1 MINUTES OF JUNE 11, 2018 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order at 8:15 a.m. WORKSESSION WITH COUNTY ENGINEER The Board met with Engineer Anthony Bardgett to talk about the ongoing roads projects. Bardgett had tentative completion dates and progress reports on each project. MINUTES OF MAY 29 & JUNE 7, 2018 Motion by Baker, seconded by Klein, carried unanimously, to approve the minutes as amended. CONSENT ITEMS Class LC Liquor License for Dubuque Jaycees Run 4 Troops, Fireworks permit for Albrecht Acres, Fireworks permit for Jeremy Freiburger and Gene Klein, IDNR Manure Management Plan for the following; Steve Hoeger, Strief Farms, Inc, and Miller Custom Hogs. Motion by Klein, seconded by Baker, carried unanimously, to approve the abovementioned consent items. PROOF OF PUBLICATION PROCUREMENT PROCEDURES Motion by Baker, seconded by Klein, carried unanimously, to receive and file the proof of publication to furnish and apply pavement marking paint for the Dubuque County Secondary Road Department. NOTICE TO BIDDERS CONSTRUCTION BID PACKAGE 2 SHOP, GARAGE, & OFFICE BUILDINGS FOR THE DUBUQUE COUNTY SECONDARY ROADS Motion by Baker, seconded by Klein, carried unanimously, to advertise for bids to be opened Thursday, July 12, 2018 at 3:30 p.m.on the above-mentioned construction project. PROOF OF PUBLICATION PUBLIC HEARING Motion by Klein, seconded by Baker, carried unanimously, to receive and file the proof. PUBLIC HEARING PLANS AND SPECIFICATIONS FOR CONSTRUCTION OF DUBUQUE COUNTY SECONDARY ROADS SHOP AND OFFICE FACILITIES County Engineer Anthony Bardgett and FEH Designs Christy Monk explained the project and approximate timeline. Chair Wickham opened the public hearing. Jeff Flynn, 7783 Kane Road, Dubuque questioned the need to bring all the roads equipment inside. Flynn agrees a new building and offices are very much needed but does not agree the building needs to be this large. Jerry Sigwarth, Sigwarth Lane, Holy Cross is the President of the Dubuque County Fair Board. The county stores their equipment in the fairgrounds buildings in the winter. Sigwarth said it makes a world of difference and he feels it is very important for vehicles to be inside. Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. PUBLIC HEARING PROPOSAL TO ENTER INTO A GENERAL OBLIGATION URBAN REVEWAL LOAN AGREEMENT Chair Wickham opened the public hearing. 246 (June 11)

3 County Auditor Denise Dolan said the county is starting to issue debt for the Seipple Road project. After the bidding starts we will have a more accurate dollar amount but a starting estimate is at $17,000,000. The debt service roof and capital projects together is a levy of 72 cents. With the FY19 budget that was just certified the Board of Supervisors were able to lower the levy rate by 36 cents. The debt for this project will only increase the levy 24 cents. The County is nowhere near their Debt Capacity. Currently taxes are at $9.63 per thousand. FY04 was $9.44 per thousand so it has been awhile since it was so low. Motion by Baker, seconded by Klein, carried unanimously, to close the public hearing. PUBLIC HEARING AMENDMENT TO ZONING ORDINANCE ZC# ST. CATHERINE CHURCH & DUBUQUE COUNTY EMERGENCY MANAGEMENT R-3 SINGLE FAMILY RESIDENTIAL TO R-1 RURAL RESIDENTIAL Chair Wickham opened the public hearing. Emergency Management Director Tom Berger explained the zoning change is to accommodate the tower for the emergency management radios. Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. AMENDEMENT TO ZONING ORDINANCE - ZC# ST. CATHERINE CHURCH & DUBUQUE COUNTY EMERGENCY MANAGEMENT R-3 SINGLE FAMILY RESIDENTIAL TO R-1 RURAL RESIDENTIAL The following amendment to the Dubuque County Zoning Ordinance is proposed. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on Monday, June 11, ZC# St. Catherine Church and Dubuque County Emergency Management R-3 Single Family Residential to R-1 Rural Residential The applicants are requesting to rezone from R-3, Single Family Residential to R-1, Rural Residential acres more or less, to rezone the area around the existing church, classroom building, and home to allow for a public safety telecommunication tower for use by the Dubuque County Emergency Management. The property, located 4.66 miles southeast of the City of Dubuque along St. Catherine Road is legally described as Lot St. Catherine Place Section 27, (T88N-R3E) Mosalem Township, Dubuque County, Iowa. 247 (June 11)

