1 MINUTES OF NOVEMBER 26 & 28, 2018 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order 9:30 a.m. WORKSESSION WITH COUNTY SHERIFF The Board met with Sheriff Joe Kennedy, Chief Deputy Dave Riniker, Clerk Sue Gaur, and Maintenance Director Steve Hahlen. The geothermal pumps for the heating system have gone up in price by approximately $6,000 each. Kennedy said with the money the City of Dubuque pays the County for heat an amendment won t be necessary. Klein said both the Sheriff s maintenance and the courthouse maintenance need to question the engineers who design projects to be more accurate in their estimations. Maintenance Director Steve Hahlen will be retiring the end of The Sheriff would like to hire someone to start training under Hahlen in the new fiscal year. He has talked to the union about the step increases with the salary. With budget worksessions starting soon the Sheriff had a spreadsheet of renting costs vs having a facility at the West Campus for offices and storage. Motion by Wickham, seconded by Baker, carried unanimously to recess at 10:30 a.m. WORKSESSION WITH COUNTY AUDITOR Upon reconvening at 10:40 a.m. the Board met with Auditor Denise Dolan to discuss deadlines for the agenda documents. Dolan would like the agenda and drop box be out by the end of the work day on Thursday to give the Board an extra day to contact department heads should they have questions. Wickham would like more information easily accessible to the public either by the website or social media. To have the agenda and then links to click on for each item on the agenda for the information. QUARTERLY ELECTED OFFICIALS AND DEPARTMENT HEAD STAFF MEETING President/CEO of the United Way of Dubuque Danielle Peterson. She would like to thank the county for their past support with 100% of all donations to the United Way stay in the ten county area covering Iowa, Wisconsin, and Illinois. 81 cents on the dollar goes into the programs while the rest is administration and overhead. 449 (NOVEMBER 26 & 28)

2 Supervisor Daryl Klein said he would like to thank all the department heads for their many years of support and working together. The Board met with Supervisor Elect Ann McDonough, County Recorder John Murphy, County Attorney Ralph Potter, GIS Project Manager Jeff Miller, Sunnycrest Manor Administrator Cris Kirsch, Veterans Affairs Randy Rennison, IT Superintendent Nathan Gilmore, Health Director Patrice Lambert, County Assessor Dave Kubik, City Assessor Rick Engelken, MHDS Regional Coordinator Jody Jansen, Sheriff Joe Kennedy, Auditor Denise Dolan, HR Administrator Dawn Sherman, and Budget Director Stella Runde. Gilmore will be meeting with department heads individually to discuss location of cameras in each department. They will also be installed in all hallways and stairwells. Sheriff Kennedy said this is for security purposes only, they have no interest in watching people work. Motion by Klein, seconded by Baker, carried unanimously to recess at 12:07 p.m. EXECUTIVE SESSION PER IOWA CODE (1)(C) Upon reconvening at 12:20 p.m. motion by Klein, seconded by Baker, carried unanimously to enter executive session per Iowa Code 201.5(1)(C). Motion by Klein, seconded by Baker, carried unanimously to recess at 2:25 p.m. WORKSESSION REGARDING DUBUQUE BASED ACT TEAM AND ACCESS CENTERS The Board met with Chris Corken of the Greater Dubuque Community Foundation, Malissa Sprenger from Turning Point Treatment Center, John Decker from Substance Abuse Services Center, Joyce McDermott from Mercy Medical Center, Julie Heiderscheit from Hillcrest Family Services, Peter Supple from the Greater Dubuque Community Foundation, and Brooke Gomez from Cresent Community Health Center. Corken is looking to establish an Access Center in Dubuque County. This would be an effort of several counties together. A project manager would need to be hired at a cost of $70,000 with benefits, construction costs of $23,700 for improvements at Hillcrest to accommodate the mental health patients, and administrative overhead of $34,184. This much needed facility would be a one stop shop for people suffering from mental health and either drug or alcohol addiction known as dual diagnosis. 451 (NOVEMBER 26 & 28)

