basis for the exercise of judicial review in the United States. He said Marbury was entitled to the position granted by Adams but the final decision ultimately was up to the new president, Jefferson. He said a provision of the Judiciary Act of 1789 that enabled Marbury to bring his claim to the court was unconstitutional since it purported to extend the court's original jurisdiction and his petition was thus denied Paul felt the worst case decided by the Supreme Court was in 1987 when it ruled that neither Dred Scott, nor any other person of African ancestry, could claim citizenship in the United States. The decision caused public outrage, exacerbated North-South tensions and precipitated the Civil War. He also noted a 1943 case in which the court ruled that a state cannot compel a student to say the pledge, noting that no one has the right to tell us how to think.

4 Also mentioned in passing was Yates v the USA, in which the court decided a Florida fisherman who disposed of a few undersized red grouper did not violate a provision of a federal statute concerned with retention of business records and that prosecutors may have been overzealous in pursuing the case. Undoubtedly the most offbeat comment was in Justice Elena Kagan dissent, quoting Dr. Seuss One Fish Two Fish Red Fish Blue Fish (1960). Fast forwarding to the present, Paul said it would be interesting to see how the court decides on whether people of the same sex can marry, whether Obamacare subsidies are legal, and whether President Obama acted constitutionally on immigration. Answering questions, he said Marshall handled several cases that dealt with the balance of power i.e. should the government decide what s constitutional or Congress or should it be the rule of law. Marshall thought the latter. Paul said politics no doubt comes into play at times in the court while the justices are appointed for life, whenever there is vacancy the president in power at the time decides who will fill it. We live in this incredible country. Government does work but maybe not the way we want, he said. Broken government? It has a lot to do with us, the voters! declared a voice from the back.