4 Motion by Baker, seconded by Klein, carried unanimously, to approve the rezoning. Motion by Baker, seconded by Klein, carried unanimously, to suspend the requirement that this amendment be considered and voted on for passage at two prior meetings. Motion by Baker, seconded by Klein, carried unanimously, that the amendment be adopted and that the zoning administrator be directed to enter the appropriate changes on the official zoning map and that the Auditor be directed to arrange for the publication of the amendment and portion of the official zoning map as amended in the official county newspapers as required by law. PUBLIC HEARING AMENDMENT TO ZONING ORDINANCE ZC# DUANE & KIMBERLY KASS A-1 AGRICULTURAL TO A-2 AGRICULTURAL RESIDENTIAL Chair Wickham opened the public hearing. The Kass would like the rezoning so they can build a house after losing their home in a fire. Curt Burbach, Ridge Road, Balltown lives adjacent to the Kass and has no problem with them having the zoning changed to build new however; Burbach is asking they remove the burned house in a timely manner. Zoning Administrator Anna O Shea said there is a required condition on rezoning that the old house will have to be removed. Duane Kass said he will be doing the removal himself and asks for a year to do so. Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. AMENDMENT TO ZONING ORDINANCE ZC# DUANE & KIMBERLY KASS A- 1 AGRICULTURAL TO A-2 AGRICULTURAL RESIDENTIAL The following amendment to the Dubuque County Zoning Ordinance is proposed. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on June 11, ZC# Duane & Kimberly Kass A-1 Agricultural to A-2 Agricultural Residential The applicants are requesting to rezone from A-1, Agricultural to A-2, Agricultural Residential 2.1 acres more or less, to be allowed to build a new home to replace the home that was burnt down and for platting and financial purposes. The property, located (June 11)

5 miles west of the City of Balltown along Ridge Road is legally described as SE NW Section 6, (T90N-R1E) Jefferson Township, Dubuque County, Iowa. 1. That 1.5 acres more or less be rezoned to A-2, Agricultural/Residential for one home only and the remainder will stay A-1, Agricultural. 2. That the balance of the parcel is not allowed to have another dwelling unless the property is rezoned for that use. Motion by Klein, seconded by Baker, carried unanimously, to approve the rezoning with the condition the old house be removed within 90 days of moving in to the new house. Motion by Klein, seconded by Baker, carried unanimously, to suspend the requirement that this amendment be considered and voted on for passage at two prior meetings. Motion by Klein, seconded by Baker, carried unanimously, that the amendment be adopted and that the zoning administrator be directed to enter the appropriate changes on the official zoning map and that the Auditor be directed to arrange for the publication of the amendment and portion of the official zoning map as amended in the official county newspapers as required by law. Zoning Administrator Anna O Shea and Dennis Johnson explained with the re-zoning there will be no changes to the farm. Motion by Baker, seconded by Klein, carried unanimously, to close the public hearing. AMENDMENT TO ZONING ORDINANCE ZC# DENNIS & DEBORAH JOHNSON A-1 AGRICULTURAL TO A-2 AGRICULTURAL RESIDENTIAL The following amendment to the Dubuque County Zoning Ordinance is proposed. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on June 11, 2018 ZC# Dennis & Deborah Johnson A-1 Agricultural to A-2 Agricultural Residential The applicants are requesting to rezone from A-1, Agricultural to A-2, Agricultural Residential 1acre more or less, to be allowed to sell the home to the neighbors daughter & son-in-law so they can continue to assist in the farming operation. That 1 acre more or less around the existing home be rezoned to A-2, Agricultural/Residential and the remainder will stay A-1, Agricultural. 2. That Lot 2 & Lot 3 of Johnson Farm Subdivision is not allowed to have another dwelling unless the property is rezoned for that use. Pat Hermsen, 7493 Washington Street, New Vienna thought he owned the land his building is sitting on but he doesn t. Jerry Sigwarth, Sigwarth Lane, Holy Cross said the complaint always was about the accumulation of stuff on the property but now it is looking better. Jim Vaske, Vaske Lane, Dyersville owns the land under the building but did not know he did. Now they want to get it straightened out. Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. AMENDMENT TO ZONING ORDINANCE #ZC JAMES & BEVERLY VASKE TRUST AND PATRICK & KIMBERLY HERMSEN B-2 HIGHWAY BUSINESS AND A-1 AGRICULTURAL TO M-1 INDUSTRIAL The following amendment to the Dubuque County Zoning Ordinance is proposed. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on June 11, 2018 ZC# James & Beverly Vaske Trust and Patrick & Kimberly Hermsen B (June 11)