4 Motion by Klein, seconded by Baker, carried unanimously to approve $125,000 to start the Access Center. Motion by Klein, seconded by Baker, carried unanimously to recess at 3:33 p.m. WORKSESSION REGARDING PROPERTY TAXES Upon reconvening at 3:40 p.m. the Board met with Wendy Runde from the Diamond Jo Casino again to discuss the penalty for late payment of property taxes. Due to bad weather County Attorney Joshua Simms was available via telephone. In his letter to the Board he referenced sections of the code. The casino paid the full years taxes then took the check back and reissued one for amount due only. In doing this they became one day late. Motion by Wickham, seconded by Klein, carried unanimously to forgive the tax penalty to the Diamond Jo Casino. WORKSESSION REGARDING LEGISLATIVE PRIORITIES The Board read the Urban County Coalition s 2019 legislative priorities picking several to discuss at the legislative dinner. WORKSESSION WITH COUNTY ENGINEER The Board met with Engineer Anthony Bardgett and Larry Steffen of Eagle Point Solar regarding solar arrays for the new Dubuque Shop at the West Campus. This project will be going out for bid. Motion by Klein, seconded by Baker, carried unanimously to recess at 5:07 p.m. Upon reconvening at 5:30 p.m. the Chair called the regular meeting to order. APPROVAL OF MINUTES OF NOVEMBER 13, 2018 Motion by Klein, seconded by Baker, carried unanimously to approve the minutes. CONSENT ITEMS Quarterly reports of the Auditor. 452 (NOVEMBER 26 & 28)

PROOF OF PUBLICATION PUBLIC HEARINGS Motion by Klein, seconded by Baker, carried unanimously to receive and file the proof of publication. PUBLIC HEARING VACATING COUNTY RIGHT OF WAY The Board met with County Engineer Anthony Bardgett to discuss three locations where he would like the right of way vacated. There is a portion on Farley Road (2.002 AC), John Deere Road (1.119 AC), and Ryan Road (.055AC). Motion by Klein, seconded by Baker, carried unanimously to open the public hearing. Ryan Davis, Davis Construction, said people park in the City of Dubuque s parking lot on John Deere Road and trespass through his property to get to Heritage Trail. Wickham asked about the county putting a walkway through the right of way from the parking lot to the Heritage Trail. Baker will go look at the areas discussed. Motion by Klein, seconded by Baker, carried unanimously to close the public hearing. PUBLIC HEARING SALE OF PARCELS TO THE CITY OF DUBUQUE There are two small parcels the City of Dubuque would like to acquire from the County to accommodate a water line project they plan to do. Engineer for the City of Dubuque Nate Kieffer explained the project to the Board. Comments from the Board were how the County owns small parcels and slivers of land in various locations throughout the City they would like to give to the City. This will be discussed again when the Treasurer is available to attend. Motion by Baker, seconded by Klein, carried unanimously to close the public hearing. PROOF OF PUBLICATION PROCUREMENT PROCEDURES MOWER WITH ROTARY CUTTING HEAD Motion by Baker, seconded by Klein, carried unanimously to receive and file the proof. RECEIPT OF BIDS MOWER WITH ROTARY CUTTING HEAD FOR THE SECONDARY ROADS DEPARTMENT Vendor Bid Amount Diamond Mowers Sioux Falls South Dakota $25, Mid Country Machinery Inc Waterloo Iowa $26, Motion by Klein, seconded by Baker, carried unanimously to receive and refer the bids to the County Engineer for a recommendation. SECURITY CAMERAS Bids were opened at the last meeting for security cameras. IT Superintendent Nathan Gilmore is recommending RACOM Critical Communications the lowest bidder at $32, He had told Department heads earlier in the day he would contact them about location of cameras within their department. Wickham questioned the number of cameras needed and said they will only be installed where the department head wants them. He also thought there should be a policy in place regarding location and who has access. RESOLUTION APPOINTMENT OF DEPUTIES, ASSISTANTS AND CLERKS WHEREAS, position vacancies have been approved for the following appointments by the Board of Supervisors through the Personnel Requisition Process. 454 (NOVEMBER 26 & 28)

RESOLUTION APPROVE NECESSARY DOCUMENTS WITH EAGLE POINT SOLAR, LLC OF DUBUQUE WHEREAS, Dubuque County has been presented with a Solar Construction Contract from Eagle Point Solar, LLC of Dubuque, Iowa for the Dubuque County Secondary Roads Farley Shop in the sum of $56,160.00, and WHEREAS, the Board of Supervisors and the County Engineer have discussed said quote and recommend accepting the quote as submitted by Eagle Point Solar for the 80 JA Solar 360W Modules 23.4kW AC Roof Mounted Solar Array and including a Five (5) Year Limited Warranty. THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the necessary documents with Eagle Point Solar, LLC for the Dubuque County Secondary Roads Farley Shop at a grand total price of $56, Motion by Klein, seconded by Baker, carried unanimously to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE VACATION OF A PORTION OF RIGHT OF WAY ON FARLEY ROAD 455 (NOVEMBER 26 & 28)

8 WHEREAS, the Dubuque County Board of Supervisors received a request to vacate a portion of right of way on Farley Road, in Section 13, Dodge Township, T88N-R2W and in Section 18, Taylor Township, T88N-R1W, and WHEREAS, a public hearing, with all proceedings in accordance with Iowa Code Chapter 306, was held on November 26 th, 2018, in the Board of Supervisors Chambers at the Dubuque County Courthouse for the purpose of vacating a portion of this right of way, and WHEREAS, the Board of Supervisors, on November 26 th, 2018, did by motion, approve the vacation, subject to the right of utilities to continue in possession of any easement existing at the time of the vacation, of the portion of Farley Road described as: That portion of Farley Road Easement located in the Southeast 1/4 of the Southeast 1/4 of Section 13, Township 88 North, Range 2 West of the 5'th P.M., and part of the Southwest 1/4 of the Southwest 1/4 of Section 18, Township 88 North, Range 1 West of the 5'th P.M., Dubuque County, Iowa. The Board of Supervisors finds no additional damages are to be paid to any claimants on this vacation. WHEREAS, said plat prepared by Dubuque County Engineer s Office has been examined by the Board of Supervisors of Dubuque County, Iowa and they find the same conforms to the laws and statutes and other regulatory ordinances and resolutions pertaining thereto. NOW, THEREFORE BE IT FURTHER RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve this vacation of the right of way, subject to the right of utilities to continue in possession of any easement existing at the time of the vacation, and directs the County Engineer's office to proceed with all necessary provisions to insure recording of this vacation. Motion by Klein, seconded by Baker, carried unanimously to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE SNOW AND ICE REMOVAL 28E AGREEMENT WITH THE CITY OF BERNARD WHEREAS, the Dubuque County Secondary Road Department agrees to perform ice and snow removal maintenance from November 1, 2018 through May 1, 2019 for the following city: Bernard 0.65 Paved Miles $1, WHEREAS, it is necessary that Dubuque County enter into a 28E agreement with each city regarding this maintenance, 457 (NOVEMBER 26 & 28)

10 THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the 28E agreement for ice and snow removal maintenance with the City of Bernard. Motion by Baker, seconded by Klein, carried unanimously to approve and authorize the Chair to sign Resolution COMMUNICATION FROM CENTER TOWNSHIP CLERK Motion by Klein, seconded by Baker, carried unanimously to receive and file the resignation of George Hellert whose township clerk term is up the end of December COMMUNICATION FROM THE CONSERVATION BOARD Motion by Baker, seconded by Klein, carried unanimously to receive and file the Conservation Board s FY18 Annual Financial Report COMMUNICATION FROM THE CITY OF DUBUQUE REGARDING A PUBLIC HEARING NOTICE FOR THE AMENDMENT AND RESTATEMENT OF THE PERU ROAD URBAN RENEWAL AREA Motion by Klein, seconded by Baker, carried unanimously to receive and file the communication. Motion by Klein, seconded by Wickham, carried unanimously to recess at 6:33 p.m. DUBUQUE COUNTY CONSERVATION BOARD STRATEGIC PLAN MEETING Upon reconvening at 11:05 a.m. November 28, 2018 Chair Wickham and Supervisor Baker attended the Conservation Board s Strategic Plan meeting. Dubuque County Conservation Board Director, Brian Preston welcomed everyone to the strategic planning meeting and each attendee formally introduced themselves. RDg Planning and Design presented an overview of themes to be discussed amongst the attendees. An overview of the DCCB mission and undertakings was reviewed by all participants, followed by a stakeholder work session analyzing the DCCB vision, mission, challenges and opportunities. After the worksession, RDg stated the next step in this strategic plan will be to develop a draft of items discussed. Meeting adjourned at 2:15 p.m. 458 (NOVEMBER 26 & 28)