7 Highway Business and A-1 Agricultural to M-1 Industrial The applicants are requesting to rezone from B-2, Highway Business and A-1, Agricultural to M-1, Industrial 1.70 acres more or less, to allow for the refurbishing of trucking and construction equipment. The property, located.06 miles southeast of the City of New Vienna along Route 136 is legally described as S ¾ E ½ SW NW and Lot 2 N ¼ E ½ SW NW all in Section 08, (T89N-R2W) New Wine Township, Dubuque County, Iowa 1. That the rezoning is for the business of refurbishing of trucking & construction equipment only and if the business ceases to operate on the property the property will revert to B-2, Highway Business. 2. That the business must apply for and receive an Air Pollution Permit from the DNR & meet all DNR air pollution standards. Motion by Klein, seconded by Baker, carried unanimously, to approve the rezoning. Motion by Klein, seconded by Baker, carried unanimously, to suspend the requirement that this amendment be considered and voted on for passage at two prior meetings. RESOLUTION FINAL PLAT OF BGJ KREMER PLACE SECTION 21 TABLE MOUND TOWNSHIP WHEREAS, there has been presented to the Dubuque County Board of Supervisors a Final Plat of Survey for, BGJ KREMER PLACE, comprised of Lot 1-2 of Waldbillig Farm in Section 21, T88N, R2E, of the 5 th PM, Table Mound Township, Dubuque County, Iowa; and WHEREAS, said final plat will create two (2) lots, namely Lot 1 and Lot 2 of BGJ Kremer Place Section 21, Table Mound Township, Dubuque County, Iowa; and WHEREAS, said final plat has been examined and approved by the City of Dubuque and the City of Dubuque Planning and Zoning Department; and WHEREAS, said final plat has been examined by the Dubuque County Planning and Zoning Commission, Dubuque County Board of Health, Dubuque County Engineer, Dubuque County Treasurer and the Dubuque County Plats Officer and has their approval endorsed thereon; and 251 (June 11)

That the above described property is within the R-1, Rural Residential district thus subject to all the requirements of that district. Section 2. That the above described final plat be and is hereby approved and the Chairperson of the Board of Supervisors is authorized and directed to endorse the approval of Dubuque County, Iowa upon said final plat. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION FINAL PLAT OF JOHNSON FARM SUBDIVISION SECTION 5 TAYLOR TOWNSHIP WHEREAS, there has been presented to the Dubuque County Board of Supervisors a Final Plat of Survey for, JOHNSON FARM SUBDIVISION, comprised of the South Half of the NW Fractional Quarter of Section 5, T88N, R1W, of the 5 th PM, Taylor Township, Dubuque County, Iowa; and WHEREAS, said final plat will replat two (2) lots into three (3) new lots, namely Lot 1, Lot 2 and Lot 3 of Johnson Farm Subdivision Section 5, Taylor Township, Dubuque County, Iowa; and WHEREAS, said final plat has been examined and approved by the City of Farley; and WHEREAS, said final plat has been examined by the Dubuque County Planning and Zoning Commission, Dubuque County Board of Health, Dubuque County Engineer, Dubuque County Treasurer and the Dubuque County Plats Officer and has their approval endorsed thereon; and WHEREAS, said final plat has been examined by the Board of Supervisors of Dubuque County, Iowa, and they find the same conforms to the statutes and other regulatory ordinances and resolutions. 10 no petition had been filed with the County asking that the question of entering into the Loan Agreement be submitted to the registered voters of the County; and WHEREAS, it is necessary at this time to take additional action to enter into the Loan Agreement; NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Dubuque County, as follows: Section 1. The Board of Supervisors hereby determines to enter into the Loan Agreement in the future and orders that General Obligation Urban Renewal Bonds or Notes be issued at such time, in evidence thereof. The Board further declares that this resolution constitutes the additional action required by Section (2) of the Code of Iowa. Section 2. Further action with respect to the Loan Agreement is hereby adjourned to the Board of Supervisors meeting scheduled for June 11, Section 3. All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 4. This resolution shall be in full force and effect immediately upon its adoption and approval, as provided by law. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION AMENDMENT TO LEASE AGREEMENT WITH THE BANNER INVESTMENTS LLC FOR OFFICE SPACE FO RTHE DEPARTMENT OF HUMAN SERVICES WHEREAS, Dubuque County has been presented with an Amendment to Lease Agreement with Banner Investments LLC for 15,292 square feet of office space for the Department of Human Services (DHS) located within the Nesler Centre, 799 Main St., Dubuque, Iowa; and WHEREAS, the Lease Agreement is a one-year term from July 1, 2018 through June 30, 2019; and WHEREAS, the monthly lease amount for all office space is $12, NOW, THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors approve and authorize the Chairperson to sign the Amendment to Lease with Banner Investments LLC for office space at 799 Main St., Dubuque, Iowa to include office space for DHS for the term of July 1, 2018 through June 30, (June 11)

11 Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVING FY19 COLLECTIVE BARGAINING UNIT AGREEMENT FOR THE ADMINISTRATIVE DEPUPTY UNIT REPRESENTED BY TEAMSTERS LOCAL 120 WHEREAS, Dubuque County has been presented with a FY19 Collective Bargaining Unit Agreement between the Administrative Deputy Unit represented by Teamsters Local 120 and Dubuque County; and WHEREAS, the agreement reflects a 3.0% wage increase effective July 1, 2018, a monthly employee health insurance premium contribution of 5% of the insurance cost, and one-time lump sum payment of $1,500 NOW, THEREFORE BE IT RESOLVED the Dubuque County Board of Supervisors approve and authorize the Chairperson to sign the FY19 Collective Bargaining Unit Agreement between the Administrative Deputy Unit represented by Teamsters Local 120 and Dubuque County. Motion by Baker, seconded by Klein, carried with Baker and Wickham voting aye and Klein nay, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE NECESSARY DOCUMENTS WITH DEMMER OIL COMPANY FOR ETHANOL BLENDED GASOLINE (GASOHOL) AND PREMIUM BIODIESEL FUEL FOR THE DUBUQUE COUNTY SECONDARY ROAD DEPARTMENT WHEREAS, plans and specifications have been prepared by FEH Design and approved by the Dubuque County Engineer for the Construction Bid Package 2 Shop, Garage, & Office Buildings for the Dubuque County Secondary Roads, and WHEREAS, this project will be reviewed and let locally by Dubuque County, subject to the Dubuque County Board of Supervisors approval of the plans, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve the plans and specifications for said project. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION BID PACKAGE 2 SHOP, GARAGE, & OFFICE BUILDINGS FOR THE DUBUQUE COUNTY SECONDARY ROADS 255 (June 11)

12 WHEREAS, plans and specifications have been prepared by FEH Design and approved by the Dubuque County Engineer for the Construction Bid Package 2 Shop, Garage, & Office Buildings for the Dubuque County Secondary Roads, and WHEREAS, this project will be reviewed and let locally by Dubuque County, subject to the Dubuque County Board of Supervisors approval of the plans, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve the plans and specifications for said project. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE NYHART AGREEMENT TO PROVIDE REQUIRED GASB 75 ACTUARIAL UPDATE AND THE IOWA 509A ACTUARIAL CERTIFICATION WHEREAS, Dubuque County has been presented with a Nyhart Company, Inc., Service Agreement to provide required services to complete the FY18 Full GASB 75 Actuarial Update and the FY18 Iowa 509A Actuarial Certification for Dubuque County; and WHEREAS, the fees for these services are $5,500 for the GASB 75 Actuarial Update and $1,250 for the Iowa 509A Actuarial Certification. NOW, THEREFORE BE IT RESOLVED to approve and authorize the Chairperson of the Dubuque County Board of Supervisors to sign the Nyhart Company, Inc, Service Agreement to provide required services to complete the FY18 Full GASB 75 Actuarial Update and the FY18 Iowa 509A Actuarial Certification for Dubuque County. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVING VOCATIONAL SERVICES BETWEEN SUNNYCREST AND ARC The Board had asked if the rates were higher this year on the contract. HR Director Dawn Sherman explained the old rate and new rates are listed in the resolution. Motion by Baker, seconded by Klein, carried unanimously, to table the resolution until they know what the 2% increase was for. RESOLTUION APPROVE QUOTES FOR REPAIR OF VENT PIPES AS PART OF COURT HOUSE ROOF PROJECT 256 (June 11)

13 WHEREAS, the vent pipes in the attic of the Court House were inspected as part of the Court Roof repair project; and WHEREAS, it was determined that three of the four pipes need to be repaired; and WHEREAS, quotes were received for the repair work from the following firms: Modern Piping, Inc. $ 3,565 Mechanical Contractors, Inc.. $ 5,700 With additional cost of $3,000 for scaffolding from Klauer Construction, the contractor; and WHEREAS, the quotes from Modern Piping, Inc and Klauer Construction were accepted. NOW, THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors approves and authorizes the Chair to sign and accept the quotes. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE CONTRACT FOR LAW ENFORCEMENT SERVICES WITH THE CITY OF WORTHINGTON WHEREAS, the City of Worthington desires to have Dubuque County and Dubuque County Sheriff provide law enforcement protection; and WHEREAS, Dubuque County and the Dubuque County Sheriff are willing to provide this service to the City of Worthington upon terms and conditions set out within the contract for Law Enforcement Services. WHEREAS, Dubuque County and Dubuque County Sheriff agree to provide the City of Worthington sixteen (16)--twenty (20) hours per month of Law Enforcement Services. WHEREAS, the City of Worthington agrees to pay Dubuque County and Dubuque County Sheriff the sum of Forty One Dollars and Twenty Cents ($41.20) per hour. WHEREAS, the City of Worthington agrees at the start of every fiscal year hereafter (July 1), the hourly rate will increase annually by 3% to Dubuque County and Dubuque County Sheriff. NOW THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors approves and authorizes the Chair to sign the Contract for Law Enforcement Services. PERSONNEL REQUISITIONS Motion by Klein, seconded by Baker, carried unanimously, to approve the two (2) temporary part-time Grounds Maintenance Workers for the Conservation Department. Motion by Klein, seconded by Baker, carried unanimously, to recess at 10:30 a.m. WORKSESSION WITH ZONING ADMINISTRATOR ENTRANCE PERMITS Upon reconvening at 10:45 a.m. the Board met with Zoning Administrator Anna O Shea and Wayne Mescher, Swiss Valley Road. Mescher would like to add a driveway so he can sell a few acres for someone to build a home on. Motion by Klein, seconded by Baker, carried unanimously, to approve the entrance. The Board met with Zoning Administrator Anna O Shea, land owner Eugene Duschner and his neighbor Dennis Johnson who addressed the Board at the last meeting. Duschner would like to add another entrance to his farm property. He currently has 14 entrances. Klein asked if any of those could be removed but Duschner said he would like to keep all of them. Motion by Klein, seconded by Baker, carried unanimously, to recess at 10:55 a.m. WORKSESSION REGARDING 911 AND NOTIFICATION OF ADDRESS CHANGES Upon reconvening at 11:05 a.m. the Board discussed the E911 system not matching the blue sign by resident s driveways. Baker said when an ambulance was called to Wayne Demmer s neighbor dispatch had the wrong 911 number. They had the neighbor s old number. Dubuque 911 Communications Manager Mark Murphy said the telephone companies don t allow anyone to make changes to addresses except for the owner of the phone account. GIS Coordinator Jeff Miller and Murphy will work together on changes. It was asked if the Communications Board could take over the responsibility of keeping the 911 numbers up to date. Motion by Baker, seconded by Klein, carried unanimously, to recess at 11:35 a.m. WORKSESSION WITH FINANCIAL ADVISORS FROM D.A. DAVIDSON FOR UPDATE ON OUTCOME OF BANK PLACEMENT OF DEBT ISSUANCE 2018B Upon reconvening at 11:42 a.m. the Board met with Vice-President Nathan Summers. Banks no longer do draw- downs where you take the money in phases as the work is completed. Now the money is received all at once. Summers anticipates the rate to be around 3 ½%. The Board will need to have a special meeting then report to Summers what the rate will be by July 23 rd. WORKSESSION WITH GRANT COUNTY TRANSMISSION LINE STEERING AND INTER- MUNICIPAL ENERGY PLANNING COMMITTEE MEMBERS REGARDING A TRANSMISSION LINE RESOLUTION The Board met with EPIC Secretary Rob Danielson and other concerned citizens asking for a resolution denying access to the farm land across Dubuque County. The Cardinal- Hickory Creek Transmission Line Project is looking to construct a line taking up farm ground making it almost impossible to continue farming the fields. Mike Deutmeyer, farmer, asked where the benefit of this is coming from. ITC will get the land owners signatures then do as they please. Steve Hoeger, farmer, was approached also for them to run the line through the middle of one of his fields. With the poles and the lines how will he be able to get around them to plant and he won t be able to use a helicopter anymore. He is absolutely against this and asks the Board to deny it. 259 (June 11)

The Board thanked everyone for bringing this matter to their attention. They will do more research and look for more information about this project prior to making any decisions. Kennedy would like to add ten cars to the fleet and do a seven year rotation. Kennedy said the Control Board will no longer allow funding from the Federal Forfeiture Fund to cover capital projects. They will allow a dollar for dollar swap from the shooting range funding to the purchase of the new cars. Consensus of the Board is to move forward with this project and bring the funding of the Shooting Range back to the Board.
